This Project Statement would be entered into under the existing Master Co-location and Shared Services Agreement in place between the City of Dubuque and Dubuque County. There is no negative budgetary impact to the City as this Project Statement sets aside County funds that the City can use when it has costs associated with this Project Statement. In return, the County would be receiving fiber capacity at costs far below any other option available to it. This Project Statement would be entered into under the existing Master Co-location and Shared Services Agreement in place between the City of Dubuque and Dubuque County. BACKGROUND In 2016 the City of Dubuque undertook its Broadband Acceleration Initiative. The Initiative focuses on public/private collaborations and includes a comprehensive strategy to reduce the cost and time required for broadband expansions in Dubuque. One effort within that strategy is the use of"Master Agreements", where an overall legal, structural and financial relationship is established between the City and broadband providers or partners and approved by City Council. Project Statements carried out pursuant to that Master Agreement can then be quickly considered and approved. In 2021 City of Dubuque and Dubuque County entered into a Master Co-location and Shared Services Agreement to accelerate the deployment of new broadband capacity to improve public services throughout the region. The City and County have entered into multiple projects under this Master Agreement, including a major collaboration to provide improved connectivity from the County Courthouse to the new County data and 911 center at the Bright Minds Campus. The success of that project led County and City to explore the ability to tie that project into a larger route that could directly connect more County facilities in a redundant "loop". The City has excess fiber on this route with the exception of the SW Arterial, which is under planning/construction now. County has requested that City consider integrating into its network a set of dedicated fibers that would run from the County data and 911 center south and across the SW Arterial and then up the Highway 151/61 route to enter the County Courthouse on the south side. Page 548 of 2490 County would contribute $150,000 to the costs of completing this route in order to make it economically feasible for the City to provide the requested service. Budget Impact There is no negative budgetary impact to the City as this Project Statement sets aside County funds that the City can use when it has costs associated with this Project Statement. In return, the County would be receiving fiber capacity at costs far below any other option available to it. RECOMMENDATION This Project Statement with the County supports the City's broadband acceleration initiative, reduces overall costs to City and County taxpayers and improves the safety and security of multiple county facilities. Crenna Brumwell, City Attorney Barry Lindahl, Senior Counsel Jim Bousley, Engineering 2 Page 549 of 2490 RESOLUTION NO. -25 A RESOLUTION APPROVING A PROJECT STATEMENT UNDER THE MASTER CO- LOCATIONS AND SHARED SERVICES AGREEMENT BETWEEN THE CITY OF DUBUQUE AND DUBUQUE COUNTY WHEREAS, the City of Dubuque, lowa ("City") and Dubuque County, lowa ("County") entered into a Master Co-locations and Shared Services Agreement dated May 10, 2021 ("Master Agreement") to support collaboration in the use of broadband infrastructure and shared services; and WHEREAS, pursuant to the terms of the Master Agreement, the City and County have prepared and mutually agreed to a new Project Statement, attached hereto as Exhibit A, titled "PROJECT STATEMENT FOR CO-LOCATION AND SERVICE SHARING," which outlines the County's use of specific segments of unused City fiber optic infrastructure to enhance and support broadband communication services for County facilities; and WHEREAS, the Project Statement provides for the County's access to approximately 81,840 linear feet of 12-strand fiber optic cable from the County 911 and Data Center on Chavenelle Road to the Dubuque County Courthouse, and includes the terms under which County shall pay a one-time fee of$150,000 to the City to offset fiber loop completion costs; and WHEREAS, the Project Statement also includes provisions for expansion, future County facility connections, and cost-sharing for repair or relocation of the fiber, in accordance with Section 2.7 of the Master Agreement; and WHEREAS, the City Council finds that this Project Statement supports the shared goal of providing robust and redundant broadband access to public facilities, promotes intergovernmental cooperation, and enhances community infrastructure; 3 Page 550 of 2490 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: 1. The Project Statement under the Master Co-locations and Shared Services Agreement between the City of Dubuque and Dubuque County, as outlined in Exhibit A, is hereby approved. 2. The City Manager is hereby authorized to execute the Project Statement and take such further actions as may be necessary to implement the terms of the agreement. 3. This Resolution shall be in full force and effect upon its passage and approval. 4 Page 551 of 2490 PROJECT STATEMENT FOR MASTER CO-LOCATIONS AND SHARED SERVICES AGREEMENT BETWEEN THE CITY OF DUBUQUE AND DUBUQUE COUNTY Pursuant to the Master Co-locations and Shared Services Agreement between the City of Dubuque (City) and Dubuque County (County) dated May 10, 2021, the Parties hereby agree to the following PROJECT STATEMENT: PROJECT STATEMENT CO-LOCATION AND SERVICE SHARING: City will license to County access to and use of certain presently unused fiber, shown on Exhibit A attached hereto, for purposes of County providing broadband communication services and support to County facilities. CO-LOCATION OR SERVICE SITE: The co-location and/or service site for this PROJECT STATEMENT is generally described below and shown on Exhibit A: City will provide approximately 81,840 linear feet of 12 strand (6 pair) of fiber optic cable running from: - County 911 and Data Center located at 7900 Chavenelle Road to the NW corner of the intersection of Seippel Road and SW Arterial, approximately 14,256 linear feet. - From the NW corner of the intersection of Seippel Road and SW Arterial Dubuque to the NE corner of intersection of SW Arterial and Elmwood Drive, approximately 43,296 linear feet. - From the NE corner of intersection of SW Arterial and Elmwood Drive to County Courthouse, approximately 24,288 linear feet. Costs associated with County connecting to the provided fiber shall be paid for by County. As City fiber capacity is expanded and County's needs identified, if excess capacity is available, County may request up to an additional 6 pair/12pair strands under this PROJECT STATEMENT. Page 552 of 2490 When County connects to City fiber loop to service existing or future County facilities, County shall be responsible for all costs relating to that connection. City and County agree that robust and redundant fiber access to County facilities is the ultimate goal and is mutually beneficial to the Parties. City and County will continue to explore the most cost-effective means to achieve that objective. City and County agree to work collaboratively to identify and share repair or relocation costs as contemplated under Section 2.7 of the Master Shared Services Agreement. CHARGES AND PAYMENT TERMS: This PROJECT STATEMENT is a joint collaboration of City and County to provide enhanced, and in the future, redundant fiber capacity for County facilities. County shall pay City a one-time fee of $150,000 to be used by City to off-set costs relating to completing the fiber loop contemplated under this PROJECT STATEMENT. TERM OF PROJECT: City will provide County an indefeasible right of use (IRU) to the fiber outlined within this PROJECT STATEMENT. Should City discontinue its use and maintenance of the fiber, City will provide County the opportunity to assume ownership and control of the fiber.
