Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, stating that he is also requesting annexation to the city of Dubuque to allow the proposed subdivision to tie into City water and sewer. Mr. Stewart indicated that the five-lot subdivision will, in part, be marketed to people who wish to keep a horse on their residential property. Staff reviewed the request, indicating that City water is available to the property, but the sanitary sewer is approximately one mile away. The Engineering Division has indicated that homeowners would have 15 years to hook up to sanitary sewer service once they have installed an approved septic system. The Zoning Advisory Commission noted that the proposed subdivision will have a new public street and will have a capped sanitary sewer system with necessary easements provided within the subdivision. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, allowing for installation of private septic systems and a capped sanitary sewer system with the necessary easements for future connection to City sewer. SUBDIVISION STAFF REPORT Page 2 Conformance with Comprehensive Plan: The subject property was not included in the City's 1995 Comprehensive Plan; however, the area was included in the City's 1997 Annexation Study. The 1997 Annexation Study designates the subject property as Area 4 and established it as Priority 1: Immediate Opportunity. Impact of Request on: Utilities: City water is available to the site. City sanitary sewer is approximately one mile away from the subject property. Each lot will have a septic system. Individual property owners will be required to hook-up to sanitary sewer when it's available. Traffic Patterns: The proposed subdivision has frontage on Old Highway Road and Seippel Road with the proposed Pinto Ridge Court street having access to Old Highway Road. There are no traffic counts available for the surrounding roadways~ Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impacts to the environment providing adequate erosion control is provided during all phases of development of the subdivision. Adjacent Properties: Staff does not anticipate any significant impacts to adjacent properties as the proposed development will only create five additional single- family building lots. Recommended Conditions on Plat: None. Staff Analysis: The submitted preliminary plat of Pinto Ridge Subdivision is currently located in Dubuque County near the southwest comer of Old Highway Road and Seippel Road. The city corporate limits currently are along the east side of the subject parcel, which includes Seippel Road. Wayne and Lynn Stewart are requesting annexation of this properbj to the City of Dubuque subject to rezoning the property to R-1 Single-Family Residential District. The proposed subdivision will subdivide an existing 25-acre parcel into five lots, a minimum of 3.9 acres in size, for development of single-family homes. The City sanitary sewer main is approximately one mile away from the property; however, the applicant has agreed to provide the necessary easements to accommodate extension of the sanitary sewer system to serve the property in the future. In addition, a capped sewer system will be installed as part of initial utility work to facilitate hooking up the subdivision to city sanitary sewer service in the future. SUBDIVISION STAFF REPORT Page 3 The Engineering Division has indicated that once the homeowners have approved septic systems they will have 15 years to tie into the city sanitary sewer system. City water service is available to the property. An existing 12' water main is located within the right-of-way of Seippel Road and will be extended along Old Highway Road and within the subdivision. The applicants wish to market these lots, in part, for people who own horses and wish to stable them on the same property as their single-family homes. Currently in the City of Dubuque, the stabling of horses is not allowed in single-family residential districts. Planning staff has prepared a text amendment to address this issue. The City's Annexation Study completed in 1997 and was designated as Area 4, which was assigned a Priority 1: Immediate Opportunity designation. Staff believes that this property does have the potential to be annexed to the City in the near term, and believes it should be developed to City standards to the extent possible. The City Council has the ultimate authority of whether to allow the site to be served with City water. Staff recommends the Zoning Advisory Commission approve the submitted preliminary plat of Pinto Ridge Subdivision.
