The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.
Discussion
Jessalyn Simon, Buesing and Associates LLC, 1212 Locust Street, spoke on behalf of
the applicant. She described the proposal to divide a lot that contains an existing home
in order to build a second house, and that the proposed house would be similar in size to
those in the neighborhood.
Staff detailed the staff report, noting the submitted final plat would divide the property into
two lots. Staff stated that in the R-1 zoning district there is a 5,000 sq. ft. minimum lot size
requirement and that as submitted, the two proposed lots would be approximately 3,279
square feet and 3,764 square feet and would require a waiver of the lot size requirement.
Staff said the lots would otherwise be in substantial conformance with the Unified
Development Code (UDC).
The Commission asked if the final plat meets lot frontage requirements and asked if a
house would meet setbacks. Staff stated that both lots would meet the minimum 50' street
frontage requirement. Staff stated the existing home has a legally non -conforming front
yard setback along Davis Street but all would comply with all other required setbacks and
the proposed home on the new lot would be compliant with all required setbacks. Staff
noted that the UDC has a minimum size for single-family residences which is a width as
20 feet and overall footprint at 720 sq. ft.
The Commission commented that the smaller lots seem to be in keeping with other
smaller lots in the neighborhood.

The Zoning Advisory Commission discussed the request and found it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Final Plat of Cedar Ridge Commercial Park subject to waiving the lot frontage
requirement for Lot 2 and Lot 3.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The Kellhoff Addition subdivision is located at the intersection of Windsor Avenue and
Davis Street. The property is being subdivided to allow for the construction of a new
single-family detached dwelling.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Simple Subdivision'. Simple Subdivisions that require a waiver of bulk regulations
must be reviewed by the Zoning Advisory Commission.
DISCUSSION
The Final Plat of Kellhoff Addition proposes to subdivide a single lot into two new lots,
one of which will contain an existing single-family home, and the other of which is
proposed for the construction of a new single-family home. The following is a description
of the proposed lots:
■ Lot 1 would contain the existing single-family home. Area: 3,279 square feet (0.075
acres), shown in yellow below.
■ Lot 2 would contain a new single-family home. Area: 3,764 square feet (0.086
acres), shown in blue below.
Lots 1 and 2 would not have the required minimum lot area of 5,000 square feet. The
required minimum lot area would need to be waived for both Lot 1 and Lot 2.
Lots 1 and 2 would have the required street frontage of 50 feet and would otherwise be
in substantial conformance with the UDC.

UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed and which does not require the construction of any
public improvements, and which creates fewer than three (3) lots."

Pursuant to the Unified Development Code (UDC) Chapter 5-2, all single-family detached
dwelling lots shall a minimum lot area of 5,000 square feet. Because the proposed Lot 1
and Lot 2 will not have the minimum area, the applicant is requesting a waiver of this bulk
regulation. The proposed lots are otherwise in substantial conformance with the UDC.
The UDC categorizes the proposed plat as a Simple Subdivision. Pursuant to UDC
Chapter 11, the Zoning Advisory Commission and City Council are the reviewing
authorities for Simple Subdivisions which require a waiver of bulk regulations. The Zoning
Advisory Commission shall review the plat to determine whether it is in substantial
conformance with the Unified Development Code.

Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Kellhoff Addition and recommends approval of the subdivision plat subject to waiving

RESOLUTION NO. 132 - 25
A RESOLUTION APPROVING THE FINAL PLAT OF KELLHOFF
ADDITION, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Kellhoff Addition
in the City of Dubuque, Iowa; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived regarding required lot area for Lot 1
and Lot 2 of Kellhoff Addition.
Section 2. That the Final Plat of Kellhoff Addition, in the City of Dubuque, Iowa is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
