Faherty et al requesting that the alley between 3rd and Fenelon Streets macadamized from Burch Street to the point of the hill in the easts referred to com on streets The petition of Ella M Weigel to reconsider the order issued for macadamizing the alley kown as the Weigel alley referred to com on streets The petition of Henry Reed asking that proceedings against him for obstructing 1st street slough be discontinued referred to com on harbors city atty and wharf master with power The petition of Dan'l Breen requesting removal of smoke sack erected by John D Bush adjacent to his premises Donohue for remission of taxes referred to com on del tax Reports of officers the recorder reported having issued thirty five licenses during the month of September for which he holds treasurers receipt for the amount of $1125.50 Received and filed Treasurer Traut reported having paid out the following amounts during the month of September for which he asks that warrants be drawn damage to property on Grand View Ave 15.00 interest on loan warrants $324.11 Postage 9.00 the report was received and filed and the recorder instrructed to draw warrants for the amounts Regular Session October 1, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin and McCarthy Absent Ald Olinger W Zugenbuehler reported that the sum of 1036.75 was necessary to pay the police force for the month of September also that he had collected the um of 8.00 for damage to lampost and 9.25 for impounding He also reported that officer hall had left the city without permission for 6 days the report was received and filed and the recoder instructed to deduct 6 days pay from officer hall's salary. Deputy Marshall O'Neil reported havin gserved the proper notice on Wm Hintrager to abate a certain nuisance situated on his property received and filed Wood Measurer Warring reported having weighed 1132 1/2 cords of wood which arrived by river and rail during the month of September received and filed Treasurer Traut reported that it would be necessary to borrow the sum of six thousand dollars to defray the expenses of the month of September and asked that the finance com be authorized to borrow that amount r and f Chief Engineer Drehouse reported having collected six & 50/100 dollar for old hose and junk sold for which he returns a receipt from the treasurer E Reynoldson weigher at the first ward scales reported having weighed 416 drafs for which he received 62.40 for 15% of which he returns a treasurers receipt for 9.55 received and filed Chas pitschner weigher at the west dubuque scales reported having weighed 153 drafts the gross receipts of which is 22.95 15% of which or 3.45 he returns a receipt from the treasurer received and filed F Fosselman weigher 5th ward scales reported having weighed 127 drafts the gross receipts 19.05 15% of which 2.85 he returns a receipt from the treasurer received and filed Market master rice reported having weighed 149 drafts for which he received 46.60 also for rent of huckster stands the sum of 24.25 for which he returns treasurers receipt he also reported having paid for 126 meals for prisoners and lodgers amounting to $25.20 and asks that a warrant be drawn in his favor for that amount the report was received and filed and the recorder instructed to draw a warrant for the amount of the bill Regular Session October 1, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Kavanaugh Martin and McCarthy Absent Ald Olinger Lamplighter Hackney reported having lighted 197 gas lamps during the month of September REceived and filed The auditor reported the sum of 1265.75 necessary to pay the city employees for the month of September received and filed City Engineer Tschergi presented a communication in relation to the bad condition of a brick building situated on the S M 1/5 of lot 452 on Clay Street between 15 and 16th streets which was referred to the marshal Police Justice D Hoffmann reported having tried three cases for violation of city ordinances and that the amount of two and 75/100 dollars due him for fees received and filed Street commissioner Foster reported having expended the sum of 2140.85 on the streets for men and teams employed as follows Salnut and Rose Strets 87.00 Sanford Street 200.00 22nd street 25.00 Queen Street 50.00 English Lane and So Ave 128.10 Iowa street 282.25 Rising Ave & West Hill 106.75 18th St Engine House 133.85 West 5th Street 199.90 Carpenter Work 27.00 Express Hauling 15.75 Miscellaneous 855.22 Total 214.82 the report was received and filed and warrants drawn for the several amounts Auctioneer Hedley reported having made sales at auction to the amount of 5510.70 138.90 of which was tranasient 15% of which is due the city 6.95 the report was received and filed and the marshal instructed to collect the amount of 6.95 City Attorney Linehan reported on the petition of Jas klung and Geo Herbst that the ciyt has no authority to deduct the amount claimed from any balance due contractors as the claim is against sub contractors On the petition of John Bell et al under the facts existing in relation to this lot and the action of the city heretofore would advise no action so far as declaring the street established by user of lot in qusetion for purpose of travel On the petition of R H collier I find that the road referred to in the petition was established by the order of the board of county commssioners January 6, 1842 and has been used as such ever since the city council authorized to remove obstructions from such highway within the city On the petition of John Talty et al I find nothing showing any liability of the city for damage that any have been caused by the wrongful acts of private parties all of which was R F Regular Session October 8, 1883 Mayor O'Donnell in the chair Present Ald Altman city engineer made a report of the profile and plat of the proposed change of grade on Walnut street from Chestnut to 14th street and recommend the blue line as shown on said map be adopted as the official grade referred to the com on streets The mayor stated that the doctor who had fallen into the 8th street sewer had agreed to settle on payment of his doctor bills referred to the city attorney and mayor to settle Ald H C Deckert from the committee on streets reported on the petition of Robert Waller that the pet be received and filed on the petition of Jas Wallace et al in favor of ordering the marshal to have the sidewalk repaired as prayed for On a communication from the city engineer that the communication be received and filed On the petition of A Minges in favor of receiving and filing On the petition of Michl Lavin in favor of receiving and filing On the resolution of Ald Crawford in relatin to the improvement of center street west dubuque that the proposed work be postponed the report was referred back to the commitee On the petition of Danl Breen in favor of doing the necessary filling wherever there is street cleaning to be had In favor of receiving and filing the petitions of John Nagle and P B martin in relation to the improvement of julien Ave in favor of receiving and filing the petition of Jacob Auer as also the petition of Geo W Jones In favor of ordering the city engineer to make an estimatae and cost of improving water street from 1st to Jones street On the petition of M H Moore et al in favor of ordering the city engineer to make a survey and plat of the road petitions a for all of which was adopted Ald Glab from the ex com of the bord of health reported in favor of paying $28.00 on the bill of Mercy Hospital adopted Ald Kavanaugh chairman com on harbors reported in favor of granting the request of the harbor master adopted Ald martin from the com on markets reported in favor of moving the hay scales closer to the Ald Hllnagle chmn on del tax reported as follows that on the application of Mr Duncan to the treasurer the present deed be cancelled and a new one made by the treasurer for the undivided one sixth of the lot which was the portion delinquent and all that ws sold so far as shown adopted In favor of granting the petitions of John M Lillig Jane Young Cath McCann and mrs Ann McLaughlin Adopted On the petition of Patk Kennedy in favor of allowing the petitioner to pay on a valuation of three hundrd dollars as prayed for adopted On the petition of S M Langworthy that the city treasurer be instructed to cancel said tax on the proper books and also the sale to Wm Hintrager of said lot for the year mentioned 1858 and to make the proper entries necessary to show said lot to be clear of taxes for said year and invalidity of the sale to Hintrager adopted Ald Deckert reported on a profile of grade of Stafford Ave from Division Street to Linwood that the red line on the profile be adopted as the official grade of stafford ave adopted Ald Crawford from the special committee appointed to confer with the gas co made a report of the conference and also of their views which was referred to the committee of the whole A communication was read from the key city gas company which was also referred to the committee of the whole Ald McCarthy reported on the petition of the new military that the privilege asked for be granted provided that said company do not occupy said hall later than ten oclock pm and further that said company pay the market master for any trouble they cause him adopted On motion the vote by which the special assessment to pay for macadamizing the alley bet 16th and 17th and clay and white was reconsidered and the following resolution was offered by Ald Deckert resolved by the city council of the city of Dubuque that to pay for macadamizing the alley from 16th to 17th bet clay and white treets by h Martinc contractor in front of and adjoining the same a special tax is hereby levied on the several lots and parts of lots and parcels of real estate here in after named esitute and owned and for the several amounts set opposite each lot as fol B Westercamp N 1/3 441 Ald Olinger Resolution Ald McCarthy offered the following whereas the obstructions on the north side of third street between Bluff and summit streets in the shape of a stone wall and steps is dangerous and interferes with travel thereon Resolved tht the marshal be and is hereby instructed to cause the same to the same to be removed within 15 days from this date at the expense of the owner of the abutting property adopted Ald Glab offered the following Resolved by the city council of the city of Dubuque that the recorder of the city of Dubuque be instructed to draw four loan warrants as follows No 1 for $1000 No 2 for $2000 no 3 for $2000 total $5000 in favor of Dubuque Fire and Marine Insurance Co No 4 for $1500 in favor of D G Scott agent payable Jan 15th 1884 at the rate interest of 6% per annum adopted Ald Deckert offered the following Be it resolved by the city council of the city of Dubuque that the city engineer be and is hereby instructed to make a survey and plat of a proposed street extending from the south end of west main street southerly to Min lot 50a thence westerly to southern avenue that said plat be filed in the city engineer's office according to section 1 chap XXV of the ordinances By Ald Deckert Be it resolved by the city counci of the city of Dubuque that the city engineer be and is hereby ordered to make plans and specifications for the improvement and ashing of 8th street sewr from East side of Iowa to East side of White st and that the city recorder advertize for bids and proposals for the performance of the work Ald McCarthy moved Deckert resolved by the city council of the city of Dubuque that in order to pay for curbing guttering and macadamizing Brad street from Julien Ave north 100 feet by J A Spier contractor in front of and adjoining the same a special tax be and is hereby levied on the several lots and parts of los and parcels of real estate situate and owned and for the several amounts set opposite each lt or parcel of real estate as follows Margaret Carr lot 2 Marshs sub Jacob Auer lot 16 Marshs Sub adopted Ald clancy offered the following resolved by the city counci that the services of pound master be dispensed with from and after this date lost On motion of ald Glab the marshal was instructed to notify the managers of the finley est to lay a sidewalk where not laid On motion of ald Crawford the com on markets were instructed to prevent outside parties from using the lower story of the city hall for storage purposes The rules wre suspended and mr Morgan addessed the council in relation to a committee of the whole carried On motion the council proceeded to elect a hog weigher Mesrs hayes Shields and Mundt were put in nomination Ald Altman was appointed teller the first ballot resulted in the choice of John Hayes On motion the motor ordinance was taken up for consideration and after being read by the recorder was provided th ecompny accept within 60 days the ordinance for the funding October 18, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Kavanaugh Martin McCarthy and Olinger Absent Ald Glab and Hollnagle The mayor stated the object of the meeting to otake action in relation to the proposed extension of the water limits Ald McCarthy offered the following resolved by the city council of the city of Dubuque that the water district for the year 1883 be the same as for 1882 with the following addition that it run from the junction of first st extenion and the outer levee along the outer levee to the south line of the Dubuque harbor Company's addition to south Locust Street to unite with the present line at Railroad Avenue Adopted Ald McCarthy offered the following Whereas the sidealk on the north side of third street from st mary's to a point on the hill at the west end of Mr P Flanegan's stone wall is so steep an incline that is dangerous for travelers to come down said walk without the aid of a railing to protect from falling Therefore be it resolved by the city council of the city of Dubuque that the street commissioner Mr Foster is hereby instructed to place a railing on said sidewalk between the above named points adopted A petition was read from H L Stout asking permission to erect a frame shed on wshington street to be used for storing dry lumber the petition was referred to the com on fire with power The petitions of P Geischecker Lorenz Eberhart and chas Stanfenberl for permission to set curbing and pave gutters in front of their property to be done to the satisfaction of the eng the petitions was on motion granted Special Session October 18, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Kavanaugh Martin McCarthy and Olinger Absent Ald Glab and Hollnagle Ald Martin offered the following Where as the number of dressed hogs now coming to the city of Dubuque in consequence of most farmers selling by live weight and whereas the revenue coming from weighing dressed hogs will not justify any man to buy scales for the short term of four months and the uncertainty of having the position but one term therefore resolved that the committee on markets is hereby instructed to furnish scales to the city weigher and the said scales be returned to the market master on the 15th of march of each year and that the scales shall remain the property of the city and in the custody of the market master who will on the first day of November of each year deliver the same to th eperson elected by the city council to the office of hog weigher Ald martin moved the adoption of the resolutio Which was amended by Ald to refer to the com on markets to report at the next regular session which was lost the ayes and nays were called on the adoption of the resolution and resulted in is adoption Ayes Ald clancy Crawford Kavanaugh Martin and McCarthy 5 Nays Ald Altman Deckert and Olinger 3 On motion of ald Crawford all petitions now on file in relation to assessment were referred to the com of the whole Ald McCarthy offered the following Resolved that the city marshal be and is hereby instructed to find out rail road crossings in teh city of Dubuque that might have flagmen and that have none placed htere by the railroad company's running through the city and report the same to the next regular session of the city council adopted On motion of Ald crawford the com on gas was instructed to notify the lamplighter that he must receive his instruction from the committee and not from the gas company carried On motion of Ald McCarthy the com on streets be instructed to notify the railroad company to place all crossings on their respective railroads in a good conditio at once carried adjourned attest J W Halpin recorder
