1883 August Council RecordsSpecial Session August 1, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger the mayor stated the object of the meeting to be to open the bids and let the contract for the building of two engine houses Ald Kavanaugh moved to defer the matter to the regular session Amended by Ald Deckert that the bids be opened and contract let at once Which was again amended by Ald Altman that the whole matter be laid on the table which was lost by a vote of seven to three Moved by Ald Crwaford that the matter be postponed until the regular session was carried Motion by Ald McCarthy that the vote on the motion to postpone was carried Motion by Ald Olinger that the bids be opened and contract let referred to the committee on fire to report at the regular session The city attorney read the contract between the city and G W Burden and pointed out the objections of Mr Burden to Special Session August 1, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger signing the same on motion the matter was referred to the com on gas with the city attorney Ald Glab offered the following resolution Where as the frame building on the north 1/2 of lot 532 in the city of Dubuque and being about 18 feet by 31 feet fronting on main street in said city has become decayed delapidated and untenantable and has for a long time and now is unoccupied and whereas said building in its present location is dangerous to surrounding property and calculated to produce diseas and is unfit for use or habitation Therefore be it resolved by the city council of the city of Dubuque that said building be and the same is hereby declared a nuisance and the marshal is instructed to notify the owner or owners in writing to remove said building within ten 10 days from the service of said notice and in case of the failure of owner or owners to remove said building within the time fixed in said notice the marshal is hereby instructed to procure the same to be removed immediately thereafter and that the expense there of shall be collected to lives and property endangered by the operation of the quarry on Bluff Street extension by Speer and Lee was on motion referred to the committee on streets with the Marshal The petition of James Sloan asking the privilege to build two frame kitchens inside the fire limits was referred to the committee on fire The petition of the Iowa Iron Works asking drainage facilities on Ninth and Washington Streets also the privilege of sinking a well in the sidewalk on Ninth Street was referred to the committee on streets The petition of P Kennedy asking a reduction in assessment and to be allowed to pay without interest referred to com on Del tax The petition of E W Duncan asking for refunding of money erroneously paid on the tax sale referred to the committee on del tax Petition of Mrs E Earley for remission of taxes of 1882 special regular referred to the com on del tax the remonstrance of Mrs Carr and jacob Auer against the improvement of Brad Street was on motion laid on the the gutter on Couler Avenue so as to drain the water into Eagle Point Avenue sewer referred to the committee on streets Petition of Geo Fengler et al for the improvement of High Street Eagle Point was referred to the committee on streets Petition of John Schrup et al for the improvement of an alley was referred to the committee on streets Petitiono f J C Aldrich et al for a sidewalk 4 foot wide on the east side of air hill street was referred to the committee on streets Petition of John Coogan contractor asking for remeasurement of work done was referred to the committee on streets and Ald Crawford Petition of Michl Lavan claiming a mistake of Eng Tschirgi in measuring macadam was refered to the committee on streets Petition of Jennie west claiming error in assessment and asking the refunding of six dollars referred to the committee on delinquent tax Petition of Geo W burden for permission to erect a frame addition to his warehouse referred to the committee on fire with power Petition of Geo Fengler et al for the operation of a ferry at Eagle Point and also a line of street railway from the said ferry to fourth and clay street an ordinance for the operation and maintenance of the same was read the first time the petition and ordinances was referred to the committee on ordinances Regular Session August 6, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger Reports of officers Lamp Lighter Hackney reported having lighted 195 gas lamps during the month of July received and filed Auditor E J Brayton reported the sum of $1267.25 was necessary to pay the city officers and employees of the city for the month of July the report was received and filed and the recorder instructed to draw warrants for the several amounts the city weighers reported as follows First Ward Scales West Dubuque Fifth Ward Market House drafts 15% Justice T T Duffy reported having tried four cases for violation of city ordinances and had collected as fines the sum of three dollars which he paid into the city treasury Also that there was due him the sum of 2.25 the costs in one case the report was received and filed Woodmeasurer Warring reported having measured 700 7/8 cords which arrived by river and rail and had received for measuring the same 28.60 received and filed market Master Rice reported having collected the sum of 26.25 for rent of huckster stands also that he had furnished 72 meals to prisoners and lodgers for which a bill is attached for 14.40 the report was received and filed and bill ordered paid Marshal Zugenbuehler reported the amount of 981.90 was necessary to pay the police force for the month of July that he had collected eight dollars for damage to lamp post one and 50 dollars as fees and two dollars for impounding animals for which receipts are attached that 65 arrests had been made during the month received and filed Regular Session August 6, 1883 Mayor saloons butchers teams peddlers hotels billiard exhibition dogs express livery received and filed City engineer Tschirgi reported an estimate of cost of improving Windsor Avenue at 1787.50 also a communication in relation to the improvement of Julien Avenue with an estimate of cost of said improvement also profiles and grades for south street of Brad Street also of alley between 11th and Jefferson street all of which was referred to the committee on streets He also reported that he had given the grade as petitioned for by Wm L Bradley also as to the dangerous condition of a wall in front of the premises of John Paul on White Street to the committee on streets with power Street commissioner Foster reported the epenses on streets for the month of July as 2032.75 expend as follows Iowa Street Couler Ave Franklin St Stafford Ave Windsor Ave Eagle Point Ave Seminary St Fifth St Third St Crossings Carpenter Work Miscellaeous Total Received and filed Regular Session August 6, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger Treasurer Traut reported having paid out 212.10 interest on warrants also $5.00 for postage and postal cards and asks that warrant be drawn for the amount received and filed Reports of committees Ald Olinger Chairman com on fire reported on several bills referred to that cmmittee and found the same correct and ordered paid The same reported on the bids for building engine houses that Mr Van Wie wished to withdraw his bid leaving P W Jones the lowest bidder Ald Olinger moved that the contracts for building of both houses be let to Mr Jones Amended by Ald Kavanaugh that the contract be let for one house only Ald McCarthy moved to lay the amendment on the table on which motion the ayes and nays were called Ayes Ald Altman Clancy Deckert Glab Hollnagle Martin McCarthy and Olinger 8 Nays Ald Crawford and Kavanaugh 2 It was moved by Ald Crawford that the contract be let for the fifth Ward Engine House which was amended by Ald McCarthy that the motion be laid on the table the ayes and nays were called Ayes Ald Altman Clancy Kavanaugh Martin McCarthy and Olinger 6 Nays ald Crawford Deckert Glab and Hollnagle the original motion being stated by the chair that the contract for both houses be let which was carried by a vote of 8 to 2 The matter of the contracts was then referred to the committee on fire with the attorney Regular Session August 6, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger moved that the chairman of the committee on fire advertise for bids for the material in the old engine houses carried Ald Crawford moved that the committee on Finance be instructed to investigate and report to the council at its adjourned session to be held august 13th whether the sum of $9545.00 required to build the two fire engine houses can be borrowed in addition to the amounts that will have to be borrowed to defray current expenses and at what rate of interest and that the execution of the contracts be postponed until the report of the committee shall be remonstrance of a sewerage which was referred to the committee on ordinance with the attorney and city engineer committee on streets The committee reported on a communication from the city engineer recommending the adoption of the green line as shown on the map as the official grade of lake street that the recommendation be adopted also that the grade of an alley between eleventh and chestnut street as shown on the profile be adopted On the petition of mrs Michael Kane that the prayer of petitioner would be granted as soon as possible on the petition of Frank Brede that the petition had been granted Petition of P Milligan the committee report in favor of referring the petition to the city attorney to determine whether the city can declare the traveled road a legal highway Petition of John Page the committee report that satisfactory arrangements have been made to repair the gutters along the petitioners premises Petition of S M Langworthy the committee report in favor of doing the communication from the city engineer in relation to improvement of alley the com report in favor of the same Petition of Dillon Sutherland that the petition be received and filed Petition of J H Lucas in favor of doing the necessary work on the wall Petition of Hugh Wiley that the petition be received and filed Petition of J Zangmeister in favor of granting the petition to lay sidewalk on the west side of Brad Stree from Julien Ave to Fifth Street Petition of C J richards that the same be received filed Petition of A Loetscher the committee report in favor of the city engineer preparing a profile and grade of Stafford Avenue Petition of John Pell et al that the petition be referred to the city attorney and the aldermen of the fourth ward Petition of James Bookley et al the committee report in favor of having the south side of julien Avenue curbed and guttered from Walnut to Hill Street The committee reported on the petition of the board of education that Nevada Street from Julien Ave to fifth street be graded curbed guttered and macadamized the report was received and further action postponed On the petition of Jas E McClain et al the com report in favor of expending thirty dollars in improving said Bell Street Petition of C Welark that the petition be received and filed On the petition of John Deery the committee report in favor of doing the necessary work to relieve the sewer from flooding the petitioners premises On the petition of James Cushing and Son the committee report in favor of referring the same to the com of the whole on a communication from the city engineer in relation to the house at the intersection of Emmet and Struary Sreet that the same be removed if not repaired within twenty days On the petition of Mrs A Murphy that the parties using the quarry be notified that they will be held liable for all accidents arising from their use of said quarry All of which was adopted Regular Session August 6, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger Ald Hollnagle Chairman Com on delinquent tax reported as follows In favor of granting the petitions of Agatha Kintzel Cath Farrell Jacob Beuselurk Mrs Rischelcth and to allow Geo W Jones to pay $60.00 as special assessment and to pay all taxes from 1878 up to date without interest the same committee reported adversely to the petitions of M Mulligan Henrietta Herzog Nick Webber and Elizabeth Stafford the report of the committee was adopted Ald Glab from the Finance Committee reported in favor of granting the petition of C Welsh the same from the Ex Com Bd of Health reported adverse to the petition D C bissell et al as the removal of garbage would cost too much adopted Ald Crawford from the special committee on delinquent tax sales book asked for further time to report granted Ald Crawford delegate to the Mississippi River Convention made a report that he had attended the convention and that he done what he could to further the interests of Dubuque and that there would be another con vention in washington next winter The city attorney to whom was referred the petition of assessor Gmehl recommended that the further time asked for be granted which was adopted The same reported on the petition of Michael Clark for damages that he found some difficulty in determining the question of fact Ald Crawford moved that Mr Clark be tendered thirty dollars in lieu of all damage the matter was referred to the committee of the aldermen from the fourth ward The city attorney called the attention of the council to the case of Simplot vs the City a committee was appointed to investigate the matter The executive committee of the board of health was on motion instructed to prepare a bill for attending the pest house and present the same for payment to the board of supervisors Regular Session August 6, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin McCarthy and Olinger Resolutions Ald Glab offered the following Resolved by the city council of the city of Dubuque that a warrant be drawn in favor of Ald P W Crawford for thirty and 20/100 dollars to pay expenses incurred in his trip to St Louis adopted ald Glab offered the following Resolved by the city council of the city of Dubuque that the finance committee be instructed to borrow three thousand dollars for the purpose of defraying expenses for the month of July Adopted Ald Glab offered the following Resolved by the city council of the city of Dubuque that a warrant be drawn in favor of the city treasurer for two hundred and seventeen and 04/100 dollars for interest paid on loan warrants adopted Ald Glab offered the following resolved by the city council of the city of Dubuque that the water district for the year 1883 be the same as for the year 1882 with the following addition that it run from the junction of First street extension and the outer levee to the south line of the Dubuque Harbor Cos addition thence west along said south line of the Dubuque Harbor cos addition to south locust street thence north along locust street to unite with the present line at railroad avenue referred to a committee of one from each ward to consist of Ald Glab Martin Hollnagle McCarthy and Kavanaugh Ald Crawford offered the following resolved that that portion of park street between center street and the city line be macadamized at the expense of the city the same width as the street beyond is being macadamized by the county the work to be done Olinger Resolutions Ald Deckert offered the following Resolved by the city council of the city of Dubuque that the south side of Julien Avenue between west Eighth street and lot 8 of Kelly's sub be graded guttered and curbed in conformity with the ordinance on that subject That the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the guttering and curbing to be done at the expense of the owners of abutting property adopted Hollnagle Kavanaugh McCarthy and Olinger Absent Ald Martin The mayor stated the object of the meeting to be to take action on several important matters laid over from the regular session ald Crawford from the committee on ordinance reported as follows To the city council of the city of Dubuque your committee on ordinance to whom was referred the ordinance entitled an ordinance authorizing the establishment and operation of the Eagle Point Ferry respectfully report that we have carefully eamined the provisions of said ordinance and recomend its adoption respectfully submitted C W Crawford P Olinger M H McCarthy com The ordinance was read for the second time and put upon its passage And ordinance authorizing the establishment and operation of the eagle point ferry Be it ordained by the city council of the city of Dubuque Sec 1 that free license full authority and right be and are hereby granted to John Rugamer John Trexler J Schroeder John Klein Frank Schroeder and Geo Fengler and their assigns to establish and for the period of twenty five yeras from the passage of this ordinance maintain and operate a ferry to be known as the Eagle Point Ferry from the point on the Mississippi near Eagle Point in said city where division street in said city meets said river across said Mississippi River to the easterly shore of said river in the state of Wisconsin under the provisions contained in this ordinance Adjourned Session August 13, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh McCarthy and Olinger Absent Ald Martin Sec 2 that within one year from the passage of this ordinance said grantees and assigns shall procure and keep at said ferry one or more boats of sufficient capacity to accomodate the public travel and business at said ferry commerce and thereafter during all seasonable times continue to run said boat or boats across said Mississippi river from the place where division Street in said city meets the shore of said river near Eagle point to the easterly side of said river in the state of Wisconsin and on being paid therefore herein provided for receive and transport over said river all persons desiring to cross and all freight offered for transportation Sec 3 That in keeping and running said Ferry Said grantees and assigns shall use all proper care and prudence to insure the safety and convenience of the traveling public Sec 4 That the city council of Dubuque shall have the right to make such rules and regulations for said ferry as it may think necessary and fix from Whereas the finance committee reported that it will be difficult if not impossible in addition to the amounts which will have to be borrowed every mmonth until next winter to defray the ordinary expenses of the city to borrow the sum of $9500 required to build the two engine houses and whereas the proposed expedient of drawing warrants on the treasury in payment for said work when there will be no funds to meet them thereby compelling the contractor to hawk them about for sale to obtain money to carry on the work is the adoption of a dangerous practice which in times past has proved disastrous and highly injurious to the credit of the city and therefore right not to be resorted and whereas in the opinion of many citizens the erection of one engine house is as much as right to be undertaken this season and will supply the present needs of the fire department Be it therefore resolved that only one engine house be constructed for at this time and that the erection of more be postponed until next spring Ald McCarthy moved to lay the resolution on the table The ayes and nays were called Ayes Ald Altman clancy Deckert Hollnagle McCarthy and Olinger si Nays Ald Crawford Glab following Resolved that the city treasurer is hereby authorized to collect the delinquent city tax that is now due at a cost of not more than five percent of the amount collected and that said city treasurer Paul Traut be held on his official bond for any acts of said collector adopted Ald Crawford moved that the committee on fire be authorized to purchase 500 feet of additional hose lost Ald Olinger tendered his resignation as chairman of the committee on fire stating that he would serve on that committee no longer Ald Olinger reported on the petition of G W Burden in favor of granting the prayer of petitioner provided he would agree to vacate the premises on proper notice which was agreed to adopted The petition of S M Langworthy in relation to tax deed held by Hintrager referred to the com on del tax The City Engineer made a rpeort and estimate of cost of extending the grove street wall which was received and action postponed unti the regular session Ald Carwford offered the following resolved that the second alley west of Bluff street be hereafter known as the Wiegle Alley adopted Ald Deckert offered the following Resolved by the city council of the city of Dubuque that the Wiegle alley be graded and macadamized in conformity with the ordinance on that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of said work the macadamizing to be done at the expense of the owners of the abutting emayor Aldermen City officers members and officers of the fire department At the request of the executive committee of the early settlers association of Dubuque County I write to earnestly request you as a body to unite in celebrating the semi-centennial of the first settlement of Iowa We hope by your aid to make the occasion a memorable one It should be so for it was here that Iowa was first settled and where she commenced under adverse circumstances her march to that high position which she now occupies among her sister states It was here that the first houses were erected the first farms made and the first white child born we have every assurance that the celevration will be a success that it will not only be one of pleasure to our citizens and their families but to all who may attend yours respectfully TS Wilson Pres On motion the rules were suspended and Mssrs T S Wilson J P Quigley John McClay and mr Myers addressed the council in relation to the celebration about to take place on the 3rd of Sept On motion the invitation was accepted of and the police force and fire department to take part in the procession also that the use of the city hall be granted free for a ball on the occasion Special Session August 16, 1883 Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Kavanaugh and Olinger Absent Ald Clancy Martin and McCarthy the mayor stated that he had revoked the saloon license of mathias Weiner on complaint of keeping a disorderly house awaiting the action of the council On motion the action of the mayor was approved of he to take such further action in the matter as he thought proper Ald Olinger offered the following Be it resolveed that we proceed to build an engine house on the corner of eighteenth street and couler ave at once according to plans and specifications already drawn Moved by Ald Olinger that the vote taken at the last session whereby the matter of Engine Houses was indefinitely postponed be reconsidered amended by Ald Kavanaugh that the motion be laid on the table lost moved by ald deckert that the rules be suspended and the resolution of ald Olinger be put upon its passage lost the committee on fire reported in favor of allowing Peter Hansen to finish his frame barn inside the fire limits the petition of F E Robert for permission to erect a frame building inside the fire limits was referred to the committee on fire with power Moved by Ald Crawford that the committee on fire be authorized to purchase 1000 feet of new hose for the use of the fire department Amended by Ald Olinger that the
