M H McClosky adressed the council n favor of having the said sidewalk order laid Referred to the committee on streets and the marshal instructed to order the abatement of any nuisance found upon the premises The petition of Marie Siege asking to cance the tax for the year 1882 on lots 134 134a and 136a in L H Langworthy's addition was read on motion of Ald Deckert the petition was received and filed Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 the petition of M M Walker for reduction of assessment for 1882 on the oriental Powder company and on the N 154 feet of lot 745 owned by key city Barrel Factory was referred to the committee of the whole the petition of Philip Henses to reduce his assessment on lots 99 and 100 McCraney's First Addition from $900.00 to $700.00 and to draw an order for the amount of over tax was referred to the committee of the whole the petition of Elizabeth Tuegel for cancellation of his taxes for 1882 on lot no 47 Langworthy's Addition was referred to the committee on delinquent tax The petition of Mary Sullivan for a cancellation of her tax for the year 1882 was referred to the delinquent tax committee the following communication and release was received and filed Received of the city of Dubuque the sum of Five Hundred Dollars in full of all claims made by me in the action commenced and now pending in circuit court of Iowa for Dubuque county against said city and in full for all claims and demands against the said city up to this 4th January 1883 and I further agreet o pay all costs of court incurred by me in said suit and to dismiss the suit at the next term Henry Hagerman The petition of Mrs Catherine Phelan asking the council to cancel her tax for the year 1882 was referred to the committee on Delinquent Tax Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The communication of James F Hedley reporting that he had sold $412.45 worth of property during the month of January Amount due the city 86 cents for which the receipt of the treasurer was attached Referred to the finance committee to examine and report upon at the next regular session The petition of Hugh Cavanaugh asking to refund him $5.60 as the amount of a dicrepancy in a weight upon the First Ward Scales was referred to the committee on Markets. The petition of Mathias Schlegel to cancel his tax for 1882 on lot No 5 West's Addition was referred to the committee on delinquent tax. Frank Morgan Chief Engineer Fire Department presented the following Dubuque February 3rd 1883 To the Honorable Mayor and City Council Gentlemen the engineer of Sol Turck Steamer reports to me that the boiler head and flues have given out I would therefore recommend that the steamer Sol Turcke have a new boiler head and new flues I would also recommend the purchase of an extra hose cart 1,000 feet of hose and a set of swinging harness to try Also that the water pipes be extended on Seventh Ninth and Eleventh Streets and that a water plug be attached thereto as near the railroad track as you see attention of the council to the fact that the legal time for redemption of part of Mineral Lot 202 had expired being ordered redeemed was referred to the committee of Finance The Dubuque street Railway presented through its secretary the following petition To the Hon Mayor and City council of Dubuque Gentlemen I would state to your honorable body that the Dubuque Street Railway with a single track as it is now being operated is not a profitable investment for the Stockholders and a very poor accommodation to the public Therefore would ask permission to lay a double track on Main Street from Jones to Thirteenth (13th) and single track from Thirteenth 13 to Fifteenth 15 on Main thence EAst on Fifteenth 15 to Clay Street Also single or double track from First and main East to Iowa or up the alley between main and Iowa to Second or Third Streets thence down to Clay Street then north on clay to Eighteenth 18 thence East on Eighteenth to Couler Avenue Thence North on Couler Avenue to Sanford Street a single or double track from Eighteenth 18 or nineteenth 19 on couler Avenue to Lake Street thence est on High Street to a point near Mr M Muschitsch's store If a single track the esubdivision of lots 13 and 14 in the subdivision of outlot 688 from tax sale of 1881 was referred to the committee on delinquent tax with the attorney The petition of Mathias Morgn asking the council to remit the interest on lot 456 for the tax of the year 1879 was referred to the committee on delinquent tax Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 engineer Tschirgi presented the following To the honorable Mayor and city council of Dubuque In accordance with the duty prescribed by ordinance I herewith respectfully submit the following report In cons consequence of limited time only the most important public buildings were inspected and they principally with reference to sections one and two of the ordinance regulating the erection of buildings and to prevent accident by fire which require that all public buildings have doors so constructed as toopen outwardly and declaring all winding stairs as nuisance to be abated The following churches were examined and found to have doors wrongfully constructed St John's Episcopal St Patrick's Church Main St M E Second Prebyterian Congregational Main Street Baptist Zions Church the principal public school buildings contain winding stairways but otherwise conform to the ordinance the three largest hotels were examined and the proprietors interviewed with reference to the facility and afety by which inmates could escape in case of fire The Lorimier House contains a broad winding sairway with halls and side stairs the main doors open inwardly The proprietor is doing everything in the way of supplying fire escapes for each room and Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 other appliances by which fires can be extinguished and the safety of the guests assured The average number of the persons present in the building at one time is about 60 For this number it seems to me the hotel is reasonably safe the key city house has also the doors outside opening inwardly it has a front entrance with a rear exit which would serve as a means of escape if cut off from the main stairway the average number of guests is about 50 which could readily escape by either of the severl exits in case of fire. The Julien House which is frequently used for balls and so forth besides the large number of guests inreviewed ws thoroughly examined I found the outside doors opening inwardly and also containing a winding stairway Each floor was examined and found several methods of exit At each end of the hall a stairway led directly to the ground floor with windows on the North side of the building opening on to the roofs of adjoining buildings There are four exits from the ground floor into the different streets The arrangement of the stairways are such that if one is impassable by fire at one end of the building the others are quite certain to afford means of escape the princpal places of commencement such as the Opera House and the Turenrs Hall were examined a the Turners Hall conforms to section 1 in having the main doors opening outwardly Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 No dangerous feature could be observed as the auditorium is on the ground floor with ample doorway The main doors of the opera house open outwardly and the stairways are not exactly winding However it is my duty to express what in my judgment and in the judgment of the many who frequent the Opera House that some additional means of exit should be furnished the large audiences which so frequently gather there I have consulted with one of the proprietors who states that their Chicago architect had expendedhis skill in arranging the stairway and that in his opinion no great danger need be apprehended as the audience could all safely reach the street in less than five minutes The building is not very high which is quite an advantage yet while the main stairway cannot be improved without remodeling the entire front I hav conceived the idea that by placing balconies at the north and south windows of the third story with a flight of stairs leading to the balcony over the front entrance from which persons could reach the pavement in safety this would accommodate the gallery On the south side of the building one or two ladders with balcony could be attached and be connected with the gallery and dress circle I would however recommend to your honorable body that a committee be appointed to confer with the proprietors of the Opera House and possibly something better or more satisfactory to all parties could be suggested and carried out As the city Hall is used only on the first floor by large gatherings the winding stairway i sno longer so objectionable while the outer doors have since my first report been made to open outwardly No other buildings than those enumerated have occurred to me as being in any sense likely to become the cause of death or suffering to the community by fire or otherwise. Leaving to my next report a more detailed and fuller account of other buidings which have been omitted in this Respectfully M Tschirgi Jr City Engineer February 5 83 Referred to the committee on Pitschner reported that he had weighed on the West Dubuque Scales during the month of January 216 drafts Gross receipts $32.40 The receipt of the treasurer attached for $4.86 which is 15 percent of present a receipt for $3210 from your city treasurer which I collected from the CM & St Paul Railroad Company as payment for their portion of 11th street sewer for which I had charged them above ordered that an order be drawn in favor of Mr Rice for said amount Auditor Brayton reported tht the amount due the city officers and employees for the month of January was $1230.74 Report received and the purpose of determinig the probable cost and how long back its complication should begin The committee on claims and the City Attorney to who was referred the petition of Clayton Wells made the following report To the honorable mayor and council Gentlemen Your committee to which was referred the communication of Clayton Wells for damages for injuries received from falling into an excavation in the street would report that said accident happened on the evening of the 2nd of May 1882 at or near the ICRR passenger depot on Jones Sgreet. The excavation was made by the Dubuque Water Co and under the provisions of the ordinance granting to said water company certain franchises said company assumes all liability for damages occassioned by its negligence or by making excavations in the streets of the city. the notice in writing upon the water company provided for by said ordinance and contract has been given by the city attorney to the water company and said company will now either settle or defend said claim Respectfully J H Shields Atty Theo Altman Pat Clancy Report adopted and received and filed Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The committee on streets reported on the petition of John T Hancock et al recommending that the prayer of the petitioners be granted and an ordinance adopted changing the name of the street from High Street to Highland Place report adopted The committee on ordinances reported on the same petition recommending the change of name asked for and presented an ordinance which the committee recommended to put on the passage and adopted report adopted The ordinance was then read for the first time as follows Be it ordained by the city council of the city of Dubuque Section 1 that a certain street in said city commending at eleventh street and running north to Arlington Street in McDaniel's Subdivision and now known and designated as High Street shall hereafter be known and designated as Highland Place and its name shall be and is hereby changed accordingly. Michael Kelly recommending that the city auditor be instructed to redeem lot 135 in Union Addition from tax sale report adopted the same committee reported on the petition of Rev Jos Kuemper for Mrs Dr Risatsch recommending that the treasurer be authorized to receive $15.00 in full for the tax on city lot 344 for 1882 report adopted The street committee reported as follows on the payroll of the street commissioner we find the within report to be correct and recommend that orders be drawn in favor of the laborers and others for the several amounts reported due Report adopted The finance committee to whom was referred the matter of the settlement of the suit of Maria Hayden made the following report To the honorable the mayor and council of the city of Dubuque Your com Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 Committee having in charge the settlement of the suit wherein Maria Hayden is plaintiff and the city of Dubuque defendant lately pending in the District Court and which settlement was ratified at a former session of the council would report that in pursuance of such settlement the said cause has been dismissed at the costs of the plaintiff and nothing remains to be done but the cancellation of the special tax levied by the city upon th epremises of said maria hayden for curbing guttering and macadamizing the street abutting thereon as provided by the terms of the settlement aforesaid B W Jones P W Crawford the report was adopted The following was presented in connectin with the above report Resolved that in view of teh fact that a settlement has been effected in the suit wherein Maria Hayden was plaintiff and the city of Dubuque defendant lately pending in the District Court and whereas said settlement was ratified at a session of the council now in pursuance of the terms of said settlement the city treasurer is hereby instructed to cancel special tax levied by the city against the property of said Maria Hayden for curbing guttering and macadamizing street abutting on said property B W Jones Theo Altman resolution adopted Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 Mr. Geo Gray was permitted to address the council on the suspension of Rule 11 on the opening of Grand View Avenue through Mineral lot no 21 lot 5 Summer Hill Addition owned by Mrs B McMahon asking renumeration for taking down the fence for right of way in the sum of $100.00 and in return Mrs McMahon to give the deed to same Ald Crawford moved that the proposition of Mr Gray Attorney for Mrs McMahon be accepted and that an order be drawn for $100 in her favor A vote was taken upon said motion and rejected by 1 fo and 8 against as follows Yeas Ald Kavanaugh 1 Nays Ald Altman clancy Crawford Doerfler Deckert Glab Jones and Olinger 8 Ald Altman moved that the matter be refered to the committee of the whole motion withdrawn Ald Deckert then moved that $60.00 be paid mrs. reported on the resolution of ald Crawford for filling certain lots recommending that the following resolution be adopted which was adopted Whereas lots nos one two three four five six seven eight nine ten and eleven in the west half of Block ten in the subdivision of the Dubuque Harbor Company's Addition to the city of Dubuque said half block being situated on teh East side of Miami Street between Jones and Dodge Street are subject to be and are covered by stagnant water at all seasons of the year to the great detriment of the health and property of the neighborhood Be it therefore resolved by the city council of the city of Dubuque that the owner or owners of said lots be and are hereby ordred and required to fill and raise each of said lots to a heighth even with the present surface of that portion of Main street fronting said lots respectively said filling and raising to be fully completed on or before the first day of July 1883 2 that if any owner or owners of any of said lots above designated shall neglect or refuse to fill up and raise said lots or any or either of them within the time herein designated said filling shall be done at the expense of the city and following specifications of the materials and workmanship necessary in the erection and completion of a new slaughter house to be erected by the Dubuque Butchers Association in the city of Dubuque Iowa General Conditions This slaughter house is to be Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 erected on the southeast corner of Sycamore and 18th Streets The main building is to be 26 feet by 100 feet The 100 feet to be the front on Sycamore Street It is to be a brick building with stone trimmings the sidewalks are to be 18 feet high with stone foundation Floor The floor in the entire building is to be made of 12 inches thick grouting well mixed and covered with 1 1/2 inches thick perfectly dry porland cement Gutter In the center of Main Hall there is to be a gutter with sufficient fall from east to west and from west to east made of Portland cement All of the slop water to be transferred to the main drain Drain the main drain ppe to be 10 inches wide made of the best quality soil pipe The drain pipe to be connected with Couler creek Stop Reserve Box The soil drain pipe to be set one foot above the floor in the slop box to keep back the grease The reserve box to be covered with a movable iron grate The box to be four feet square on the inside and walled all around with a 12 inch thick brick wall well cemented all around the floor of this box is also to be of brick and well cemented Partitions All partitions Regular Session February 5, 1883 to be 6"x6" and rest on stone foundations These posts are to support the roof Roof the roof is to be covered with matched and planed fencing and covered with sheet iron printed on both sides The roof is to be constructed of 2 x 6" planks as per plan Boxes The slaughter boxes to be closed with doors on the side of the cattle hall Each door closes the hall when box is opened Ventilation There are to be four ventilators on top of the gable of the roof four feet squre and fourteen feet high At the lower end there is to be a trap door hung on hinges which is closed by means of a rope on rollers All windows are single windows which balance on axles for ventilation Above each door there is to be a window as shown on the elevation plan with four lights All doors are to be double flooring doors Chimneys Two smoke stacks are to be built at each gable end for heating purposes Pulleys the cattle will be drawn up by means of iron pulleys with iron chaines These pulleys hang on the iron axles to which there are two iron wheels attached all to be made so as to be movable Cattle Boxes All cattle Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab building is to be supplied with the city water works connections to be made to the slaughter hall and the cattle pens Finally all the work throughout the entire building is to be done in best workmanlike manner according to the true intent and meaning of the plans and specifications and to the entire satisfaction of the superintendent and owners All materials are also to be the best of reported that that lady was willing to accept the $60.00 allowed by the city council for the opening of Grand View through her premises on motion of Ald Crawford the recorder was instructed to draw an order in her favor for said amount upon the presentation of the proper right of way deed The committee on finance reported on the bill of D S Wilson of 26.40 recommending that the same be paid report the committee on ordinances presented the following which was read the first time An ordinance granting to the CM and St P Railroad Co the right to extend its track on Jackson Street across Seventh STreet and along the sidewalk on the west side of Jackson Street Be it ordained by the City Council of the city of Dubuque Section 1 that permission be and the same is hereby granted to the C M and St P Railroad Company to extend the track now operated by it on the west side of Jackson Street along said Jackson Street across Seventh Street to the sidewalk on the west side of said jackson street and along said sidewalk for the distance of 100 feet Sec 2 That the track hereby authorized shall be laid to the established grade and should the grade be changed at any time by the city the said track shall be changed to conform to such change of grade at the expense of said railroad company Sec 3 The said track shall be so laid as not to interfere with any culverts or drains where the same crosses SEventh STreet and the said railroad company shall plank or otherwise cover the space between the rails of said track where the same crosses Seventh Street as may directed by the City Council and in such a manner as to afford an easy passage for mayors and other vehicles and shall keep said track where the same crosses said Seventh Street properly ballasted and the space between the rails and to the ends of the ties and the street adjacent thereto so graded that wagons and other vehicles may with ease pass Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 over the same Sec 4 The track or extension hereby authorized shall be so operated so far as the running of cars are concerned as to interfere as little as possible with the passage of wagons other vehicles and foot passengers over and along said Seventh Street not shall any car or cars be allowed to stand on that part of the said track where the same crosses Seventh Street and the sidewalks thereof. Sec 5 The said company shall strictly comply with all reasonable police regulations which the city may establish in relation to the running of cas on the extension hereby authorized Sec 6 A failure to comply with the provisions and restrictions of this ordinance on the part of said railroad company their successors or assigns shall operate as forteiture of the privileges hereby granted and said track shall be removed and taken up on the order of the city council Section 7 This ordinance shall be in force from and after its passage and the publication thereof in the official papers of the of John McCoy for the construction of the bridge on 16th street over the Couler Creek be reconsidered Carried Ald Deckert then moved that Mr McCoy be allowed the sum of 150.00 and the auditor be nstructed to open an account with him adopted Dr J E Brady presented a bill of $6.50 for damages to his horse by falling through a bridge referred to the committee on claims On motion the matter of the condition of the Key City Gas Company's lamps was referred to the committee on police and gas to report upon Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The chairman of the committee on streets made the following report upon the report of the Engineer on Bridge your committee on streets respectfully recommends that the contractor for the within named improvement be paid on account the sum of $212.25 and that the auditor be instructed to open an account with said contractor and charge him with the amount Ald Crawford moved that the report be adopted Rule 11 was suspended and the contractor Mr McCoy addressed the city council stating that he had understood he would receive his full claim by the 15th day of January AD 1883 Ald Deckert moved to receive and file amendment was adopted by the following vote 5 for to 3 against Yeas Ald Altman Deckert Glab Jones and Olinger 5 Nays Ald Clancy Crawford and Kavanagh 3 The motion of Ald Deckert to $150.00 on account was then concurred in and the recorder instructed to draw an order in favor of Mr John McCoy for said amount Ald Kavanaugh presented a deed for right of way purposes together with a plat of the ground through lots 1 2 3 4 6 7 8 and 9 in Kavanaugh and Barry's Subd of Mineral lot No 23 which he asked the council to accept Ald Crawford replied that he was in favor of compensating Mr Kavanaugh for the quanitity Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 of ground taken for the opening of Grand View Avenue according to the awards given other parties in the vicinity for similar purposes provided however that Mr Kavanaugh would not insist on or require the obligation of not being obliged to lay sidewalk for seven years to be carried out Engineer was called upon and stated that about an acre and a fraction of Mr Kavanaughs ground had been condemned The aforesaid deed and plat were then referred to the following committee Ald P W Crawford Ald H C Deckert Ald P Clancy Ald J H Shields Attorney Ald Crawford stated that the sum of $100.00 was retained from Mr Rebman for a balance on the improvement of Roberts Avenue and moved that an order be drawn for said amount in favor of Mr. Rebman Ald Jones called for the placing of the motion of ald Crawford in writing Ald Crawford there upon submitted the following resolution resolved that Mr Wm Rebman the contractor for the improvement of Roberts Avenue be paid the balance due him on his said contract Ald Jones moved that action be postponed until a full council meeting was had carried Regular Session
