Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: February 24, 2025 Dubuque All -America City ­ 2007.2012.2013 2017*2019 RE: Bee Branch Creek Trail Project — Phase 1 Project Iowa DOT Project No. TAP-2100(697)-81-31 (PROJECT 5544000003, PROJECT 5524000003, PROJECT 5521000014 and 5524000016) INTRODUCTION The attached resolution provides for the acceptance of the public improvement construction contract for the Bee Branch Creek Trail Project — Phase 1 Project, Iowa DOT Project No. TAP-2100(697)-81-31. BACKGROUND This project included construction of a 10-foot-wide multi -use trail that connects from 12th street on the south, goes around the Alliant solar field on the east side and connects with Sycamore Street via passing under the 151/61 overpass. Engineering staff worked with Fehr Graham out of their Manchester, IA office to design the project. The consultant and staff worked diligently with the Iowa DOT, EPA, US Army Corps of Engineers and Iowa DNR to design a project that would not encroach on the AY McDonald site with known environmental contamination. The project included the construction of a PCC Concrete trail from 12th Street, around the Alliant Solar Field on 12th Street over to Sycamore Street. The project included the following: - 1587 LF of PCC Concrete Trail - 878 SY of Reinforced 6" PCC Sidewalk - 231 LF of Ornamental Metal Railing - 3255 CY of Embankment - 750 SF of Segmental Retaining Wall Additionally, lighting conduit and trail light bases were installed to accommodate the future lighting of the trail. Installing this infrastructure now during the trail construction will minimized costs for a future lighting the trail. Page 124 of 629 DISCUSSION The Bee Branch Creek Trail Project — Phase 1 Project, Iowa DOT Project No. TAP- 2100(697)-81-31 was completed by Tschiggfrie Excavating in the final contract amount of $694,213.21 which is an 14.8% increase from the original contract amount of $604,809.62. The increase is primarily due to adding trail lighting infrastructure and the need for additional slope stabilization next to the pond. Breitfelder, City Clerk, 50 W. 1311 St., Dubuque, IA 52001, (563) 589-4100 RESOLUTION NO. 74-25 ACCEPTING THE BEE BRANCH CREEK TRAIL PROJECT — PHASE 1 - IOWA DOT PROJECT TAP-U-2100-697-81-31 AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR WHEREAS, the Public Improvement Contract for the Bee Branch Creek Trail Project — Phase 1 - Iowa DOT Project TAP-U-2100-697-81-31 (the Project) has been completed by the contractor, Tschiggfrie Excavating (Contractor), and the City Engineer has examined the work and recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $694,213.21-1 and WHEREAS, the Contractor has previously been paid $673,386.81, leaving a balance of $20,826.40-1 and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Director of Finance and Budget is hereby directed to pay the balance of the retainage of $20,826.40 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa chapter 26.13.
