INTRODUCTION
This memorandum requests the City Council to conduct a public hearing on April 7, 2025,
for the Heeb Street Reconstruction Project related to the levying of special assessments.
BACKGROUND
The section of Heeb Street just south of Kaufmann Avenue is a dead-end street that has
very old utilities. The water main is an old 4" main that doesn't meet current standards.
The majority of the houses (5 out of 6) have lead water services where multiple properties
are daisy chained to provide service. This is problematic because if a services line leaks,
it impacts multiple properties. There has been one lead service line failure in this area in
the last 10 years that has impacted multiple properties.
The sanitary sewer main also needs to be replaced. The last house on the Heeb Street
is still on septic system because the current sanitary main doesn't extend far enough to
the south to service this property.
The street itself has old brick pavers overlaid with asphalt. The end of the Heeb Street
does not have a proper cul-de-sac to allow traffic to easily turn around.
DISCUSSION
This project will include the reconstruction of the street with 7" HMA pavement, new curb
and gutter, new sidewalk on the west side, installation of a modified cul-de-sac at the end
of the street and the complete replacement of all water main, sanitary main and
associated services for both utilities. The historic brick pavers under the existing asphalt
street will be salvaged and stockpiled for future use on a city project.
PUBLIC ENGAGEMENT
City staff have sent letters to the abutting property owners in this corridor and held
individual meetings with property owners requiring permanent easements.

PROPERTY ASSESSMENTS
Low- to moderate -income property owners subject to assessments will be eligible for
financial assistance of the assessments for the owner -occupied resident property
depending on family size and income level.
According to State Code Section 384.62, the assessments shall not exceed twenty-five
percent of the value of the lot as shown by the plat and schedule approved by the council.
There is no assessments for this project that meets these criteria.
Abutting properties can pay assessment balances in excess over $500 over a 15-year
period with 3% interest. Abutting property owners can pay their assessment balance to
the City Engineer within the first 30 days after receiving the final notice of special
assessment to avoid interest charges.
ACTION TO BE TAKEN
I respectfully request the City Council conduct a public hearing on April 7, 2025, and to
approve the Resolution of Necessity and the Preliminary Schedule of Assessments for
the Heeb Street Reconstruction Project through the adoption of the enclosed resolutions.

RESOLUTION OF NECESSITY FOR THE HEEB STREET RECONSTRUCTION
PROJECT
Whereas, the plat, preliminary schedule of assessments, and estimate of total cost
for the Heeb Street Reconstruction Project have been duly prepared and approved by the
City Council of the City of Dubuque and ordered placed on file in the office of City Clerk.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The Heeb Street Reconstruction Project will provide:
This project involves the reconstruction of Heeb Street in the City of Dubuque,
Iowa. The project includes removal and replacement of an existing street pavement and
sidewalks and drive approaches. Historic brick pavement will be removed and salvaged.
The roadway is approximately 400 feet in length and 21 feet in width with a 4' sidewalk
on the westerly side. The scope of work also includes the installation of new curbs and
gutter, placement of a 7-inch asphalt pavement, replacement of 380 lineal feet of sanitary
sewer, 320 lineal feet of water main, and portions of the private service connections to
the following addresses 2151, 2141, 2131, 2121, 2109, and 2019 Heeb Street.
There is on file in the office of the City Clerk an estimated total cost of the work,
and a preliminary plat and schedule showing the amount proposed to be assessed to
each lot for the improvement.
The date, time, and place the council will hear property owners subject to the
assessment and interested parties for or against the improvement, its cost, the
assessment, or the boundaries of the district: the 7th day of April 2025, at 6:30 p.m., in the
Historic Federal Building Council Chambers, 350 West 6th Street, Dubuque, Iowa.
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements.
Unless a property owner files objections with the City Clerk at the time of hearing
on the resolution of necessity, the property owner is deemed to have waived all objections
pertaining to the regularity of the proceeding and the legality of using the special
assessment procedure.
Said improvements shall be constructed in accordance with the plans and
specifications which have been approved by the City Council and are now on file in the
Office of the City Clerk. The cost of making such improvement will be assessed against
property lying with the assessment limits.
The above resolution was introduced, approved and ordered placed on file with the City
Clerk this 3rd day of March, 2025.

Whereas, the City Council of the City of Dubuque, Iowa, has given its preliminary
approval to the plat, preliminary schedule of assessments, and estimated total cost for
the Heeb Street Reconstruction Project and ordered the plat, schedule of assessments,
and estimate of total cost placed on file in the Office of the City Clerk; and
Whereas, the proposed Resolution of Necessity for Project has been introduced
and is now on file in the Office of the City Clerk.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The City Council will meet on the 7th day of April 2025, at 6:30 p.m. in the Historic
Federal Building Council Chambers, 350 West 6th Street, Dubuque, Iowa. At which time
the owners of property subject to assessment for the proposed improvement or any other
person having an interest in the matter may appear and be heard for or against the making
of the improvement, the boundaries of the district, the cost, the assessment against any
lot, or the final adoption of a resolution of necessity.
A property owner will be deemed to have waived all objections unless at the time
of hearing the property owner has filed objections with the City Clerk.
The City Clerk be and is hereby authorized and directed to cause a notice of the
time and place of such hearing to be published in a newspaper having general circulation
in the City of Dubuque, Iowa, which notice shall be published once each week for two
consecutive weeks, the first publication of which shall be not less than ten days prior to
the day fixed for its consideration.

the valuation of each lot within a district approved by the City Council of the City of
Dubuque, Iowa, for a public improvement of the type(s) and in the location(s) as follows:

April 2025, at 6:30 p.m., in the Historic Federal Building, 350 w 6th Street 2nd Floor,
Dubuque, Iowa.
Said special assessments are now on file in the office of the City Clerk.
The scope of the Project is as follows:
