The Dubuque City Council met in special session at 5:30 p.m. on May 6, 2024, in the
second-floor Council Chambers of the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell,
Sprank, Wethal; City Manager Van Milligen, City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a special session of the City Council
called for the purpose of conducting work sessions on Project HOPE and iJAG’s City Life
Presentation.
WORK SESSIONS
1. Project HOPE Update
Alex Baum, Director of Advocacy, Data, and Learning with the Community Foundation
of Greater Dubuque presented an update on Project HOPE activities and responded to
questions from the City Council.
This work session concluded at 6:01 p.m.
2. Iowa Jobs for America’s Graduates (iJAG) City Life Student Presentation to City
Council
Community Engagement Coordinator Temwa Phiri made introductory remarks. iJAG
Education Specialist Janie Hessong provided an overview of the iJAG program at Ste-
phen Hempstead and Dubuque Senior High Schools. Laila Saunders, Ana Bermudez,
Wyleah Jaeger, and Olivia Skemp presented about their experiences participating in City
Life and responded to questions from the City Council.
There being no further business, Mayor Cavanagh declared the meeting adjourned at
6:25 p.m.

The Dubuque City Council met in regular session at 6:32 p.m. on May 6, 2024, in the
second-floor Council Chambers of the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell,

Mayor Cavanagh read the call and stated this is a regular session of the City Council
called for the purpose of conducting such business that may properly come before the
City Council.

1. Neighborhood Association Recognition was accepted by Sandy Plumley, Robin
Kennicker, Hilary Dalton, Cathy Sorenson, Sheri Copley, Thea Dement, and Jerry Noll on

2. Building Safety Month (May 2024) was accepted by Building Code Advisory and
Appeals Board Member Tom Townsend on behalf of the Housing and Community Devel-

8. Walk, Bike, and Roll to School Day (May 8, 2024) was accepted by Assistant Planner
Jason Duba on behalf the Safe Routes to School Partnership, consisting of the City of

Dubuque, the Dubuque Community School District, and Holy Family Catholic Schools.
9. Public Works Week (May 19-25, 2024) was accepted by Public Works Director Ari-
elle Swift and City Engineer Gus Psihoyos on behalf of the Public Works Department and
Engineering Department.
10. Ric Jones 50 Years of Service Recognition: Mayor Cavanagh presented Council
Member Jones with a surprise proclamation commemorating his 50 years of service to
the City of Dubuque.

3. Disposition of Claims: City Attorney advised that the following claims have been
referred to Public Entity Risk Services of Iowa, the agent for the Iowa Communities As-
surance Pool: John Klauer for vehicle damage; Cassidy Loffa for vehicle damage; Scott
Puccio for vehicle damage; Katherine Shaffer for vehicle damage. Upon motion the doc-
uments were received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed,
and Resolution No. 104-24 Authorizing the Chief Financial Officer/City Treasurer to make
certain payments of bills that must be paid and approved for payment in accordance with
City procedures was adopted.

AUTHORIZING THE CHIEF FINANCIAL OFFICER / CITY TREASURER TO MAKE

CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAY-
MENT IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that
the Finance Director-City Treasurer shall keep an accurate account of all disbursements,
money, or property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods
and services have been pre-audited by Finance Department personnel in accordance
with generally accepted internal control procedures and have been determined to have
been requisitioned for a lawful municipal purpose; and
Whereas, the Chief Financial Officer-City Treasurer has provided a list of Expenditures
attached hereto, and by this reference made a part hereof, to be drawn to pay for goods
and services provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -
18 adopted May 7, 2018, authorized the Chief Financial Officer -City Treasurer to issue
checks in payment of certain expenditures known as Exception Expenditures prior to Cit y
Council approval and such list is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The Chief Financial Officer-City Treasurer is hereby authorized to issue
payment for goods and services provided for City purposes in response to the purchase
orders and contracts issued in compliance with state and municipal code requirements
as requested by designated requisitioning authorities in accordance with approved budget
appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Chief
Financial Officer are hereby authorized and directed to provide the statement of receipts
and disbursements to the City Council, and to publish a summary thereof.

5. Maturity Extensions of State Revolving Fund Planning and Design Loans, Series
2021A, 2021B and 2021C: Upon motion the documents were received and filed, and
Resolution No. 105-24 Extending the Maturity Dates of the City’s Sewer Revenue Capital
Loan Notes Anticipation Project Notes, Series 2021A -C was adopted.

RESOLUTION EXTENDING THE MATURITY DATES OF THE CITY’S SEWER REVE-
NUE CAPITAL LOAN NOTES ANTICIPATION PROJECT NOTES, SERIES 2021A-C
Whereas, the City Council of the City of Dubuque, Iowa (the “City”), has previously
authorized the issuance of its Sewer Revenue Capital Loan Notes Anticipation Project
Note, Series 2021A, in a principal amount not to exceed $970,000 (the “Series 2021A
Project Note”) to the Iowa Finance Authority, as lender (the “Lender”), for the purpose of
paying the cost, to that extent, of planning and designing improvements and extensions
to the Municipal Sanitary Sewer System (the “Utility”) of the City; and
Whereas, the City Council has also previously authorized the issuance of its Sewer
Revenue Capital Loan Notes Anticipation Project Note, Series 2021B, in a principal

amount not to exceed $350,000 (the “Series 2021B Project Note”) to the Lender for the
purpose of paying the cost, to that extent, of planning and designing improvements and
extensions to the Utility; and
Whereas, the City Council has also previously authorized the issuance of its Sewer
Revenue Capital Loan Notes Anticipation Project Note, Series 2021C, in a principal
amount not to exceed $160,000 (the “Series 2021C Project Note”) (the Series 2021A
Project Note, the Series 2021B Project Note and the Series 2021C Project Note are col-
lectively referred to hereinafter as the “Project Notes”) to the Lender for the purpose of
paying the cost, to that extent, of planning and designing improvements and extensions
to the Utility; and
Whereas, the City intended to refund the Project Notes by their scheduled maturity
date on March 19, 2024, through the issuance of bonds or notes, but refunding proceeds
were not yet available to the City; and
Whereas, the Lender has agreed to extend the maturity date of the Project Notes to
September 19, 2024, on the terms hereinafter set out.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA, AS FOLLOWS:
Section 1. The maturity date of the Project Notes is hereby extended to September 19,
2024, and the Project Notes shall continue to bear interest at the rate of 0% per annum
from the date hereof to their maturity.
Section 2. The City Council hereby reserves the right to prepay principal of the Project
Notes in whole or in part at any time prior to the maturity thereof with accrued interest to
the date of such payment.
Section 3. The Mayor and City Clerk are hereby authorized and directed to enter into
whatever legal documents are required by the Lender to effectuate the provisions of this
resolution.
Section 4. All resolutions or parts of resolutions in conflict herewith be and the same
are hereby repealed, to the extent of such conflict.

6. 2024 – Q2 Update on Childcare Challenges and Collaborations: Upon motion the
documents were received and filed.
7. Burlington Street Water Main Improvement Project 2023: Project Acceptance and
Resolution: Upon motion the documents were received and filed, and Resolution No. 106-
24 Accepting Public Improvement Contract for the Burlington Street Water Main Improve-
ment Project was adopted.

ACCEPTING PUBLIC IMPROVEMENT CONTRACT FOR THE BURLINGTON
STREET WATER MAIN IMPROVEMENT PROJECT
Whereas, the public improvement contract for the Burlington Street Water Main Im-
provement Project (the Project) has been completed by the Contractor, Tschiggfrie Exca-
vating of Dubuque, Iowa, (Contractor), the Water Department Director has examined the

work and recommends that the Project be accepted; and
Whereas, the final contract amount is $351,987.11 of which retainage in the amount
$18,214.95 shall be held for 30 days after acceptance and approval, and paid at that time
provided no claims from others are filed; and
Whereas, the City Council finds that the recommendation of the Water Department
Director should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the Water Department Director is approved, and
the Project is hereby accepted.
Section 2. The Chief Financial Officer is hereby directed to pay to the Contractor the
balance of the final payment of $18,214.95 as provided in Iowa Code chapter 573.13.

8. Award of CY2024 Family Self Sufficiency Coordinator Grant : Upon motion the doc-
uments were received and filed, and Resolution No. 107 -24 Authorizing the Director of
Housing and Community Development to execute the acceptance of the notice of award
for the HUD Family Self-Sufficiency Program Grant was adopted.

AUTHORIZING THE DIRECTOR OF HOUSING AND COMMUNITY DEVELOPMENT
TO EXECUTE THE ACCEPTANCE OF THE NOTICE OF AWARD FOR THE HUD
FAMILY SELF-SUFFICIENCY PROGRAM GRANT
Whereas, the U.S. Department of Housing and Urban Development has published a
Notice of Funding Availability (NOFA) for the Family Self-Sufficiency Program to be uti-
lized for the salaries of program coordinators combining the funding for the FSS coordi-
nators that serve Housing Choice Voucher (HCV) participants and/or Public Housing (PH)
participants for Calendar Year 2024; and
Whereas, the City of Dubuque has administered Project Self-Sufficiency since Sep-
tember 1987 that became the Family Self-Sufficiency (FSS) Program in July 1994; and
Whereas, the City of Dubuque has received funding for an FSS coordinator continu-
ously from 1994 thru 2019, 2021 thru 2023; and
Whereas, the City of Dubuque proposes to continue administering the FSS program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1: That the Director of Housing and Community Development is hereby au-
thorized and directed to execute the Notice of Award (HUD Form 1044) for the HUD FSS
program grant.
Section 2: That the Director of Housing & Community Development is hereby author-
ized and directed to forward said grant award and resulting standard executed contract
to the respective agencies in a timely fashion and as required by the U. S. Department of
Housing and Urban Development.

9. Five Flags Pyrotechnics Permit: City Manager recommended City Council approval
of a permit to use pyrotechnics at a music performance at Five Flags on May 17, 2024.

10. Request Approval to Hire a Temporary Summer Teen Night Supervisor Position
for the 2024 Season: Upon motion the documents were received, filed, and approved.
11. 2024 Maintenance Dredging Project No. 1 - Award Public Improvement Contract
Project Number: 5546000001-304-67990 Harbor Area Dredging: Upon motion the docu-
ments were received and filed, and Resolution No. 108-24 Awarding Public Improvement
Construction Contract for the 2024 Maintenance Dredging Project No. 1 was adopted.
RESOLUTION NO. 108-24
AWARDING PUBLIC IMPROVEMENT CONSTRUCTION CONTRACT FOR THE 2024
MAINTENANCE DREDGING PROJECT NO. 1
Whereas, sealed proposals have been submitted by contractors for the 2024 Mainte-
nance Dredging Project No. 1, (the Project) pursuant to Resolution No. 74-24 and Notice
to Bidders published on the City of Dubuque, Iowa website and plan room service with
statewide circulation on the 5th day of April 2024; and
Whereas, said sealed proposal was opened and read on the 25th day of April 2024
and it has been determined that Newt Marine Service, of Dubuque, Iowa submitted low
bid in the amount of $312,000.00, and is the lowest responsive, responsible bidder for the
Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That a Public Improvement Construction Contract for the Project is hereby
awarded to Newt Marine Service and the City Manager is hereby directed to execute a
Public Improvement Construction Contract on behalf of the City of Dubuque for the Pro-
ject, subject to the concurrence of the Iowa DNR and USFWS.

12. Kerper Court and Kerper Boulevard Intersection Improvement Project (PROJECT
5521000047): Upon motion the documents were received and filed, and Resolution No.
109-24 Accepting the Kerper Court and Kerper Boulevard Intersection Improvement Pro-
ject and authorizing final payment to the contractor was adopted.

ACCEPTING THE KERPER COURT AND KERPER BOULEVARD INTERSECTION IM-
PROVEMENT PROJECT AND AUTHORIZING FINAL PAYMENT TO THE CONTRAC-
TOR
Whereas, the Public Improvement Contract for the Kerper Court and Kerper Boulevard
Intersection Improvement Project (the Project) has been completed by the contractor,

Eastern Iowa Excavating and Concrete LLC (Contractor), and the City Engineer has ex-
amined the work and recommends that the Project be accepted; and
Whereas, the final contract amount for the Project is $1,052,761.98; and
Whereas, the Contractor has previously been paid $1,000,123.88, leaving a balance
of $52,638.10; and
Whereas, the City Council finds that the recommendation of the City Engineer should
be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Director of Finance and Budget is hereby directed to pay the balance
of the retainage of $52,638.10 as provided in Iowa Code chapter 573, and to pay such
retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa chapter
26.13.

13. Schmitt Island Sanitary Improvements Project: City Manager recommended City
Council approval of the committee and authorization to release an RFP for a consultant
to assist with the design of the Schmitt Island Sanitary Improvements Project. Upon mo-
tion the documents were received, filed, and approved.
14. Approval of an Easement Agreement for a Permanent Signage Easement across
QWEST Corporation Property on John F. Kennedy Road as part of the Smart Traffic
Routing with Efficient Traffic Signals (STREETS) Project: Upon motion the documents
were received and filed, and Resolution No. 110-24 Approving an agreement with
QWEST Corporation for a grant of permanent signage easement over QWEST Corpora-
tion Property on JFK Road as part of the STREETS Project, in the City of Dubuque, Iowa
was adopted.

APPROVING AN AGREEMENT WITH QWEST CORPORATION FOR A GRANT OF
PERMANENT SIGNAGE EASEMENT OVER QWEST CORPORATION PROPERTY ON
JFK ROAD AS PART OF THE STREETS PROJECT, IN THE CITY OF DUBUQUE,
IOWA
Whereas, QWEST Corporation. has executed an Easement Agreement for a Grant of
Permanent Signage Easement through, under and across Part of Lot 1 of US West Place
in City of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of the Ease-
ment Agreement for a Grant of Permanent Signage Easement through, under and across
Part of Lot 1 of US West Place in City of Dubuque, Iowa, a copy of which is attached
hereto.

Section 2. The City Manager and Mayor are hereby authorized and directed to execute
and acknowledge on behalf of the City of Dubuque any instruments in connection here-
with.

15. Irrevocable License – 799 Locust Street: City Manager recommended City Council
approve the irrevocable license for Cottingham & Butler at 799 Locust Street to encroach
in the public right of way as described in the irrevocable license. Upon motion the docu-
ments were received, filed, and approved.
16. Southwest Arterial / US52 Corridor Right-of-Way Survey & Replat: AECOM - Con-
sultant Services Supplemental Agreement No. 1 : Upon motion the documents were re-
ceived and filed, and Resolution No. 111-24 Approving the Consultant Professional Ser-
vices - Supplemental Agreement No. 1 Between AECOM Technical Services, Inc. and
the City of Dubuque to complete land survey and replating of property along the South-
west Arterial / US52 Corridor from US Highway 20 to US Highway 61 / 151 was adopted.

APPROVING THE CONSULTANT PROFESSIONAL SERVICES -SUPPLEMENTAL
AGREEMENT NO. 1 BETWEEN AECOM TECHNICAL SERVICES, INC. AND THE
CITY OF DUBUQUE TO COMPLETE LAND SURVEY AND REPLATING OF PROP-
ERTY ALONG THE SOUTHWEST ARTERIAL / US52 CORRIDOR FROM US HIGH-
WAY 20 TO US HIGHWAY 61 / 151
Whereas, per the terms of the Memorandum of Understanding (MOU) and the Transfer
of Roadway Jurisdiction (TOJ) Agreements between the City and the Iowa Department
of Transportation, the City is responsible for the survey and replating of the highway cor-
ridor to allow for the roadway and interchange property to be conveyed from the City of
the State of Iowa; and
Whereas, now that the Southwest Arterial / US52 project is completed, the City re-
tained AECOM Technical Services, Inc. to survey and plat the highway access control
right-of-way, plating the interchange locations, plating right-of-way for the frontage roads,
and identifying any potential excess remnant parcels. Once the replating of the highway
access control right-of-way is completed from US 20 to US 61 / 151, the highway corridor
property will be conveyed from the City of the State of Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That said Consultant Professional Services - Supplemental Agreement No.
1 between AECOM Technical Services, Inc. and the City of Dubuque for to complete land
survey and replating of property along the Southwest Arterial / US52 corridor from US
Highway 20 to US Highway 61 / 151 is hereby approved.
Section 2. That the City Manager be authorized and directed to execute said Consult-
ant Professional Services - Supplemental Agreement No. 1 with AECOM Technical Ser-
vices, Inc.

17. 2024 LEMHWA COPS Grant: City Manager recommended City Council approval
to apply for the 2024 Law Enforcement Mental Health and Wellness Act (LEMHWA) Grant
in the amount of $118,062.63. Upon motion the documents were received, filed, and ap-
proved.
18. Letter of support for Chronic Wasting Disease Ambassadors: City Manager recom-
mended City Council approval of a letter of support for the Iowa Department of Natural
Resources and Iowa State University Extension to the Wildlife Society's Conservation
Education Award for their Chronic Wasting Disease (CWD) course. Upon motion the doc-
uments were received, filed, and approved.
19. Letter of Support for Crescent Community Health Center's funding request for the
Advance Cancer Prevention and Care for Blacks/African Americans Program : City Man-
ager provided a copy of a letter of support to the Iowa Cancer Consortium Board of Di-
rectors to fund Crescent Community Health Center's Advance Cancer Prevention and
Care for Blacks/African Americans Program. Upon motion the documents were received,
filed, and approved.
20. Amended Citizen Participation Plan: Upon motion the documents were received
and filed, and Resolution No. 112-24 Adopting the Amendment of the Citizen Participation
Plan for the Community Development Block Grant Program was adopted.

ADOPTING THE AMENDMENT OF THE CITIZEN PARTICIPATION PLAN FOR THE
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
Whereas, the City of Dubuque, through a public meeting proposed the Amended Citi-
zen Participation Plan for the Community Development Block Grant Program; and
Whereas, the Community Development Advisory Commission held a public meeting
on April 17th, 2024 to receive community input on the Amended Citizen Participation Plan

Whereas, City and Wilson House Apts., LLC have entered into a Development Agree-

Whereas, the City Council has tentatively determined that it would be in the best inter-

newal Tax Increment Revenue obligations, as provided by Iowa Code Chapter 403 pur-

continued provision of transit service for the citizens of Dubuque.

2. Greater Dubuque Development Corporation - Quarterly Update: Motion by Roussell
to receive and file the documents and listen to the presentation. Seconded by Resnick.
President and CEO Rick Dickinson presented the quarterly update on the activities of the
Greater Dubuque Development Corporation (GDDC). Responding to questions from the
City Council, Mr. Dickinson summarized the history of the Access Dubuque Jobs website
and GDDC’s support of the iJAG program. Motion carried 7-0.
3. 2024 Dubuque Area Chamber of Commerce Washington DC Fly -in Report: Motion
by Farber to receive and file the documents and listen to the presentation. Seconded by
Jones. Director of Strategic Partnerships Teri Goodmann provided a report on the 2024
Dubuque Area Chamber of Commerce Washington DC Fly-in. Council Members thanked
Ms. Goodmann for coordinating the event. Motion carried 7-0.
4. Reschedule Work Session: Inclusive Dubuque Update: Motion by Roussell to re-
ceive and file the documents and update the work session start time to 6:00 p.m. on
Monday, May 20, 2024. Seconded by Wethal. Mayor Cavanagh stated that he will miss
the work session due to attending the American Flood Coalition Summit. Motion carried
7-0.
5. Work Session Request: Historic Millwork District Master Plan Update : Motion by
Jones to receive and file the documents and reschedule the work session to review the
final draft of the Historic Millwork District Master Plan from 5:15 p .m. to 6:00 p.m. on

COUNCIL MEMBER REPORTS
Council Member Roussell reported on presenting at the Growing Sustainable Commu-
nities Conference, attending Dubuque Trees Forever’s Arbor Day Celebration, volunteer-
ing for Dubuque Days of Caring, and volunteering for Dubuque Main Street’s Summer
Farmer’s Market.
Council Member Sprank also reported on Dubuque Days of Caring, in addition to at-
tending the first responder’s dinner, neighborhood association meetings, the ground-
breaking for The Key Hotel on Chaplain Schmitt Island, and the opening day of the Dubu-
que Farmers Market. Mr. Sprank also reported on meeting s with residents of Table

Mound Mobile Home Park and an artist who is making a sculpture out of refurbished
Comiskey Park playground equipment for Audubon Elementary.
Council Member Farber congratulated Dr. Jeffrey Bullock on his retirement as Presi-
dent of the University of Dubuque. Ms. Farber also reported on attending the Visiting
Nurses Association (VNA)’s golf fundraiser and the upcoming Millwork Night Market.
Council Member Jones also reported on attending The Key Hotel groundbreaking. Mr.
Jones additionally reported on the recent adoption of the Dubuque Metropolitan Solid
Waste Agency’s Strategic Plan, delivering remarks at a Workers Memorial Day event,
and the Fire Department’s Hall of Fame Awards.
Mayor Cavanagh reported on three recent events that occurred: the Growing Sustain-
able Communities Conference, the Julien Dubuque International Film Festival, and the
University of Iowa’s Initiative for Sustainable Communities Partnership.
City Manager Van Milligen stated that Council Member Wethal recently had an op-ed
on school safety published in the Telegraph Herald.
CLOSED SESSION
Motion by Jones to convene in closed session at 8:47 p.m. to discuss Pending Litiga-
tion and Purchase or Sale of Real Estate – Chapter 21.5(1)( C),(j) Code of Iowa. Se-
conded by Wethal. Mayor Cavanagh stated for the record that the attorney who will con-
sult with City Council on the issues to be discussed in the closed session is City Attorney
