The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.
Discussion
Kathy Canfield, 10080 Timothy Street, Dubuque, IA spoke on behalf of the applicant and
outlined the request to replat the existing lots to three lots. She stated that they are
replating the properties to allocate some property to family members and to consolidate
the remaining existing into one lot.
Staff detailed the staff report, noting the submitted Plat of Survey of Sandman Homestead
is located in Dubuque County within the city's extraterritorial jurisdiction area. Staff stated
that the plat will reconfigure fifteen (15) existing lots into three (3) lots and will align an
existing roadway easement. Staff noted that two lots will not have frontage on a public or
private street which does require a waiver of the street frontage requirements.
The Commission questioned when the property was originally platted, and Ms. Canfield
stated that it was platted sometime around 1976.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Final Plat of Sandman Homestead subject to waiving the street frontage
requirement for Lot 1 and Lot 3.

A RESOLUTION APPROVING THE FINAL PLAT OF SANDMAN HOMESTEAD,
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Sandman
Homestead, Dubuque County, Iowa that is within the City's 2-mile extraterritorial
jurisdiction; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage on a public
street or an approved private street for Lot 1 and Lot 3 of Final Plat of Sandman
Homestead.
Section 2. That the Final Plat of Sandman Homestead, Dubuque County, Iowa is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey.

INTRODUCTION
The proposed subdivision plat consists of fifteen (15) existing lots which together total
approximately 43 acres. The existing subdivision also includes a private roadway
easement known as Bel Ami Dive. The proposed Final Plat of Sandman Homestead
proposes to reconfigure the existing lots into three (3) new lots and to relocate the private
roadway easement known as Bel Ami Drive to better align with an existing driveway.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Minor Subdivision'. All Minor Subdivisions require review by the Zoning Advisory
Commission. Additionally, Lot 1 and Lot 3, would not have frontage along an approved
public or private street, and therefore require a waiver of the street frontage requirement.
DISCUSSION
The Final Plat of Steadman Homestead proposes to reconfigure fifteen (15) lots into three
(3) new lots and to relocate a private roadway easement. The following is a description
of each proposed parcel:
■ Lot 1 (1.815 acres) is proposed to have no frontage along a public or private street-,
however, it would be accessible from Military Road via a private roadway
easement (Bel Ami Drive). This lot would contain an existing single-family
residence and associated accessory structures.
■ Lot 2 (31.729 acres) is proposed to have frontage along the western side of the
property along Military Road-, however, access to the property from Military Road
will be across a private roadway easement (Bel Ami Drive). The property is
undeveloped.
■ Lot 3 (9.351 acres) is proposed to have no frontage along a public or private street-,
however, it would be accessible from Military Road via a private roadway
easement (Bel Ami Drive). This lot would contain an existing single-family
UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed and which does not require the construction of any
public improvements and which creates three (3) or more lots."

residence and associated accessory structures.
Pursuant to the Unified Development Code (UDC) Chapter 11-14, all lots shall have
frontage along a public street or an approved private street. Because the proposed Lot 1
and Lot 3 will not have any frontage, the applicant is requesting a waiver of this bulk
regulation. The proposed lots are otherwise in substantial conformance with the UDC.
The UDC categorizes the proposed plat as a Minor Subdivision. Pursuant to UDC Chapter
11, the Zoning Advisory Commission and City Council are the reviewing authorities for a
Minor Subdivisions and for subdivisions which require a waiver of bulk regulations. The
Zoning Advisory Commission shall review the plat to determine whether it is in substantial
conformance with the Unified Development Code and shall consider the waiver of the
street frontage requirement for Lot 1 and Lot 3.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Sandman Homestead and recommends approval subject to waiving the street frontage
requirement for Lot 1 and Lot 3.
