City Engineer Gus Psihoyos is recommending City Council adopt a resolution accepting
the public water main utility improvements that the developer, The Butler Children's
Garden Foundation, Inc., has recently completed across Part of Lot 2 of Y-Camp Place
No. 3, in the City of Dubuque, Iowa.
Per the Development Agreement between the City of Dubuque and The Butler
Children's Garden Foundation, Inc., the developer was to construct a public water main
extension serving the newly constructed Butler Children's Garden facility adjacent to
and north of the Dubuque Arboretum property.
The public water main utility extension was recently completed by the owner as per the
agreement. The new water main improvements have been inspected and approved by
Engineering Department staff. The City of Dubuque will own and maintain the public
water main utility extension.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of public water main utility
improvements that the developer, The Butler Children's Garden Foundation, Inc., has
recently completed across Part of Lot 2 of Y-Camp Place No. 3, in the City of Dubuque,
Iowa.
BACKGROUND
Per the Development Agreement between the City of Dubuque and The Butler
Children's Garden Foundation, Inc., the developer was to construct a public water main
extension serving the newly constructed Butler Children's Garden facility adjacent to
and north of the Dubuque Arboretum property.
The public water main utility extension was recently completed by the owner as per the
agreement. The new water main improvements have been inspected and approved by
Engineering Department staff. The City of Dubuque will own and maintain the public
water main utility extension (see attached map).
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
The owners have requested City's acceptance of the improvements across Part of Lot 2
of Y-Camp Place No. 3, in the City of Dubuque, Iowa, in the City of Dubuque, Iowa.
Upon inspection by the City, it has been determined that the public improvements
required by said agreement have been completed in accordance with plans approved
by the City Staff and in conformance with City specifications.

RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements as
described above.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
water main utility improvements across Part of Lot 2 of Y-Camp Place No. 3, in the City
of Dubuque, Iowa.

RESOLUTION NO. 94-25
ACCEPTING PUBLIC WATER MAIN UTILITY IMPROVEMENTS ACROSS PART OF
LOT 2 OF Y-CAMP PLACE NO. 3, IN THE CITY OF DUBUQUE, IOWA
Whereas, per a Water Main Construction Agreement between the City of Dubuque
and The Butler Children's Garden Foundation, Inc., the parties wished to set forth terms
for the extension of a proposed public water main utility located in Part of Lot 2 of Y-Camp
Place No. 3, in the City of Dubuque, Iowa; and
Whereas, pursuant to said agreement, certain public improvements including
water main utility and appurtenances, were installed by The Butler Children's Garden
Foundation, Inc.; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public water main utility improvements in Part of Lot 2 of Y-Camp Place No. 3, in the
City of Dubuque, Iowa, be and the same are hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, The Butler Children's Garden Foundation, Inc., until
March 17, 2027.
Passed, approved and adopted this 1711 day of March 2025.
