Council met at 9:10 p. in.
Mayor Schunk in the chair.
Present —Aids. Frith, Haas, Martin,
O'Rourke, Rand, Saul and Singrin-
Absent —None.
Ald. Frith moved that the Council
- proceedings for the month of May,
1908, be approved as printed. Carried.
Ald. Frith stated that there were
. several property owners present who
wished to address the Council in rela-
tion to the improvement of various
streets and moved that the regular
• order of business be suspended to
. allow the remonstrators permission to
address the Council. Carried.
City Recorder Linehan presented
_ and read the printed notice certified
to by the publisher, of the Council's
- intention to improve Windsor avenue
from the southerly curb line of Eagle
Point avenue to a point about 350 feet.
`,northerly therefrom.
No remonstrance being filed and no
-one in the room objecting to the im-
provement of said street, the notice
was, on motion, received and filed.
City Recorder Linehan also present-
- ed and read the printed notice, certi-
fied to by the publisher, of the Coun-
cil's intention to improve Jackson
street from Eighth to Tenth street.
Remonstrance of Carr, Ryder & Adams
Cb. et al against said improvement
was then read and notice was, on
motion, received and filed and the re-
- monstrance referred to the committee
of the whole.
City Recorder Linehan also present-
ed and read the printed notice, certi-
fied to by the publisher, of the Coun-
cil's intention to reimprove Washing-
ton street from Eighth street to
Eleventh street.
No remonstrance being filed and no
• one in the room objecting to the said
improvement, the notice was, on
motion, received and filed.
City Recorder Linehan also present -
ed and read the printed notice, certi-
fied to by the publisher, of the Coun-
cil's intention to improve White street
from Fourth street to Sixth street.
Remonstrance of M. Kassler et al
- against said improvement was then
read, and the rules were suspended to
-- allow remonstrators permission to ad-
-dress the council. Mr. M. Kassler and
J. R. McFarland then addressed the
"Council. Remonstrance was then on
motion referred to the committee of

the whole and the notice received and
filed.
City Recorder Linehan also present-
ed and read the printed notice, certi-
fied to by the publisher, of the Coun-
cil's intention to improve Sixth street
from Locust street to Main street. Re-
monstrance of Telegraph- Herald et al
remonstrating against the paving of
said street was then read and rules
were suspended to allow remonstra-
tors permission to address the Coun-
cil. Mr. H. B. Glover and H. B.
Gniffke then addressed the Council.
On motion remonstrance was referred
to the committee of the whole and the
notice received and filed.
City Recorder Linehan also present-
ed and read the printed notice, certi-
fied to by the publisher, of the Coun-
cil's intention to improve Locust
atreet from Eighth street to Fourth
street. Remonstrance of Allen Staples,
et al, against the said improvement
was read and rules were on motion
suspended to allow remonstrators per-
mission to address the council, Miss
Mae Peabody, Dr. Allen Staples,
Messrs. H. B. Glover, Harold Wallis
and D. D. W. Carver then addressed the
council. On motion remonstrance was
referred to the committee of the whole
and notice received and filed.
Alderman Frith moved that the mat-
ter of the improvement of Windsor
avenue, Locust street, Sixth street,
IVhite street, Jackson street and
Washington street be referred to the
committee of the whole to view the
grounds. Carried.
City Recorder Linehan also presented
and read the printed notice, certified
to by the publisher, of the council's
intention to improve Milwaukee ave-
nue from Couler avenue to Jackson
street.
Rules were, on motion, suspended to
allow property owners permission to
address the council in relation to the
improvement. Mr. Dan Lyons then ad-
dressed the council, asking' that coun-
cil have Milwaukee avenue improved
as soon as possible. Ald. Frith stated
property owners on said street were
anxious to have cement curb and gut-
ters used on said street.
No remonstrance being filed and no
one in the room objecting to said im-
provement, the notice was, on motion,
received and filed.
PETITIONS AND COMMUNICA-

Communication from the Key City
council of United Commercial Travel
ers of America, inviting the Mayor
and city council to go with them to

Davenport on June 5th to boost Du-
buque, was read and on motion of Ald.
Frith their invitation was accepted
and as many members of the council
as can will attend the excursion.
Petition of Matt Czizek, et al, asking
that provision be made to drain tha
water on Washington street between
Rhomberg and Lincoln avenues, also
that sewer and water pipes be extend-
ed in said street, was on motion of Ald.
Frith referred to the committee o`,
the whole.
Petition of the Illinois Good Roads
company asking that the council take
up the matter of using their liquid
asphalt for macadamized streets was
on motion of Ald. Frith referred to
the City Engineer to investigate and
report to the committee of the whole.
Communication from William Hin-
triger, asking that the taxes for the
year 1907 be canceled on the portion
of strip of ground condemned by jur-
ors and purchased by the city for the
opening of Alta Vista street was on
motion of Ald. Rand referred to the
committee on finance.
Remonstrance of Edward Muntz re-
monstrating against the paying of
special assessment levied against lot
46, Oxford heights Add., for construct-
ing sanitary sewer in Alta Vista street
was on motion of Ald. O'Rourke refer-
red to the committee of the whole and
the city engineer.
Bids for improvement of Louisa
street from Delhi street to Grace
street were presented, and on motion
of Ald. Rand were ordered opened as
follows:
O'Farrell Contracting Co., grading
per cubic yard, 25e; curbing per lineal
foot, 60c; guttering per square yard
60c; macadamizing per square yard,
65c. •
Geo. L. Korman, grading per cubic
yard, 20c; curbing per lineal foot, 53c;
guttering per square yard 53c; ma-
cadamizing per square yard 57c.
On motion of Ald. Martin the con-
tract for improving Louisa street was
awarded to Geo. L .Korman, and his
bond fixed at $500.00, providing the
Property. abutting on Louisa street
will stand the assessment for said im-
provement.
Petition of the Fifth Ward Non -
Partisan league asking that the coun-
cil appoint a committee to confer with
the officials of the C., M. & St. P. R.
R. Co., with a view of having a via-
duct built over the railway tracks
from Johnson avenue to Sycamore
street was on motion of Ald. Frith re-
ferred to the committee of the whole
and Mr. Stapleton to be notified to be
present at the meeting.
Petition of the Fifth Ward Non -
Partisan league asking that the coun-
cil order brick or cement sidewalk laid'
on the east side of Prince street from
Eagle Point avenue to Sanford street.
Also on the east side of Elm street
from Sanford avenue to Twenty -sixth
street except where walks are already
laid, was, on motion of Ald. Frith, re-
ferred to the sidewalk inspector.
Petition of the Fifth Ward Non -
Partisan league asking that the health -
officer be instructed to have the gar-
bage and ashes on Lincoln avenue
from Kniest street to the C. G. W.
tracks and along the C. G. W. tracks -
from Lincoln avenue. to Eagle Point
avenue removed and to have the prat- -
tice of using said property for a
dumping ground discontinued, was.
on motion of Ald. Frith, granted and
the petition referred to the sanitary
policeman to comply with their re-
quest.
Petition of Andrew McGrath et al
asking that Rigi street from Bennett
to Grace street be opened, was, on •
motion of Ald. Frith, referred to the
committee of the whole.
Petition of H. Neuwoehner asking
that he he granted permission to lay a
cement sidewalk eight inches above
the present curb on Rhomberg avenue
abutting lot 70, McCraney's First Ad-
dition, was, on motion of Ald. Frith,
referred to the committee of the
whole.
Petition of Hugh Markey asking
that the council investigate the condi-
tion of the stone wall on Thomas
Place abutting his property, claiming
his property was damaged by water
coming through said wall onto his
property was read, and, on motion of
Ald. Frith, rules were suspended to
allow Mr. Markey permission to ad-
dress the council. On motion of Ald.
Frith the petition was then referred
to the committee of the whole.

May 22nd, 1908, of the regular session•
of May 21, 1908, the following motion
made by Ald. Frith, was adopted:
"That the Times - Journal be made
the official paper of the City of Du—
buque."

As the matter has been settled amic-
ably in the committee of the whole
this evening by the appointment of
both the Telegraph - Herald and Times -
Journal as official papers of the City
of Dubuque. I therefore hereby veto
the motion offered by Ald. Frith, and
adopted by the Council May 22, 1908,
making the Times- Journal the only
official paper of the City of Dubuque.

To the Honorable Council, City of
Dubuque:
Gentlemen: —I herewith return to
you the report of the committee of the
whole recommending that a warrant
for fifty dollars be drawn in favor of
Guy White, adopted at the adjourned
session of the Cout_ci1 held May 22,
1908.
Mr. White was never appointed
Street Commissioner by the old coun-
cil and is not entitled to the salary o
the position. Further than that he
agreed with me to serve as acting
Street Commissioner for the months of
March and April for seventy -five dol-
lars per month. He drew that sum on
.April and May first without a murmur
that there was anything wrong, or
that there was any shortage in his war-
rant. I have favored Mr. White in
the past two years and would gladly
do him a legitimate favor today. But
the city absolutely* owes him nothing
I therefore return to you the report
of the committee of the whole recom-
mending that he be paid the sum of
fifty dollars and hereby veto the mo-
tion that carried adopting same..

showing ground line on Milwaukee
avenue, and proposed grade line, the
said grade line being shown in red.
It will require approximately 800

this street to the proposed grade.

Gentlemen: —In compliance with
your resolution of May 22nd, I hand
you a profile of West Third street,
'from Bluff street to Burch street.
The grade line shown in red indi-
-cates grade adopted by the City Coun-
cil on August 10th, 1908.
The grade line shown in blue from
'Summit street to Burch street, station
13+80 to 17+40, indicates a change of
grade between those points, adopted
by the City Council on August 11th,
1870.
The grade line shown in blue from
station 3 +00 (100 ft. east of St. Mary's
•street) to station 13 +80 (Summit
street) is a proposed new grade.
I would recommend that the grade
'line shown in red line and figures from
station 0 +00 to station 3+00, and the
grade line shown in blue line and blue
'figures, from station 3 +00 to station
17 +40, be adopted.

were referred to the Committee of the
- Whole to view the grounds and the
Engineer to drive stakes showing pro-
posed grade.
City Attorney Lyon reported as fol-
lows:
To the Honorable Mayor and City
Council:
Gentlemen: —In the matter of the
- petition of Margaret Rubeck, stating
that by an error of the conveyancer
- Lot 2 of Lot 3 of Lot 11,, Kniest's sub-
division in the City of Dubuque was
conveyed to said City of Dubuque June
4, 1888, for the purpose of making pos-
sible the extension of Lincoln avenue,
and which conveyance should have
been Lot 3 of Lot 3 of said Lot 11,
Kniest's subdivision, which said peti-
tion was referred to us by your honor-
- able body, for investigation, we would
' respectfully report that we have exam-

ined into the matter and find that the
conveyance in question was erroneous-
ly made, the plat showing that it is
Lot 3 of 3 which is used for said Lin-
coln avenue extensicn, and that the
city has never claimed any interest in
Lot 2 of 3 and it was never intended to
convey the same to the city.
We would respectfully recommend,
therefore, that the petition in question
be granted, that the quit claim deed
by said Margaret Rubeck conveying to
the City of Dubuque Lot 3 of the sub-
division of Lot 3 of Lot 11 in Kniest's
subdivision in the City of Dubuque be
accepted, and that the Mayor be au-
thorized to sign and deliver to said
Margaret Rubeck the correction deed
submitted by her, conveying to her by
quit claim deed Lot 2 of Lot 3 of Lot
11, Kniest's subdivision, that her title
in said lot may be cleared.

Sidewalk Inspector Tropf reported as
follows:

Council.
Gentlemen: —In regard to the peti-
tion of the Fifth Ward Non - Partisan
League, asking that the sidewalk on
the east side of Windsor avenue from
the gate of the Linwood cemetery to
Davis avenue he put in a serviceable
condition, I wish to report that I have
done as instructed. and said walk was
put in good condition before Memorial

tee on streets, presented and read a
hill of O'Farrell Contracting Co.. for
1,000 cubic yards of grading on Asbury
street, $250.00, and moved that a war-
rant in the sum of $250.00 be ordered

Aid. Saul, chairman of the commit-
tee on streets, also reported as fol-
l"ows :
Your committee on streets, to whom
was referred the petition of S. ,I. Patch
asking that permanent stakes showing
the grade b'e set out on Villa street
abutting lot 199 in Union Addition,
would respectfully recommend that
the 'city engineer be instructed to set
stakes showing the Z a'de on Said Villa
treet.
Also your committee on streets to
Whom was referred the estimate of the
city engineer for the grading done by
the O'Farrell Contracting Co. on Alta
Vista street, would respectfully recom-
mend that the sum of seven hundred
dollars be allowed on said estimate,
and that a warrant in said amount be
ordered drawn on the city treasurer
in favor of said contractors.
Also your committee on streets, to
whom was referred the petition of J.
G, Strelau asking that the name of
Alma street be changed to Montrose
Terrace, and also the petition of C. H.
Hyde asking that the name of Rebecca
street be changed to Fairview Place,
would respectfully recommend that
the prayer of the petitioners be grant-
ed and that the ordinance committee
be instructed to prepare an ordinance
changing the names of said streets as
herein recommended.

Aid. Saul moved the adoption of the
various reports of the committee on
streets. Carried.
Ald. Martin. chairman of the com-
mittee on police and light, reported
that hats received for use of police-
men on contract were not the same as
the sample and committee had return-
ed them and that the hats for the
policemen as ordered by the commit-
tee would be received in a few clays.
Ald. Singrin, chairman of the com-
mittee on sewers, reported as follows:
Your committee on sewers, to whom
was referred the bill of Mike Mullen
for putting in new drinking fountain
at Linwood cemetery, would respect-
fully report that we have investigated
said 13111 and have found said bill to
he correct and would respectfully rec-
ommend that a warrant in the sum of
$29.75 be ordered drawn in full ,set-
tlement of said bill.

the report of the committee 'on sewers.

Ald. Singrin, chairman of the come
mittee on markets, also reported as
follott%s:
Your committee on markets, to
whom was referred the bill of Joseph
Blasen for repairing locks on the desks •
in the council room would respectfully
report we have examined into said bill
and have found the bill to be correct
and we would respectfully recommend
that a warrant in the sum of $3.60 be -
ordered drawn in favor of Joseph
Blasen in full settlement of said bill.

Ald. Singrin moved the adoption of
the report of the committee oh inar-
kets. Carried.
Ald. Rand, chairman of the commit-
tee on public grounds and buildings,
stated that several of the engine
houses were in need of repairs and
painting, but committee had not fully
investigated the extent of the work.
Ald. Rand also stated the city at-
torney had advised him that the city
is obliged to fix up a room as asked;
for by the Dubuque Woman's club for
juvenile court and the committee on ,
public grounds and buildings would
have same fixed up as soon as possible.
Ald. Rand also reported that the -
committee on public grounds and '
buildings had arranged for flowers to
be placed in the different city parks.
Ald. Martin, chairman of the board '
of health, reported as follows:
Dubuque, Iowa, May 29th.
To the Honorable Mayor and City
Council:
Gentlemen: —Your Board of Health
herewith submits the rules and reg-
ulations of the State Board of Health,
the adoption of which, as well as their
publication, are made by law compul-
sory on all local Boards of Health
throughout the state. We would re-
spectfully report that said Rules and
Regulations were adopted at our meet-
ing held May 26th, 1908, and were duly
published as required by law on May
27th and May 28th, 1908, and we re
spectfully ask that the action of the
Board of Health be approved.
Your Board of Health also respect-
fully reports that We have ordered all
the property owners on both sides of
Jackson streets from 17th street to
Eagle Point avenue and on the west
side of Washington street from 17th
street to Eagle Point avenue to con-
nect their premises with the sanitary
sewer.

follows:
Your committee of the whole, to
whom was referred the report of thc
state auditors on the condition of the
books of the various departments of
the City of Dubuque, would respect-
fully recommend that said report be
referred to the City Attorney for his
opinion as to the legality of the claims

spectfully recommend that said reports
be referred back to the Mayor for him
to appoint an auditing committee as
provided by law.

would respectfully recommend that the
committee on public grounds an 1
buildings be authorized to purchase
flowers for the different parks and con-
tract any indebtedness necessary for
the laying out of the beds and the
planting of said flowers not in excess
of two hundred dollars.
Also your committee of the whole,
to whom was referred the matter of
printing of the official proceedings of
the City Council, would respectfully
recommend that the Telegraph - Herald
and the Times - Journal both be ap-
pointed official papers, the Times -Jour-
nal alone to publish the semi - monthly
pamphlet, and that the Labor Leader
and National Democrat publish the of-
ficial notices, advertisements, procla
mations and ordinances, the latter two
papers to receive as compensation the.
sum of $12.50 each per month.
Also your committee of the whole,
to whom was referred the petition of
Edw. C. Peaslee, asking that the coun-
cil accept the sum of $621.01 in full set-
tlement of all taxes both regular and
special levied against lots 189 and 190,
City, would respectfully recommend
that the prayer of the petitioner be
granted and that the treasurer be in-
structed accordingly.
Also your committee of the whole,
to whom was referred the report of
the Board of Health, would respectful-
ly recommend that the contract for
cleaning the vaults be awarded to Dan
Thoman at the prices specified in his
bid. We would also approve of the
action of the board in ordering the
vault on Alta Vista street cleaned.
The matter of the contract with Dr.
Becker for the caring of contagious
diseases, however, we would respect-
fully recommend same be referred to
the City Attorney for his opinion as
to whether the city is in duty bound
to create such an office, and if so,
where his salary is to come from.
Also your committee of the whole
would respectfully recommend that
because the Committee Clerk acts as
clerk to all the different departments
of the city that all his salary be
charged, the same as any other gen••
eral employe, to the expense fund.
Also your committee of the whole,
to whom was referred the petition of
H. J. Jecklin, et al, asking that Mil -
ville road be put in passable condition,
• would respectfully report that we have
already instructed the Board of Super-
visors of Dubuque County to expend
not to exceed $700.00 on the improve-
ment of said street.
We would further recommend that
the City Attorney be instructed to
ascertain the amount available for use
under the order of the City Council
from the county road fund and give a
written opinion as to the legal right
of the city in matter of ordering work
done on the streets of the city and
adjacent thereto and having the cost.
of said work charged to the county
road fund.

Ald. O'Rourke moved the adoption
of the various reports of the commit-
tee of the whole. Carried.
Ald. Frith stated that the Board of
Supervisors had received and filed the
communication of the City Council
asking that they improve Davis ave-
nue and Millville road, and read the
Published report of the action of the
Board in the matter.
Ald, Frith moved that the City At-
torney be instructed to commence pro-
ceedings immediately against the
Board of Supervisors of Dubuque
County to compel said board to per-
form such work upon Millville Road
and Davis avenue as has been ordered
by the City Council, charging the
cost thereof to the county road fund
levied in Julien Township, and also
to perform such work upon the streets
within the City or adjacent • thereto as
may he ordered from time to time by
this City Council. Carried.
Ald. Frith moved that the Street
Commissioner enforce the ordinance in
reference to obstructions being left in
the gutters, and to see that all gutters
in the city : are kept clear `from all , ob-
structions. Carried.

Police enforce the speed ordinance
within the city limits on the Chicago
Great Western Railway company and
to proceed against the violators at

RESOLUTIONS AND MOTIONS.

of the City of Dubuque, That the City
Engineer be and he is hereby directed
to prepare plans and specifications for
a culvert on North street and an esti-
mate of the same and to submit the
same to the street committee at its
next meeting.

deemed necessary and advisable to
improve North street from Grandview
avenue to a point about six hundred
feet west thereof, and it is hereby

guttering and macadamizing against
the abutting property.

cost thereof to be paid by the city, if
any, and the cost thereof and amount
assessable upon each lot or parcel of
land adjacent to or abutting upon
such improvement per front foot, and
to file such plat and estimate in the
office of the city recorder, that after
the filing of said plat and estimate in
his office, the city recorder shall pub-
lish in three consecutive issues of a
newspaper published in this city, a
notice stating that such plat and esti-
mates are on file, the location and na-
ture of the improvement, kind of ma-
terial to be used and an estimate of
its cost, and the time before which ob-
jections thereto can be filed, and the
time fixed for hearing, which time
shall not be less than ,five days after
the last publication of such notice, and
after such publication shall have been
made, the city recorder shall, at the
next regular session of the City Coun-
cil, notify the council thereof in writ-

Resolved, That said improvement
shall be completed on or before the
first day of November, 1908, and shall
be paid for in the manner prescribed
by Chapter XXXII. of the Revised
Ordinance of the City of Dubuque for
the payment of the cost of street im-
provements.
The proposals for doing said work
shall be acted upon by the council on
the 18th day of June, 1908, and the ,
City Recorder is hereby ordered to
give ten days' notice by publication,
asking for proposals as provided by
ordinance.

PETITIONS AND COMMUNICA-
TIONS.
Petition of J. W. Milett et al asking
that sidewalks be ordered laid on the
west side of Cornell street between
May Place and Thomas street, also on
the south side of Thomas street be-
tween Cornell and Henion streets,
where not already laid, was on mo-
tion of Ald. Frith referred to the side-
walk inspector to report back to the
Council.
Petition of Peter Kiene & Son ask-
ing that the Water Works Trustees be
instructed to make payment of
$1,000.00 due the Smedley Pump Co.,
was read.
Ald. Martin then spoke, protesting
against the action of the Water Works
Trustees in sending the Holly Pump
to Rockford, Illinois, to be overhauled
and repaired. After much discussion
the petition was, on motion -of Ald.
Frith, referred to the committee of the
whole to invite the Water Works
Trustees to meet with the committee
in reference to the bill.
Petition of C. H. Berg et al asking
that the city give John Burns work
on the streets, was, on motion of Ald.
Frith, referred to the Street Commis-
sioner.
Petition of A. L. Rhomberg, asking
that the taxes on lots 640 and 641,
East Dubuque addition, and block 24,
Railroad add., for the year 1907 be
canceled, said lots being used for the
detention hospital, was on motion of
Ald. Frith granted andH the Treasurer
to be instructed accordingly.
Petition of Dubuque and
Bridge Co., asking that the taxes on
the bridge for the year 1907 be can-
celed as per the resolution passed
when the bridge was built, was on
motion of Ald. Martin referred to the
committee of the whole.
Petition of Adolph Gonser asking
that the City Engineer be instructed
to give hire the grade on lot 41, Alt -
sausers sub., so he can build on said
lot, was on motion of Ald. Haas
granted and the City Engineer to be
instructed to give the grade as asked
for.
Petition of the Fifth Ward Non -
Partisan League asking that the Chief
of the Fire Department be instructed
to report to the Council at their next
meeting the condition of the Bijou
theatre, and the improvements neces-
sary to be made on said theatre before
it is opened to the public next autumn,
was on motion of Ald. Frith referred
to the committee of the whole to view
the grounds.
The petition of the Upper Mississip-
pi River Improvement Association
asking that a warrant be ordered
drawn for $250.00 in favor of N. J.
Schrup, treasurer of the Association,
to pay the annual dues of the City of
Dubuque, was read, and on motion of
Ald. Frith rules were suspended to al-
low Mr. C. T. Hancock permission to
address the Council. Ald. Frith then
moved that the Mayor sign a warrant
in the sum of $250.00 in favor of the
Association as asked for. Carried.
Petition of Frank Schulz et al ask-
ing that the Council have the water
mains extended in alley between
Rhomberg and Garfield avenues from
Middle to Reed avenues, was on mo-
tion of Ald. Martin referred to the
Water Works Trustees with recom-
mendations of the Council that the
mains be extended as asked for.
Ald. Frith moved as an amendment
that the Mayor appoint a committee
to wait on the Water Works Trustees
to see if they can not arrange to have
the water mains extended as asked
for. Amendment carried.

Petition of F. W. Ccates asking that
the storm water sewer on Walnut
street be extended from its present
terminus at West Eleventh street,
north to Rose street, was on motion
of Ald. Rand referred to the commit-
tee of the whole.
Remonstrance of Barney Struteman
et al remonstrating against the levy-
ing of a special assessment on their
property for the proposed improve-
ment of Windsor avenue, was on mo-
tion granted.
Ald. Frith moved that the matter of
the improvement of Windsor avenue
be referred to the committee of the
whole. Carried.
Communication frc m James Lee
asking that the Council investigate
the matter of water from Fenelon
Place flowing into his property known
as the south 100 feet of lot 4 of city
lot 692, and damaging same, also ask-
ing that Council have damage already
done repaired and other means adopt-
ed for taking care of the overflow of
water from Fenelon Place, was on
motion of Ald. Saul referred to the
committee of the whole to view the
grounds.
Original Notice in the District Court
of damage suit of Thomas Fitzsim-
mons, claiming damages against the
city for $5,000.00, was presented and
read, and on motion of Ald. O'Rourke
referred to the City Attorney.
Preliminary notice and certified
statement of claim for $7,500.00 of
Emma M. Wilkinson for personal in-
juries claimed to have been sustained
by her by falling on Louisa street, was
on motion of Ald. O'Rourke referred
to City Attorney.
Bids for improving Milwaukee ave-
nue were presented, and on motion of
Ald. Frith were ordered opened and
referred to the City Engineer to esti-
mate total.
Bids are as follows:

Chief, which petition was referred to
me fo. investigation, I would respect-
fully report that I have examined the
Bijou theatre and find that all the re-
quirements of the state law regarding
the protection of the public in public
buildings in case of fire, have been
complied with; the building having
all the fire escapes, exits, entrances,
fire extinguishers and hose as required
by law, and I can find no negligence
on the part of the managers of the
Bijou theatre in compliance with the
laws of the state. four Fire Chief
would respectfully recommend that
the matter be referred to the commit-
tee of the whole to go over the build-
ing thoroughly with the Fire Chief
for a more detailed examination of
the building.

Whereas, The contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer, as hereinafter described, has
been completed, and the City Engi-
neer has computed that the cost and
expense of said improvement amount
to five hundred twenty -one and 55 -100
dollars, therefore he it
Resolved, By the City Council of
the City of Dubuque, That to provide
for the cost of constructing an eight -
inch tile pipe sanitary sewer in Alta
Vista street from Yale ,street to West
Fifth street, the Mayor, be and he is
hereby required to execute and deliv-
er to the City Recorder, to be by him
registered and countersigned, one
bond for two hundred and fifty dol-
lars and one bond for two hundred
and seventy -one and 55 -100 dol-
lars, numbered 652 and 653, dated
June 22nd, 1908, payable on or before
seven years after the date thereof,
and bearing interest at the rate of
five per cent. per annum, payable
semi - annually.

sale of thirty-eight 5500.00 refunding
improvement bonds authorized by the
City Council February 6, 1908.
We attach hereto the receipt of the
Treasurer for the $19,000.00 and also
his receipt for $372.24, the amount re-
ceived for accrued interest on said is-

Ald. Frith moved that the matter
of grade of St. Ambrose street be re-
ferred to the committee of the whole
to view the grounds and the Engineer
to drive stakes on St. Ambrose street
showing grade before committee views
the grounds. Carried.
Ald. Martin, chairman of the corn -
mittee on police and light, presented
and react the following:
We have examined the matter of
taking steps to enforce the ordinance
with reference to the payment of tax
on clogs.
The object of requiring the owners
of clogs to pay a tax thereon is two-
fold; to raise revenue, and to prevent
the keeping of worthless dogs.
One method of proceeding is to em-
ploy a clog catcher, and to authorize
him to catch, impound and kill all
unlicensed dogs in the city. This
causes many persons who have dogs
which they desire to keep, to take
out licenses, and it rids the city of
many worthless dogs, but it does not
cause all the persons who keep dogs
to take out licenses, it does not
rid the city of all worthless or un-
licensed dogs, and it causes to be im-
pounded and killed many valuable
dogs on which the owners would glad-
ly pay tax.
Another method is to employ a dog
enumerator, whose duty is to enumer-
ate all the dog owners in the city and
to require them to take out licenses
on their dogs, or to surrender them
to be killed. On their refusal to do
either, they can be proceeded against
under the ordinance and fined. By
this method, all risk of impounding or
killing valuable dogs is avoided, and
every unlicensed dog is killed. By
making the compensation to the dog
enumerator to consist in part of a
percentage upon the dog tax paid dur-
ing the period of his employment,
(payable at the termination of his
service) it is believed that a thorough
enumeration can be effected, and a
tax collected on every dog which is in
the city at the end of the enumeration.
We recommend the latter plan, and
the adoption of the following resolu-
tion:
Resolved, That the committee on
police are hereby authorized to em-
ploy, upon such compensation as they
shall deem suitable, a dog enumerator,
the term of whose employment shall
end at their pleasure, and whose duty
it shall be, wholly under their di-
rection, to enumerate the dog owners
and dog harborers in the city; to ac-
cept from such owners or harborers,
at their pleasure, any dogs surrender-
ed by them, and to kill or otherwise
dispose of same; to notify owners or
harborers of unsurrendered dogs to
take out licenses on same; and to
perform such other acts, in reference
to catching unlicensed dogs and pro -
curing evidence against persons who
violate the ordinance concerning dog
licenses, as said committee may di-
rect; and that said committee, in con-
junction with the City Attorney, be
further authorized and - directed to
take such legal steps against violators
of said ordinance as to them shall
seen proper.
Ald. Martin moved the adoption of
the report and resolution.
Ald. Frith stated he was opposed to
having the clog pound at the present
location on Jackson street in such a
thickly populated neighborhood.
After much discussion the resolu-
tion and report were adopted by the
following vote:

Ald. O'Rourke moved as an amend-
ment that the resolution of Ald. Mar-
tin be referred to the committee of

Ald. Frith offered the following:
Be It Resolved by the City Council
of the City of Dubuque, That it is
deemed necessary and advisable to
construct a sanitary sewer in the al-
ley between Rhomberg and Garfield
avenues and it is hereby proposed to
construct a sanitary sewer in said al-
ley as follows, to -wit: An eight -inch
tile pipe sanitary sewer in said alley
between Rhomberg and Garfield ave-
nues from Middle avenue to Reed
avenue, and to assess the cost of said
sewer against the abutting property.
Ald. Frith moved the adoption of
the resolution.
Carried by the following vote:

Ald. Frith also offered the follow-
ing:
Be It Resolved by the City Council
of the City of Dubuque, That the City
Engineer be and he is hereby directed
to prepare a plat and specifications
for an eight -inch tile pipe sanitary
sewer in the alley between Garfield
avenue and Rhomberg avenue, show-
ing the location and general nature of
such improvement, the extent thereof,
the size and kind of material to be
used, and to prepare an estimate of
the cost thereof and the amount as-
sessable upon each lot or parcel of
land adjacent to or abutting thereon
per front feet or square feet in area,
and to file such plat, specifications
and estimate in the office of the City
Recorder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stating
that such plat is on file, and generally
the nature of the sewer, its location,
size and kinds of material to be used,
and the estimate of its cost and fixing
the time, before which objections can
he filed, which time shall not be less
than five days after the last publica-
tion of said notice, and after the cotn-
pletion of the publication of such no-
tice, he shall at its next session no-
tify the Council thereof in writing
with a printed copy of such notice ac-
companying the same.

Ald. Rand, chairman of the com-
mittee on claims, reported as follows:
Your committee on claims, to whom
was referred the bill of Dr. W. P. Slat-
tery for $75.00 for examinations in
various cases of personal injuries sus-
tained by reason of falling on de-
fective sidewalks, would respectfully
recommend that the sum of $50.00 be
allowed on said claim provided that
said amount be accepted in full set-
tlement thereof, and that a warrant
in said amount be ordered drawn on
the City Treasurer.

tee on public grounds and buildings
had flowers placed in parks and the
expense of the work and flowers
would be much less than the $200.00

service on Jackson street is not satis-
factory and considerable complaint is
being made on the service.
Ald. O'Rourke stated that there
were a shortage of water hydrants in
the city, and the committee of the
whole would recommend additional
hydrants.
Ald. Haas, chairman of the com-
mittee on supplies, reported as fol-
lows:
Your committee on supplies, to
whom were referred the bills of
Harger & Blish for $19.35, the Enter-
prise Printing Co. for $32.50, and
Kelly's Book Store for $12.05 for sup-
plies furnished various city officers,
would respectfully recommend that
said bills he • allowed and that war-
rants in the several amounts be or-
dered drawn on the City Treasurer in
settlement of the claims.

follows:
Your committee of the whole, to
whom was referred the petition of
the Dubuque Commercial Club asking
that it be granted permission to con-
duct an auction on the regular Month-
ly Market Day without having to pay
the regular auctioneer's license there-
for, would respectfully recommend
that said petition be not granted, but
in lieu thereof and in view of the
good done the city generally by the
holding of said market days, that the
city donate annually to the Dubuque
Commercial Club, a sum equal to the
fee charged for an auctioner's license;
said donation to be contingent upon
there being held r.ot less than twelve
market clays annually by said Club.
Also, your committee of the whole,
reporting on the within communica-
tion of the Superintendent of Sprink-
lin, would respectfully recommend
that the Board of Water works Trus-
tees be instructed, in order to facili-
tate the loading of the sprinkling car,
to have a hydrant put in at the south-
west corner of Rhomberg avenue and
Kniest street and one at the street car
barn; the selection of the location of
the latter. whether to be inside or out-
side the building, to be 'left to the
judgment of said Trustees and the
Union Electric Company.

RESOLUTIONS.
Ald. Martin offered the following:
Be It Resolved by the City Council
of the City of Dubuque, That from
and after the first clay of July, 1908,
the working day for all employes of
the city working on streets, sewers or
other public works being done by the
City, shall begin at 8 o'clock a. m.
and close at 5 o'clock p. m., and that
they be allowed one hour at noon for
dinner, with the daily wage remain-
ing as at present.
Ee It Further Resolved, That this
City Council pledges itself to adopt at
the proper time, resolutions request-
ing the representatives from Dubuque
county to the Thirty -third General
Assembly of the State of Iowa, to use
their utmost endeavors to secure the
enactment of a law providing that
cities shall have the power to incor-
porate in the specifications for all
contracts let for public work, the pro -'
vision that eight hours shall consti-
tute a day's labor for all men working
on Such contract work.

Petition of the Security Building Co.
asking that the Council give Mr.

space occupied by his wagon on the
northeast corner of 8th and Main
streets was on motion received and
filed.
Petition of Peter A. Ziegler et al
asking that the dog pound be moved
from its present location on Jackson
street near Twenty -fifth street, was
read, and on motion of Ald. Frith the
rules were suspended to allow the pe-
titioners permission to address the
council. Mr. Thomas Barry and Pe-
ter Ziegler then addressed the Coun-
cil.
Ald. O'Rourke moved that the pe-
tition be referred to the committee of
the whole. Carried.
Ald. Frith moved that the Humane
Society be notified to endeavor to find
some other more suitable place than
the present one on Jackson street for
their dog pound. Carried.

for shoeing the carpenter's horse dur-
ing the month of April, 1908, would
respectfully recommend that said bill

whom was referred the profile show-
ing a proposed grade on Yale street,
would respectfully recommend that

Mayor of the City of McGregor, Iowa,
had appealed to him asking that the
City of Dubuque loan them a fire en-

the water from the flooded buildings,
stating that the present condition is
causing considerable sickness. Mayor -
Schunk further stated that he had
sent the Chief of the Fire Department
with the reserve fire engine and an
engineer up to McGregor and asked
that his action be approved. 011 mo-

Mayor was approved.

Vista street to lot No. 18 of Oxford
Heights subdivision in the City of Du-
buque, Iowa, be and the same is here-
by adopted and established as shown
by the profile of said street and Trade_

in future a moderate charge will be
made to cover said expenses, and that
for the present the Market Master,
under the supervision of the proper
committee of the City Council be in-

department was in need of a new
horse to replace one of the patrol
horses and moved that the committee
on police and light be empowered to
advertise for bids for a new patrol

that committee try this method before
purchasing new horse.
Ald. Frith moved that the grade of
Hennepin street as submitted by the
City Engineer be accepted, subject to
the decision of the street committee
and be referrrd to the ordinance com-
mittee to prepare ordinance establish-
ing the grade. Carried.

Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder, until 8:00 p. m.,
Thursday, June 18th, 1908, for the im-
provement of Milwaakee avenue from
Couler avenue to Jackson street, in
accordance with plans and specifica-
tions prepared by the City Engineer
and now on file in the office of the
City Recorder.
It is estimated by the City Engineer
that said improvement will require
736 lineal feet of new curbing set.
736 lineal feet of guttering.
1033 square yards of macadamizing.
Earth filling, 800 cubic yards.
The work to he paid for when said
work is completed and as prescribed
by Chapter XXXIT of the Revised Or-
dinances of 1901, of the City of Du-
buque, work to be completed on or be-
fore November 1st, 1908.
Bidders must state price per lineal
foot for new curbing set, the price per
lineal foot for guttering, the price per
square yard for macadamizing, also
price per cubic yard for grading.
Each bid must be accompanied by a
certified check for $50.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded.
The City Council reserves the right

Section 1. That a grade on Mil-
waukee avenue from Couler avenue to
Jackson street, in the City of Du-

the south curb line of Sixth street to

paving at Fourth and White streets
in accordance with the plans and spec-
ifications prepared by the City Engi-

It is estimated by the City Engineer

3168 square yards of brick paving and
