SUBJECT: Acceptance of Public Off -site Roadway and Utility Improvements at the
Intersection of Seippel Road and Airborne Road Adjacent to Lot 1 of
Airborne Place, in the City of Dubuque, Iowa
DATE: January 28, 2025
Per a Public Improvements Agreement between the City of Dubuque and Kwik Trip,
Inc., approved by the City Council via Resolution 411-23, the developer was to
construct water main, sanitary sewer main, and turning lane improvements on Airborne
Road, all adjacent the future Kwik Trip Convenience Store/Gas Station site at the
intersection of Airborne and Seippel.
The public sanitary sewer extension, water main extension, and turning lane
improvements were recently completed by the owner as per the agreement. The new
public improvements have been inspected and approved by Engineering Department
staff. The City of Dubuque will own and maintain said water main, sanitary sewer main,
and turning lane improvements as shown on the attached exhibit.
The owners have requested City's acceptance of the improvements adjacent to Lot 1 of
Airborne Place, in the City of Dubuque, Iowa. Upon inspection by the City, it has been
determined that the public improvements required by said agreement have been
completed in accordance with plans approved by the City Staff and in conformance with
City specifications.
City Engineer Gus Psihoyos is recommending City Council adopt the resolution
accepting the public water main, sanitary sewer main, and turning lane improvement
adjacent to Lot 1 of Airborne Place, in the City of Dubuque, Iowa.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of public water main,
sanitary sewer main, and turning lane improvements that the developer, Kwik Trip, Inc.
has recently completed adjacent to Lot 1 of Airborne Place, in the City of Dubuque,
Iowa. Said Lot 1 is the future Kwik Trip Convenience Store/Gas Station site at the
intersection of Airborne and Seippel Road.
BACKGROUND
Per a Public Improvements Agreement between the City of Dubuque and Kwik Trip,
Inc., approved by the City Council via Resolution 411-23, the developer was to
construct water main, sanitary sewer main, and turning lane improvements on Airborne
Road, all adjacent the future Kwik Trip Convenience Store/Gas Station site at the
intersection of Airborne and Seippel.
The public sanitary sewer extension, water main extension, and turning lane
improvements were recently completed by the owner as per the agreement. The new

DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the developer shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
The owners have requested City's acceptance of the improvements adjacent to Lot 1 of
Airborne Place, in the City of Dubuque, Iowa. Upon inspection by the City, it has been

determined that the public improvements required by said agreement have been
completed in accordance with plans approved by the City Staff and in conformance with
City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
described above.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
water main, sanitary sewer main, and turning lane improvement adjacent to Lot 1 of
Airborne Place, in the City of Dubuque, Iowa.

RESOLUTION NO. 32-25
ACCEPTING PUBLIC OFF -SITE ROADWAY AND UTILITY IMPROVEMENTS AT THE
INTERSECTION OF SEIPPEL ROAD AND AIRBORNE ROAD ADJACENT TO LOT 1
OF AIRBORNE PLACE, IN THE CITY OF DUBUQUE, IOWA
Whereas, per a Public Improvements Agreement between the City of Dubuque
and Kwik Trip, Inc., approved by the City Council via Resolution 411-23, the parties
wished to set forth terms for the extension of certain public water main and sanitary sewer
main utilities and the installation of turning lane improvements on Airborne Road, all
adjacent to Lot 1 of Airborne Place, in the City of Dubuque, Iowa; and
Whereas, pursuant to said agreement, certain public improvements including
public water main, sanitary sewer main, and turning lane, were installed by Kwik Trip,
Inc.; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public water main, sanitary sewer main, and turning lane improvements on Airborne
Road, all adjacent to Lot 1 of Airborne Place, in the City of Dubuque, Iowa, as shown on
the attached Exhibit, be and the same are hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, Kwik Trip, Inc., until February 3, 2027.
Passed, approved and adopted this 3rd day of February 2025.
