The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report, and related materials are attached for your review.
Discussion
Terry Koelker, Buesing & Associates, 1212 Locust Street, spoke on behalf of the property
owners, Carl & Mary Summers. He stated they are seeking to replat three lots to relocate
two existing accessory structures onto one lot, 65 Meadow Lane.
The Commission asked if the properties are under common ownership, and Mr. Koelker
replied yes.
Staff detailed the staff report, noting the submitted Final Plat of Summers Place
subdivides three properties at the end of Meadow Lane, which are under common
ownership. Staff explained that the Zoning Board of Adjustment recently approved the
Special Exception to allow more than 1,000 square feet of detached accessory structures
on one lot. Staff noted the three properties affected by the plat are otherwise compliant
with the zoning district bulk regulations. Staff explained that 49 Meadow Lane will have
shared access to its driveway across the driveway for 65 Meadow Lane.
The Commission asked whether the newly created lot at 65 Meadow Lane would meet
the maximum lot coverage requirement, and staff replied yes.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the Final Plat of Summers Place.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The proposed Final Plat of Summers Place affects three properties located at the end of
Meadow Lane. The properties include 45, 49, and 65 Meadow Lane, which are all
currently under common ownership. The proposed plat would reconfigure the existing lots
into three new lots.
Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified
as a Minor Subdivision'. All Minor Subdivisions require review by the Zoning Advisory
Commission.
The Final Plat of Summers Place proposes to subdivide three existing lots by allocating
portions of the properties at 45 and 49 Meadow Lane to the property at 65 Meadow Lane.
The portions of the two lots that are being allocated to 65 Meadow Lane contain existing
accessory structures. The following is a description of the proposed subdivision lots:
■ Lot 1 would be the remaining portion of 45 Meadow Lane.
■ Lot 2 would be the remaining portion of 49 Meadow Lane.
■ Lot 3 would consist of the existing property at 65 Meadow Lane and the reallocated
portions of 45 and 49 Meadow Lane.
All three lots would maintain their existing street frontage. An access easement is
proposed across portions of Lot 3 (65 Meadow Lane) for the benefit of Lot 2 (49 Meadow
Lane) to have continued access to an existing garage and parking pad.
Images of the existing and proposed lot configurations are
provided on the following page.
UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed and which does not require the construction of any
public improvements, and which creates three (3) or more lots."

The UDC categorizes the proposed plat as a Minor Subdivision. Pursuant to UDC Chapter
11, the Zoning Advisory Commission and City Council are the reviewing authorities for
Minor Subdivisions and for subdivisions which require a waiver of bulk regulations. The
Zoning Advisory Commission shall review the plat to determine whether it is in substantial
conformance with the Unified Development Code.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Summers Place and recommends approval of the subdivision plat as submitted.

A RESOLUTION APPROVING THE FINAL PLAT OF 65 MEADOW LANE SUMMERS
PLACE, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of 65 Meadow Lane
Summers Place in the City of Dubuque, Iowa; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Final Plat of 65 Meadow Lane, in the City of Dubuque, Iowa is
hereby approved, and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
