Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.
Discussion
Dan Marti, Origin Design, 137 Main Street spoke on behalf of the applicant. He stated
that the proposed plat had been reviewed and approved by the city about 20 years ago
but was mistakenly not recorded at that time. This error was recently discovered and they
are looking to remedy it by recording the plat.
Staff detailed the staff report, noting the submitted final plat consolidates a number of lots
into four new lots. Staff stated that the survey was originally reviewed and approved in
2005, but recording was never completed. Staff described that four lots were being
created, one for the gas station, one for the Hy-Vee Store, and then two, Lot A and Lot B,
were to be dedicated to the city for public right of way and utility purposes. He said the
proposed lots are in substantial conformance with the Unified Development Code.
Commissioners did not have any questions and found the request appropriate.
There were no public comments.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Final Plat of Hy-Vee Subdivision No. 2 as submitted.
A simple majority vote is needed for the City Council to approve the request.

OWNER'S CONSENT AND EXPLANATORY AFFIDAVIT

Whereas, a subdivision plat named "Hy-Vee Subdivision in the City of Dubuque, Iowa"
(the "Final Plat") concerning real estate located at 300 S Locust Street, Dubuque, Iowa and legally
described thereon was approved for recording by Resolution No. 418-04 dated November 15, 2004
and recorded with the subdivision plat on April 11, 2005 as File No. 2005-00005400.
Whereas, subsequent to recording of the Final Plat, the Dubuque County Auditor
determined that the Final Plat was filed in violation of Iowa Code § 354.11 (2005) and in violation
of local subdivision regulations because the Final Plat was not accompanied by documents from
the County Treasurer, County Auditor, County Recorder and City Assessor.
Whereas, as a result of such violation, the subdivision plat was not processed nor any
acknowledgement made to recognize the lots and street lots of the Final Plat in the county records.
Whereas, the Final Plat was prepared at the request of the undersigned owner and
proprietor, Hy-Vee, Inc. ("Hy-Vee") and has been of public record for more than ten (10) years.
No part of the Final Plat has been re -platted, subdivided, corrected, annulled or vacated. Except
for the intent to dedicate Valley Street and certain public utilities, sanitary sewer, storm sewer and
water mains as they appeared on the Final Plat, no part of the Final Plat has been sold or conveyed
by Hy-Vee.
Whereas, all public improvements and conditions set forth in Resolution No. 418-04 have
been completed and accepted by the City with respect to the Final Plat.
Whereas, Hy-Vee has requested that the City annul the Final Plat based upon the omission
of the required documents.
Whereas, Hy-Vee has requested that the City approve a new subdivision plat named "Hy-
Vee Subdivision No. 2 in the City of Dubuque, Iowa" to replace the Final Plat, which new
subdivision plat shall conform as nearly as possible to the original lot lines shown on the Final
Plat.
Whereas, Hy-Vee has requested that the City accept re -dedication of Valley Street together
with the public utilities and other public easements as they appear on Hy-Vee Subdivision No. 2.
Whereas, Hy-Vee acknowledges that the location of the following electric easements may
be uncertain because their legal descriptions rely on the Final Plat which has not been accepted by
the county and Hy-Vee desires that such easements be recognized as existing and re -granted to
their respective grantees for purposes of their respective easement area locations as shown on the
subdivision plat for Hy-Vee Subdivision No. 2:
(a) Plat of Easement prepared for Alliant Energy depicting two (2) ten foot (10') wide
electric easements recorded May 11, 2005 as Instrument No. 2005-00007237.

(b) Electric Line Easement granted to Interstate Power and Light Company recorded
December 13, 2017 as Instrument No. 2017-00015354.
(c) Electric Line Easement granted to Interstate Power and Light Company recorded
November 12, 2021 as Instrument No. 2021-00018628, which Electric Line
Easement included abandonment of a previous Easement granted to Interstate
Power Company by the City of Dubuque recorded March 12, 1952 in Book 142,
Page 633.
Now, therefore, in consideration of the foregoing, the foregoing plat of HY-VEE
SUBDIVISION NO. 2 IN THE CITY OF DUBUQUE, IOWA, is made with the free consent of
and in accordance with the desires of the undersigned owner and proprietor of said real estate. The
undersigned acting pursuant to Iowa Code § 354.19 (2025), hereby dedicates and grants to the
public Valley Street (Lots A and B) together with the public utilities and other public easements
as shown on the foregoing plat for Hy-Vee Subdivision No. 2 in the City of Dubuque, Iowa.

INTRODUCTION
The applicant, on behalf of Hy-Vee on South Locust Street, is looking to consolidate lots,
ultimately creating four lots and formalizing easements throughout their property.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Minor Subdivision'. All Minor Subdivisions require review by the Zoning Advisory
Commission.
DISCUSSION
The Final Plat of Hy-Vee Subdivision No. 2 proposes to consolidate a number of lots into
four new lots. The following is a description of the proposed subdivision lots:
■ Lot 1 would contain the Hy-Vee Gas Station and is .83 acres, shown in red below.
■ Lot 2 would contain the main Hy-Vee building and parking lot and is 6.68 acres,
shown in blue below.
■ Lot A (38 sq. ft.) to be dedicated to the City for right-of-way and utility purposes,
shown in orange.
■ Lot B (530 sq. ft.) to be dedicated to the City for right-of-way and utility purposes,
shown in green.
A colored version of the subdivision plat is provided on the following page.
The UDC categorizes the proposed plat as a Minor Subdivision. Pursuant to UDC Chapter
11, the Zoning Advisory Commission and City Council are the reviewing authorities for
Minor Subdivisions. The Zoning Advisory Commission shall review the plat to determine
whether it is in substantial conformance with the Unified Development Code.
UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed and which does not require the construction of any
public improvements, and which creates three (3) or more lots."

RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of Hy-
Vee Subdivision No. 2and recommends approval of the subdivision plat.

A RESOLUTION APPROVING THE FINAL PLAT OF HY-VEE
SUBDIVISION NO. 2, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Hy-Vee
Subdivision No. 2 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears additional right of way areas of Valley Street
(Lot A and B), together with certain public utility easements, which the owner by said final
plat has dedicated to the public forever; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of additional right of ways of Valley Street (Lot A
and B), together with certain public utility easements, as they appear on said final plat, be
and the same are hereby accepted; and
Section 2. That the Final Plat of Hy-Vee Subdivision No. 2, in the City of Dubuque,
Iowa is hereby approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
