Notice of Special Assessment.
Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
regular session of the City Council to
be held December 3rd, 1908, to pay
for the improvement of Milwaukee
Avenue from Couler Avenue to Jack-
son Street, Wilmer Cook, contractor.
Amount of special assessment,
$1,099.87, same to be assessed against
the abutting property upon and along
said street.
And that there is a plat and sched-
ule on file in the office of the City Re-
corder of said City of Dubuque, show-
ing the street on which said improve-
ment was made, and the separate lots
and parcels of ground or specified
portions thereof subject to assessment
of such improvement, the name of the
owner thereof, as far as practicable,
and the amount to be assessed against
each lot or parcel of ground, which
plat and schedule are subject to pub-
lic inspection.
And that any and all persons ob-
jecting to said special assessment or
to said plat must file his or their ob-
jection in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil to be held December 3rd, 1908, or
to appear at said session of the Coun-
cil to show cause, if any you have,
why said assessment should not be
levied.

Ald. O'Rourke moved that rules be
suspended to grant permission to Mr.
Fitzpatrick, attorney for the Illinois
Central Railroad Co., to address the
Council in reference to special assess-
ment levied against said railroad com-
pany for the improvement of Iowa
and First Streets. Carried.
Mr. Fitzpatrick then addressed the
Council, showing blue print of tracks
of company and extent of the im-
provement on the Illinois Central
company's property.
On motion of Ald. Singrin, the mat-
ter was referred to the Committee of
the Whole and City Attorney and the
Illinois Central to furnish the Com-
mittee with copy of the map of their
lines.
Bids for furnishing City with hay
and oats were presented and, on mo-
tion of Ald. Frith, were ordered
opened, as follows:
M. Hogan, No. 1 white oats, 59
per bushel of 35 lbs. Choice upland
hay, $10.50 per ton. Choice timothy
hay, $11.90 per ton.
J. J. Nagle, choice timothy, $13.50
per tor. Choice upland hay, $11.00
per ton. Choice wild hay, $9.00 per
ton. Choice white oats, 65c per
bushel of 35 pounds.
Thomas F. Kane, choice upland or
timothy baled or loose hay for one

Ald. Frith moved that contract for
furnishing City with hay and oats be
awarded to Jacob Haudenshield.
Ald. Saul moved as an amendment
that bids for furnishing City with
hay and oats be referred to the Com-
mittee of the Whole. Amendment
carried.
Bids for privilege of conducting
skating rink for the season of 1908-
1909 were ordered opened, as follows:
John Keckevoet, for privilege of
conducting rink, $25.00.
Ald. Rand moved that privilege be
awarded to • John Keckevoet for
$25,00, he being the only bidder.
Carried.
Ald. Frith moved that the Harbor
Master be instructed to lay out the
lines for Skating Rink. Carried.
PETITIONS AND COMMUNICA-
TIONS.
Petition of Mrs. William Ballard,
asking that the taxes for the year
1907 on the west 1 /2 , of Lot 3 of the
subdivision of Mineral Lot 149 be can-
celed, she being a widow in poor
health and unable to pay said taxes,
was on motion of Ald. Haas, referred
to the Delinquent Tax Committee.
Petition of Mrs. Katharine Bannon,
asking that the taxes on the N. 1 /2 of
City Lot 556 for the years 1906 -1907
be canceled, she being a widow de-
pending on the support of her son,
Thomas Bannon, who is suffering
from the effects of an injury sustain-
ed last summer and is, therefore, un-

able to pay said taxes, was, on mo-
tion of Ald. Saul, granted and the
Treasurer to be instructed according-
ly.
Petition of J. F. Kunz, asking that
the Treasurer be instructed to accept
$50.00 in full settlement of special as-
sessment levied against lots 7 and 8
in Guernsey and Langworthy Add. for
the improvement of Alpine Street,
was, on motion of Ald. Singrin, re-
ferred to the Committee of the Whole.
Petition of Dubuque Star Brewing
Co., asking that the Treasurer be in-
structed to accept payment of their
taxes in accordance with the action of
the City Council of April 7th, 1898,
was, on motion of Ald. O'Rourke, re-
ferred to the Committee of the Whole.
Petition of H. Fitzgerald, asking
that the Engineer be instructed to
give him a grade on Hodgdon Ave-
nue, so that he can build on lots 3,
4 and 5 in Littleton and Sawyer's
Add., was, on motion of Ald. Frith,
referred to the City Engineer to find
out if grade has been established on
said street.
Petition of Spahn -Rose Lumber
Co., asking for the right and privi-
lege to make a connection with the
storm water sewer on Eighth Street
in the alley between Washington and
Jackson Streets for the purpose of
draining surface water which stands
in the alley, was, on motion of Ald.
Saul, referred to the Street Commit-
tee.
Petition of the A. A. Cooper Wagon
& Buggy Co., asking that the assess-
ment for 1906 -1907 on their levee
property be reduced to $6,000.00;
also that the assessment for 1906 and
1907 on the N. 43% feet of Lot 117,
be reduced to $2,500.00, was, on mo-
tion of Ald. O'Rourke, referred to the
Committee of the Whole.
Petition of the Brotherhood of Rail-
way Trainmen, by Wm. Fuller and L.
F. Cook, committee, asking for per-
mission to use Armory Hall on or
about the night of January 28th, was,
on motion of Ald. Rand, not granted,
owing to the inability to properly
heat the building at that time of the
year; it is dangerous to use the hall
because the heating of the building
melts the snow on the roof, causing
water to leak through and onto the
ceiling of the hall, which ceiling is now
liable to fall, especially when the
roof is leaking, and the Recorder to
notify the committee accordingly.
Petition of Max Kistler, asking that
the Treasurer be instructed to accept
$102.70 without interest in full for
special assessment levied against Lot
1 in Ernst Fengler Add., for the im-
provement of Fengler Avenue, also to
accept $86.93 without interest assess-
ed against the same lot for the im-
provement of Garfield Avenue, was,
on motion of Ald. Frith, referred to
the Committee of the Whole.
Petition of the Eagle Point Lime
Works, asking that they be granted
additional time until May 15th, 1909,
for the brick guttering of Alpine
Street, was, on motion of Ald.
O'Rourke, referred to the Committee
of the Whole.
Remonstrances of John Hale, John
Steadman and Charles Yates against
the levying of a special assessment
against the property for the improve-
ment of Grandview Avenue in front
of their property, were, on motion of
Ald. Saul, referred to the Committee
of the Whole.

invitation extended to the Mayor and
City Council to attend an informal
discussion of the commission plan of
government for cities, to be held at
the Dubuque club Monday evening,
December 7th, 1908, was, on motion

Ald. Frith again brought up the
Markey police matter and after Much
discussion Ald. Martin inquired of the
City Attorney what rights the Chief
of Police and the Fire Commissioners
had in this matter.
City Attorney Lyon stated that the
power to promote or reduce in posi-
tion of the police force lies within the
power of the Chief of Police and not
with the Commissioners, also that the
Commissioners have the right to re-
instate, but have no right to designate
the position.
Ald. O'Rourke moved that the City
dispense with all but one Night Police
Captain, and the Chief of Police be in-
structed to have only one Night Po-
lice Captain until case of Mr. Markey
has been settled. Carried.
City Recorder Linehan presented
and read the printed notice, certified
to by the publishers, of the Council's
intention to levy a special assessment
for the improvement of North Street
from Grandview Avenue to a point
about 546 feet west thereof by George
L. Korman, contractor. No remon-
strance being filed and no one in the
room objecting to the levying of
special assessment for the improve-
ment of said street, the notice was,
on motion, received and filed.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
Council's intention to levy a special
assessment for the construction of a
sanitary sewer in West Third Street,
College Avenue and Allison Place by
O'Farrell Contracting Co., contractors.
No remonstrance being filed and no
one in the room objecting to the levy-
ing of the special assessment for the
construction of said sewer, the notice
was, on motion, received and filed.
City Recorder Linehan also pre-
sented and read the printed notice,
certified to by the publisher, of the
Council's intention to levy a special
assessment for the improvement of
Locust Street from Sixth to Eighth
Streets by M. Tschirgi & Sons, con-
tractors. No remonstrance being filed
and no one in the room objecting to
the levying of the special assessment
for the improvement of said street,
the notice was, on motion, received,
and filed.

mittee on Ordinances, presented and
read an Ordinance giving the name of
Stines Street to the street dividing
Gmehle's Sub. from A. Stine's Sub.,
ir. the City of Dubuque, Iowa, and
moved that the reading just had be
considered its first reading. Carried.
Ald. Martin then moved that the
rules be suspended for the purpose of
reading the Ordinance by its title for
the second time.

AN ORDINANCE giving the name of
Stines Street to the street dividing
Gmehle's Sub. from A. Stine's Sub.
in the City of Dubuque, Iowa.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That the street dividing
Gmehle's Sub. from A. Stine's Sub.
in the City of Dubuque, Iowa, and
extending from the alley first east of
Stafford Avenue to the alley first west
of Althauser Avenue be and the same
is hereby named Stines Street.
Section 2. This Ordinance shall be
in force and take effect from and
after its passage by the City Council
and its publication one time in the
Dubuque Telegraph - Herald and
Times - Journal newspapers.
Adopted , 1908.

an Ordinance Regulating and Provid-
ing for an Additional Tax on the
Traffic in Intoxicating Liquors in the
City of Dubuque and moved that the
reading just had be considered its first
reading. Carried.
Ald. Martin moved that the rules
be suspended for the purpose of read-
ing the Ordinance for the second
time by its title.
Ald. Frith moved as an amendment
that the Ordinance be referred to the
Committee of the Whole. Amend-
ment carried.
Ald. Saul, chairman of the Commit-
tee on Streets, reported as follows:
Your Committee on Streets would
respectfully report that we have ex-
amined the improvement on the alley
first south of Hennepin Street from
Windsor Avenue to Stafford Avenue,
Wilmer Cook, contractor, and would
respectfully recommend that said
work be accepted and that the City
Engineer be instructed to prepare a
special assessment against the lots or
parcels of real estate subject to as-
sessment for such improvement and
file the same in the office of the City
Recorder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance.
Also your Committee on Streets
would respectfully report that we
have examined the curbing, gutter-
ing and macadamizing on Washing-
ton Street from Eighth Street to
Tenth Street, Wilmer Cook, contrac-
tor, and would recommend that said
work be accepted and that the City
Engineer be instructed to prepare a
special assessment against the lots or
parcels of real estate benefited by
such improvement and file the same
in the office of the City Recorder,
who will thereupon publish the notice
of said assessment as required by

Ald. Martin, chairman of the
Board of health, reported as follows:
To the Honorable Mayor and City
Council:
Gentlemen: —Your Board of Health
begs to report that owing to the prev-
alence of contagious and infectious
diseases in the City and rumor hav-
ing been current that parties having
the care of patients have neglected to
report the cases to the City Recorder
and have also failed to observe the
rules of the Board of Health in refer-
ence to the proper quarantine of such
cases, it was unanimously decided to
prosecute everyone violating the law
in regard to all infectious or conta-
gious diseases and that the proper no-
tice be published.
Also that all parties suffering with
small pox be urged and encouraged
to go to the Detention Hospital for
treatment. P. R. MARTIN,

Ald. Martin moved the adoption of
the report of the Board of Health.

Ald. Frith stated that rumor had
been current that the House Boat used
in connection with the Detention
Hospital had been stolen and moved
that the matter of the missing House
Boat for the Detention Hospital be
referred to the Chief of Police to re-
port back to the Council. Carried,
Ald. O'Rourke stated that some
talk had been made as to the condi-
tion of the Detention Hospital, that
same was in need of some repairs,
and moved that matter of putting the
Detention Hospital in shape be re-
ferred to Ald. Rand to make inquiries
and with power to have repairs made
if found necessary. Carried.
Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of the
Goosehorn Mining Co., asking that it
be granted permission to sink a min-
ing shaft on Bradley Avenue in
Grandview Park Addition, would re-
spectfully recommend that the prayer
of the petitioner be granted, provid-
ing said mining company file with the
City Recorder a bond approved by the
City Attorney for $5,0'00.00, condition-
al on holding the City harmless in
case any damage to person or prop-
erty should occur by reason of the
location of said shaft or the opera-
tion thereof and conditioned further
that said company will, when through
with same, properly arch and fill said
shaft to the entire satisfaction of the
Committee on Streets.
Also your Committee of the Whole,
reporting on the petition of F. B.
Lothrop, who claims that he has been
overassessed for the curbing and gut-
tering of Walnut Street, would re-
spectfully recommend that said peti -'
tion he referred to a special commit-
tee composed of the City Engineer,
the Street Commissioner and Alder-
man Rand.
Also your Committee of the Whole,
to whom was referred the petition of
the Germania Stock Co., by E. A.
Lungwitz, its president, asking that
the valuation on Germania Hall be
reduced as formerly, would respect-
fully recommend that the said prop-
erty, known as City Lot 209, be placed
at 86,000.00 for the year 1907, and
that the Treasurer be instructed ac-
cordingly.

Alderman O'Rourke offered the fol-
lowing:
Be It Resolved by the City Council
of the City of Dubuque:
That the taxes for the year 1908 for
the following purposes be levied as
provided by law on all taxable prop-
erty within the limits of said city the
respective number of mills on the
dollar of the assessed valuation of all
taxable property in said city as set
out below:
General Fund 6 2 -3 mills.
Fire Fund 2 mills.
Water Works Sinking
Fund 1 mill.
Water Works Interest 1 mill.
Library 1 -3 mill.
Be it Further Resolved, That for
the purpose of cleaning, sprinkling
and repairing the streets, a tax of
two (2) mills on the dollar on all the
taxable property therein be levied in
each of the road districts of the City
of Dubuque.

Alderman Singrin offered the fol-
lowing:
Whereas, former City Councils
have vacated conditionally and at dif-
ferent times all streets and alleys
from the railroad tracks east to the
river and between Twelfth and Thir-
teenth Streets, and
Whereas, The foregoing action,
especially as it referred to those
streets and alleys east of the alley be-
tween Cedar and Sycamore Streets
was rescinded and the vacation there-
of annulled by the City Council be-
cause of non - compliance with the con-
ditions imposed, and
Whereas, It has been stated that
the District Court has since vacated
the plat of that part of East Dubuque
Addition lying between the railroad
tracks and the river, thus nullifying
the action of the City Council, and
Whereas, No notice of said pro-
posed vacation had been served on the
City or opportunity given it to show
cause why such vacation should not
be made, and
Whereas, The time is fast arriving
when an outlet through said proper-
ty for better protection from fire will
be an absolute necessity as well as a
much - needed convenience to those
living in East Dubuque Addition and
employed in the lumber yard and
other industries south of Twelfth
Street, and
Whereas, The closing of the streets
and alleys in question must prove
detrimental to the development of all
property east of the tracks; therefore
Resolved by the City Council of
the City of Dubuque, That the City
Attorney be and he is hereby directed
to prepare an opinion showing the ex-
act present status of all streets and
alleys east of the railroad tracks to
the river from Twelfth to Thirteenth
Streets and also the alley between
Cedar and Sycamore Streets from
Thirteenth to Fourteenth Streets, and
stating what steps would be necessary
to take to have the action of the court
set aside and have at least some of
the streets and alleys opened for
public use.

Petition of Morris, Johnson, Brown
Mfg. Co., asking that they be granted
an exemption from taxation for an
additional five years, was, on motion
of Ald. Singrin, referred to the Com-

Petition of Thomas Connolly Est ,
asking that the Treasurer be instruct-
ed to accept the amount of the origin-
al assessment in full settlement of the
special tax assessed against City Lots
177 and 178 for the brick paving of
Iowa Street, was, on motion of Ald.
O'Rourke, referred to the Committee
of the Whole.
Petition of L. E. Elliott, asking that
the special assessment levied against
the S. 1 -3 of Lot 13 and the N. 1 -3 of
Lot 14 for the construction of a sani-
tary sewer in Allison Place be can-
celled, was, on motion of Ald.

of the Whole.
Ald. O'Rourke moved that the mat-
ter of the extension of sewer in Alli-
son Place for a distance of 170 feet
be referred to the City Attorney to re-
port back to the Council at its next

Petition of the Fifth Ward Non-
Partisan League, asking that the
Council issue an order compelling all
owners of property in the Fifth Ward
abutting on sanitary sewers to con-
nect their property with the sanitary
sewer, was, on motion of Ald. Haas,
referred to the Board of Health.
Petition of the Fifth Ward Non -
Partisan League, asking that the
Council enforce the Ordinance in re-
lation to the removal of snow and ice
from the sidewalks, was, on motion
of Ald. Frith, granted, and the Side-
walk Inspector to be instructed to en-
force the Ordinance.
Ald. Rand moved that the Sidewalk
Commissioner and Street Commission-
er be instructed to enforce the Ordi-
nance in relation to removal of snow
and ice and the Chief of Police as-
sist these officers by having police-
men report to hrm the places where
snow has not been cleaned off within
the time required by Ordinance. Car-
ried.
Petition of C. J. Kruse, asking that
the Treasurer be instructed to accept
$25.00 in full settlement of special
assessment levied against Lot 1 of Lot
59, Sanford's Sub., for the improve-
ment of Prince Street, was, on motion
of Ald. Frith, referred to the Com-
mittee of the Whole.
Communication from the Smedley
Steam Pump Co., asking that the
Council take some action on their bill
for $887.70 for goods furnished the
Water Works Department of the City
previous to March 1st, 1907, was, on
motion of Ald. Rand, referred. to the
Mayor and Finance Committee to con-
fer with Water Works Trustees on
matter of hill and to report to the
Council at their next meeting.
Petition of Mrs. J. E. Dunlavey,
asking that the Council adopt resolu-
tions for consent to sell and keep for
sale intoxicating liquors in the City of
Dubuque, was read and, on motion,
granted.
Whereupon the following resolution

Be It Resolved by the City Council
of the City of Dubuque: That con-
sent is hereby given Mrs. J. E. Dun -
lavey to sell and keep for sale intoxi-
cating liquors, and deal therein, in the
City of Dubuque, Iowa, as provided by
law. Adopted unanimously.
Petition of James H. Shields, ask-
ing that the City Engineer be instruct-
ed to establish permanent grade and
curb line of Sixth Street in the Du-
buque Harbor Improvement Com-
pany's Addition and determine the lo-
cation of such cross streets as are in-
cluded in the original plat of said Ad-
dition, also to fix and establish the
location of a permanent station at the
east end of Sixth Street, so that the
lots on said street may be determined
and designated by metes and bounds,
was, on motion of Ald. O'Rourke, re-
ferred to the Committee of the Whole.
Petition of Christ Braun, asking
that an electric arc lamp be placed at
the corner of Sixth Avenue and Lin-
coln Avenue, also that temporary side-
walk of cinders be ordered laid on the
south side of Sixth Avenue from
Rhomberg to Lincoln Avenues, was.
on motion of Ald. Haas, referred to
the Committee of the Whole.
REPORTS OF OFFICERS.
Mayor Sehunk reported that the
petition of the residents of West Du-
buque for an extension of the street
car line along Asbury Street had
been referred to him by the Commit-
tee of the Whole, with instructions to
interview the Union Electric Com-
pany on the subject. He reported to
have interviewed General Manager L.
D. Mathes relative to the extension of
the road as requested by the petition-
ers, and that he had been assured by
that gentleman that the desired ex-
tension would be made next summer.
On motion report was approved.

quest of H. Fitzgerald for grade on
Hodgdon Avenue at lots 3, 4 and 5,
Littleton and Sawyer's Addition, and
in compliance with your instructions
to look up grade on Hodgdon Avenue,
would say that said avenue has not
been opened, Lot 59 of Littleton and
Sawyer's Addition being school prop-
erty and is shown as being in the
name of James Herod, deed being
from Harriet Bonson to J. Herod,
January 21, 1892.
Under the circumstances no grade
can be given. Would say further that
should there be a grade established
at some future time, it would neces-
sarily be of such abruptness as to
make vehicle traffic almost impossi-
ble.

City Attorney Lyon reported as fol-

Gentlemen: The undersigned, who
was directed by your honorable body
to prepare an opinion showing the ex-
act present status of all streets and
alleys east of the railroad tracks, to
the river, from Twelfth to Thirteenth
Streets, and also the alley between
Cedar and Sycamore Streets from
Thirteenth to Fourteenth Streets, and
stating what steps it would be neces-
sary to take to have the action of
the court set aside and have at least
some of the, streets and alleys opened
for public use, respectfully reports as
follows:
I find that on April 8th, 1907, there
was filed in the office of the Clerk of
the District Court, a petition for va-
cation signed by the A. Y. McDonald
8T, Morrison Mfg. Co., asking that all
that part of the plat of East Dubuque
No. 2, including all of the lots de-
scribed in the petition, (the numbers
of which appear in the copy of the
decree hereto attached,) and also
those parts of Maple Street, Cedar
Street, Sycamore Street, Lynn Street
and Ash Street located between
Twelfth and Thirteenth Streets, and
the alleys located between Pine and
- Maple Streets and Twelfth and Thir-
teenth Streets, and Maple and Cedar
Streets and Twelfth and Thirteenth
Streets, and Cedar and Sycamore
Streets and Twelfth and Fourteenth
Streets and Sycamore and Lynn and
Twelfth and Thirteenth Streets and
Lynn and Ash Streets and Twelfth
and Thirteenth Streets, as the same
are included and located on the plat
of East Dubuque No. 2, be vacated
and the land comprising said lots,
streets anl' alleys be as though it had
never been platted into lots as East
Dubuque No. 2.
I further find that notice of the fil-
ing of said petition was posted in
three public places, and one at the
main door of the Court House of Du-
buque County on the 8th day of April,
1907. That on the 7th day of May.
1907, the District Court of said Coun-
ty fixed the time of the hearing of said
petition for the 17th day of May, 1907,
and that notice of said time of hear-
ing was given by a publication in the
morning edition of the Times - Journal
en the 9th day of May, 1907.
That on.the 17th day of May, 1907,
the time fixed in said notice of the
hearing of said petition, the City of
Dubuque appeared in said action
through its attorneys, J. W. Kintzing-
er and E. E. Bowen, and filed objec-
tions to the application for vacation.

That from time to time during the
course of the year 1907 various plead-
ings were filed in said action by the
City of Dubuque through its attor-
neys, Kintzinger and Bowen.
That there was a hearing to the
Court in said matter in which said
City was represented by the said at-
torneys and on the 23rd day of April,
1908, the said Court entered a decree
of vacation of said plat as prayed for
in said petition. a copy of which de-
cree I hereto attach and make a part
hereof.
In the decree above referred to the
Court finds that all proper notices re-
mitred in such proceedings for vaca-
tion have been posted and published
and that no persons other than the
City of Dubuque makes any objec-
tions to the said vacation, and that
no valid obj has been made to
said vacation, and that the streets and
alleys asked co be vacated were not
needed for public use or public high-
ways.
In effect the Court's decree holds
that all the preliminary steps requir-
ed by law have been taken. The de-
cree being entered and no appeal
therefrom having been taken by the
City within the time required by law,
in my judgment, the said vacation
becomes a finality and binding upon
the City and all others who may be
interested and I know of no steps
which the City could now take to have
the action of -,he Court set aside.
The decree hereto attached shows
the present status of the streets and
alleys referred to in your resolution.

Be it Resolved by the City Council of
the City of Dubuque:
Section 1. That a grade on Martha
Street in the City of Dubuque, Iowa,
be and the same is hereby established
and adopted as shown by the profile
of said street prepared by the City
Engineer and accepted by the City
Council on the 1st day of October,
1908, being No. 657, and marked

way Company from 29th Street north,

Whereas, Said ditch has no outlet
and consequently holds back the
water, permitting it to seep through
the ground and into the cellars of the
abutters; therefore
Resolved by the City Council of the
City of Dubuque, That the Street
Commissioner he and he is hereby
instructed to notify said railway com-
pany to make some provision for the
carrying off of said water, either by
filling the ditch or by constructing a
culvert under its right of way.

accompanying blue print, it be grant-
ed permission to cross Wall Street,
Cedar Street and Pine Street and also

AN ORDINANCE,
REGULATING AND PROVIDING
FOR AN ADDITIONAL TAX ON
THE TRAFFIC IN INTOXICATING
LIQUORS IN THE CITY OF DU-
BUQUE, IOWA.
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. That there shall be as-
sessed against every person, co -part-
nership, corporation or association
within the City of Dubuque, (other
than registered pharmacists ho' ding
Permits in compliance with law,) en-
gaged in selling and keeping with in-
tent to sell intoxicating liquors, and
against any real estate and the owners
thereof wherein or whereupon intoxi-
cating liquors are sold or kept with
intent to sell, a tax of One Hundred
and Twenty ($120.00) Dollars yearly,
payable in four equal installments.
quarterly, in advance, on the first
clay af January, April, July and Oc-
tober of each year, the first quarterly
payment hereunder to become due on
the first day of January, 1909. Said
taxes shall be assessed by the City
Council and shall go into the general
fund of the city, and such taxes shall
be a perpetual lien on all property,
both real and personal, used in con-
nection with such business, and shall
constitute a valid claim against the
persons engaged in such business and
against the owners of real estate
wherein or whereon said business is
conducted.
Sec. 2. It shall be the duty of the
City Assessor, in the months of De-
cember, March, June and September
of each year, to return to the City
Auditor a list of places wherein in-
toxicating liquors are sold or kept with
intent to sell, together with the name
of the occupants, tenants, owners or
agents of the property whereon such
business is conducted.
Sec. 3. Should the City Assessor for
any reason fail or refuse to perform
h is duty, as set forth in Section 2 of
this Ordinance, then and in that event
any three citizens of the city can pro-
cure the listt g of the names of the
J ersons engaged in the sale and keep-
ing with intent to sell intoxicating
liquors, together with description of'
the real estate whereon such business
is conducted, and the name of the
owner or owners thereof, in the same
manner as provided by law in cases of
Township Assessors failing or refusing
to report to the County Auditor.
Sec. 4. It shall be the duty of the
City Council and the officers of the
City of Dubuque to do ail things and
rerform all acts necessary to carrying
into effect the provisions of the laws
of the State of Iowa, in relation to
Persons engaged in selling and keep-
ing for sale intoxicating liquors.
Sec. 5. Whenever the Board of Su-
rervisors is mentioned in the laws of
the State of Iowa, in relation to per -
scns engaged in selling intoxicating
liquors, and acts amendatory thereto,
it shall be understood herein to mean
the City Council of the City of Du-
buque, and whenever the word
"county" appears, it shall be under-
stood to mean the City of Dubuque,
and whenever the words "county at-
torney" appear they sha'1 be under-
stood to mean the City Attorney.
Sec. 6. Taxes may be rebated in
such manner as the City Council may,
by resolution or otherwise, determine,
not in conflict with the laws of the
State of Iowa.
Sec. 7. All druggists in the city sell-
ing intoxicating liquors, except in
strict compliance with the provisions
of the pharmacy law of the State of
Iowa. and any real estate on which
such selling of intoxicating liquors, or
keeping with intent to sell same takes
place, and the owners of such real
estate, shag be the subject of assess-
ment by the City Assessor, as above
Provided, and they shall be subject to
all penalties and assessments provid-
ed for in this Ordinance.
Sec. 8. The failure on the part of
any person, partnership, corporation
or association, holding a - resolution of
consent, duly applied for and granted
in the manner as provided by the laws
of the State of Iowa to the sale of
intoxicating liquors in the city, to pav
the taxes provided by law quarterly
in advance, and to the city treasurer
the additional quarterly tax as herein
rovided, and file a dup icate receipt
for such payment with the city audi-
tor, shall work an immediate forfeit-
ure of the resolution of consent, and
of the further right of such persons or
Party to do business under the pro-
visions of this ordinance.
Sec. 9. The city shall have the right
to collect the special taxes hereinbe-
fore provided for, and shall have pow-
er to enforce the collection thereof in
the same manner it has to enforce the
collection of taxes for the general
revenue of the city, and shall have the
right to collect the same by distress

and sale of real estate and personal
property, at the same time and in the
same manner and with the same effect
and upon the same notice and by the
same officers, as for the collection of
taxes levied for the general revenues
of the city, and it shall have the right
to maintain actions in law for the re-
covery of such taxes in the manner
provided by the laws of the State of
Icwa in relation to intoxicating liquors
and all acts amendatory thereof.
Sec. 10. If any mulct tax is due on
any piece of property at the time of
advertising property for sale at the
general tax sale, then the Treasurer
shall advertise such property for sale,
and the same shall be sold at said tax
sale unless the said mulct tax is
sooner paid.
Sec. 11. This ordinance shall be in
force and effect from and after its
passage and publication in the Daily
Telegraph - Herald and Times - Journal
the official newspapers of the City of
Dubuque, Iowa.

RESOLUTIONS AND MOTIONS.
Alderman Saul offered the follow-
ing:
Whereas, By an ordinance, passed
by the City Council of the City of Du-
buque, on the 15th day of July, 1891,
that part of Camp Street lying and
extending easterly from Water Street
to the Levee, was vacated and annulled,
and S. D. Ryan, his heirs and assigns,
was permitted to fill, grade and use
that part of said street so vacated, in
connection with the meat packing
plant then in operation adjacent to
said street; and
Whereas, Said ordinance further
provides that the portion of said
street so vacated should revert to said
City whenever the use thereof was
discontinued for packing houses pur-
poses, and that said City should not
be required or expected to compen-
sate said S. D. Ryan, his heirs or as-
signs, for any filling or other im-
provement made by him on said
street so vacated; and
Whereas, said plant used by said
Ryan for packing house purposes has
not been in operation or used for meat
packing'purposes for more than seven
years last past, and by reason of said
discontinuance of said meat packing
business as aforesaid, all rights grant-
ed to said Ryan under said ordinance
have reverted to the City.
Therefore, Be it Resolved by the
City Council of the City of Dubuque,
That all rights granted to said S. D.
Ryan under said ordinance afore-
said, because of the discontinuance of
the business, for the convenience of
which said ordinance was passed, are
hereby revoked, cancelled and an-
nulled, and said street heretofore va-
cated as aforesaid, is hereby declared
to be a part of the public streets of
said City, and open for travel and use
by the residents of said City and the
public generally.

That said Iowa Oil Company be and
is hereby granted the privilege of
using that part of Camp Street lying
easterly from Water Street to the
Levee in connection with its business
during the pleasure of the City Coun-
cil of the City of Dubuque, and that
all rights hereby granted to said Iowa
Oil Company may at any time be re-
voked by said Council upon giving
thirty days notice to said Iowa Oil
Company.

Therefore be it resolved by the City
Council of the City of Dubuque:
That the City Engineer be and he
is hereby directed to prepare a plat
showing generally the location, na-
ture and extent of the proposed im-
provement on the south side of Twen-
ty- seventh Street between Jackson
and White Streets, and in front of
and abutting lot 213, Davis Farm
Add., and the kind of material to be
used, and an estimate of the entire
cost thereof and the amount and cost
of such improvement, and the amount
and cost thereof, to be paid by the
city, if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to or abutting
upon such improvement per front
foot, and to file such plat and esti-
mate in the office of the City Recor-
der; that after the filing of said plat
and estimate in his office, the City Re-
corder shall notify said abutting and
adjacent property owners, as pro-
vided by ordinance, that such plat and
estimate are on file, the location and
nature of the improvement, kind of
material to be used, and an estimate
of its cost, and the time before which
objections thereto can be filed, and
the time fixed for hearing, which
time shall not be less than five (5)
days after the service of such notice,
and after such service shall have been
made, the City Recorder shall, at tha
next regular session of the City Coun-
cil, notify the Council thereof in writ-
ing, with a copy of such notice ac-
companying the same.

Railway Company, that several of the
locomotives of said company are not
provided with spark arresters, and
Whereas, During the dry season of
the year several houses have been set
afire by sparks alighting thereon, any
one of which might have resulted in
a disastrous conflagration had it not
been noticed in time, and
Whereas, The noise occasioned by
the blowing of the whistles on said
locomotives is also a cause of com-
plaint from said residents as the same
has become an unbearable nuisance;
therefore
Be it Resolved by the City Council
of the City of Dubuque, That the
City Attorney be and he is hereby in-
structed to take immediate steps to
compel said railroad company to have
spark arresters placed on all its en-
gines operating within the limits of

torney prosecute both the Chicago,
Milwaukee & St. Paul Railroad Com-

teenth Street railroad crossings at

Mayor Schunk stated that accord-
ing to the agreement made with the
Aldermen he had made arrangement
with the City Assessor and his depu-
ty to complete the work of getting out
the tax books, they to be paid one
extra month's salary for extra time
needed for the completion of the
work, and asked that his action be
approved.
On motion of Ald. Frith the action
of the Mayor was approved.

Mayor Schunk stated the meeting
was a Special Session of the Council
and was called to take up and con-
sider the following matters:
The matter of cleaning storm sew-
er in Kaufman Avenue.
Bids for veterinary services for the
horses of the various departments of
the city for the ensuing year.
For the purpose of having Assessor-
Elect sworn in.
To confirm the Assessor's ap-
pointees.
To levy the saloon tax.
To consider the petitions of various
retail liquor merchants, asking that
the Council adopt resolutions grant-
ing them consent to sell and keep for
sale intoxicating liquors in the city of
Dubuque and to adopt the resolutions
of consent to these retail liquor mer-
chants.
Mayor Schunk then administered
the oath of office to Assessor -Elect
Kelly.
Ald. Frith moved that the Street
Commissioner be instructed to notify,
the sewer men to clean out the storm
sewer in Kaufman Avenue. Carried.
Ald. O'Rourke moved that the
Council reconsider their action in in-
structing the Street Commissioner to
have sewer men clean out the Kauf-
man Avenue storm water sewer. Car-
ried.
Ald. O'Rourke moved that the
Street Commissioner be instructed to
inspect the storm water sewer in
Kaufman Avenue, estimate the cost
of doing the work and proceed with
the work of cleaning out the sewer
and report to the Council at the next
meeting. Carried.
Bids for doing the veterinary work
on the various horses of the different
departments of the City for the en-
suing year were presented and on mo-
tion of Ald. Frith were ordered open-
ed as follows:

On motion of Ald. Saul contract for
veterinary services for the ensuing

City Assessor - Elect, asking that the
Council approve his appointment of
Allan Wiedner and Frank Kenneally
as his deputies in the City Assessor's
office, was read, and, on motion of
Ald. O'Rourke, appointments were

Mayor Schunk stated that the meet-
ing was a Special Session called for
the purpose of considering the peti-
tions for consent to sell and also to
manufacture spirituous, malt and
vinous liquors, in the City of Dubuque,
Iowa.
City Recorder Linehan then pre-
sented statement showing that the
Board of Supervisors had canvassed
the vote on the statements of con-
sent to manufacture spirituous, malt
and vinous liquors.
Whereupon Ald. Frith offered the
following:
Whereas it appears by the official
proceedings of the Board of Super-
visors of Dubuqut County, Iowa, that
there has been filed with the County
Auditor of Dubuque County, Iowa,
written statements of consent to the
sale of intoxicating liquors in the City
of Dubuque, which said statements of
consent, after canvass by the Board
of Supervisors of Dubuque County,
have been found to contain the sig-
natures of eighty -eight per cent of
the legal voters of said City of Du-
buque, voting at the last General
Election in November, 1908, and said
Board of Supervisors found said state-
ments sufficient and by proper resolu-
tion authorized the sale of intoxicat-
ing liquors under the provisions of
law, within the limits of the City of
Dubuque.
And whereas there has been filed
with the City Recorder and presented
to the City Council of the City of Du-
buque for action, a written statement
of consent to the manufacture of
spirituous, malt and vinous liquors for
sale at wholesale within the limits of
the City of Dubuque, and such writ-
ten statements of consent are found
by said City Council of the City of
Dubuque to have been signed by more
than fifty per cent of the legal voters
of the City of Dubuque, voting there-
in at the last preceding General Elec-
tion, in November, 1908, and it fur-
ther appearing that the filing of said
statements of general consent was
timely and in compliance with law.
Be It Resolved by the City Coun-
cil of the City of Dubuque, That we
find said written statements of con-
sent for the Manufacture within the
limits of the City of Dubuque of spir-
ituous, malt and vinons liquors for
safe sufficient, and we de hereby grant
consent to indtvidtials, co- partnerships

p. m. Thursday, December 3rd, 1908,
for the use of the Ice Harbor for skat-
ing rink purposes for the season of
1908 -1909.
The rink to be managed under the
control of the police department.
A certified check in the sum of
$25.00 on some Dubuque bank must
accompany each bid as a guarantee
that a contract will be entered into if
awarded.
The city reserves the right to reject

NOTICE TO HAY AND GRAIN
DEALERS.
Sealed proposals will be received at
the City Recorder's office up to 8:00
o'clock p. m. December 3rd, 1908, to
furnish the Fire, Police and Street De-
partments of the City of Dubuque
with good number one white oats and
about 10 or 15 carloads of choice up-
land or timothy baled hay and num-
ber one loose timothy hay for the
term of one year from December lst,
190S.
Such oats and hay to he delivered in
such quantities and at such places as
may be ordered by the city from time
to time. All hay and oats to be
weighed on the city scales and deliv-

Notice to Physicians, Osteopaths,
Nurses and the General Public.
You are hereby notified that under
the rules of the State Board of Health,
you are required to give immediate
notice to the Mayor or the City Re-
corder of every recognized case of
contagious or infectious disease, and
within 12 hours after having made a
diagnosis, file written notice of the
same with either of the above named
officials.
Failure on the part of any Physi-
cian, Osteopath or Nurse to properly
report cases of infectious or contag-
ious diseases or to conform to the
quarantine requirements will render
the offender liable to suspension or
revocation of their certificate by the
State Board of Medical Examiners.
Heads of families and persons in
charge of premises occupied by pa-
tients failing or neglecting to comply
with the foregoing will be subject to
a fine of $100 or be imprisoned in the
city jail for a period of thirty days.

Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That the street dividing
Gmehle's Sub. from A. Stine's Sub. in
the City of Dubuque, Iowa, and ex-
tending from the alley first east of
Stafford avenue to the alley first west
of Althauser avenue be and the same
is hereby named Stines street.
Section 2. This ordinance shall be
in force and take effect from and after
its passage by the City Council and its
publication one time in the Dubuque
Telegraph - Herald and Times - Journal

BUQUE, IOWA.
Be It Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. That there shall be as-
sessed ' against every person, co -part-
nership, corporation or association
within the City of Dubuque, (other
than registered pharmacists holding
hermits in . compliance with law,) en-
gaged in selling and keeping with in-

tent to sell intoxicating liquors, and
against any real estate and the owners
thereof wherein or whereupon intoxi-
cating liquors are sold or kept with
intent to sell, a tax of One Hundred
and Twenty ($120.00) Dollars yearly,
Payable in four equal installments.
quarterly, in advance, on the first
day of January, April, July and Oc-
tober of each ' year, the first quarterly
payment hereunder to become due on
the first day of January, 1909. said
taxes shall be assessed by the City
Council and shall go into the general
fund of the city, and such taxes shall
be a perpetual lien on all property,
both real and personal, used in con-
nection with such business, and shall
constitute a valid claim against the
persons engaged in such business and
against the owners of real estate
v or whereon said business is
conducted.
Sec. 2. It shall be the duty of the
City Assessor, in the months of De-
cember, March, June and September
of each year, to return to the City
Auditor a list of places wherein in-
toxicating liquors are sold or kept with
intent to sell, together with the name
of the occupants, tenants, owners or
agents of the property whereon such
business is conducted.
Sec. 3. Should the City Assessor for
any reason fail or refuse to perform
his duty, as set forth in Section 2 of
this. Ordinance, then and in that event
any three citizens of the city can pro-
cure the listing of the names of the
rersons engaged in the sale and keep-
ing with intent to sell intoxicating
liquors, together with description of
the real estate whereon such business
is conducted, and the name of the
owner or owners thereof, in the same
manner as provided by law in cases of
Township Assessors failing or refusing
*o report to the County Auditor.
Sec. 4. It shall be the duty of the
City Council and the officers or the
City of Dubuque to do ail things and
rerform all acts necessary to carrying
into effect the provisions of the laws
of the State of Iowa, in relation to
persons engaged in selling and keep-
ing for sale intoxicating liquors.
Sec. 5. Whenever the Board of Su-
rervisors is mentioned in the laws of
the State of Iowa, in relation to - per-
sons engaged in selling intoxicating
liquors, and acts amendatory thereto,
it shall he understood herein to mean
the City Council of the City of Du-
buque, and whenever the word
"county" appears, it shall be under-
stood to mean the City of Dubuque,
and whenever the words "county at-
torney" appear they shall be under-
stood' to mean the City Attorney.
Sec. 6. Taxes may be rebated in
such manner as the City Council may,
by resolution or otherwise, determine,

not in conflict with the laws of the
State of Iowa.
Sec. 7. All druggists in the city sell-
ing intoxicating liquors, except in
strict compliance with the provisions
of the pharmacy law of the State of
Iowa. and any real estate on which
such selling of intoxicating liquors, or
keeping with intent to sell same takes
place, and the owners of such real
estate, shall be the subject of assess -
rnent by the City Assessor, as above
provided, and they shall be subject to
all penalties and assessments provid-
ed for in this Ordinance.
Sec. 8. The failure on the part of
any person, partnership, corporation
or association, holding a resolution of
consent, duly applied for and grante 1
in the manner as provided by the laws
of the State of Iowa to the sale of
intoxicating liquors in the city, to pay
the taxes provided by law quarterly
in advance, and to the city treasurer
the additional quarterly tax as herein
provided, and file a duplicate receipt
for such payment with the city audi-
tor, shall work an immediate forfeit-
ure of the resolution of consent, and
of the further right of such persons or
party to do business under the pro-
visions of this ordinance.
Sec. 9. The city shall have the right
to collect the special taxes hereinb?-
fore provided for, and shall have pow-
er to enforce the collection thereof in
the same manner it has to enforce the
collection of taxes for the general
revenue of the city, and shall have the
right to collect the same by distre's
and sale of real estate and personal
property, at the same time and in the
same manner and with the same effect
and upon the same notice and by the
same officers, as for the collection of
taxes levied for the general revenues
of the city, and it shall have the right
to maintain actions in law for the re-
covery of such taxes in the manner
provided by the laws of the State of
Iewa in relation to intoxicating liquors
and all acts amendatory thereof.
Sec. 10. If any mulct tax is due on
any piece of property at the time of
advertising property for sale at the
general tax sale, then the Treasurer
shall advertise such property for sale,
and the same shall be sold at said tax
sale unless the said mulct tax is
sooner paid.
Sec. 11. This ordinance shall be in
force and effect from and after its
passage and publication in the Daily
Telegraph - Herald and Times - Journal
the official newspapers of the City of
Dubuque, Iowa.

AN ORDINANCE establishing grades
on Martha Street and on the alley
first west of Alta Vista Street from
Martha - Street to West Fourteenth
Street, in the City of Dubuque,
Iowa.
Be it Resolved by the City Council of
the City of Dubuque:
Section 1. That a grade on Martha
Street in the City of Dubuque, Iowa,
be and the same is hereby established
and adopted as shown by the profile
of said street prepared by the City
Engineer and accepted by the City
Council on the 1st day of October,
1908, being No. 657, and marked
"Profile showing grade of Martha
Street and of alley from Martha
Street to West Fourteenth Street, b.
m's. foundation of brick house No.
164 Alta Vista Street, elev. 291.82."
Said grade beginning at the west lot
line of Alta Vista Street, which is sta-
tion 0, elevation 289.40; thence to sta-
tion 1, elevation 286.40; thence to
station 1-87, elevation 279.00; thence
to station 3+93, west end of Martha
Street, elevation 267.50.
Section 2. That a grade on the al-
ley first west of Alta Vista Street from
Martha Street to West Fourteenth
Street be and the same is hereby es-
tablished and adopted as shown by the
profile of said alley prepared by the
City Engineer and described in Sec-
tion 1 hereof. Said grade beginning
at the north line of Martha Street,
which is station 0, elevation 279.00;
thence to station 1+61.50, elevation
281.00; thence to station 3+43, south
line of West Fourteenth Street, eleva-
tion 275.50.
Section 3. This Ordinance to be in
force and take effect from and after
its passage by the City Council and
its publication one time in the Du-
buque Telegraph- Herald and Times -
Journal newspapers.

Notice to Veterinarians.
Sealed proposals will be received at
the office of the City Recorder up to
8:00 o'clock Tuesday evening, Decem-
ber 29th, 1908, for doing the veterin-
ary work and furnishing the medi-
cines for the horses of the Fire, Police
and Street departments, and for all
horses owned by the city, for the
term of one year, commencing Jan-
uary 1st, 1909. Bidders must state
the price per horse per month for do-
ing such work and furnishing all
medicine. The city reserves the right
to reject any and all bids.

Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
regular session of the City Council to
be held January 7th, 1909, to pay for
the improvement of the alley first
north of Ries Street from Windsor
Avenue to Stafford Avenue, by Wilmer
Cook, contractor.
Amount of special assessment,
$362.28, same to be assessed against
the abutting property upon and along
said street.
And that there is a plat and sched-
ule on file in the office of the City Re-
corder of said City of Dubuque, show-
ing the alley on which said improve-
ment was made, and the separate lots
and parcels of ground or specified
portions thereof subject to assessment
of such improvement, the name of the
owner thereof, as far as practicable,
and the amount to be assessed against
each lot or parcel of ground, which
plat and schedule are subject to pub-
lic inspection.
And that any and all persons ob-
jecting to said special assessment or
to said plat must file his or their ob-
jection in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil to be held January 7th, 1909, or
to appear at said session of the Coun-
cil to show cause, if any you have,
why said assessment should not be
levied.
