Assistant City Engineer Robert Schiesl is recommending City Council approve and
authorize the Mayor to execute Amendment No. 1 to the Grant Agreement between the
City, the Iowa DOT, and the FHWA for the RAISE Infrastructure Planning Grant to
complete the Engineering Design and NEPA / Environmental Study Phase to advance
development for the B2E2 project.
The original Planning Grant project completion date of July 31, 2025, was based upon
an assumed National Environmental Policy Act (NEPA) Classification of a Categorical
Exclusion. After review, it has been determined that an Environmental Assessment is
the most likely outcome due to the potential impacts to the historical district within the
project limits. Due to this, the Planning Grant project completion deadline is being
extended to December 31, 2028, to complete NEPA requirements.
There are no anticipated budgetary impacts because of the RAISE Infrastructure
Planning Grant Amendment No. 1.

INTRODUCTION
The enclosed resolution authorizes the Mayor to execute an Amendment No. 1 to the
Grant Agreement between the City, the Iowa Department of Transportation (Iowa DOT),
and the Federal Highway Administration (FHWA) for the RAISE Infrastructure Planning
Grant to complete the Engineering Design and NEPA / Environmental Study Phase to
advance development for the project entitled "Building Bridges to Employment and Equity
(B2E2)"
BACKGROUND
The City was awarded a U.S. Department of Transportation (USDOT) RAISE
Infrastructure Planning Grant which will provide for the planning and design of a
multimodal transportation corridor project for proposed improvements to the Elm Street
corridor, the 16th Street corridor, the Kerper Blvd. corridor, Chaplain Schmitt Island
corridor, and the proposed 14th Street Railroad (vehicular and pedestrian) Overpass
bridge project.
In June 2024, the City was awarded a USDOT $25 million RAISE Capital Grant to
implement construction phases to complete the proposed 14th Street Railroad Overpass
bridge and the multimodal transportation corridor improvements.
DISCUSSION
Through collaborative discussions with the Iowa DOT and FHWA staff, it was determined
that an amendment to the RAISE Planning Grant Agreement was necessary to revise the
Planning Grant project development schedule to align with the RAISE Capital Grant.
The original Planning Grant project completion date of July 31, 2025, was based upon an
assumed National Environmental Policy Act (NEPA) Classification of a Categorical
Exclusion. After review, it has been determined that an Environmental Assessment is the
most likely outcome due to the potential impacts to the historical district within the project
limits. Due to this, the Planning Grant project completion deadline is being extended to

RESOLUTION APPROVING GRANT AGREEMENT AMENDMENT NO. 1 WITH THE
U.S. DEPARTMENT OF TRANSPORTATION FOR THE AWARDED RAISE

WHEREAS, the City was awarded $2.28 million in U.S. Department of
Transportation RAISE Planning Grant funds to assist with the planning and design of
multimodal transportation corridors for the project entitled "Building Bridges to
Employment and Equity (B2E2)"; and
WHEREAS, the RAISE Infrastructure Planning Grant was awarded and fully
executed on November 11, 2023, between the City, the Iowa Department of
Transportation, and the Federal Highway Administration; and
WHEREAS, in June 2024, the City was awarded a RAISE Capital Grant to
implement construction phases to complete the proposed 14th Street Railroad Overpass
bridge and the multimodal transportation corridor improvements; and
WHEREAS, it was determined that an amendment to the RAISE Planning Grant
Agreement was necessary to revise the Planning Grant project development schedule to
align with the RAISE Capital Grant; and
WHEREAS, through Amendment No. 1, the Planning Grant project completion
deadline is being extended to December 31, 2028, to complete NEPA requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA, THAT:

FIRST AMENDED AND RESTATED GRANT AGREEMENT UNDER THE
FISCAL YEAR 2022 RAISE GRANT PROGRAM
This agreement is between the United States Department of Transportation (the "USDOT") and
the Iowa Department of Transportation (the "Recipient").
This agreement reflects the selection of the Recipient to receive a RAISE Grant for the
Rebuilding Bridges to Employment and Equity project.
The USDOT and Recipient executed a grant agreement on November 7, 2023 ("the Original
Grant Agreement"). This agreement amends and restates in its entirety and replaces the Original
Grant Agreement.
If schedule A to this agreement identifies a Designated Subrecipient, that Designated
Subrecipient is also a party to this agreement, and the parties want the Designated Subrecipient to
carry out the project with the Recipient's assistance and oversight.
The parties therefore agree to amend and restate the grant agreement to read in its entirety as
follows:
ARTICLE 1
GENERAL TERMS AND CONDITIONS.
1.1 General Terms and Conditions.
(a) In this agreement, "General Terms and Conditions" means the content of the document
titled "General Terms and Conditions Under the Fiscal Year 2022 Rebuilding American
Infrastructure with Sustainability and Equity (RAISE) Grant Program: FHWA Projects,"
dated October 18, 2022, which is available at hops://www.transportation.gov/policy-
initiatives/raise/raise- rg ant -agreements. The General Terms and Conditions reference the
information contained in the schedules to this agreement. The General Terms and
Conditions are part of this agreement.
(b) The Recipient states that it has knowledge of the General Terms and Conditions.
(c) The Recipient acknowledges that the General Terms and Conditions impose obligations on
the Recipient and that the Recipient's non-compliance with the General Terms and
Conditions may result in remedial action, terminating of the RAISE Grant, disallowing costs
incurred for the Project, requiring the Recipient to refund to the USDOT the RAISE Grant,
and reporting the non-compliance in the Federal -government -wide integrity and
performance system.

2. Supporting Narrative.

o RAISE investment will help Dubuque make significant progress toward achieving its
climate change mitigation goals as outlined in the City's 2020 Climate Action Plan. The
project aligns with the plan's goal to reduce vehicle miles traveled (VMT) by 10% by
2030. To help achieve this goal, the plan calls for transforming 25% of local roads into
Complete Streets and increasing public transit ridership. Complete Streets and a
connected system of transit, bike, and pedestrian infrastructure will also contribute to
Dubuque's goal of a 34% reduction in greenhouse gas emissions by 2030.

pollution. The project directly supports residents living in the North End, Point and
Washington neighborhoods by providing safe streets, sidewalks, and bike lanes for

o RAISE investment in Dubuque's transportation infrastructure will build on efforts already
undertaken to improve equity and reduce barriers to opportunity for minority residents,
particularly those living in and adjacent to the project area. Based on U.S. Census data, the
2021 Dubuque Equitable Poverty Reduction and Prevention Plan notes that a staggering
56.1% of Black residents live in poverty, compared to 13.2% for White residents, and
experience unemployment at a rate four times higher than Whites. The highest median
household income among Black Dubuque's is found in Census Tract 5 with a value of only
$22,059, followed by Census Tract 1 with a value of $21,382.
o RAISE investment will help ameliorate these inequities by reducing obstacles that
systematically and structurally block individuals from equal access to economic
opportunities. The project's interconnected Complete Streets components will enhance safe
access to key job centers and critical community resources, including the Crescent
Community Health Center and the nearest grocery store on Elm Street, and reduce the
negative impacts of automobile dependency for minority residents living in and around the
project area. Potential new development may also provide a second grocery option for the
neighborhood.

The City of Dubuque is a member of the Dubuque Metropolitan Area Transportation Study (DMATS),
which has a comprehensive Title VI plan to promote equal opportunity employment.
The Iowa Department of Transportation, as lead oversees of the DMATS transportation planning
process, required a separate and standardized Title VI Plan for the agency. As part of their grant
agreements, DMATS agrees to Federal certifications and assurances, which include the Title VI
program.
The Recipient will ensure the City will conduct or facilitate training programs on Title VI issues and
regulations for employees, and facilitate Title VI training for appropriate staff, contractors, and
subrecipients. A summary of the training conducted will be documented.
The Recipient will also ensure public service announcements or notices are posted of proposed
planning related hearings, meetings, or the formation of public advisory boards in newspapers or other
media reaching the affected community. The Recipient will further ensure the full utilization of
available minority publications or media; and, where appropriate, provide written or verbal
information in languages other than English.
Title VI text will be included in all Request for Proposals and Contracts.

DMATS FY 2024 Transportation Planning Work
In March 2023, the Iowa Department of Transportation (Iowa DOT) Civil Rights Division performed
a compliance audit of the City of Dubuque Title VI Sub -Recipient program. The City's Title VI
procedures and processes meet the Iowa DOT and FHWA requirements and are being carried out in
accordance with governing regulations, policies, and procedures as they relate to transportation
activities.
