The application, staff report and related materials are attached for your review. Discussion Justin Lau, Buesing Associates, 1201 Locust Street, spoke on behalf of the applicant. He noted that there are currently two residential lots, and they were looking to create individual house lots since it was previously communal. The Commission asked what would happen to the parking lot and clubhouse parcels and Mr. Lau noted they would be owned by the homeowner's associate (HOA). Staff detailed the staff report, noting that the Estates of Dubuque parent company, Vintage Cooperatives by Ewing Properties, is in the process of transferring ownership of the subdivision to the Homeowners Association of The Estates of Dubuque (HOA). The HOA is now seeking to subdivide the property create individual lots for each of the 35 single-family residences in the subdivision. Staff noted that no changes would occure to the existing street lots and that the streets and stormwater detention basin would remain private and be managed by the HOA. Staff noted a letter submitted to the Commission requesting to table the case. Planning Staff discussed the letter and noted that the letter describes a private legal matter. Staff noted that the City Attorney's office was consulted and they confirmed and the Commission and City Council are not party to the terms outlined in the letter, and that it should have no bearing on their review. The Commission questioned why the subdivision change is needed. Mike Dalsing, 3651 Vintage Lane, representative of the HOA, noted that this new plat will allow them to sell lots of in order to pay off the bank and others. He further noted that the unfinished buildings would be owned by the HOA. The Commission discussed whether tabling the request was necessary and ultimately decided to continue with the platting process and make a recommendation to City Council. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the Final Plat of Vintage Estates No. 2. Kennedy Road and Derby Grange Road, within the Rustic Point subdivision. The subdivision was initially platted in 2023 to allow for a cooperative that consisted of two lots containing 35 single-family residences, a club house, a surface parking lot, stormwater detention, and three lots for street rights -of -way. At this point in time, the Estates of Dubuque parent company, Vintage Cooperatives by Ewing Properties is in the process of transferring ownership of the subdivision to the Homeowners Association of The Estates of Dubuque. As part of that process, they are seeking to dissolve the cooperative ownership structure and intend to further subdivide the existing lots so that each homeowner will also own the lot on which their home resides. The proposed subdivision would create individual lots for each single-family residence in the subdivision. The streets would remain as originally platted. The streets and stormwater detention basin would remain private and be managed by the homeowner's association. Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified as a Minor Subdivision'. All Minor Subdivisions require review by the Zoning Advisory Commission. DISCUSSION The Final Plat of Vintage Estates No. 2 proposes to further subdivide Lot 1 and Lot 2 in the original subdivision plat. The following is a description of the proposed subdivision: ■ Lots 1 through 35 (new) are proposed to create individual lots for the thirty-five (35) residences that have been constructed within the subdivision. Each residence would be placed on an independent lot. (Shown in green in the image below.) ■ Lot A (existing) is for the Lasso Court right-of-way and would remain unaltered from the original plat recorded in 2023. (Shown in orange in the image below.) ■ Lot B (existing) is for the Vintage Lane right-of-way and would remain unaltered from the original plat recorded in 2023. (Shown in red in the image below.) ■ Lot C (existing) is for the Ewing Drive right-of-way and would remain unaltered from the original plat recorded in 2023.
