Flora Pool and Sutton Pool Water Playground Project
Sealed bids were received to construct water playgrounds at Flora and Sutton Pools.
Leisure Services Manager Gil Spence is recommending award to the Iow bidder,
Portzen Construction, in the amount of $725,021. Considering the previous expenses
related to design fees, this results in the project being over budget by $141,330. Gil
Spence has been able to identity other Leisure Services projects that came in under
budget or that could be delayed to a future date to cover this extra expense.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Flora Pool and Sutton Pool Water Playground Project
INTRODUCTION
The purpose of this memorandum is to provide a recommendation on awarding the
contract for constructing water playgrounds at Flora and Sutton Pools.
DISCUSSION
Sealed bids were received on June 5, 2001, to construct water playgrounds at Flora and
Sutton Pools. A summary of the bids received is as follows:

The FY 2001 C.I.P.-budget contains $262,500 and the FY 2002 C.I.P. budget contains
$439,000 ($701,500 total) for this project, design and engineering. Portzen's base bid plus
Alternate 2, 3 and 4 results in a total bid of $725,021. Adding design fees ($117,810) to the
Iow bid ($725,021), total project cost is $842,830. This results in the project being
$141,330 over budget. Design fees are $48,810 over the budgeted amount and
construction costs are $92,521 over the budgeted amounts.
Alternate 4 - SCS equipment is the interactive equipment shown in the video dudng budget
presentations. Alternate 5 - Com-pac equipment would be substitute for the SCS equip-
water playgrounds, page two
ment and is not interactive. We included this alternate for a cost comparison and do not
feel the savings are worth the change to non-interactive equipment.
This is an important project that the citizens are looking forward to and one we very much
would like to see move forward. To help make up the cost overrun, we propose using
savings from the following pool projects where savings have resulted or where the project
can be re-budgeted for a later date without a significant impact to the operation.

The balance of the shortfall of $24,130 will be covered from savings in park division capital
projects, including painting Town Clock light standards, renovating park office and
McAleece storm sewers.
RECOMMENDATION
I recommend that the contract be awarded to Portzen Construction in the amount of
$725,021.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions approving the
plans and specifications and awarding the contract to Portzen Construction in the amount
of $725,021.

RESOLUTION ADOPTING PLANS AND SPECIFICATIONS
WHEREAS, on the 7th day of May, 2001, plans, specifications, form of contract and
estimated cost were filed with the City Clerk of Dubuque, Iowa for the FLORA AND
SUTTON POOLS WATER PLAYGROUND CONSTRUCTION PROJECT.
WHEREAS, notice of hearing on plans, specifications, form of contract, and
estimated cost was published as required by law.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the said plans, specifications, form of contract and estimated cost are hereby
approved as the plans, specifications, form of contract and estimated cost for said
improvements for said project.

RESOLUTION NO.
AWARDING CONTRACT
WHEREAS, sealed proposals have been submitted by contractors for the FLORA
AND SUTTON POOLS WATER PLAYGROUNDS CONSTRUCTION PROJECT pursuant
to Resolution No. 184-01, and notice to bidders published in a newspaper published in the
City of Dubuque, Iowa, on the 11th day of May, 2001.
WHEREAS, said sealed proposals were opened and read on the 5t~ day of June,
2001, and it has been determined that the bid of PORTZEN CONSTRUCTION, in the
amount of $725,021.00 was the lowest bid for the furnishings of all labor and materials and
performing the work as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
That the contract for the above improvement be awarded to PORTZEN
CONSTRUCTION, and the Manager be and is hereby directed to execute a contract on
behalf of the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's bond, the
City Treasurer is authorized and instructed to return the bid deposits of the unsuccessful
bidders.

cost for the SUTTON POOL AND FLORA POOL WATER PLAYGROUNDS
CONSTRUCTION PROJECT, in accordance with the provisions of Chapter 384, City
Code of Iowa, at 6:30 p.m. on the 18th day of June, 2001, in the Public Library
Auditorium in Dubuque, Iowa. Said proposed plans, specifications, form of contract and
estimate of cost are now on file in the office of the City Clerk. At said hearing any
interested person may appear and file objections thereto or to the cost of the
