As you know PFAS has been an ongoing issue for our organization and many others.
Litigation on this matter continues against a number of defendants.
The City has retained the Baron & Budd law firm as outside counsel related to PFAS
litigation. The City of Dubuque participated in MDL (multi -district litigation) affiliated with
public water provider bellwether cases in South Carolina against 3M.
The case against 3M has settled for an amount not less that $10,500,000,000 and not
more than $12,500,000,000. A claims administrator was charged with overseeing the
allocation of the settlement funds.
Settlement awards are based on a formula tied to PFAS testing and results to fairly and
equitably allocate the settlement amount to the qualifying class members. The 3M
settlement amounts will be received over a period of years. 65% of the settlement
amount will be paid in 2025. 35% will be paid over the remaining years. The net
payment is currently estimated at $3,387,026.89. This amount could increase slightly
as the claims administrator is holding a certain percentage of the settlement back as a
precaution and there will also be interest distributed at a later date.
Actions against other PFAS manufacturers remain outstanding and it is possible
additional litigation will be pursued, so the City of Dubuque can expect additional funds
in the future.
