The Parks and Recreation Advisory Commission reviewed the plan at their recent meeting and unanimously recommend City Council approval of the plan. The naming of the park will be submitted to the City Council after the Commission has engaged the public into the process over the next month. The FY 26 capital improvement budget contains $200,000 as required by the Development Agreement. The funding is sales tax 20% for the construction. The funding will be reimbursed by the South Pointe Housing Renewal Area TIF. I concur with the recommendation and respectfully request Mayor and City Council approval. k�4 Mic ael C. Ware, Parks and Recreation Director SUBJECT: South Pointe Subdivision Park Plan for Approval DATE: June 10, 2025 INTRODUCTION Dubuque AII•Amanu Clq nniaMw.wx: uxzr 2007-2012.2013 2017*2019 The purpose of this memo is to request City Council approval of the South Pointe subdivision park plan provided by Dubuque South Pointe, L.L.C. 1110]:loll] LI I lr� The City Council on June 17, 2024 entered into a First Amendment to Development Agreement by and between the City of Dubuque, Iowa and South Pointe, L.L.C. The First Amendment contained Section 2.1.1-1 that outlines if the developer opts to construct the park a process for the development, construction, and reimbursement of up to $200,000 for creation of the park. Lot J of the South Pointe #2 subdivision is set aside for the park. DISCUSSION South Pointe, L.L.C. submitted plans to the city's Design Review Team. Parks and Recreation representatives reviewed the plans for compliance with the details in Section 2.1.1-1. of the First Amendment to the Development Agreement. The park site plan attached is in compliance with the requirements in Section 2.1.1-1. The park site plan is attached, and the last two pages show the playground that will be a part of the park. The agreement outlines the Developer must maintain general liability insurance on the park lot and appurtenances as well as property coverage on the playground equipment until the park is accepted by City. Proof of insurance shall be submitted to the City. The Developer shall submit to the City Clerk securities (form of Letter of Credit or Bond) in the amount of 110% of the total park project cost estimate. After the two (2) year bonding period, the park lot, infrastructure, and appurtenances shall be dedicated to the City. The acceptance of the park is subject to City Council review and approval. Page 745 of 1053 The developer has indicated their timeframe for completion of construction of the park is this fall.
