Petitions and Communications.
Petition of Mrs. Helen May asking
that the tax for the year 1907 on lot
106 Union Add. be canceled, she be-
ing a widow in poor circumstances
and unable to pay same was on mo-
tion of Ald. Haas referred to the
Delinquent Tax Committee.
Petition of Isabelle Schuyler ask-
ing that the assessment on Lot 2,
McDaniel's Park Hill Adcl., be reduced
to the rate at - which it had been
assessed for a number of years was on
motion of Ald. O'Rourke referred to
the Committee of the Whole.
Petition of a taxpayer on Stafford
Avenue asking that sidewalks abut-
ting property of various parties on
said street, as mentioned in petition,
be ordered improved at once, was, on
motion of Ald. Frith, referred to the
Sidewalk Inspector with power.
Petition of Dominick Fisch asking
that Klingenberg Terrace be repaired
as soon as possible was on motion of
Ald. Haas referred to the Committee
of the Whole to view the grounds.
Petition of Mary L. Casey asking that
the taxes for the year 1907 on Lot 2,
Finley Add. be canceled., she being
a widow with three small children in
poor health and unable to pay same
was on motion of Ald. Haas referred
to the Delinquent Tax Committee.
Petition of the Dubuque Commer-
cial Club asking that the council re-
fund the $10.00 paid by them for
auctioneer's license for two months
was on motion of Ald. Haas granted
and the Recorder to be instructed to
draw a warrant in said amount.
Communication from Dubuque Hu-
mane Society in reference to chang-
ing the location of the dog refuge
was on motion of Ald. O'Rourke re-
ferred to the Committee of the Whole
and the petitioners notified to be
present at the meeting.
Communication of the Universal
Art Division of the Dubuque Woman's
Club asking that the council have the
parks of the city thrown open to
the children and their friends one day

each week, and that the Keep Off
The Grass signs be ignored on these
days, said privileges to commence on
the Fourth of July was on motion of
Ald. O'Rourke referred to the Com-
mittee of the Whole.
Communication from Union Electric
Co. asking that the council select a
new location for the arc light now in-
stalled at the corner of Coates avenue
and Walla street, or grant the Electric
company permission to take the arc
lamp clown as it is an impossibility
to keep the globe on the lamp, boys
in the neighborhood breaking them
as soon as they are put on the lamp
was on motion of Ald. O'Rourke re-
ferred to the Committee on Police and
Light.
Petition of A. C. ]3uettell and Wm.
T. Roehl asking that they be granted
permission to confer with the Com-
mittee on Streets in reference to the
curbing on College Avenue, abutting
on their property so that they can
lay permanent sidewalks was on mo-
tion of Ald. O'Rourke referred to
the Committee of the Whole to view
the grounds.
Claim of Josephine Prowse, by J.
W. Kintzinger, her attorney, claiming
damages to her property, lot No. 3,
Glendale Addition to the amount of
$500 was on motion of Ald. O'Rourke
referred to the Committee of the
Whole. -
Reports of Officers.
Mayor Schunk stated that in com-
pliance with the law requiring the
appointment of Water Works Audi-
ting Committee, would respectfully
report that he had appointed Ald. D.
W. Rand, Ald. W. Singrin, and Ald.
E. E. Frith as the Auditing Commit-
tee of the Water Works.
Mayor Schunk also stated that he
had not signed the resolutions for the
improvement of St Ambrose street,
as the property of one of the abutters
would not stand the assessment for
the improvement and the owner of
the property had not signed a waiver.
Ald. Rand stated that Mr. Ilg, the
owner of the property referred to, had
agreed to sign the waiver.
• Mayor Schunk then stated that he
would sign the resolutions as soon as
the proper waivers were signed.
City Treasurer Brinkman reported
as follows:

Gentlemen: —I herewith submit my
report of defective lights for the
month of June, 1908.
I find from the reports of the po-
lice department that the total hours
that 18 lamps failed to burn would
equal 2 -3 of one lamp burning for one
month, or $3.60.

On motion of Ald. Martin the re-
port was received and the city auditor
instructed to deduct from the Union
Electric company's hill for the month
of June, 1908, the sum of $3.60.

City Attorney Lyon reported as fol-
lows:
To the Honorable Mayor and City
Council:
Gentlemen: —On February 20; 1908,
the City Council of this city adopted
an ordinance providing for the regu-
lation of gas rates and meters and
providing a penalty for the violation
thereof.
On April 6, 1908, the Key City Gas
company brought an action in the cir-
cuit court of the United States for
the Northern District of Iowa„ East-
ern Division, against the City of Du-
buque, in which the said company
asked that the city be enjoined from
enforcing the ordinance as passed on
Feb. 20, 1908, which action is still
pen ding.
On April 7, 1908, a temporary re-
Straining order was issued by said
court. The ordinance adopted on
Feb. 20, 1908, was so adopted as I am
informed, without any investigation
upon the part of the then city coun-
cil, and without giving the Key City
Gas company any notice of the inten-
tion of the council to change the
price of rates to be charged for gas.
While the City Council undoubtedly
has the authority to fix reasonable
rates to be charged by the gas com-
pany, the Gas company should have
been given reasonable notice of the
intention of the Council to exercise its
rights to fix the same, as provided in
section 3 of the ordinance adopted by
the City Council of this city on
August 26, 1897, which said ordinance
being chapter 4 of special ordinances
in the book of revised ordinances of
1901 of the City of Dubuque.
It will undoubtedly cost the city a
considerable sum to defend the afore-
said action and doubting my ability
to successfully defend the action un-
der the existing circumstances, I deem
it my duty to advise the present Coun-
cil to repeal the ordinance adopted
Feb. 20, 1908, and thus relieve the
city from the expense of attempting
to sustain the present amendment.
I would therefore recommend your
honorable body that the ordinance as
amended and adopted on Feb. 20,
1908, be repealed.

Hugh Markey by John A. Cunning-
ham, his attorney, asking that the
condition of the stone wall on Alt -
hauser avenue be investigated, would
respectfully report that the matter
has been referred to the Street Com-
missioner and the alderman of the
Fifth Ward with power for final
action.
Also your Committee of the Whole,
to whom was referred the remon-
strance of E. Muntz against the pay-
ment of the special assessment for the
sanitary sewer for lot 46 on Alta Vista
street, south of Julien avenue, would
respectfully recommend that said re-
monstrance be received and filed.
Also your Committee of the whole,
to whom was referred the petition of
F. W. Coates, asking that the storm
sewer in Walnut street, be continued
from West Eleventh street to Rose
street, would respectfully recommend
that said petition be received and
filed. We would further recommend
that in lieu of the sewer petitioned
for, that a cement curb an.d gutter be
ordered laid on said Walnut street be-
tween the aforesaid points.

Alderman Saul offered the follow-

of the City of Dubuque, That North

Street from Grandview Avenue to a
point about six hundred feet west
thereof be improved by grading, curb-
ing, guttering and macadamizing the
same in accordance with the plans
and specifications for such improve-
ment prepared by the City Engineer
and now on file in the office of the
City Recorder, and be it further
Resolved, That said improvement
shall be completed on or before the
1st day of November, 1908, and shall
be paid for in the manner prescribed
by Chapter XXXII. of the Revised
Ordinances of the City of Dubuque
for the payment of t'e cost of street
improvements.
The proposals for doing said work
shall be acted upon by the Council
on the 16th clay of July, 1908, and
the City Recorder is hereby ordered
to give ten days' notice by publica-
tion asking for proposals as provided
by ordinance.
Ald. Saul moved the adoption of the
resolution. Carried by the following

Delhi Street to the south line of
Dodge Street he improved by grading,
curbing, guttering and macadamizing
the same in accordance with the

shall be completed 011 or before the
first day of November, 1908, and

City Recorder Linehan presented
and read the printed notice certified
to by the publisher, of the Council's
intention to improve North street
from Grandview avenue to a point
about six hundred feet west thereof.
No remonstrance being filed and no
one in the room objecting to the im-
provement of said street, the notice
was, on motion, received and filed.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
Council's intention to improve Grand
view avenue from Delhi street to
Dodge street.

with presents the receipt of the City
Treasurer for Five Hundred and
Twenty -one and 55 -100 Dollars, the
proceeds of the sale at par of Im-
provement Bonds 652 and 653. Said
bonds having been issued for defray-
ing the cost of the sanitary sewer or-
dered by the City Council in Alta
Vista street from Yale to West Fifth

Ald. Saul, chairman of the Commit-
tee on Streets, reported as follows:
Your Committee on Streets, to
whom was referred the petition of J.
H. Spencer et al, asking that Pickett
street be repaired, cleaned and side-
walks ordered thereon, would respect-
fully recommend that the prayer of
the petitioners be granted and that
the proper officers be instructed to see
that the conditions complained of be
remedied as early as possible.

Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referrer: the remonstrances
of M. Kassler et al against the brick
paving of White street, Allen Staples
et al against the brick paving of Lo-
cust street from Eighth street to
Fourth street, Carr, Ryder & Adams
Co., against the brick paving of
Jackson street and the Telegraph -
Herald et al against' the brick paving
of Sixth street, would respectfully
recommend that all said remon-
strances be received and filed.
Also your Committee of the Whole,
to whom was referred the petition of
the Dubuque and Wisconsin Bridge
company, asking that the City Treas-
urer be instructed, in accordance with
the existing agreement between said

Alderman Rand also offered the fol-
lowing:
Be it Resolved by the City Council
.of the City of Dubuque, That the City
Engineer be and he is hereby directed
to prepare a plat showing generally
the location, nature and extent of the
proposed improvement on the west
side of Walnut Street from West
Eleventh Street to Rose Street, and
the kind of material to be used, and
an estimate of the entire cost there-
of, and the amount and cost of such
improvement, and the amount assess-
able upon any railway or street rail-
way company, the amount and cost
thereof, to be paid by the city, if any,
and the cost thereof and amount
assessable upon each lot or parcel of
land adjacent to or abutting upon
such improvement per front foot, and
to file such plat and estimate in the
office of the City Recorder; that after
the filing of said plat and estimate in
his office, the City Recorder shall pub-
lish in three consecutive issues of a
newspaper published in this city, a
notice stating that such plat and es-
timates are on file, the location and
nature of the improvement, kind of
material to be used, and an estimate
of its cost, and the time before which
objections thereto can be filed, and
the time fixed for hearing, which time
shall not be less than five days after
the last publication of such notice,
and after such publication shall have
been made, the City Recorder shall,
at the next regular session of the City
Council, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.
Ald. Rand moved the adoption of
the resolution.

On motion of Ald. O'Rourke Coun-
cil took a recess and went into Com-
mittee of the Whole.
Upon reconvening at 10:15 p. m.
Ald. O'Rourke presented the follow-
ing reports of the Committee of the
Whole.
Your Committee of the Whole
would respectfully recommend that
John Bohn be appointed the inspector
on the Bee Branch sewer in Wash-
ington Street at a salary of $50.00 per
Montii . -said .appointment to .take ef-
fect when contractor begins to lay the
rock.
Also your Committee of the Whole
would respectfully recommend that
the City Engineer be instructed to fur-
nish a copy of the plans and specifi-
cations for said sewer to the above -
said inspector, John Bohn.

that the meeting was an adjourned
meeting of the regular meeting of
July 2nd, 1908, and was called to take
up and consider all matters which
may properly come before the City
Council.
Petitions and Conmiunications.
Petition of John Beringer et al
asking that an arc light be placed on
Belmond Street was on motion of Ald.
Rand referred to the Committee of
the Whole.
Petition of Nic Smith, owner of lot
1 of the Subdivision of lot 1 of 6, L.
H. Langworthy's Add., asking that the
Treasurer be instructed to refund
$6.71, paid by him for special assess-
ment levied in 1904 for constructing
sewer in White Street, as sewer is
so constructed that he cannot connect
his property with said sewer, was on
motion of Ald. Frith referred to the
Committee of the Whole to view the
grounds.
Petition of the Dubuque Biscuit
Company asking that their personal
taxes be remitted for a period of
seven years, beginning with the year
1908, was on motion of Ald. Frith re-
ferred to the Committee of the
Whole.
Petition of John Keckevoet asking
that the city accept $100.00 in full
settlement for wharfage and rent of
space for boat livery for the year
1908 was read. Ald. Rand moved that
the petition be referred to the Com-
mittee of the Whole. Carried.
Petition of Mrs. Louisa Lange ask-
ing that the Council take the neces-
sary steps to widen Wilbur Avenue
between Rock Street and Olive Street.
Also that Olive Street between Wil-
bur Avenue and Jefferson Avenue be
opened for travel and that said street
be graded and made passable for
teams, was on motion of Ald. Rand
referred to the Committee of the
Whole, City Engineer and City At-
torney.

lice and Fire Commissioners law cre-
ates a vacancy in the position of any
commissioner twenty days after the
nomination and acceptance of a par-
ty nomination for a political office.
Under this provisicn Mr. Jacob
Haudenschield is no longer a mem-
ber of the Board.
To fill the vacancy I have the
honor of appointing Hon. George
Ragatz, Sr., and submit same for

Dear Sirs: - -I hereby return to you.
the Ald. O'Rourke resolution adopted
at the June 25th, 1908, session of
your honorable body, providing for
the brick paving of Locust Street
from Sixth to Eighth Streets.
There has been a general protest
of the property owners abutting on
this street it is proposed to brick pave
against having the work done at this
time. It is pointed out that this is a
dull year in general trade and most
inopportune for extensive improve-
ments. It is also shown that the
street is not in had condition, and
that the work can as well be done
next year as this, and at less incon-
venience and burden. It is also a.
fact that the proposed brick paving
will involve the city in an expenditure
of nearly seventeen hundred dollars
for the brick paving to be done -
abutting Washington Park, an ex-
pense the city can ill afford at this
time.
I therefore return to you the Ald.
O'Rourke resolution calling and pro-
viding for the brick paving of Locust
Street from Sixth to Eighth streets,
and hereby veto the motion that car-
ried adopting the same

The same objections by abutters
offered to the brick paving of Locust
Street from Sixth to Eighth Streets
are made against the improvement of
Sixth Street from Main to Locust
Streets. Though in this case there is
no city property abutting on the pro-
posed improvement, so the city will
not be involved in any expense in this
proposition. However, having vetoed
the Locust Street proposition for
brick paving, I see no reason why I
should approve of this one.
I therefore return to you the Ald.
O'Rourke resolution calling and pro-
viding for the brick paving of Sixth
Street from Main to Locust Streets,
and hereby veto the motion that car-
ried adopting the same.

To the Honorable Council:
Dear Sirs: - -I herewith return to
you the Alderman Rand resolution
adopted at the June 25th, 1908, ses-
sion of your honorable body for a
charge of $1.50 per hour for night
rental, and $1.00 per hour for day
rental of halls and rooms in the City
Hall.
I am opposed to this rental charge
for halls in the City Hall, because
none of them have been at any time
used for pecuniary benefit other than
the securing of funds for charitable
purposes. The Sherman Circle, the
St. Elizabeth Society, Miss Brennan's
Industrial Class of Children of the
Poor, all these are conducted for the
most worthy purpose of securing
funds in aid of the deserving poor.
The ladies in charge of these worthy
organizations have done a noble work
in aid of worthy charity in the past,
and I am opposed to, at this time,
hampering them in their good work,
and perhaps driving them out alto-
gether by charging for rooms that the
city has at the present time absolute-
ly no use for. I do favor placing
meters in these - rooms - and letting the
different societies pay the bills for
the gas used, but beyond that I am
unalterably opposed to the charging
of a rental for the rooms.
I therefore return to you the Ald.
Rand resolution recommending
charging of rental for City Hall
rooms, and hereby veto the motion
that carried adopting the same.

reconsider their action in referring
the petition of John Keckevoet to the
Committee of the Whole. Carried.
Ald. Haas then moved that the pe-
tition of John Keckevoet asking that
the city accept $100.00 in full settle-
ment of wharfage, license, etc., be
granted, provided payment is made
before July 20th, 1908.
Ald. Singrin asked for the opinion
of the City Attorney as to whether
the city could accept $100.00.
Attorney Lyon then addressed the
Council, recommending that $100.00
be accepted.
Ald. Rand stated that he was not
opposed to granting Mr' Keckevoet's
petition but thought it would conflict
with the City Ordinances.
Motion of Ald. Has was then put
and was carried.
Ald. Rand moved that the Council
reconsider their former action in re-
ceiving and filing the veto of Mayor
Schunk in the resolution for the im-
provement of Locust Street from
Sixth Street to Eighth Street; also
the veto of the resolution for the
paving of Sixth street from Main to
Locust Streets.

of the bidders on these streets had
presented his bid five minutes late

that said report he approved and the
recommendation therein contained
carried out by the adoption of an or-
dinance repealing the action of the
City Council of February 20, 1908.

James Alderson and G. M. Orvis, ask-
ing that Yale Street be improved from

Alta Vista Street to the center of
Harvard Street, showing the locations
and general nature of such improve-
ment, the extent thereof, the size and
kind of material to be used, and to
prepare an estimate of the cost there-
of and the amount assessable upon
each lot or parcel of land adjacent to
or abutting thereon per front feet or
square feet in area, and to file such
plat, specifications and estimate in the
office of City Recorder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stating
that such plat is on file, and generally
the nature of the sewer, its location,
size and kinds of material to be used,
and the estimate of its cost, and fix-
ing the time before which objections
can be filed, which time shall not be
less than five days after the last pub-
lication of said notice, and after the
completion of the publication of such
notice, he shall at its next session, no-
tify the Council thereof in writing
with a printed copy of such notice ac-
companying the same.

the City Recorder; that after the fil-
ing of said plat and estimate in his
office, the City Recorder shall publish

On motion of Alcls. Saul and Sin-
grin the pay rolls on streets and sew -

dered 'drawn to pay the various

City Recorder Linehan presented
and read the printed notice, certified
to by the publisher, of the council's
intention to improve St. Ambrose
Street from Asbury Street to Willow
Street. No remonstrance being filed
and no one in the room objecting to
the said improvement, the notice was,
on motion, received and filed.
Assistant City Attorney Willging re-
ported the following:
To the Honorable Alayor and City
Council of the City of Dubuque:
Gentlemen: —In response to the re-
quest of your Committee of the Whole
for an opinion relative to the action
which the city may take with refer-
ence to the clog pound or home for
dogs located at 25th and Jackson
Streets I would submit the following:
Paragraph 27 of Section 7 of the
Charter gives the City Council the
power, and it is made their duty, to
make all such ordinances as to them
shall seem necessary to provide for
the safety, preserve the health, pro-
mote the prosperity and improve the
morals, order, comfort and conveni-
ence of said city and the inhabitants
thereof. Code Section 947 contains a
like power.
Code Sec. 696, which is made ap-
plicable to special charter cities, gives
to such cities the power to prevent in-
jury or annoyance from anything dan-
gerous, offensive or unhealthy, and to
cause any nuisance to be abated, etc.
The question presenting itself next
is one of fact, whether the pound or
harbor in question constitutes a
nuisance, materially infringing upon
the rights of the community in ques-
tion. "The criterion for determining
whether or not a particular use of
property is a nuisance is its effect
upon persons of ordinary health and
sensibilities and ordinary modes of
living." "An act or use of property to
constitute a nuisance must violate
some legal right, either public or pri-
vate, and must work some material
annoyance, inconvenience or injury,
either actual or implied from the in-
vasion of the right."
The test has been defined as fol-
lovis: "In all such cases, the question
is whether the nuisance complained of
will or does produce such a condition
of things. as, in the judgment of rea-
sonable men, is naturally productive
of actual physical discomfort to per-
sons of ordinary sensibilities,' and of
ordinary tastes and habits, and as, in
view of the circumstances of the case,
is un reasonable and in derogation of
the rights of the complainant."
Where the nuisance complained of
exists in the creation of noises, the -
noise must be unreasonable, unusual,.
ill- timed, although it may be com-
paratively slight, if it so affects the -
nervous system as to produce actual
physical pain in persons of ordinary
sensibilities. If the noises are only oc-
casional, without causing serious dis-
comfort or annoyance, they will not_
constitute a nuisance.
Noises made by dogs and other ani-
mals, kept collectively, have repeated-
ly been declared nuisances, where the -
barking, whining, stamping, etc.,
have been in such proximity and at
such times and in such a degree as to
cause serious discomfort and annoy-
ance.
It would seem, therefore, that the
Council has the power to order the-
discontinuance of a nuisance of this
nature, if it is satisfied as to its ex-
istence. Respectfully,

Assistant City Attorney Willging be-
received and the dog shelter on the
corner of Jackson and 25th Streets be
condemned as a nuisance and ordered
abated.

dress the Council in reference to the
dog pound. Carried.
Mr. Chas. Eichhorn, Peter Ziegler,.

After much discussion, Ald. Rand
moved as an amendment to Ald.
F'rith's motion that the Committee on_
Police and Light provide another
place for the care of dogs. Amend-

read an ordinance establishing the
grade on Hennepin Street from Wind-
sor Avenue to Stafford Avenue and
moved that the reading' just had be
considered its first reading. Carried.
Ald. Martin then moved that the
rules be suspended for the purpose of
reading• the ordinance by its title for
the second time.
By unanimous consent the second
reading of the ordinance was laid over
to the next meeting of the Council.

improvement, and if we go ahead and
make it, the city will be at a great
loss in making up out of its own fi-
nances, the difference between what
can be assessed to the abutting prop-
erty owners and the actual cost of the
improvement. It' the difference were
but trifling I would overlook it be-
cause the •• improvement is greatly
needed. ' But the difference is too
great to permit of even" considering it.
I therefore return to you the Ald.
Rand resolution providing for the im-
provement of West Locust Street, and
hereby veto the motion that carried
adopting the same.

the Gas Ordinance was also present-

To the Honorable Council, City of
Dubuque:
Dear Sirs: —I herewith return to
you the ordinance repealing an ordi-
nance providing for the regulation of
gas rates and meters and providing a
penalty for the violation thereof.
The City Attorney in his report to
your honorable body says that the
passage of the ordinance adopted
February 20, 1908, was faulty in that
no notice of the Council's intention to
reduce the rate had been given the
Gas company. His fear that he could
not successfully combat the Gas cone-
pany's counsel certainly cannot be due- .
to any such reason. The Key City Gas
company as a matter of fact did have
notice 01 the city's intention to reduce
the price of gas twenty - five days be-
fore the ordinance became operative.
To prove this assertion I attach the
affidavit of City Recorder Linehan
that he, on March 6, 1908, twenty - five
days before the ordinance went into
effect, gave the Key City Gas com-
pany the proper legal notice of the
city's intention to reduce the price of
gas to ninety cents on. April 1, 1908.
This demonstrates conclusively that
the City Attorney's contention that no
legal notice had been given is clearly
wrong, and he must have been misin-
formed of the facts. The City Attor-
ney also overlooked a very important
statute bearing on this -case, that states
that 110 contract, ordinance or resolu-
tion shall in any way abridge the right
of a city to regulate the price of gas
at any time. -
In C hapter 4 of General Powers of
Municipal Corporations, in the 1902.
Supplement to the Code of Iowa —
Section 725, it is clearly and concisely
stated `.'they shall have power to reg-
ulate and fix the rent or rate for
water, GAS, heat and electric light,
and these powers shall not be abridged
by ordinance, resolution or contra.ct."
This does away entirely with the
ordinance that provided for notice tb
the company before reduction of the
price of gas could be made. It does
away entirely with the alleged faulty
procedure in adopting the ordinance.
It establishes the fact that the ordi-
nance was properly adopted and is
legal.

Petition of Mrs. Margaret Olinger

grounds.
Petition of Joseph Welu et al ask-
ing that they be granted permission

The annual report of the Dubuque
Bridge Company for the year ending
April 30th, 1908, was presented and
read and on motion of Ald. Frith was
referred to the Committee of the

Bids for the improvement of Pleas-
ant Street, Hennepin Street and Lo-
cust Street were, on motion of Ald.
Frith, opened and read and referred
to the City Engineer to estimate.
Bids for the improvement of Yale
Street, Jackson Street and Washing-
ton Street were, on motion of Ald.
Frith, opened and read and referred
to the Committee of the Whole, there
being but one bid submitted for each
of the contracts.
Bids for construction of sidewalk
on south side of Fifteenth Street
abutting city property were presented.
City Recorder Linehan stated that one
of the bidders for said work had pre-
sented his bid late. Ald. Frith moved
that bid that was submitted late be

Bid of N. Kolfenbach, being the-
only other bid submitted for the con-
struction of the sidewalk abutting

the gas company's campaign of
education in the April election has not
changed one iota my contention that
we should have ninety -cent gas, and
have it at once. As one of the brands
plucked from the burning in that
memorable campaign, I accept the is-
sue and stand with the people upon
it. I regard it as a special privilege
and am proud to stand, even though
perhaps alone in this Council for the
right of the citizens of Dubuque to
Obtain gas at the reasonable ninety -
cent rate. And whenever that com-
pany declares that it is not a reason -
able rate, challenge it to the proof,
and it will not dare, as it has not
dared, to meet the issue fairly and
soliarely.
I therefore return to you the ordi=
nance designed to repeal the ninety -
cent gas ordinance unsigned, and
hereby veto the motion that passed
adopting the same.

ordinance establishing the grade on
Hennepin Street from Windsor Ave-
nue to Stafford Avenue, said ordinance
having been read for the first time at
the session of the Council held July
16th, 1908, and he then moved that
the ordinance be adopted.
Ald. Frith moved that the rules be
suspended to allow the property own-
ers abutting on said street permission
the proposed grade on Hennepin
Street. Carried.
Mr. Curt Koehler addressed the
Council in favor of adopting the
grade as proposed.
Mr. C. T. Hancock, of the Linwood
Cemetery Association, and Mr. Theo-
dore Grobe addressed the Council,
remonstrating against change of the
present grade of the street.
Ald. Frith then moved that the
Council take a recess of ten minutes
to examine the iprofile of Hennepin
Street. Carried.
Upon reconvening at 10:00 p. m.,
Ald. Martin moved that the ordinance
establishing the grade on Hennepin

Be it Resolved by the City Council
of the City of Dubuque, That a sani-
tary sewer of eight -inch tile pipe be
constructed in Yale Street from the
present manhole at the intersection of
Alta Vista. Street easterly to the cen-
ter of Harvard Street, according to
the plans and specifications of said
sewer prepared by the City Engineer
and now on file in the office of the
City Recorder, and be it further
Resolved, That said sewer shall be
completed on or before the 20th day
of August, 1908, and shall he paid for
at the time and in the manner pre-
scribed by Chapter XXXIV of the Re-
vised Ordinances of 1901 of the City
of Dubuque for the payment of the
cost of constructing sewers. The pro-
posals for doing such work will be
acted upon by the Council on the - 6th
day of August 1908, and the City Re-
corder is hereby ordered to give ten

tate and P. J. Ruegamer and extend-

ly, direction to conform with the pres-
ent alley terminating opposite the
center of the division line between
said lots 22 and lots 25 and 26 in
said addition, all of which property
is situated in the City of Dubuque,
Iowa; . therefore, be it
Resolved by the City Council of the
City of Dubuque, That the City Engi-
neer be and he is hereby directed to
make a survey and plat of such pro-
posed improvement, showing the land
or lots through or over which the
same is proposed to be made, the
names of the owners thereof, and the
quantity of land proposed to be taken
and file such plat in his office for pub -
lic lhspection; that after such plat is
so prepared and filed, said Engineer
shall give the owners of the property
through or over which such improve-
ment is proposed to be made, notice
as prescribed in Section 2, Chapter
XXXI. of the Revised Ordinances of

Be It Ordained by the City Council of

Section 1. That an ordinance en-
titled "An ordinance providing for the
regulation of gas rates and meters and
providing a penalty for the violation
thereof." passed February 20, 1908, to
take effect 1st day of April, 1908, be
and the same is hereby repealed.
Section 2. This ordinance to be in
force and take effect from and after
its passage by the City Council and
its publication one time in the Times -
Journal and Telegraph - Herald news-
papers of the City of Dubuque.
