1883 March Council RecordsRegular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The minutes of the February session were read and approved The following petitions in relation to taxes were read and on motion referred to the delinquent tax committee viz T OSullivan Mary Ryan Catherin Newhouse Tax of 1882 Mary J Luke Margaret Rooney Edward Moore Henrietta Bielman Malissia Eggleston Mrs S F Osborne mary Boyle Johanna Broderick Susan Murphy Mrs P Vyverberg Catherine Newhouse Tax of 1875 The petition of J P Schroeder and others in relation to the grade of iowa and 16th streets was on motion of Ald Doerfler referred to the committee on streets The petition of George Zumhof and Son in relation to the erection of a small frame building on the corner of Fourth and Clay Streets was referred to the committee on public grounds and buildings and the engineer with power Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 the petition of John Hartig in relation to the removal of the engine house on lot 185 was referred to the committee on fire The petition of Wm Rebman in relation to a special tax levied for laying of sidewalk on lots Nos 5 and 6 of the subdivision of lot 2 of outlot 673 was referred to the committee on streets the petition of B B Richards in relation to the erection of a private wooden residence at the corner of 15th and locust streets was referred to the committee of the whole The petition of John E Brady and other practitioners of medicine in relation to a protest against the publication of the names and residences in cases of births was read Rule 11 was suspended to allow Dr Bready to address the council in favor of the remonstrance Ald Doerfler was in favor of the publications and moved to receive and file the remonstrance of the doctors Amended to refer to the committee of the whole The petition of A McCann in relation to a reduction of his assessment in the sum of $1500.00 and asking for the amount of $18.00 to be refunded as overtax of 1882 was read Rule 11 was suspended and Mr McCann addressed the council asking for said reduction On motion of Ald Kavannagh the prayer of the petitioner was granted and the recorder instructed to draw an order in favor of Mr McCann for the sum of $18.00 Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The petition of Henry Hune in relation to refund the sum of $6.00 as over tax on the south one fifth of City 441 was read On motion of Ald Altman the prayer of the petitioner was granted and the recorder instructed to draw a warrant in favor of Mr Hune for $6.00 The petition of Dennis Smith in relation to the erection of a frame building south of Jones Street was read and referred to the committee on Public Grounds and Buildings with power. The city auditor presented the following Auditors Office February 21st 1883 to his honor the Mayor and City Council In pursuance to your insructions new warrants were issued to Mr Thos Kavanaugh to take up ones which had become defaced The old warrants were surrendered to me and as I should prefer you to take some action looking to their total destruction will you please consider the matter and streets and alleys improved and assessed during the year ending February 28th 1883 $8258.71 Total cost of grading streets and alleys during the year ending FEbruary 28th 1883 $2682.55 Total cost of sidewalks ordered laid during the year ending Februray 28 1883 $689.67 Total cost of miscellaneous improvements not assessed made during the year Regular Session March 5, 1883 Mayor Linehan in the inceased over that of the previous year owning to the construction of several large storm water sewers principal the one on 8th street and on Dodge Street I would most respectfully recommend that the construction of a system of sewage be commenced and used as the warning system as examined and investigated at Memphis Tenn proves to be successful and is admirably adapted for this city I would reimburse Mr Pitschner in the amount of 3.00 Frank Fosselman reported that he had weighed on the Fifth Ward Scales during FEbruary 240 drafts The gross amount $36.00 Receipt of Treasurer for $5.40 attached 15 percent due the city Report received and filed The city recorder reported that the amount due from licenses issued and paid for the month of February was one hundred dollars report received and filed The lamp lighter reported that he had lighted 195 gas lamps during the month of February report adopted and filed James F Hedley reported that he had sold during the month of Addition served notice February 9th 1883 Referred to the city attorney to examine and report upon The market master reported that he had weighed 316 drafts on the market house scales during February at 15 cents $47.40 The receipt of the treasurer attached to board of prisoners and lodgers 115 meals at 20 cents $23.00 Report received and filed and hat Mr Rice be paid $23.00 the council then Altman chairman of the committee on claims recommending that an order be drawn in favor of petitioner to refund amount paid by him for within license less a reasonable tax for the yeaer 1882 and the recorder be insructed to draw a warrant for said amount $84.10 report adopted The committee on Claims reported on the petition and claim of John E Brady of $6.50 recommending that the same be paid following report on the petition of J K Graves et al as follows to the city council of the city of Dubuque Your committee on streets to which was referred the petition of J K Graves and others asking the council to cause Fourth Street extended so as to reach the west line of the old stone quarry on fourth street bluff andn that Fenelon Street be also extended from its present eastern termination to said stone quarry and thence North to the North line of said Fourth Street Extension would respectfully report that said improvement is earnestly desired by all the citizens on the Bluffs in that part of the city and consider it a matter of great importance to them We therefore recommend that the prayer of the petition be granted and that the city engineer be instructed to make a survey and plat of said proposed improvement showing the land or lots through or over which the same is proposed to be made the names of the owners thereof and the quantity of land proposed to be taken and when said plat and survey are completed that said plat be filed in said Engineers Office according to ordinance Also that the engineer give the notices provided for in Section 2 of the ordinance to Kavanaugh and Olinger 6 Nays Ald Altman Deckert and Jones 3 The street committee with Ald Clancy made the following report upon the plat and deed of Alderman Kavanaugh To the city council of the city of Dubuque Your committee to which was referrd the plat of the subdivision of Mineral Lot No 23 submitted by Thos Kavanaugh for the approval of the city Council and the deed presented by mr Kavanaugh relinquishing the right of way through the said lot as shown by the plat for a portion of th eetension of Grnad View Avenue respectfully report that we would recommend the approval of the plat of the subdivision when the proper dedication shall be made on the same the deed from Mr Kavanaugh for the right of way for Grand View Avenue we regard as objectionable as it provides that he shall not be assessed for the laying of any sidewalks along the property for the period of seven years Sidewalks will undoubtedly be needed along the street very soon and in our opinion the cost should be assessed against the property as in other cases. Otherwise the expense will have to be paid by the City Mr Kavanaugh has stated to the committee that he will be willing to convey the right of way without the reservation as to sidewalks if the city will pay him for the same at the same rate as was allowed by the jury to the other propertyholders on the street which was at the rate of $100.00 per acre as your com Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 is informed the ground taken from mr Kavanaugh is something over an acre and the amount would be about $100 We append the written communication from the city attorney stating that Mr Kavanaugh has never made any dedication or in any manner released the right of way so far as the public is concerned he can fence up t the street at any time Your committee recommend that mr Kavanaugh be allowed for the right of way for the portion of Grand View Avenue shown on his plat at the rate of $100 per acre the quantity of ground tken to be ascertained and certified by the city engineer and that an order be drawn for the same Respectfully submitted P W Crawford Pat Clancy H C Deckert Report of the committee was adopted and ordered that a warrant be drawn in favor of Mr Kavanaugh for $100 provided that the property owner shall not be exempt from laying a sidewalk when ordered on the aforesaid premises The committee on streets reported on the petition of A M Downer et al together with a profile of Iowa Street from 5th to 7th streets as follows The property owners abutting on Iowa Street from 15th to 17th streets having signed the proposed change of grade as shown on the within profile we would recommend that the said change of grade be adopted Report was correct report adopted and ordered that the several claims be paid The committee on public grounds and buildings reported on the petition of John P Page recommending to receive and file the said petition report adopted The same committee reported on the petition of Rev P Burke recommending that the prayer of the petitioner be granted but that he pay gas bills and the fees allowed the market master report adopted The comittee on police and gas reported favorably on the loction of several lamps report adopted the committee on delinquent tax made the following reports on the several petitions referred to them all of which were severally adopted that the assessment of Mrs J W Parker for the year 1882 on lot NO 2 of subdivision of lot 3 of outlot 738 be placed at $1000 That the assessment of Philip Heuses on lots 99 and 100 in McCraney's 2nd addition be reduced to $700 for 1882 That the tax of Ann Stuart on lot 33 in Wests Addn be extempted for 1882 Regular Session March 5, and S 1/2 of lot 283 Don's Farm That the petition of Patrick Smith asking for exemption of tax of 1882 be tranted That the petition of M Schlegel asking for the year 1882 be granted on exemption of tax That the tax of Mrs Kate Seidel on lot No 17 in Gates Subdivision be cancelled for 1882 The special committee to whom was referred the petition of John P Page reported on the same as follows Your committee recommend that the city lease to John P Page for the term of Twenty Five Years at the rent of $40.00 per year lot 27 of city Lot 304 to be improved and used in connection with his new hotel report adopted and attorney to draw lease The delinquent tax committee and city attorney made the following report upon the petition of the A M E Church to the hon the city council of the city of Dubuque Gentlemen Your committee to which was referred the petition of the African Methodist Episcopal Church relating to the sale in 1882 for the taxes of 1881 of lot no 7 in Central Addition and asking that said premises be declared exempt from taxation for the said year 1881 on the ground that the same was during said year owned and used for church purposes would report Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 that after an examination of the records we find that on the 9th of August 1880 said premises were conveyed to the African M E Church and have since been owned and used by said church for church purposes and could not be taxed for said year 1881 And therefore recommend that the purchaser at tax sale of said premises for the year aforesaid be notified by the Treasurer that upon application therefore by said purchaser the money paid at tax sale shall be refunded and the treasurer authorized to refund the same upon such application in acordance with the ordinances upon that subject respectfully submitted J H Schields Attorney H C Deckert P Olinger P C Foley Delinquent Tax Committee Report adopted The committee on Delinquent Tax together with the City Attorney made the following report upon the petition f Wm Carter To the hon Mayor and council of the city of Dubuque Gentlemen Your committee to which was referred the communication of Wm Carter asking that the taxes for 1881 on the South 42 feet of Lot 754 or lot 5 of the subdivision of lot 754 and 755 be cancelled as exempt would report respectfully that on the 30th of April 1878 the south 42 feet of lot 754 was conveyed to the Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 African M E church and owned by said church until the 30th of June 1881 when th esame was conveyed to petitioner and has been owned by him since that time Section 3 of the tax ordinance provides that all real estate shall be bested and assessed each year in the name of the owner thereof on the first of january The A M E Church was the owner and held the legal title of said premises on the first of January 1881 and occupied the same as a church and was therefore exempt We would therefore recommend that said tax be cancelled but that petitioner pay the taxes for 1881 on the north 14 feet of said lot Respectfully H C Deckert P Olinger P C Foley Delinquent Tax Committee J H Shields Attorney Report adopted The special committee on sewerage consisting of Ald Crawford Deckert Kavanaugh Altman and Foley to which referred the subject of a general system of sewerage for the city and also the petition of Asa Horr and other owners of property abutting on the alley between Main and ocust streets asking the city council to construct a tile sewer along said alley from First to Seventeenth Streets in accordance with the warning system submitted a preliminary report the said committee being unanimous in deeming it unwise for the city council while contemplating Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 contemplating the adoption of a general system of sewerage and before the plans for the same were fully matured and adopted to put in a sewer in that particular locality The report contained a long summary of suggestions etc. Received and filed Notices having been served upon Wm Hintrager and W K deLorimer in relation to their assessments the document was received and filed The committee of the whole to whom was referred the petition of the dubuque Street Railway recommending to postpone action on the same to April 1883 Report adopted The same committee reported on the protest of Dunnebecke et al recommending to postpone the same to April 1883 Adopted The same committee reported on the petitions of mr Hintrager Mrs O Langworthy to special committee adopted Also on the petition of W K de Lorimer recommending to cancel $5000 moneys and credits for 1883 Report adopted The committee on Fire reported on the petition of C S Bentley recommending to grant prayer of the same Report adopted Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 Ald Deckert presented the following Resolved by the City council of the City of Dubuque that a sidewalk four feet wide of good ten inch plank be within 30 days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks in the south side of Eagle Point Avenue northeast of Johnson Avenue in front of and abutting Lot 1 of mineral lot 467 Adopted by a unaminous vote as follows yeas Ald Altman Clancy Crawford Deckert Foley Glab Jones Kavanaugh and Olinger the committee on ordinances presented an ordinance amending SEction 71 of Chapter 32 of Revised Ordinances and reducing the penbalty on redemption from tax sales which was read the first time Rule 29 was then suspended by the following vote Yeas ald Altman Clancy Crawford Doerfler Deckert Foley Glab Jones Kavanaugh and Olinger No Nays The ordinance was then read a second time and passed The same committee presented an ordinance granting to the Dubuque butchers association the rigth the right to construct a general slaughter house and imposing certain obligations in relation thereto Read the first time Rule 29 was then suspended by the following vote Yeas Ald Altman clancy Crawford Doerfler Deckert Foley Glab Kavanaugh and Olinger 9 Nays Ald Jones 1 Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 The ordinance was then read a second time and passed On motion of Ald Crawford the plans and specifications of the union slaughter house were ordered approved Ald Crawford moved that Mr Wm Rebman be paid a balance of $100.00 due on Roberts Avenue On motion of Ald Crawford the report of the Finance Committee in relation to an Index book was adopted and ordered that such a book be gotten up not to exceed $400.00 Ald Deckert offered the following Resolved that the alley between 18th and 19th streets and White and Jackson streets be graded and macadamized and the cost of macadamizing the same be assessed to the abutting property Referred to the street committee Ald Crawford offered the following Resolved That the sum of $5.35 paid by Capt Parker as part of his taxe on Sub lot 3 as part of his taxes on Sub Lot 3 of outlot 738 of lot no 2 for the year 1882 and which sum becomes due Capt Parker by reason of the reduction of the assessment on said real estate from $1500 tp $1000 be repaid and an order drawn in favor of Capt Parker for said sum Adopted Ald Deckert offered the following Resolved by the City Council of the City of Dubuque that a sidewalk four feet wide of good two inch plank be within 30 days of this notice constructed and laid in conformity with the ordinance in relation to sidewalk on Hinds and Company of $32.46 was referred to the committee on claims The bill of Henry Jungk of $9.50 was referred to the street committee Ald Crawford moved that the key city gas co bills be not paid
