previous regular adjourned and special sessions were read and approved The following petitions were read and disposed of as follows the petitions of Geo Hograff John VanDillen John Theis John Kiefer Joseph Vogel Sophia Prange C M and St P Railroad Co Geo Seige Agatha Kintzell Jacob Benslink Mary Shannon and Bridget Gregory and Mrs Smith in relation to taxes and assessments were referred to the committee on delinquent tax the petitions of J W Wallace et al Peter Kiene et al and mrs K Glab et al in relation to placing new lamps was referred to the committee on police and gas the petitions of Geo W Jones Wm Coates Ira Hanson N W Boyes Frank Brede J Zangmeister M Kearney Dillen Sutherland Era Sutel and Christian Jungk in relation to the improvement of streets and sidewalks was referred to the committee on streets The petitions of John Steffes et al for an increase in the wages for teams employed by the city and the petition of Julia Flannery for compensation for damages caused by the extension of Grand View ave was referred to the committee of the whole The petition of the electric Light and Power Company for certain privileges was on motion referred to the same committee The Hollnagle Kavanaugh McCarthy Martin and Olinger The petition of T Herbst for reduction of his butchers license was on motion received and filed The petition of Fisher and Co for privilege to pile wood on Clay street was on motion received and filed The petition of the Iowa Iron Works for privilege to use temporary portions of the streets adjoining their works received and filed The petition of A Heeb and other citizens of the fifth ward to erect an engine house and place one of the engines in the same at the corner of Eighteenth and Clay streets was referred to the committee on fire The petition of Frank Brede to be allowed to build a frame house inside the fire limits was referred to the com on fire the petition of T O'Sullivan to have the time for completion of the city assessment extended to the regular session in August was referred to the city attorney the petition of J K Graves to be allowed to build an elevator on fourth street was referred to the city attorney to draft an ordinance on the same the petition of Mrs Stange for settlement of her claim for damages by reason of the running of the motor to committee on claims The petition of H Borgwald for straigtening of couler creek was referred to two ald from the fifth ward The petition of E Sheppley against granting a new charter to the motor co referred to com on motors The petition of Mrs markey in relation to a nuisance near her premises was referred to the Marshal The petition of H Huber et al in relation to grade of street and alley was referred to the city engineer the petition of T O'Sullivan to have a committee appointed to examine the abstract book of tax sales and redemption from 1857 to 1878 the mayor appointed ald Crawford Clancy and Deckert the Council then adjourned until 2 o'clock pm The council met at 2 oclock pm Reports of officers Lamplighter Hackney reported having lighted 195 Gas lamps during the month of May received and filed Pound Master Koenig reported having collected four and 15/100 dollars for impounding animals during the month of May for which he returns treasurers receipt received and filed James F Hedley reported having sold at auction during the month of May real estate and stocks of merchandise to the amount of $4532.00 received and filed Edward Reynoldson weigher of the first ward scales reported having weighed 132 drafts from the 11th to the 31st of May including for which he received 19.80 15% returned to the city $2.97 received and filed Frank Fossellman weigher fifth ward scales reported weighing 107 drafts for month of May 15% returned to city $2.40 received and filed Chas Pitschner from West Dubuque Scales reported weighing 98 drafts during the month of May 15% or $2.40 returned to city received and filed Street commissioner Foster reported the sum of $1978.00 as necessary to pay the men and teams employed on streets during the month of May Received and filed and draw warrans for the amounts Market Master S B Rice reported having weighed 143 drafts on the market house $21.40 for which he returns the treasurers receipt also that he furnished 96 meals to prisoners and lodgers for which he paid out 19.20 received and filed and draw warrant for the amount Auditor C J Brayton reported that twelve hundred and forty nine and 90/100 dollars was necessary to pay the city officers and employees for the month of May Received and filed and draw warrants for the amounts Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger reports of the officers Recorder Halpin reported having 83 licenses during the month for which he holds the treasurers receipts for the amount of $2717.75 Referred to the finance com Woodmeasurer Warring reported having measured 2187 2/8 cords of wood during the month of may for which he received $65.60 received and filed Street commissioner foster reported having collected one hundred and twenty two dollars for which he attches the treasurers reciepts received and filed Marshal Zugenbuehler reported that the sum of $925.05 was necessary to pay the police force for the month of May also that there had been fifty arrests made during the month and he has returned treasurers receipt for 1.50 as fees collected received and filed City engineer Tschirgi reported the cost of grading and re-macadamizing Main Street from first to eighty street at $905.86 and relaying crosswalks $320 and that the cross streets would need some attention also on the petition of Wm L Bradley for the grade of Lake street I find that two grade lines are shown I deem it best that a resolution adopted declaring the blue line as the official grade as shown on the profiles recorded in grade book No 1 Also as to railroad avenue bridge I would recommend that the bridge be taken down and the span reduced from fifty to twenty feet and the approaches filled with earth and stone this can be done for about what the repairing would cost and would be a permanent structure Estimate of cost of the building $449.00 Also the estimtae of improving alley from Eagle Point Ave to Lake Street between Jackson and Washington Streets at $1001.85 all of which was referred to the committee on streets C C Coakley police justice reported having tried three cases for the violatio of city ordinances and accompanies his report with the treasurers receipt for $7.00 the amount of fines collected received and filed City Attorney Linehan presented a written report or opinion on the motor question which was read by the mayor to the council Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger reports of committees Ald Crawford from the committee on ordinance reported as follows To the city council of the city of Dubuque Your committee to whom the draft of an ordinance presented by the Dubuque Street Railway Company granting the additional rights asked for by said company of laying a double track on Main Street from Jones to Thirteenth Street from Thirteenth Street northerly on Clay and Eighteenth Street and Couler Avenue to Sanford Streets also of constructing lines of single track railway on Main street from thirteenth streets to fifteenth streets hence easterly on fifteenth street to clay street also from the intersection of Main and First street easterly on first street to Iowa street thence northerly on Iowa Street to third street thence easterly on third to clay thence northerly on clay street to thirteenth also from the intersection of couler avenue and nineteenth street easterly on nineteenth street to jackson street thence northerly on jackson street to lake street thence easterly on lake street to high street thence northeasterly on high street to eagle point Beg leave to report that we have duly considered the question and crefully examined the ordinances which the company desires to have adopted We find that the ordinance is intended to entirely supercede the original ordinance granted in 1867 and which expires by limitation in a little over four years It makes a new grant from the present time of all the rights now possessed by the company under its old charter with the additional ones above specified for the term of twenty five years the provisions of th eordinance impose no binding obligations upon the company whatever it merely provides that the company shall forefiet th eright to lay the double track to lay the double track or to construct either of the additional lines of railway unless done within two years there is no compulsion on the part of the company to lay a single foot of additional track either double or single or to make any improvements whatever It secures however the renewal of its charter for twenty five yeras from the present time this seems to your committee what might be termed a jug handled management the effect of the ordinance if passed would be to give the company a renewal for twenty five yeras of all its present rights and grant of certain additional privileges which it is under no obligation to carry out No consideration whatever ensures to the city for the extension for a quarter of a century of the company charter your committee cannot recommend the passage of a measure by which the city would be placed at so great a disadvantage we have prepared instead and herewith present the draft of an ordinance which merely grants the company additional privileges applied for without revising the one heretofore granted or providing for any extension of the charter It contains the condition that the railway company shall pay one half the expense cutting the surface of Union Street Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger reports of committees between curbs from first to eighteenth street as a consideration for the right to lay the double track it also provides that all new track rails shall be of the best and most approved pattern which will be of no obstruction to the street The ordinance prepared by your committee further provides that of the railway company shall within four years put down its double track on main Street and shall also have constructed and put in operation all the additional lines of railway which it asked the right to lay except from JOhnson Avenue to Eagle Point and shall have complied in good faith with all other conditions in its charter as ammended It shall then be entitled on the expiration of its charter on October 1st 1887 to a renewal of its franchises for a further term twenty years Believing that the interset of teh city are fully provided for and protected we recommend the passage of the ordinances all of which is respectfully submitted P W Crawford Com P Olinger On motion the report was received and the ordinance read as petitioned for M Cosgrove in favor of receiving and filing Mrs Attwell the claim has been settled received and filed Bernard Conlan in favor of receiving and filing petition M H Moore in favor of referring to the com of the whole John Sullivan that the marshal be ordered to remove obstructions Norweigen Plow Co the petition had been granted T J Donohue the grade is established and that the improvements be postponed John Cooney that the petition be received and filed Wm M Davis that the necessary grading be done whenever the city needs filling Remonstrance of Johanna Flynn to grant the prilileges to lay gravel sidewalk by June 15 1983 Petition of Jas Howie et al that city eng be instructed to prepare profile and grade and estimate cost of grading Petition of Peter Pline in favor of doing the necessary gading Petition of S M Langworthy in favor of ordering the C M & St P Railroad to open the necessary culvert on south side of eighth street Petition of Ellen Quinlivan in favor of ordering the marshal to summon a new jury to condemn the right of way all of which was adopted Ald M H McCarthy Chairman Com on P G & B reported on the bill of G L Torbert for insurance on city hall McCarthy Martin and Olinger Reports of committees Ald John Glab chairman on printing reported on the several bills referred to that committee in favor of paying the same with the corrections noted adopted Ald Chas Hollnagle Chairman on delinquent tax reported in favor of granting the petitions of Martin Theis Adam Pier Margaret Glennon James Brunskill and Mrs H Heeb and adversely to the petition of John Peitrict the report was adopted Ald O Olinger committee on fire reported on the recommendtion of the chief engineer to build an engine house on the corner of 4th and locust street and that the committee on fire be instructed to obtain plans for the same also as to the fire alarm that the telephone company agrees to furnish trap locks at their expense also that the bills referred to them last session are correct and ordered paid adopted Ald John Glab committee on finance reported on the bill of H A Schrunk that the same be received and filed also presented a communication from treasurer traut requesting the city council authorize the finance committee to borrow five thousand to defray the expenses for the month of may adopted Ald john glab from the board of health reported on the bill of Martin Kane as clerk of the board of health recommended allowing Mr Kane the sum of $250.00 for his services Mr Kane to give a receipt in full of all claims against the city the rules were suspended and Mr Kane address the council and said he would not accept the amount allowed The mayor appointed as a committee on equalizaation the following Ald Kavanaugh McCarthy Martin Glab and chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions Ald Olinger offered the following Be it resolved by the city council of the city of Dubuque that the committee on Fire with the chief of the Fire Department be and are hereby instructed and empowered to make such deduction in the members of the fire department as to them shall seem advisable and to reorganize the working epartment in such manner as the shall deem best for the security of the property of the citizens and the greater efficiency of the department adopted Ald Deckert offered the following Be it resolved by the city council of the city of Dubuque that eighth street on the north side between main and iowa street be macadamized guttered and curbed in conformity with the ordinance upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper police for bids and proposals for the performance of said work the guttering curbing and macadamizing to be done at the expense of the owners of the abutting property adopted by a full vote of the council Ald Deckert offered the following Resolved by the city council of the city of Dubuque that the alley between white and jackson streets from 18th to 19th streets be graded and macadamized in conformity with the ordinance upon that subjec tthat the city engineer be and is hereby directed to make the necessary plans and specifications for said improvements and that the city recorder be directed to give the proper notice for bids and proposals for the performance of the work the macadamizing to be done at the expense of the owners of abutting property adopted by a full vote of the council Ald Glab offered the following Resolved by the city council that the finance committee be instructed to borrow five thousand dollars to pay the expenses of the month of May adopted by a full vote of the council Ald Glab resolved that the recorder be instructed to draw a warrant in favor of the city treasurer for $88.20 for interest paid on loans adopted Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions ald Glab offered the following Resolved by the city council of the city of Dubuque that the city purchase five copies of the new city directory for the use of the city officers and that the city recorder draw an order for the treasurer for the amount at $3.00 per copy the ayes and nays were called ayes Ald Deckert Glab Hollnagle martin and Olinger 5 Nays Ald Altman Clancy Crawford Kavanaugh and McCarthy 5 The mayor being called on voted aye and the resolution was adopted Ald Clancy offered the following Resolved by the city council of the city of Dubuque that the following prices of gas to be furnished to the city and to private consumers in teh city for one year from this date be fixed at the following prices For each public street lamp twenty dollars for lighting public buildings the city $2.75 for each 1000 cubic feet to private consumers $2.75 for each 1000 cubic feet setting new posts and lamps complete twenty dollars each adopted by a unaminous vote of the council Ald Crawford offered the following Whereas Messers Martin and Strane for the purpose of quarrying rock have excavated the sidewalk on the west side of prairie in front of lot no 783 in A McDaniels subdivision and have neglected and refused to refill said sidewalk although duly notified to do so Be it resolved that the city engineer be insructed to cause said sidewalk to be refilled to the proper grade at the expense of said martin & Strane and to deduct the amount of said expense from the first estimate in their favor made by said engineer for work done for the city under any contract performed for being performed by said contractors adopted Ald Glab offered the following Whereas the citizens on fifth and broad street are complaining of a goos pond with stagnant water which will cause sickness around that neighborhood if not removed before hot weather sets in said goos pond lies on the north side of west fifth street on lot no 10 Therefore be it resolved that the street commitee with teh engineer be instructed to adopt a plan to remov e said nuisance at once and charge the expense to the owner of the property adopted Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions Ald Deckert offered the following Be it resolved by city council of the city of Dubuque that the committee on fire be instructed to have plans and specifications prepared for the erection of Engine houses at fourth and eighteenth streets and to present the same as soon as they can be obtained Ayes Ald Crawford Deckert Glab Hollnagle Martins and Olinger 6 Nays Ald Altman Clancy kavanaugh and McCarthy 4 Adopted on motion the rules were suspended and Mr Howard allowed to address the council in relation to the gas question he wished the matter would referred to some committee to consult with the gas co on motion the matter was referred to the committee of the whole The contracts were then opened and read and awarded to the lowest bidder as follows Alley from twelfth to thirteenth street between white and jackson to Wm Rebman for sum of $201.10 Alley between Jackson and Washington Street from Eagle Point Avenue to Sanford Street to Wm Rebman for the sum of $881.30 Alley from Sixteenth to Seventeenth street between Clay and White Street to Hugh Martin for the sum of $192.60 Iowa street from fifteenth to seventeenth streets to Chas Steucks for the sum of $296.64 Sanford Street Sewer to C Premmassing for the sum of $145.00 Eight street sewer between Main and Iowa to Wm Rebman for $718.00 the matter of engaging an engineer to take charge of the steamer during the absence of Mr Strinsky at the tournament was referred to the com on fire with power Regular Session June 4, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Ald McCarthy moved an amendment that the matter be indefinitely postponed the ayes and nays were called on the amendment ayes ald Altman Clancy Crawford Kavanaugh and McCarthy 5 Nays Ald Deckert Glab Hollnagle Martin and Olinger 5 The mayor voted to postpone Ald Olinter moved that mr Martin Kane be allowed the sum of $400.00 in full settlement of his claim for services as clerk of the board of health Ayes Ald Clancy Kavanaugh Martin McCarthy and Olinger 5 Nays Ald Altman Crawford Deckert Glab and Hollnagle 5 Mr Mayor being called voted in the affirmative On motion the salary of the clerk of the board of health was fixed at $200.00 per year adopted Ald Glab offered the following Resolved by the city council of the city of Dubuque that a warrant be drawn in favor of Wm Hintrager for the sum of Four Hundred Dollars to redeem from tax sale of lands of Graham and Wooten under agreement between Graham and Wooten and the city of Dubuque in relation to said redemption On motion the rules were suspended and Mr Howard again addressed the council asking for a hearing for the gas co On motion of Ald Olinger to reconsider the resolution to fix the price of gas the ayes and nays were called Ayes ald Deckert Glab martin McCarthy and Olinger 5 Nays Ald Altman Clancy Crawford Hollnagle and Kavanaugh 5 whole the petition of Michael Clark for damages was referred to the committee on streets to investigate the petition of the key city gas co having been granted was on motion received and filed the petition of John Nagle in relation to a sidewalk on his premises as on motion referred to the committee on streets with the marshal The petition of John Drehouse chief engineer of the fire department asking for a further appropriation to pay expenses of attending the tournament was on motion granted the petition of L Converse et al in relation to sewer on division street was referred to the committee on streets On motion of ald Clancy the recorder was instructed to draw a warrant in favor of the key city gas co for the amount of twenty five dollars to pay for one broken on eighth street and that the marshal collect the amount from Mrs Fischer and pay the same into the treasury Bills allowed John McCoy Fifth Ward Hose Hugh Martin H A Schrunk John Newman The city attorney suggested that the amount to be paid for Sanford Street sewer he collected at once on motion the street committee was directed to collect the same at onc and pay into the city treasury Regular Session June 8, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle McCarthy Martin and Olinger Absent Ald Kavanaugh Mr Bush the secretary of the motor railway company presented an ordinance to regulate the running of said motor which was read by the recorder on motion the matter was referred to the city attorney to draft an ordinance in accordance with the statue to contain a clause that the company pay all damages incurred and give sufficient bond to indemnify the city from all damages that may occur adopted by a vote of 6 ayes against 3 nays adjourned attest
