Ald. Frith moved that the Council
Proceedings for the month of August,
1908, be approved as printed. Car-
ried.

on motion of Ald. Rand, referred to
the Committee on Claims and City At-
torney.
Petitions and Communications.
Petition of Otto M. Schmid et al,
asking that a cement curb and gutter
be placed on ,Grandview Avenue in-
stead of cement gutter and stone
curb, as provided In the specifications
for the improvement of said street and
waiving all damages,' was read and on
motion of Ald. Frith the rules were
suspended to permit the parties inter-
ested in the change of the plans for
the improvement of Grandviw Ave-
nue to address the Council.
Mr. C. T. Hancock, Francis Coates,
Sr.. and Herbert Adams then ad-
dressed the Council in favor of hav-
ing cement curb and gutter on Grand-
- view Avenue.
Ald. Frith moved that the petition
of Otto M. Schmid et al, asking that
the curb and gutter on Grandview
Avenue he constructed of cement ma-
terial be granted, provided the con-
tractor will sign a contract to that ef-
fect. Carried.
Petition of Peter A. Ziegler et al
and 141 other signers, stating on oath
that the Shelter Home for Dogs on
Jackson •Street, near 25th Street, is a
nuisance and a• disgrace to the neigh-
borhood and asking that the Council
order the nuisance abated.
Ald. Martin moved that the prayer
of the petitioners be granted and the
Dog Shelter declared a nuisance.
This brought about considerable
discussion, after which Ald. Saul
moved as an amendment to Ald. Mar-
tin's motion that the petition be re=
ferred to the Committee of the Whole.
Amendment lost by the following vote:

Nays —Alds. Frith, Haas, Martin
and Rand.
Original motion carried.
Ald. Frith moved the Chief of Po-
lice he instructed to notify the par=
ties sheltering the dogs on Jackson
Street to abate the nuisance complain=
ed of within 10 days from date.
Ald. Martin moved as an amend-
ment to Aid..Frith's motion that the
parties be allowed 60 days time in
which to abate the nuisance. Amend-
ment carried.
Petition of Mrs. Susie Wieland, ask-
ing that the taxes for the year 1907
be exempted on Lot 1 of the Sub. of
L. H. Langworthy's Add., she I.eing a
widow with several small children de-
pending oh her for support, was, on
motion of Ald. Frith, referred to the
Delinquent Tax Committee.
Petition of Mrs. C. D. Hayden, ask-
ing that the taxes on her homestead
be canceled for the year 1907, she be-
ing a widow with several children de-
pending on her for support and un-
able to pay said taxes, was, on mo-
tion of Ald. Frith, referred to the De-
linquent Tax Committee.
Petition of Louisa Schwartz, asking
that the taxes on lot 6, in Kringle's
Sub, and lot 6a of Quigley's out lot
711 be cancelled for the year 1907,
she being a widow and unable to pay
said taxes, was on motion of Ald.
Frith referred to the Delinquent Tax
Committee.
Petition of Schmid Mfg. Co., asking
that the City Treasurer be instructed
to accept the taxes for the year 1907,
according to the exemption, granted
them June 18, 1903, for a period of
5 years, was, on motion of Ald. Frith,

AN ORDINANCE establishing a grade
on Walnut Street from Chestnut
Street to West Eleventh Street in
the City of Dubuque, Iowa.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That a grade on Walnut
Street from Chestnut Street to West
Eleventh Street in the City of Du-
buque, Iowa, he and the same is here-
by established and adopted as shown
by the profile of said street and grade
prepared by the City .Engineer and
accepted by the City Council on the
9th day of July, 1908, being No. 653,
and marked "Profile and Grade of
Walnut Street from Chestnut Street to
West Eleventh Street, b. ms. coping
northwest corner Walnut and Chest-
nut Streets, elevation 255.66 and fire
plug northwest corner West Eleventh
Street, elevation 231.44." Said grade
beginning at the south line of Chest-
nut Street, which is station 0, eleva-
tion 253.27; thence to station 1+24,
north curb Rose Street, elevation
252.27; thence to 'station 1 +63, ele-
vation 251.40; thence to station
4 +62, north curb West Eleventh
Street, elevation 228.50.
Section 2. This Ordinance shall be
in force and take effect from and after
its passage by the City Council and its
publication one time in Dubuque
Telegraph - Herald and Times- Journal
newspapers.

Communication from the Finley
Hospital Board, asking that the Sani-
tary sewer be extended from West
Third and Booth Street to College
Avenue, thence in Allison Place to
first Angle west of College Avenue,
was, on motion of Ald. Martin, grant-
ed.
Communication from the Mayor and
Clerk of the City of Ottumwa, Iowa,
asking that the City of Dubuque send
a large body of representatives to the
Eleventh Annual Convention of the
League of Iowa Municipalities, to be
held in that city September 16th, 17th
and 18th, was, on motion . of Ald.
Frith, referred to the Committee of
the Whole.
Communication from League of
Iowa Municipalities by F. G. Pierce,
secretary, asking that the City of Du-
buque send a delegate to the Annual
Convention of the League, to be held
at Ottumwa, also asking that the City
pay their annual dues as members of
the League, was, on motion of Ald.
Frith, referred to the' Committee of
the Whole.
Communication from the Fifth
Ward Non- Partisan League, asking
that sidewalks of brick or cement be
laid on both sides of Hart Street from
Couler Avenue to Valeria Street, was,
on motion of Ald. Frith, referred to
the Sidewalk Inspector.
Petition of S. B. Lattner, asking that
the City Engineer be instructed to es-
tablish a grade on Martha Street from
Alta Vista Street west, so that he can
have lots abutting on said street im-
proved, was, on motion of Ala. Rand,
referred to the Committee of the
Whole.
Bids were presented for the im-
provement of Windsor Avenue. The
alley first east of Windsor Avenue
from Hennepin Street south.
The alley north of Ries Street from
Windsor to Stafford Avenue.
Ald. Frith moved that the bids be
opened. Carried.
Bids for improving Windsor Avenue
are as follows:
O'Farrell Co., new curbing, 70c; re-
setting old curb, 20c per lineal foot;
brick paving, $1.98 per square yard.
Peter Eisbach, new curbing, 80c;
resetting old curb, 27c per lineal foot;
brick paving, $1.98 per square yard.
Ald. Martin moved that the bids on
Windsor Avenue be rejected and the
Recorder be instructed to readvertise
for bids. Carried.
Bids for improving the alley north
of Ries Street from Windsor to Staf-
ford Avenues are as follows:
Peter Eisbach, grading, 35c per
cubic yard; guttering, 75c per square
yard, and macadamizing, 69c per
square yard.
Wilmer Cook, grading, 25c per cubic
yard; guttering, 68c per square yard,
and macadamizing 68c per square
yard.
Ald. Frith moved the contract for
above named alley be awarded to Wil-
mer Cook and his bond placed at
$100.00.
Ald. Rand moved as an amend-
ment to Ald. Frith's motion, that the
bids be referred to the Committee of
the Whole. Amendment lost and
original motion _carried.
There being but one bid for the im-
provement of the alley first east of
Windsor Avenue from Hennepin
Street south, the bid was, on motion
of Ald. O'Rourke, ordered returned to
the bidder without reading and the
Recorder instructed to re- advertise
for bids.
Their being no bids received for the
laying of a cement sidewalk on the
east side of Cardiff Street, in front of
Lot 13 of City Lot 724, the Recorder
was also, on motion of Aid. Rand, in-
structed to re- advertise for bids.
Reports of Officers.
Mayor Schunk stated that, accord-
ing to the Ordinance, it became in-
cumbent on the Council at the present
session to appoint a Committee on
Assessments to act as a Board of
Equalization, consisting of one Alder-
man from each ward, and he sub-
mitted the following list which, on
motion of AId -. Frith, was approved:

to your honorable body that Mr. P.
W. Crawford has put down a plank
walk on the south side of Chestnut
Street, abutting lot 779 of A. McDan-
iel's Sub., estimated length of said
walk, 30 feet. This is contrary to the
City Ordinance and I ask your honor-
able body to give me proper orders in
regard to same.

City Recorder Linehan presented
and read the printed notice, certified
to by the publisher, of the Council's
intention to open an alley across Lots
22„ 25 and 26 of Wick's Addition.
No remonstrance being filed, on mo-
tion of Ald. Frith, rules were suspend-
ed to grant Mr. Wodrich permission
to address the Council. Mr. Wodrich
then addressed the Council, remon-
strating against the proposed opening
of the alley.
Ald. Frith then moved that the
matter of the opening of the alley be
referred to the Committee of the
Whole and Mr. Wodrich be notified to
be present at the meeting. Carried.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
.Council's intention to levy a special
assessment for the cutting of weed's
during the months of July and part
of August, 1908. No remonstrance be-
ing filed and no one in the room ob-
jecting to the levying of said special
assessment for cutting of weeds, the
notice was, on motion, received and
filed.
Whereupon Ald. Martin offered the

ties to send 'a delegate to its twelfth
annual convention to be held in Oma-
ha. September 30th to October 2nd,
1908, would respectfully recommend
that Mayor Schunk be appointed such
delegate. All expense connected with
the trip, however, to be borne by him-
self.

strance of Reeder Langworthy et al
against the proposed brick guttering
of Alpine Street and also the resolu-
tion ordering said work done, would

that the present Engineer, Mr. Paul
Ilg, declares that the lines as laid out

made and they have accumulated,
about the manner in which the Iowa
Telephone Company has been con-
ducting its business with our citizens,
and
Whereas, the methods adopted by
said company to compel subscribers
to put in a higher priced service than
they thought they could afford ap
pears unfair, for Instance: Phones of
retail houses have been placed on the
same line with private houses, where
the owner did not wish to pay for
higher priced service, with the result
t hat the phone would be ringing con -
th'nuously, the evident intent being to
rause annoyance, and
Whereas, said company has appar-
-ently advanced the rates for both pri-
vate and business service, and
Whereas, - our streets have been
torn up by this company and often
not replaced properly, our streets and
alleys look like forests, its wires pre-
- vent speedy work where the same is
most necessary; that is, in case of fire,
it has by the purchase of a lot, taken
valuable property off from the tax list,
it is given fire and police protection,
the street is sprinkled, swept and
Cleaned in front of its property, and
this company, demanding more at-
tention and occupying more of the
public streets and alleys than any
other corporation in the city, pays for
the protection of its property and all
other benefits conferred by the City
of Dubuque, the insufficient sum of
$98.00 per annum; therefore,
Resolved by the City Council of
the City of Dubuque, That the City
Attorney be and he is hereby directed
to prepare as expiditiously as possible
an opinion and present the same to
the City Council, as to whether the
City of Dubuque has any control, po-
lice regulations or otherwise over said
company.

said Company it sees fit so to do. We
would therefore, recommend that said
petitioners be referred to the officers
of said Company for the desired privi-

asking that it be exempted from tax-
ation as provided by previous action

recommend that the prayer of the pe-
titioner he granted and that the City

to whom was referred the communi-
cation of P. F. Rooney in relation to
the lines of the crossing for Robinson
avenue across the sidewalk on Julien
Avenue, would respectfully recom-
mend that the City Engineer be in-
structed to give the lines for said
crossing.
Also your Committeee of the Whole
would respectfully report that we
have taken up the matter of lower-
ing the water mains on Grandview
Avenue with the City Attorney, with
a view of determining where the lia-
bility for such lowering lay, and that
the City Attorney has given it as his
opinion that it is the duty of the Water
Works Trustees to attend to all such
matters. We would, therefore, rec-
ommend that the Board of Water
Trustees be notified that the water
mains along that part of Grandview
Avenue that it is proposed to improve
are dangerously near the surface so
that they may take the proper steps
to protect the same. Also that said
Board be requested to put in taps
along said main about 300 feet apart
for the purpose of sprinkling parking
it is proposed to lay out along said
avenue.

Connell must appoint a board of reg-

Ald. Frith inquired of the City At-
torney what action, if any, had been
taken in -reference to his motion of
June 4, 1908, that the City Attorney
be instructed to commence proceed-
ings against the Board of Supervisors
immediately to compel said board to
repair Davis Av as ordered by
the Council.
City Attorney notified the Council
that no action had been taken as yet,
but would come before the October
term of court.

buque, Iowa.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on the al-
ley first north of Ries Street from
Windsor Avenue to Stafford Avenue
in the City of Dubuque, Iowa, be and
the same is hereby adopted as shown
by the profile of said alley prepared
by the City Engineer and accepted by
the City Council on the 3rd day of
Septemer, 1908, being No. 654, and
marked "Profile showing grades of al-

Electrician be instructed to have the
electric light in front of the Sacred
Heart church put in shape and prop-
erly lighted at once. Carried.
Ald. O'Rourke moved that the
Council take a recess of 15 minutes.
Ald. Frith stated that the newspa-
pers were publishing articles to the
effect that the meetings of the Coun-
cil Committee of the Whole were
star chamber sessions and moved
that all the Committee of the Whole

James Street be changed so as to con-
form with street level of West Third
Street, where such streets intersect,

Ald. O'Rourke stated that Dr. Al-
derson, the owner of all the property
on both 'sides of Yale Street, wanted
to have cement curb and gutter put
on said street instead of the stone
curb and gutter as contracted for and
also wanted to have surface of the
street, when finished, covered with
tarvia, contractor being willing to
consent to such changes, and moved
that the prayer of the petitioner be
granted, provided proper waivers be

Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That a grade on West
'Twelfth Street and Grove Terrace
from Bluff Sires to Arlington Street
in the City of Dubuque, Iowa, be and
the same is hereby adopted and es-
tablished, as shown by the red line on
the profile of said street and grade
prepared by the City Engineer and
accepted by the City Council on the
17th clay of September, 1908, being
No. 655 and marked "Profile and
Grade of West Twelfth Street and
'Grove Terrace from Bluff Street to
Arlington Street, b. m.'s. doorsill of
- house 98 on Grove Terrace, elevation
•104.71; east. end of north curb of Ar-

Street from Fourth to Sixth Street by

assessment against all lots or parcels
of real estate subject to assessment
for such improvement and file the
same in the office of the City Recor-

lowing' reports made to him by Mar-
ket Master Katz:

mittee on Markets.
Dear Sir: I would respectfully re-
port that T have examined all the pub-
lic scales in the city and find the same
to be in good condition with the ex-
ception of the following':
Scale at T. Donahue's store, Grand-
view Avenue and South Dodge Street,
weighs fairly accurate when load is in
center of the platform, but when test-
ed in one corner it shows 35 pounds
over and in another 25 pounds less.
This scale I tested with 200 -pound test
weights. I would ye commend that the
weigher be instructed to cease weigh-
ing on this scale until same is put in
good repair and properly balanced.
Scale at West Dubuque. I find that
the planks in the platform are cut too
long for the frame or else the frame
is giving away and rubs on the end
of the planks. I tested this scale with
100 -,pound test weights and found that
it weighed 25 pounds short. The
weigher informs me that those scales
are the property of the city and have
always been heretofore taken care of
by 'the city.

I also inspected and tested the
wagon scales of Mrs. Deckert and Mr.
George Pfiffner and find that the
scale of Mr. 1?fiffner is correct and
the scale of Mrs. Deckert is in such
a condition that it is impossible to
weigh a load correctly on same. I
would therefore recommend that the
latter scale be kept out of commission
until same is repaired.

Street Commissioner be given power
to have the scales repaired. Carried.
Ald. O'Rourke, chairman of the
Ccmmittee of the Whole, reported as
follows:
Your Committee of the Whole
would respectfully recommend that
during the stress of work in the En-
gineer's office, the rodman be relieved
from the duty of acting as clerk for
the Street Commissioner, and that the
duties devolving on him as such clerk
be performed by the Deputy Auditor.
Also your Committee of the Whole,
to whom was referred the remon-
strance of Geo. Grundy et al against
any change in the established grade
of North Street, would respectfully
report that all the signers to said re-
monstrance have since agreed to a
proposed change and have signed a
waiver on a profile showing such
change of grade. We would, there-
fore, recommend that said remon-
strance be recei'ed and filed and that
the proper steps lie taken to make
said change a matter of record.
Also your Committee of the Whole
would respectfully recommend that
the Ordinance Committee and City
Attorney be instructed to prepare an
Ordinance providing for a city license
of $120.00 per annum for the sale of
liquor, either at wholesale or retail,
in the City of Dubuque, Iowa, said
license to be payable quarterly in ad-
vance and to commence on the 1st day
of October, 1908.

Ald. O'Rourke stated that some of
the parties had not paid for the space
they were occupying in the Ice Har-
bor and asked' if they could not be
compelled to pay for said space.
City Attorney Lyon stated that he
had already secured conviction in two
cases against these delinquents, one of
which cases has been appealed to the
District Court, and he did not wish
to incur additional expense until after
these two cases have been settled.
Ald. Saul was excused at 11:00 p.
m.
Ald. Martin, chairman of the Com-
mittee on Police and Light, stated
that Mr. Frank Venn, the Dog
Enumerator, had been suspended and
stated that according to the report
submitted to the Council by that
committee he believed the appointing
and discharging was entirely in the
hands of the Committee on Police and
Light, subject to the approval of the
Council and asked why Mr. Venn had
been suspended. After considerable -
discussion pro and con Ald. O'Rourke
moved that the action of the Mayor
in suspending Mr. Venn be sustained
and the services of Dog Enumerator
be dispensed with for the balance of
the season.
Motion lost by following vote:
Yeas -- -Aids. Frith and O'Rourke.
Nays - -Aids. Martin, Rand and Sin -
grin.
Absent —Alds. Haas and Saul.
Ald. O'Rourke moved that the City
Auditor be instructed to not pay any
warrants unless there is money in the-
funds from which to pay same. Car-
ried.
Add. Frith moved to adjourn to
Thursday evening, October 1st, 1908.

To Whom It May Concern:

notified that it is the intention of the
City Council of the City of Dubuque
to improve Julien avenue from Bluff
street to the easterly curb lines of
Alta Vista street by reguttering the
same with brick on a macadam foun-
dation and to curb and reset curb
where. necessary.
That the plat and estimate of said
proposed improvement is now on file
in the office of the City Recorder.
It is estimated by the City Engineer
that said improvement will require
2,262 square yards brick gutter on a .
macadam foundation, 560 lineal feet
of new curbing set, and 1,100 lineal
feet of old curbing reset, making a
total estimated cost to the abutting
property owners of $3,922.00.
Any person having objection to said
improvement is hereby notified to ap-
pear before the City Council at its
regular session to be held October
1st, 1908, or to file with the City Re-
