The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report and related materials are attached for your review.
Discussion
Dan Miller, 1013 Patricia Ann Drive, spoke on behalf of the application. He explained that
they would like to zone the house and lane as residential. He noted that that this is part
of settling his family's inheritance, his brother wants to stay in the house, and they want
to sell the farmland separately.
Staff detailed the staff report and described the surrounding area noting that this would
be an expansion of the adjacent R-1 zoning. Staff explained that the AG district does not
allow a home as a principal use, so the applicant is seeking to rezone to allow the home
to be separate from the farmland zoned AG. Staff displayed the plat of the land
subdivision but clarified that the subdivision plat is not under the Commission's review
and that the plat is in substantial conformance with city code.
There were no public comments.
The Zoning Advisory Commission discussed did not have any questions or concerns and
found the request appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approved the request.
A simple majority vote is needed for the City Council to approve the request.

Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
infill and mixed -use development. The City's Future Land Use Plan identifies the
property as Single -Family Residential. As proposed, the rezoning would be consistent
with that land use designation.
Impact of Request on:
Utilities: The site is adequately served by both city water and sanitary sewer. Mains for
both utilities are located along Peru Road.
Traffic Patterns/Counts: The Iowa Department of Transportation (IDOT) last counted
the vehicle trips alone along this section of Peru Road in 2021. At that time, the
average annual daily traffic count was 6,000 vehicles. The applicant is requesting to
rezone approximately 1.85 acres of the subject property to R-1 in order to allow the
existing single-family residence to be on a lot separate from the agricultural use. The
remaining approximately 21 acres of the site will continue to be used for agriculture.
Since the proposed rezoning will not change the uses (residential and agriculture) that
already exist on the property, it is not anticipated that the rezoning request would result
in a negative impact on traffic in the area.
Public Services: Public services are adequate to serve the site regardless of how it
may be utilized or redeveloped.
Environment: The subject site totals approximately 23 acres. The property has
historically been utilized for agriculture uses and is improved with a single-family
residence and detached accessory structure. The property owner wishes to rezone an
approximately 1.85 acres area of the site in order to allow the existing single-family
residence to be on a lot separate from the agricultural use.
The single-family residential use exists and is consistent with the adjacent residential
uses surrounding the property. As such, it is not anticipated that there would be any
adverse effects on the environment.
Adjacent Properties: The subject property is surrounded by residential and agriculture
properties on all sides. The requested R-1 rezoning would be a continuation of the
permitted residential uses in the surrounding area.
CIP Investments: None.
Staff Analysis: The applicant is seeking to rezone a portion of the property from AG
Agriculture to R-1 Single Family Residential zoning district. The subject site has
historically been zoned for agriculture use and is an active farming operation.
The subject site consists of two lots totaling an approximately 23-acre lot. The property
is improved with an existing single-family residence and a detached accessory

denotes the area proposed to be rezoned to R-1. Per the image below, the proposed
Lot 1 would contain the existing single-family residence and detached accessory
structure, and Lot 2 would contain the existing agriculture use.

In the AG -Agriculture zoning district, a single-family residence is only allowed as an
accessory use to a principal permitted use such as agriculture. Consequently, the
applicant is requesting to rezone the proposed 1.85-acre Lot 1 from AG to R-1 in order
to allow the existing single-family residence as a permitted principal use separate from
the agriculture use.
Below is a chart showing the permitted uses in both the AG and R-1 zoning districts.
The highlighted items are permitted in both zoning districts. The R-1 zoning district

The AG district is intended to conserve farmland for agricultural purposes and to serve as a "holding" zone to prevent the premature development of large

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter —described
property from AG Agriculture District to R-1 Single -Family Residential , to wit:
As shown on Exhibit A, and to the centerline of the adjoining public right-of-
way, all in the City of Dubuque, Iowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication as
provided by law.

PUBLIC NOTICE is hereby given that the Dubuque City Council
will conduct public hearings on the 21st day of July, 2025, at
6:30 p.m., in the Historic Federal Building, 350 W. 6th
Street, 2nd floor, Dubuque, Iowa, on the following:
REZONINGS
1. Request from Michelle Mihalakis to rezone property
located at 2167 Jackston St. from R-2A Alternate Two -Family
Residential to C-4 Downtown Commercial zoning district.
2. Request from Freddy Kammiller to rezone property at Bluff
Street, PIN 1025401021 from R-2 Two -Family Residential to OR
Office Residential zoning district.
3. Request from Dan Miller, Miller Family Property, LLC to
rezone property at 4178 Peru Road from AG Agriculture to R-1
Single -Family Residential zoning district.
TEXT AMENDMENT
1. Request from City of Dubuque to amend the Unified
Development Code C-5 Central Business zoning district
requirements for wall and freestanding signs.
At the meeting, the City Council will receive oral and
written comments from any resident or property owner of said
City to the above action. The official City Council agenda
will be posted the Friday before the meeting and will contain
public input options. The agenda can be accessed at
