SUBJECT: Acceptance of Certain Subdivision Improvements in North Grandview

DATE: January 28, 2025
As a condition of the subdivision plat approval through Resolution No. 308-06 and
Resolution No. 8-21, the developer of in North Grandview Estates No. 2 was required to
install certain public improvements including street paving with curb, sanitary sewer
main, water main, storm sewers and catch basins, street lighting, fiber optic conduit,
accessible sidewalk ramps, and storm water detention facilities and to dedicate said
improvements to the City upon completion.
On January 27, 2025, the developer requested City's acceptance of the improvements
in North Grandview Estates No. 2. Upon inspection by the City, it has been determined
that the public improvements required by Resolution 308-06 and Resolution No. 8-21,
except for storm water detention facilities and associated outfall pipes, have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.
City Engineer Gus Psihoyos is recommending City Council adopt a resolution accepting
the public improvements, except for storm water detention facilities and associated
outfall pipes, as described above. Maintenance guarantees for said public
improvements shall be provided by the owners, Ehrlich Properties, LLC, for a period of
two (2) years from the date of acceptance by City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of certain public
improvements that the developer, Ehrlich Properties, LLC, has recently completed in in
North Grandview Estates No. 2 subdivision.
BACKGROUND
As a condition of the subdivision plat approval through Resolution No. 308-06 and
Resolution No. 8-21, the developer of in North Grandview Estates No. 2 was required to
install certain public improvements including street paving with curb, sanitary sewer
main, water main, storm sewers and catch basins, street lighting, fiber optic conduit,
accessible sidewalk ramps, and storm water detention facilities and to dedicate said
improvements to the City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On January 27, 2025, the developer requested City's acceptance of the improvements
in in North Grandview Estates No. 2. Upon inspection by the City, it has been
determined that the public improvements required by Resolution 308-06 and Resolution
No. 8-21, except for storm water detention facilities and associated outfall pipes, have
been completed in accordance with plans approved by the City Council and in
conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements,
except for storm water detention facilities and associated outfall pipes, as described
above. Maintenance guarantees for said public improvements shall be provided by the

owners, Ehrlich Properties, LLC, for a period of two (2) years from the date of
acceptance by City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting certain public
improvements in North Grandview Estates No. 2.

RESOLUTION NO. 33-25
ACCEPTING PUBLIC IMPROVEMENTS IN NORTH GRANDVIEW ESTATES NO. 2, IN
THE CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution 308-06 and Resolution 8-21, certain public
improvements including street paving with curb, sanitary sewer main, water main, storm
sewers and catch basins, street lighting, fiber optic conduit, accessible sidewalk ramps,
and storm water detention facilities were installed by the developer of North Grandview
Estates No. 2, in the City of Dubuque, Iowa; and
Whereas, the improvements, except for storm water detention facilities and
associated outfall pipes, have been fully completed and the City Manager has examined
the work and has filed a certificate stating that the same has been completed in
accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public improvements in North Grandview Estates No. 2, except for storm water
detention facilities and associated outfall pipes, be and the same is hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, Ehrlich Properties, LLC, for a period of two (2) years
from the date of this resolution.
