Street from Windsor Avenue to Staf-
ford Avenue, Peter Eisbach, con-
tractor.

$1,401.57, same to be assessed against
the abutting property upon and along
said street.
And that there is a plat and sched-
ule on file in the office of the City Re-
corder of said City of Dubuque, show-
ing the streets on which said improve-
ments were made and the separate
lots and parcels of ground or speci-

PETITIONS AND COMMUNICA-
TIONS.
Petition of the Illinois Central Rail-
road Company, asking that they be
given permission to extend their side-
track known as the Becker coal track,
from the terminus of said track, just
south of Wall Street in Block 20 and
west of Cedar Street, crossing Wall
Street, Cedar Street and Pine Street
in said city and connecting with the
tracks of the C. G. W. R. R. Co. in
Block 17, was read and on motion of
Ald Singrin, rules were suspended to
allow Mr. T. J. Fitzpatrick, attorney
for the Illinois Central, permission to
address the Council. Ald. Frith then
moved that the petition of the Illi-
nois Central R. R. Co. be referred to
the Committee of the Whole to
view the grounds and Mr. Fitzpatrick
be notified to be present at the meet-
ing. Carried.
Petition of Miss S. J. Goldthorpe et
al, asking that an electric arc lamp be
placed at the intersection of Tenth
and Bluff Streets, was, on motion of
Ald. Frith, referred to the Commit-
tee of the Whole.
Petition of W. D. Middlesworth et
al, remonstrating against the proposed
erection of a retaining wall in Alice
Street (also known as Ardmore
Terrace) and asking that the Street
Committee and City Engineer investi-
gate the matter, was on motion of Ald.
Rand, referred to the Committee of
the Whole, and the Street Commis-
sioner to stop any work on said Street,
if same has been started.
Petition of the Young Women's
Christian Association, by Miss Augusta
Eighmey, president, asking that their
property, known as lot 101 and N. 18
feet of Lot 102, be exempted from
taxes for the year 1907 and to place
said property on the list for exemption
from future taxation, including the
year 1908, and the Treasurer be in-
structed accordingly, was. on motion
of Ald. Rand, granted and the Treas-
urer to be instructed accordingly.
Petition of Miss J. F. Kunz, asking

Ald. O'Rourke, chairman of the
Committee on Finance, reported as
follows:
Your Committee on Finance here-
with presents the receipts of the City
Treasurer for $1,775.93 received from
the sale of bonds issued for the im-
provement of Louisa Street, $2,331.88
received from the sale of bonds issued
for the brick paving of Sixth Street
and 84,303.52 received from the sale
of bonds issued for the improvement
of Asbury Street.
Also your committee on Finance
would respectfully recommend that
the sum of $4,000.00 be transferred
from the Improvement Fund to the
Improvement Bond Fund for the pur-
pose of redeeming $3,500.00 in bonds
which became due on Nov. 1st, and
to pay other bonds that have been is-
sued against city property for street
improvements.

mend that said work be accepted and
that the City Engineer be instructed
to prepare a special assessment
against the lots or parcels of real es-
tate benefited by such improvement
and file the same in the office of the
City Recorder, who will thereupon
publish the notice required by ordi-
nance.
Also your Committee on Streets
would respectfully report that we
have examined the macadamizing on
Asbury Street, from Cherry Street to
the alley first south thereof, O'Farrell
Contracting Co., contractors, and
would recommend that said work be
accepted and that the City Engineer
be instructed to prepare a special as-
sessment against the lots or parcels of
real estate benefited by such improve-
ment and file the same in the office
of the City Recorder, who will there-
upon publish the notice required by
ordinance

Ald. Rand, chairman of the Com-
mittee on Claims, reported as follows:
To the Honorable Mayor and City
Council:
Gentlemen: —Your Committee on
Claims and City Attorney would re-
spectfully report that there is now
pending in the District Court of Du-
buque County, Iowa, the case of
Michael W. Gleason vs. City of Du-
buque, Iowa, in which plaintiff claims
damages in the sum of five thousand
dollars for injuries sustained in falling
on a defective and slippery sidewalk
on the west side of Prairie Street, be-
tween Arlington Street and West
Fourteenth Street, on June 28th, 1908,
by reas-?n of which he suffered a frac-
ture of his left wrist, from which he
was unable to do his usual work for a
considerable time, he having been a
clerk in the United States railway
mail service.
Your committee, having examined
into the facts of this case, deeming
it to the best interests of the City that
the same be compromised and settled,
they have accordingly made and re-
ceived an offer of compromise with
the plaintiff, by the payment to him
of the sum of one hundred twenty -
five ($125.00) dollars and the court
cost, amounting to six dollars and
fifty -five cents ($6.55.)
We therefore recommend that said
settlement be approved and that war-
rants be drawn in favor of the Mayor
for said amounts, to effect same.

was referred the petition of Mrs. An-
na Lorenz, asking that she be granted
permission to erect a barn fifty feet
long by twenty -six feet wide on City
Lot 297, would respectfully recom-
mend that the prayer of the petitioner
be granted provided the sides and roof
of said building be sheathed with

Ald. O'I ;ourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of
Mrs. Cora Dunlap, stating that she is
the widow of an honorably discharg-
ed soldier of the War of the Rebellion
and being unaware of the exemption
to which she was entitled under the
law, she had paid into the city treas-
ury the sum of $3.75, the amount as-
sessed against her for personal prop-
erty, and asking that the same be re-
funded, would respectfully recommend
that the prayer of the petitioner be
granted and that a warrant in said
amount be ordered drawn on the City
Treasurer, payable to the petitioner.
Also your Committee of the Whole,
to whom was referred the petition of
Mrs. Anna Dietl, asking that on ac-
count of poverty the taxes on her
property be canceled for the year
1907, would respectfully recommend
that the prayer of the petitioner be
granted and that the Treasurer be in-
structed accordingly.
Also your Committee of the Whole,
to whem was referred the petition of
Carrie E. Mink, asking that the in-
terest on the assessment levied against
her property for the construction of a
sanitary sewer in Grandview Avenue
be canceled, would respectfully recom-
mend that said petition be received
and filed.
Also your Committee of the Whole,
to whom was referred the matter of
the opening of the alley between
Rhomberg and Garfield Avenues at
Middle Avenue, would respectfully re-
port that we have held a conference
with the owners or their representa-
tives, of all the property involved, and
it was agreed unanimously that should
the city exempt the property needed
for the opening of said alley from the
special assessments to be levied for
the construction of the sewer and the
macadamizing of the alley that the
strip required for the alley would be
dedicated to the City. We respectful-
ly report that we order the improve-
ment subject to the consent of ad-
ministrator of the Rugamer estate.

Gentlemen: —Your Board of Health
would respectfully report that we
have awarded the contract to M. E.
King for caring for the patients at
the Detention Hospital and for occu-
pying said Hospital when no patients
are there. He to receive the follow-
ing compensation:
When there are no patients at the
Hospital, $5.00 per month.
When there are less than 5 patients
at the hospital, $3.50 per day.
When there are 5 to 10 patients at
the Hospital, $4.00 per day.
When there are more than 10
patients at the Hospital, $5.00 per day.'
Which we submit to your honorable
body for approval.
Also your Board of Health respect-
fully reports that the following prop-

Bids for furnishing the City with
hay and oats for the various depart-
ments for the ensuing year were pre-
sented.
Ald. Frith stated that an error had
been made in advertising the kind of
hay and oats and moved that all the
bids be returned to the bidders un-
opened and the Recorder readvertise
for bids when committee had decided
on quality of hay and oats wanted for
the various departments. Carried.
Recorder stated that there was but
one bid presented for furnishing City
with coal and wood and that was pre-
sented after the time advertised in the
notice.
Ald. Rand moved that the bid be
returned to the bidder unopened. Car-
ried.
Ald. Frith moved that the matter
of the furnishing City with coal and
wood for the ensuing year be referred
to the Committee of the Whole to
make some arrangements. Carried
Bid for winding, oiling, repairing
and caring for the town clock for the
ensuing year was presented and or-
dered opened, as follows:
J. P. Buechele & Co., cleaning,
winding, oiling and the furnishing of
small materials for keeping city clock
in repair from Nov. 1, 1908, to Nov.
1, 1909, one year, for the sum of
$144.00.
On motion of Ald. Martin the con-
tract was awarded to J. P. Buechele
$ Co., they being the only bidder.
Ald. Frith stated that the lunch
wagons now being used on the streets
of the city are entirely too large and
are dangerous, and moved that the
matter of lunch wagons be referred to
the Chief of Police and Committee on
Police and Light for investigation.
Ald. Frith moved that the O'Farrell
Contracting Co. be notified to repair
Washington Street north of Twenty -
fifth Street, where they constructed
the Bee Branch sewer. Carried.
Ald. Frith moved that the Street
Commissioner be instructed to compel
all the railroad companies to have all
their crossings and sidewalks put in
first class shape at once. Carried.
Ald. Martin moved that the City At-
torney be instructed to enforce the
City Ordinances in reference to com-
pelling the Arthur McCann Estate,
owner of City Lots 609a and 610a,
John Allgeyer, owner of N. 1 -2 of S.
M. 1 -5 and S. 1 -4 of M. 1 -5 of City
Lot 496, and P. Ternes Estate, owner
of S. 1 -5 of City Lot 450, to connect
said premises with the sanitary sewer.

with hay and oats for the ensuing year
were presented and were opened and
read, and, on motion of Ald. Martin,
all bids were rejected and the Re-
corder instructed to readvertise for
bids for hay and oats.

showing proposed extension of Grove -
land Place, was presented and, on mo-

City Attorney Lyon reported as fol-
lows:
To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen: The undersigned, to
whom was referred the "matter of
salaries of three police captains and
as to the rights of the Board of Po-
lice Commissioners and the Chief of
Police," respectfully reports as fol-
lows:
Section 679h of Title 5, Chapter
2 -a of the Supplement to the Code of
Iowa, 1897, provides as follows: "All
police officers and policemen, except
the chief of police, * * * shall
be subject to removal by the Board
of Police and Fire Commissioners for
misconduct or failure to perform their
duty, under such rules and regulations
as may be adopted by said Board
whenever said Board shall consider
and declare said removal necessary
for the proper management or disci-
pline of said department; but the
chief of police may peremptorily sus-
pend or discharge any member of his
force for misconduct or neglect of
duty or disobedience of orders; pro-
vided, that any person so suspended
or discharged, within five days there-
after may appeal to the said Board,
and said Board shall investigate the
causes of his removal or discharge,
and if the same are found insufficient,
he shall be reinstated."
In the instant case the officer in
question appealed from the chief's or-
der. and the Board, after subjecting
him to a penalty, reinstated him.
It is my opinion that upon the ex-
piration cf the time fixed in the order
of suspension, the officer, upon report-
ing for duty, would be entitled to his
position on the force, and as the sal-
ary annexed to a public office is inci-
dent to the title to the office, and not
to its occupation and exercise, the of-
ficer would be entitled to receive a
ca.ptain's pay from the time of the
expiration of his suspension, whether
he was permitted to perform a cap-
tain's duty or not.
Under the authority vested in the
Board by the section above quoted, it
would seem that, while the chief of
police has power to suspend or dis-
charge a member of his force, his
action, under certain conditions, is re-
viewable by the Board, and any dis-
position made by them of the ,nat-
ter is final.
The council having authorized only
two police captains, the city can be
held responsible for only the salary
of that number, and it follows from
what I have already stated, that the
officer appointed to temporarily fill
the place of the suspended officer,
would only be entitled to a captain's
salary during the term of suspension
of the captain.
I have been informed, but not
authoritatively, that the officer who
was reinstated by the Board, was re-
duced in rank since the expiration of
his suspension by the chief; if this
be a fact, it might alter my opinion
as to who would' be entitled to the
captain's salary after the date of the
reduction. I give no opinion on this
phase of the question, however, at
the present time.

in broken black line, a grade estab-
lished December 14th, 1887, extend-
ing from Rhomberg Avenue to station
13 +26. The new grade proposes a
radical change, and is an improve-
ment to abutting property. Same is
referred to you for consideration.

Regular Session, November 20th, 1908
Be it Resolved, That we tender
his family our heartfelt sympathy and
profound regret in their great be-
reavement, and that the great grief
we know they must feel be assuaged
by the thought that after long and
patient suffering he rests in peace, and
be it further
Resolved, That as a mark of re-
spect for the deceased that we attend
the funeral and that these resolutions
be spread upon the records of the City
Council.
Ald. Frith moved the adoption of
the resolution. Carried.
Ald. Saul moved that the Street
Commissioner be instructed to collect
all the outstanding accounts due the
City of Dubuque for rolling, for dirt
sold and all other monies due the City.
Ald. Martin moved that the Street
Commissioner be instructed to notify
the property owners on the east side
of Garfield Avenue from Windsor
Avenue north to fill the sidewalk with
cinders. Carried.
Ald. O'Rourke moved that the
street Commissioner notify the prop-
erty owners on Grandview Avenue
south of Dodge Street to replace old
wooden sidewalk with cinders where
sidewalks are in need of repair. Car-
ried.
Ald. Frith moved to adjourn to Fri-
day evening, November 20th, 1908.

Mayor Schunk stated that the meet-
ing was an adjourned meeting of the
Adjourned Regular Session of Novem-
ber 20th, 1908, of the regular session
of November 19th, 1908, and was
called to take up and consider all mat-
ters which may properly come before
a regular session of the City Council.
Alderman O'Rourke, chairman of
the Board of Equalization, reported
as follows:
Your Board of Equalization, regu-
larly appointed by your honorable
body at the first meeting of Septem-
ber last to equalize the assessment of
all taxpayers in accordance with Sec-
tion 3, Chapter 56, of the Revised
Ordinances of the City of Dubuque
of 1901, would respectfully report
that we have performed all the du-
ties required by said chapter and that
we held a meeting on Nov. 19th, 1908,
and adjourned from day to day until
Nov. 21st, 1908, when a final meet-
ing was held. These latter meetings
were for the purpose of giving a
hearing to those who felt aggrieved
by the action of the Board and those
who desired to address the Board,
and after giving careful considera-
tion to the proposed changes to the
assessments, we respectfully recom-
mend that the following changes be
confirmed:

the City Assessor may proceed with
his tax list for the year 1908 that ha
be notified that it is the intention of
the Council to make the levy 13 mills,
and that the proper resolution be pre-
'pared and presented to the City Coun-
cil for adoption at its next session.

Goose Horn Mining Company were
anxious to have the Council take im-

Ald. O'Rourke moved that rules be
suspended to grant permission to Mr.
Fitzpatrick, attorney for the Illinois
Central Railroad Co., to address the
Council in reference to special assess-
ment levied against said railroad com-
pany for the improvement of Iowa
and First Streets. Carried.
Mr. Fitzpatrick then addressed the
Council, showing blue print of tracks
of company and extent of the im-
provement on the Illinois Central
company's property.
On motion of Ald. Singrin, the mat-
ter was referred to the Committee of
the Whole and City Attorney and the
Illinois Central to furnish the Com-
mittee with copy of .the map of their
lines.

Bids for furnishing City with hay
and oats were presented and, on mo-
tion of Ald. Frith, were ordered
opened, as follows:

Ald. Frith moved that contract for
furnishing City with hay and oats be
awarded to Jacob Haudenshield.
Ald. Saul moved as an amendment
that bids for furnishing City with
hay and oats be referred to the Com-
mittee of the Whole. Amendment
carried.
Bids for privilege of conducting
skating rink for the season of 1908-
1909 were ordered opened, as follows:
John Keckevoet, for privilege of
conducting rink, $25.00.
Ald. Rand moved that privilege be
awarded to • John Keckevoet for
$25.00, he being the only bidder.
Carried.
Ald. Frith moved that the Harbor
Master be instructed to lay out the
lines for Skating Rink. Carried.
Petition of Mrs. William Ballard,
asking that the taxes for the year
1907 on the west 1/ of Lot 3 of the
subdivision of Mineral Lot 149 be can-
celed, she being a widow in poor
health and unable to pay said taxes,
was on motion of Ald. Haas, referred
to the Delinquent Tax Committee.
Petition of Mrs. Katharine Bannon,
asking that the taxes on the N. 1 /2 of
City Lot 556 for the years 1906 -1907
be canceled, she being a widow de-
periding on the support of her son,
Thomas Bannon, who is suffering
from the effects of an injury sustain-
ed last summer and is, therefore, un-
