Under the terms of the cooperative agreement, the Iowa DOT will install key ITS infrastructure at the US 61 - 151 interchange, including an ITS pole, equipment cabinet, conduit, power supply, and speed feedback sign. The City will be responsible for installing and maintaining fiber optic connections, network switches, and cameras to provide video coverage of the interchange. The City will provide access to the camera feeds to the Iowa DOT at no cost, while the Iowa DOT will supply power to the City's ITS equipment at no cost to the City. This project aims to enhance traffic monitoring and safety by improving visibility, data collection, and emergency response capabilities at a critical traffic interchange. The City's estimated contribution to the project is approximately $15,000, with the Iowa DOT funding a majority of the improvement costs. This agreement outlines a collaborative project to install Intelligent Transportation System (ITS) improvements at the US 61 - 151 interchange to enhance traffic monitoring and safety. BACKGROUND The proposed project will enhance both the Iowa DOT and the City's ability to monitor traffic operations and improve public safety at the US 61 - 151 interchange. This location has been identified as a critical point for monitoring due to high traffic volumes and the need for improved visibility and data collection. The City's Emergency Medical Services (EMS), Police, and Fire Departments, along with Dubuque County, have expressed strong interest in deploying cameras at this location to assist with real-time traffic operations and emergency response. The Iowa DOT also plans to install advanced warning signs to encourage trucks to slow down before entering the northbound US 151 ramp from the west. DISCUSSION Under the terms of the cooperative agreement, the Iowa DOT will install key ITS infrastructure at the US 61 - 151 interchange, including an ITS pole, equipment cabinet, conduit, power supply, and speed feedback sign. Breitfelder, City Clerk IOWA DEPARTMENT OF TRANSPORTATION Cooperative Agreement County Project No. Iowa DOT Agreement No. Staff Action No Dubuque N/A 2025-16-054 N/A This Agreement, is entered into by and between the Iowa Department of Transportation, hereinafter designated the "DOT", and the City of Dubuque, hereafter designated the "CITY", in accordance with Iowa Code Chapters 28E, 306, 306A and 313.4 as applicable; The DOT and CITY propose to jointly install, as part of an Intelligent Transportation System (ITS) project, an ITS network consisting of cameras and other ITS infrastructure (conduit, fiber optic cable, handholes, poles) at the U.S. 61 and U.S. 151 interchange to assist in traffic operations and information dissemination in and around the City of Dubuque area; and The CITY and DOT are willing to jointly participate in said project, in the manner hereinafter provided; and This Agreement reflects the current concept of this project which is subject to modification by mutual agreement between the CITY and the DOT; and Therefore, it is agreed as follows: 1. Project Information a. The DOT, or their authorized contractor, will be responsible for the following ITS infrastructure and device installation: • ITS pole foundation, 45' ITS pole, and ITS cabinet near the SW corner of the U.S. 151 Eastbound to U.S. 61/U.S. 151 Northbound bridge. • Providing power to the ITS cabinet. • 2" conduit and required handholes from the ITS pole location to the existing CITY owned fiber vault near the intersection of Elwood Drive and Silver Oaks Drive. • Speed feedback sign on the ITS pole. b. The CITY, or their authorized contractor, will be responsible for the following ITS infrastructure and device installation: • Fiber optic cable in the newly installed 2" conduit from the ITS pole location to the existing CITY owned fiber vault. • All required splicing and terminations of the fiber optic cable to their existing fiber backbone cable. • All required network switches. • Installation of camera(s) on the ITS pole to provide sufficient video coverage of the interchange area including a view of the Eastbound to Northbound ramp. c. The CITY shall complete the work listed under Paragraph 1 b. within 30 calendar days after the DOT provides notification to the CITY that the DOT has completed the installation of items listed under Paragraph 1 a. d. The DOT will allow the CITY to use their existing power source at no cost to the CITY. 2025-16-054_Dubuque Page 362 of 848 e. The CITY will provide, at no cost to the DOT, access to the camera video feeds and grants permission for the DOT to record and archive the video feeds. 2. Project Costs a. Each party is responsible for their own costs unless noted elsewhere in this agreement. 3. Ownership and Maintenance a. At the completion of the project, the DOT will take ownership of all DOT installed infrastructure and devices listed under Paragraph 1 a. of this Agreement with the exception of the conduit and handholes required for the CITY owned fiber optic cable. The DOT shall perform all future maintenance including locating, restoration, relocations, and repairs that may become necessary for the DOT owned infrastructure. b. At the completion of the project, the CITY will take ownership of all CITY installed infrastructure and devices listed under Paragraph 1 b. of this Agreement including the conduit and handholes required for the CITY owned fiber optic cable. The CITY shall perform all future maintenance including locating, restoration, relocations, and repairs that may become necessary for the CITY owned infrastructure. c. The CITY shall obtain all necessary permits to perform work within DOT right of way. 4. General Provisions a. The DOT will have no liability for any of the CITY installed and owned equipment. b. To the extent permitted by law, the DOT and CITY shall indemnify and hold each other, their employees and agents, wholly harmless from any damages, claims, demands, or suits by any person or persons to the extent caused by the respective acts or omissions by the DOT or CITY, or the officers, agents, or employees of either, in the course of any work done in connection with any of the matters set forth in this Agreement. c. No new legal or administrative entity is created by this Agreement. d. No property will be jointly held as part of this Agreement. e. Nothing in this Agreement shall be construed to create joint or several liability of a party hereto for the acts, omissions or obligations of the other party. Each party shall be liable only for its own acts and the parties shall have such rights of indemnity and contribution among themselves with respect to this Agreement and the undertakings hereunder as shall be permitted by law and consistent with the provisions of this Agreement. f. If any part of this Agreement is found to be void and unenforceable then the remaining provisions of this Agreement shall remain in effect. g. This Agreement is not assignable without the prior written consent of the DOT. h. It is the intent of both (all) parties that no third -party beneficiaries be created by this Agreement. i. This Agreement, as well as the unaffected provisions of any previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the CITY and DOT regarding this project. All previously executed agreements will remain in effect except as amended herein.
