previous regular and special sessions were read and approved The petition of John Deery in relation to backed sewer on west locust st with the claim for damage was on motion referred to the committee on streets The petition or remonstrance of Frank Miten in relation to the opening of ninth street in Harris addition was on motion referred to the committee on streets with instructions to defer the opening of said street until Jan 1st 1884 The petition of S S Scott in relation to the condition of the Julien House sewer was referred to the executive committee of the board of health the petition for settlement of the claim for damages of Mrs Ellen Quinlavan her proposition to accept $150 in full of all damages was accepted the amount to be paid when she removes obstructions and gives the proper deeds The petition of Michl Kane in relation to removal of macadam owned by the city and on her premises was referred to the committee on streets the petition of Gotfried Gmahl in relation to saloon license was referred to the mayor with power the petition of P J Milligan for the opening of a street south from Grand View Avenue was referred to the committee on streets Regular Session July front of and on his premises was referred to the committee on streets The petition of the Dubuque Drum Corps for the privilege of using the city hall for drilling purposes was granted the market master to designate the nights and the hours they shall use the same the petition of Michl Mulligan for remission of taxes of 1882 on his home was referred to the committee on delinquent tax the city weigher reported having weighed seventy one drafts on the west Dubuque scales which he received $10.65 15% or 1.60 returned to the city treasurer received and filed Frank Fosselman city weigher reported having weighed 132 drafts on the fifth ward scales gross receipts 19.80 treasurers receipt attached for 2.95 or 15% received and filed Edward Reyoldson city weigher reported having weighed 246 drafts on the first ward scales gross receipts 36.90 treasurers receipt attached for 5.55 or 15% received and filed S B Rice market master reported receipts from city scales $25.05 also rent of huckster stands 23.75 for which he attaches a receipt from the treasurer for both amounts also that he had furnished 146 meals to prisoners and lodgers for which he paid 29.20 and the report was received and filed and bill ordered paid Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger reports officers Chief Engineer Drehouse reported the expenses of attending the tournament at waterloo as $157.95 and he returns treasurers receipt for $100.00 as the Also a receipt for 8.15 for old hose sold the report was received and filed and the recorder ordered to draw a warrant in his favor for 7.95 the balance of the expenses Auditor C J Brayton reported the amount due city officers and employees for the month of June as 1265.75 received and filed Recorder J W Halpin reported having issued 204 licenses during the month of June for which he holds the treasurers receipt for the amount of $2525.50 received and filed Auctioneer James F Hedley reported auction sales during the month of June amounting to $11,722.00 no transient sales received and filed Street commissioner foster reported the amount of $2070.40 necessary to pay the men and teams employed in improving the streets during the month of June the report was received and filed and the recorder instructed to draw the warrants for the several amounts due Police Justice Hoffman reported having tried 12 cases for violation of city ordinances from which he collected 7.00 in fines and he returns a receipt from the treasurer for the amount also that there is due him for fees in cases 2.25 received and filed and ordered paid Marshal Zugenbuehler reported that 965.15 necessary to pay the police force for the month of June Also that there had been 91 arrests made during the month and that he ha received and turned into the city treasurer 1.00 as fees also had collected and holds treasurers receipt for 25.00 for a broken lamp post received and filed Treasurer traut reported having paid interest on loan warrant 30.67 also paid J D Bush 165.46 for damage to property R & J and the recorder instructed to draw Wood measrer Warring reported having measured 951 cords of wood for which he receieved $33.30 received and filed the resignation of police officer Nick Reutz was read and on motion it was accepted City engineer Tschirgi reported adversely to the petition of H Huber et al for a change of grade on Lake Street reports of committees ald Deckert from the committee o sreets reported on the petition of J Holland et al that a two foot crossing be placed on eighth street on the south side between main and iowa streets on the ptition of R W Stewart agent that the marshal be instructed to remove the obstructins and open water street on the petition of Ira Stanson that a four foot plank sidewalk be laid bet on Chestnut street between prairie and walnut streets On the resolution of Chas Hollnagle that a two foot sidewalk be laid on eagle point avenue from couler avenue to lot 18 in burtons addition on the petition of Michl Clark for damage to property by the falling of the wall on eleventh street be referred to the city attorney On the resolution of Ald Glab to abate a nuisance that teh lot ot lots be filled so as to drain the water into the culvert on Glen Oak Avenue on the petition of R Armstrong et all the committee report in favor of putting in a water break of macadam where asked for On the petiiotn of M Carney et al the committee report in favor of ordering a four foot plank sidewalk on the north side of west of west locust street from the west line of cox street to alta vista on the petition of Wm Coates et al the committee report in favor of the city engineer preparing a profile and grade south street on the petition of Eve Seitel that the opening of said ninth street Harris addition be postponed until January 1st 1884 On the petition N W Boyes et al the committee report in favor of instructing the marshal to open that portion of a street on the west side of O'hares addition Ald Deckert reported on the petitions of Christian Jungk Sm H foster for the improvement of alley L Converse in relation to culvert The petition of John Becker for bridge on Eagle Point Ave communication from city eng in relation to Dell Street that the several petitions be received and filed Ald John Glab Chrmn com of the whole reported on the petition of John Steffes and other teamsters for an increase in the wages of teams employed by the city that the same be received and filed on the petition of the electric light and power company that the committee on ordinance prepared the proper ordinance for said company and that the committee on streets grant the right of way to set the poles and make the necessary arrangements for the introduction of said light On the petition of M H Mayne et al that the petition be referred to the committee on streets with the city engineer adopted Ald B Olinger chairman com on fire reported On the bills of Jos Newberg nat Brass & Iron Works and F Roehl that the bills were correct and recommend the payment of the same also on the petition of Frank Prede that the petition be granted on the resolution offered at the last session that the committee had instructed the city chief engineer to reorganize the fire department Ald Chas Hollnagle chairman com on del tax reported in favor of granting the petitions of Bridget Gregory Mrs Smith Sophia Prange and mary Shannon the committee reported adversely to the petitions of Mrs Leo Seige R S Heist Joseph Vogel John Theis John Van Dillen John Kiefer and Jacob Kratz also that the petition of Geo Hograth be referred to the city attorney A communication was read from C J Walsh relative to a warrant drawn on the treasurer for $400.00 in favor of martin kane that the refuses to pay the warrant in full claiming that said Kane has drawn $115.00 of the amount on motion the treasurer be instructed to tender the sum of 285.00 in full payment of said warrant adopted A communication from Capt Ed Moore for an increase in his salary was on motion referred to the committee on police Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Ald Glab from the finance committee reported that it would be necessary to borrow the sum of six thousand $6,000 dollars to pay the expeses for the month of june Ald crawford from the committee on ordinances presented odinances for the construction operation and maintenance of the motor street railway which after being read further action was deferred until the adjourned session to be held on July 9th 1883 The city attorney presented an ordinance in relation to billiard license which after being read a second time was adopted The committee on finance reported an ordinance to provide for the funding of the floating debt which after being read by the recorder further action was postponed until the adjourned session to be held July 9th 1883 the ordinance in relation to teh double track street railway coming up and mr linehan being present the sales were suspended and mr Linehan allowed to address the council he stated that the company objected to section 3 which ways that the company shall pay half the cost of cutting down main he offered for consideration of the council the ordinance granted to a company by the city of Des Moines to lay and operate a new street railway A remonstrance was read from the property holders on Main street north of thirteenth street objecting to laying of track along said street north of thirteenth street A motion by Ald Glab to strike out section 3 of the ordinance was lost by the deciding vote of the mayor Further consideration of the matter was postponed until the adjourned session of the council to be held July 9th 1883 and the ordinance then to be put on its passage The city engineer presented a profile of grade of an alley between chestnut and eleventh streets from prairie to walnut street which was referred to the committee on streets Also a communication in relation to the old brick building on the corner of Emmett and St mary Street that the same was dangerous Com on streets with power Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Ald McCarthy reported on the bill of Asa Horr that he found the same correct and recommended the payment of the same adopted On motion of Ald Crawford the mayor city attorney and recorder were empowered to make a new contract with the Globe gas light co the old contract having expired the city attorney asked for further time to draft an ordinance for the erection and operation of an eevator on fourth street On motion of Ald McCarthy that a committee of three be appointed to wait on mr Graves and ascertain whether the project had been abandoned the mayor appointed ald McCarthy Hollnagle and Kavanaugh On motion of Ald Olinger the drinking fountain on the corner of Thirteenth and Washington was ordered resolutions Ald Deckert offered the following be it resolved by the city council that lots 10 and 11 of S M Langworthy's addition be filled up sufficiently to drain the present stagnant water into the sewer at Glen Oak Ave the height to be fixed by the City Engineer said work to be done within 15 days from date of service of notice on the owner adopted Ald Deckert that Brad street in marshe's addition between Julien Ave and a point 100 feet north of Julien avenue be graded guttered curbed and macadamized in conformity with the ordinance upon that subject that the city engineer be and he is hereby directed to makek the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the guttering curbing and macadamizing to be done at the expense of teh abutting property adopted Ald Deckert that a sidewalk four feet wide of good two inch plank be within fifteen day sof thisnotice constructed and laid in conformity with the ordinance in relation to sidewalks on the west side of Broad Street between Julien Ave and West Fifth Street adopted Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions Ald Deckert resolved by the city council that a sidewalk two feet side of good two inch plank be within 15 days of this notice constructed and laid in conformity with the ordinance in relation to sidealks on the south side of eagle point ave between couler ave and lot 18 Burtons add adopted Ald Deckert resolved by the city council that a sidewalk four feet wide of good two inch plank be within fifteen days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks on bth sides of Chestnut street bewteen Prairie street and walnut street adopted By Ald Deckert resolved by the city council that a sidewalk four feet wide two inch plank be within fifteen days of thisnotice constructed and laid in conformity with the ordinance in reltion to sidewalks be laid on the north side of west locust street between the west line of Cox's addition and Alta Vista Street adopted By Ald Deckert be it resolved by the city council that the alley between Washington and jackson Streets from Lake street to Eagle Point Ave be graded and macadamized in conformity with the ordinance upon that subject That the city engineer be and is hereby directed to make the necessary plans and speciications for said improvement and that the city recorder directed to give the proper notice for bids and proposals for the performance of said work the macadamizing to be done at the expense of the abutting property adopted Ald Deckert resolved by the city council that the alley between Tenth and Eleventh Street and Washington and jackson Streets be graded and macadamized in conformity with the ordinance upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and teh city recorder directed to give the proper notice for bids and proposals for the performance of the work the macadamizing to be done at the expense of the abutting property adopted Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions Ald Deckert offered the following resolved by the city council of the city of Dubuque that sixteenth street between clay and iowa streets be graded guttered curbed and macadamized in conformity with the ordinance upon that subject that the city engineer be and he is hereby directed to make the proper plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of said work the guttering and curbing and macadamizing to be done at the expense of the abutting property adopted Ald Deckert offered the following resolved by the city council of the city of Dubuque that julien Ave between Walnut st and Hill st be guttered and curbed in conformity with the ordinance upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder to give the proper notice for bids and proposals for the performance of said work the guttering and curbing to be done at the expense of the abutting property Ald Clancy offered the following resolved by the city council of the city of Dubuque that the rates and prices of gas to be furnished to the city of Dubuque and t private consumers therein be fied as follows for one year from July 1st 1883 for each public street lamp $25.00 For settting new posts and lamps complete $25.00 gas to private consumers $3.00 per 1000 feet Gas for city purposes $2.25 per 1000 feet adopted Ald Glab offered the following resolved by the city council of the city of Dubuque that the finance committee be instructed to borrow six thousand (6000) dollars to pay the expenses of the month of June 1883 adopted Regular Session July 2, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy Martin and Olinger Resolutions Ald Glab offered the following resolved by the city council of the city of Dubuque that the marshal be instructed to notify the property owners on west Fifth Street from Nevada street to Delhi Road on the south side thereof to repair their sidewalks said walks to be not less than three feet wide adopted Ald Glab offered the following resolved by the city council of the city of Dubuque that the marshal be instructed to notify the owner of the blue barn at south east corner of first and main street to abate the nuisance now located there and cause the cellar or hole to be filled adopted Ald Olinger presented a plan for a new engine house on fourth street also an estimate of cost of same and an estimate of the cost of an engine house in the fifth ward the commitee was granted further time to report On motion of Ald McCarthy the council proceeded to elect a policeman to fill the vacancy caused by the resignation of Nick Lents which resulted in the election of Peter Scharf on the fifth ballot On motion of Ald McCarthy the marshal be instructed to proceed to collect the brokers license according to the ordinance on that subject Also that the city engineer give the property owners along the north side of third street to lay their sidewalks within the shortest possible time according to the resolution adopted at the June session On motion the chief engineer was instructed to take care of the key city hook and ladder truck he thought best Mr W J Cantillion being present on motion he was allowed to address the council in behalf of the residents of the bluffs asking for police protection during the summer months on motion the matter was Martin and Olinger Absent Kavanaugh The mayor stated the object of the meeting to be the consideration of several matters laid over at the regular session Police officers OBrien and Hanlon being present were called on to explain why no arrests were made on the occassion of the disturbance at Bush's Grove on July 1st The officers explained in an apparently satisfactory manner their conduct on the occasion Ald Crawford stated that he had ammended the ordinance in relation to the street railway which had been referred back for that purpose the ordinance as ammended was read and offered as a substitute for the ordinance before submitted Ald Crawford then moved the adoption of the substitute the ayes and nayes were called for and resulted as follows Ayes Ald Clancy Crawford Deckert Glab Martin McCarthy and Olinger 7 Nays Ald Altman Adopted A petition was read from the DNW Railroad asking for right of way through the city also for grounds for depot which was referred to the committee on streets On motion of Ald Crawford the rules were suspended and Mr Knight allowed to address the council in relation to the filling of a certain lot on Jones and Warren Street ald Crawford offered the following whereas Lot No 2 of block no 6 in the Dubuque Harbor Companys addition to the city of Dubuque is subject to be covered with stagnant water at all seasons of the year to the great detriment of the health of that part of the city and whereas it is impossible from the nature of the locality to drain the water from said lot be it therefore resolved that said lot is hereby ordered and required to be filled up and raised to a height equal to the present surface of Jones Street abutting on said lot said raising and filling to be completed by the first day of October 1883 Resolved further that a copy of this resolution duly certified by the recorder under the seal of the city be served by the city marshall on the owner or owners of said lot adopted Regular Session July 9, 1883 sewer at foot of fourth street as the present gutter was nuisance the matter was referred to the committee on streets and engineer with power Petition of Mrs Stafford asking for remission of part of her taxes was referred to the committee on delinquent tax The petition of John Bell et al in relation to the closing of west eighth street between Wilson Avenue and the old corporation line was referred to the committee on streets Remonstrance James Brophy et al in relation to repairing of Julien Avenue between Walnut and Hill Street the resolution ordering the work done and the matter of said improvement postponed and referred to the city engineer to examine into the condition of said street A communication from John Essman and o ther firemen in relation to their dismissal from the Fire Departmenbt was referred to the committee on fire with the city attorney The petition of Frank Rafferty and other residents on South Locust Street complaining as to obstructions in said street and also on the sidewalks was referred to the committee on streets and marshal The petition of Mrs A Murphy Administratix in relation to damage to property caused by flooding of her property was referred to the com on streets The petition of L C Bissell and other resident citizens on the bluffs asking that garbage be collected on the bluffs as well as down town referred to the ex com bd health with power The petition of S M Langworthy in relation to the filling of several lots also for sidewalk grade on Brad Street was referred to the committee on streets Ald Olinger from the committee on fire made the following report your committee to whom was referred the subject of building of Engine houses would respectfully report that they have examined into the matter and would recommend that the city proceed at once to erect an engine house in the 5th ward at a cost of $1500.00 and one on 4th and locust st to cost $4000.00 the above buildings are not to be finished at present but only to consist of walls and roof to protect the apperatus and finished at the pleasure Regular Session July 9, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Altman Clancy and McCarthy 3 Ald Deckert offered the following Resolved by the city council of the city of Dubuque that the alley between Locust and Bluff Street from Fifth to Sixth Street be macadamized in conformity with the ordinance upon that subject and the city engineer b and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder give the proper notice for bids and proposals for the performance of the work the macadamizing to be done at the expense of the owners of the abutting property adopted After rescinding the resolution offered at the last for the improvement of the alley between 10th and 11th street between Jackson and Washington Ald Deckert offered the following Resolved by the city council of the city of Dubuque that the alley between Jackson and Washington street from 11th to 12th street be graded and macadamized in conformity with the ordinance on that subject that the city engineer be and is hereby instructed to make the necessary plans and specifications for said improvement and that the city recorder give the proper notice for bids and proposals for the performance of said work the macadamizing to be done at the expense of the abutting property adopted Ald Crawford offered the following Resolved that the marshal be instructed to assign a policeman to that portion of the city lying on the bluffs which is situated west of Bluff Street north of third street east of Brad Street and south of Julien Avenue also a policeman to patrol that portion of the city on the bluffs situated west of Bluff Street south of Fourteenth Street East of Alta Vista Street and north of Julien Avenue also a policeman on the southern portion of the city this order to remain in force until further that the council proceed to elect three policemen to serve until November 1 1882 adopted The mayor appointed Ald Martin Teller and the council proceeded to ballot which resulted in the election for the positions of Timothy ODriscoll Wm Frith and J P Donehue Ald Glab offered the following REsolved by the city council of the city of Dubuque that loan warrants be drawn n favor of mary S Blake as follows one for $2000.00 one for $2,000 one for $1000 and one for $707.25 also one in favor of N W Kimball for one thousand dollars to pay for the money borrowed to pay current expenses adopted On motion the marshal was instructed to enforce the dog ordinance to such extent as not to draw the city into expense carried Ald Crawford called up the matter of the mississippi river improvement convention and through the city should send a delegate to said convention On motion of Ald Glab that Ald Crawford be allowed the sum of twenty five dollars as expenses and that he attend said convention The motor ordinance and the ordinance for funding the floating debt being called up action on these matters was deferred until the next regular session adjourned Attest J W Halpin Kavanaugh An ordinance granting certain additional rights and privileges to the Dubuque Street Railway Company Be it ordained by the city council of the city of Dubuque Section 1 That in addition to the rights and privileges heretofore granted and now possessed by the dubuque Street railway company under the provisions of an ordinance entitled an ordinance authorizing and regulating street railways in the city of Dubuque adopted October 4th 1867 the following additional rights and privileges are hereby granted to said Dubuque Street Railway to-wit First to change its present line of street railway on Main Street from the intersection of Main and Jones Streets to the intersection of Main and thirteenth Streets Also on Clay Street from the intersection of Clay and Thirteenth Streets to the intersection of Clay and Eighteenth streets also on Eighteenth Street from the intersection of Eighteenth Street and Couler Ave also on Couler Avenue from the intersection of Eighteenth Street and Couler Avenue to Sanford Street from a single to a double track Second to construct maintain and operate in connection with its lines already in operation a line of single track railway with the necessary side trcks and turnouts commencing at the intersection of Main and First or Main and Second Streets at the option of the company and running thence east on First or second street to Iowa Street thence north on Iowa Street to Third Street thence east on third Street to Clay street thence north on Clay Street to Thirteenth St Also commencing at the intersection of Main and Thirteenth St thence northerly to Fifteenth Street thence easterly on Fifteenth St to Clay street also commencing at the intersection of Couler Avenue and Nineteenth Street and running thence Easterly on Nineteenth street to Jackson Street thence northerly on Jackson Street to Lake Street thence easterly on Lake Street to High Street thence northeasterly on High Street to Eagle Point and it is hereby provided that in the event that Lake Street shall hereafter be extended westerly to couler Avenue the line of said railway from couler avenue to Eagle Point shall be so changed as to commence at the intersection of couler avenue and lake street and run thence easterly on lake street to high street in lieu of the route on the portions of nineteenth and jackson streets as above specified it is further provided that no cars shall be run on that portion of Clay street between Twelfth and thirteenth streets during market hours without the consent of the city council Regular Session July 9, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle McCarthy Martin and Olinger Absent Kavanaugh Section 2 The gauge of the tracks of said Dubuque Street Railway company shall be and is hereby fixed at four feet eight and one half inches between the highest portion of the rails and in changing its railway on main street from a single to a double track and in constructing the and additional lines of railway authorized in th eproceeding section of this ordinance said company shallmake use only of a train rail the width of which from outside to outside shall be not less than five inches and the height along the wagon edge and from the train to the highest part of the rail shall not be more than seven-eighths of an inch a section of the kind of rail proposed to be used shall be first submitted to the council an dapproved by the council said company shall within two years from the passage of this ordinance replace the rails now in use on thirteenth Clay and Eighteenth streets and couler avenue from Eighteenth Street to Sanford Street with rails of the kind above described provided that in the construction of the line of railway herein authorized from couler Avenue to Eagle Point said company may use rails taken from its line of railway now in operation and replaced by said new and approved rail The privilege herein granted to said railway company of laying a double track on Main Street is upon the further express condition that said company shall pay to the city of Dubuque one half the expense of lowering the surface of main Street from First to Eighth Street between curbstones in each manner and to such an extent AS THE CITY COUNCIL SHALL DETERMINE AND APPROVE SAID EXPENSE TO BE ASCERTAINED AND DETERMINED BY THE estimates of the city engineer whose report to the council on the subject shall be final and conclusive The aid one half the expense of reducing the surfact of said street so ascertained shall be demed a debt against said street railway company payable within thirty days after the final report and estimate of the city engineer to the city council of the expense of said work the provisions of this section shall have no force unless the work of cutting down the surfact of main Street shall be commenced by the city of Dubuque within one year from the date of the taking effect of this ordinance in the construction of the additional lines of railway provides for in the first section of this ordinance and in changing the line on main street from a single to a double track the tracks shall be placed as near the center of the streets as practicable and shall conform as closely as possible to the surface of the street and shall be constructed and maintained Regular Session July 9, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle McCarthy Martin and Olinger Absent Kavanaugh in such manner as not to obstruct or interfere with the ordinary travel on said streets: it shall be the duty of the street railway company in constructing said additional lines of railway and said double track to re-macadamize the portion of the said streets between rails and between the tracks said work to be done under the supervision and to the approval of the city engineer and said company shall keep the portion of the street between the rails and between the tracks where a double track is laid in perfect repair and condition The officer acting as street commissioner of the city of Dubuque shall be the judge of the necessity for repair at anny time of said portion of any street and shall have authority to make such repairs at the expense of the railway company whenever said company shall neglect to make the same after being notified to do so by said street commissioner Nothing in this section shall be construed to operate to relieve the street railway company from any responsibility for damage caused by the bad condition of its tracks or to render the city of Dubuque liable therefore in the event of teh city of Dubuque shall hereafter change the mode of paving any street occupied by the tracks of the Dubuque Street railway company from macadamizing to any other method of improvement it shall be the duty of said railway compay to improve the portion of teh streets between the rails and between its tracks at its own expense so as to conform to the change made by the City and in case it shall fail to do so the city of Dubuque may cause the same to be done at the expense of the railway company Provided the provisions of this section shall not apply to any change in the mode of having within ten years from the taking effect of this ordinance The rights and privileges hereby granted shall cease and determine as to all streets and parts of streets not occupied with single or double tracks as herein authorized within four years from the date of the passage hereof Provided that if said company shall be delayed by order or injunction of any court or judge thereof in the construction of any portion of the lines of railway or double track thereof the time of such delay shall be given to said company for the completion of the portion of th eline on any street or part of any street over and above teh time designated in this section for the construction and putting in operation of the same This provision for additional time is on the express condition that in case any such injunction or order shall be issued upon the application of any party other than the city of Dubuque said company shall immeditely notify the mayor and city attorney of such order or injunction and therefore the mayor Regular Session July 9, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford assist the attorney of the railway company in so doing said company shall pay all expenses that may accrue by reason of such suit or suits The additional rights and privileges granted by this ordinance shall be subject to all the ocnditions and provisions contained in the ordinance referred to in the first section hereof and to which this ordinance is supplemental and nothing herein contained shall be construd to change impair or waive any of the provisions or requirements of said ordinance nor to revive or extend any of the rights or privileges therein granted and not now in force except as herein expressly provided That if at the expiration of its present charter from the city of Dubuque as amended by this ordinance on the first day of October 1887 Said Dubuque Street Railway Company shall have constructed and put in operation within the time limited in the sixth section of this ordinance all the additional lines of street railway provided for in the first section of this ordinance except from Johnson Avenue to Eagle Point and shall have laid and put in operation the double track on main street in accordance with the provisions hereof and shall in all respects have complied with and carried out in good faith all th eprovisions conditions and obligations of this ordinance and of the original ordinance passed October 2nd 1867 then said company shall be entitled to an extension of all the rights and privileges now in force granted by said original ordinance and hereby amended for a further term of twenty years from the first day of October 1887 That the said Dubuque Street Railway Company shall be required within thirty days from the passage here of to file with the mayor an unconditional acceptance in writing of the provisions of this ordinance that on the filing of said acceptance this ordinance shall be published in the official papers of the city and shall take effect from and after the date of its publication in the Dubuque Daily Herald In case said street railway company fail to file said acceptance within thirty days then this ordinance shall cease to have any further force or effect adopted July 9th 1883 J W Halpin City Recorder Waring being present the rules were suspended and he addressed the council on his plan of sewerage On motion of Ald McCarthy the mayor appointed a committee of five interested citizens to draft a proper ordinance for the purpose of putting in the proposed sewer Ald McCarthy moved to reconsider the resolution offered by Ald Crawford at the previous session in relation to the filing of a certain lot in the Harbor Company's addition as a mistake had been made in the description of said lot the motion prevailed and after amending the resolution so as to read lot 2 of Block 9 in the Harbor
