1883 November Council ProceedingsRegular Session November 5, 1883 LIGHT TEXT- CANNOT READ Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Clancy and Kavanaugh relation to assessments were committee on equalization Mary Wolf notification from the auditor in relation to a tax sale of the com on delinquent tax lamp locality was referred to the committee on police and gas mayor and the two aldermen from the fifth ward with power McBride asking for the settlement of his claim against the city was referred to the committee on claims Jos Hickham and others asking for the erection of lamps on high street from Johnson to tenth street referred to the com on police and gas Adolph Kochendorfer asking for refund saloon license to committee of the whole Regular Session November 5, 1883 LIGHT TEXT- CANNOT READ Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Clancy and Kavanaugh Petition injuries received by walking into Eighth Street sewer was referred to the mayor and city attorney petition Grove Street wall refer to com on streets crossing yates street over west 14th referred to the committee on streets Petition of F E Stout et al asking for the opening of a street south from Grand View Ave was referred to the committee on streets with the Engineer petition asking that Francis Street and Eagle Point Ave to com on streets erect a sign post on the referred to com on streets A communication from the Dubuque River and Belling company in relation to the purchase of fire hose to the com on fire Reports of officers Lamplighter lighted 198 gas lamps during the month Auditor $1266.66 was necesary to pay th eofficers and city employees for the month of October the report was received and filed the city weigher reported as follows first ward 81 drafts west dubuque 126 fifth ward 225 They returned treasurers receipt for 15% of the gross receipts and the reports were received and filed The recorder reported having issued 26 licenses during the month the report was received and filed Regular Session November 5, 1883 LIGHT TEXT- DIFFICULT TO READ Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Clancy and Kavanaugh Marshal month of October the report was received and filed warrants drawn for the several he also reported that there had been 3 arrests made during the month for the following offenses assault 4 intoxication 31 violating city ordinance 1 vagrance 4 disturbing the peace 3 he also recommended the placing of a flagman on the jones st crossing of the C M & St Paul Railroad Treasurer Traut reported having paid out for interest on warrants $182.20 postage 6.00 restaurants for which he asks that warrants be drawn in his favor report of committees the commmitte on streets reported as follows improvement of an alley north of Third St to receive and file Ald Hollnagle Chairman of the committee on delinquent tax reported on the petitions of Gertrude Tenhoff Gibson Collinson Margaret Donehue and mary Jane Colligan asking for the abatement of taxes for the year 1882 in favor of granting prayer of petitioners they also reported on the ptition of the cm & st paul railroad company that all the lot mentioned except lots 251 305 and 306 in east dubuque were not subject to assessment except for water tax they being right of way property We therefore recommend that the assessment and by of tax on all said lots except lot 251 305 and 306 be cancelled for all the years they have been accepted for right of way on the payment of the water tax on same which has not been already paid report adopted On the petition of Richard Cox the city attorney endorsed the following report I find the mineral lot 91 was assessed for the year 1868 not 1858 as dated in the petition as follows Regular Session November 5, 1883 LIGHT TEXT- DIFFICULT TO READ Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Clancy and Kavanaugh R cox 10.80 paid B C Flanagan 10.60 paid Unknwn 10.60 2.66 acres of which was sold to W Hintrager August 29, 1871 without any other on further discription that Cox and Flanagan paid on all they owned in said lot and all assessed to them that the description in the deed to Hintrager is indefinite uncertain and the deed is therefore void and casts no cloud upon the letter of the petitioners I see no good reason why any settlement should be made with Mr Hintrager Upon the foregoing the committee on delinquent tax made the following report Your committee having investigated the sale of a portion of mineral lot no 91 to william hintrager for the taxes of 1868 find that the description of the ground sold is no indefinite that it cannot be located or ascertained and is therefore foic for uncertainty. The sale therefore cannot operate as a cloud on the title of petitioner We recommend tht the treasurer be instructed to endorse on the proper record of tax sales that the sale was void report adopted On the petition of Cath Morrisey the same committee reported adverse to prayer of petitioner report adopted On the petition of James E Mclain in relation to delinquent tax for 1858 on N 1/2 M 1/5 city lot 446 the same committee reported in favor of granting the prayer of petitioner and taht the treasurer be instructed to make the proper corrections on his books report adopted the committee on harbors reported on the petition of Henry Reed that they had instructed the harbor master to withdraw the suit against Mr Reed upon payment of costs report adopted The committee on police and gas reported on the petition of Edwin Court that they had ordered the fountain closed report adopted The committee on fire reported on the petition of Dan Breen as follows Committee recommend that the owner of the stack be notified to raise the same to a sufficient height to prevent the cinders falling upon the adjoining houses or take such other necessary precautions as will abate the nuisance ecommittee of the whole reported on the petition of H L Swords in relation to a charter for the water gas co as follows your committee would recommend that the ordinance and petition be referred to the committee on ordinances report adopted On the petition of James Cushing the same committee reported recommending that the sum of $25.00 be expended by the committee on streets in improving Ann Street report adopted the same committee reported on the claim of mathias morgan recommending that it be referred back to the committee on claims on motion it was recommitted to the committee of the whole with the recommendation that when the committee meet to take action on it Mr Morgan ex street commissioner Beckman and the city engineer Tschirgi be notified to be present The special committee to whom was referred the petition of Frank Rafferty in relation to obstruction of sidewalks on South Locust Street recommended that the petition be received and filed report adopted The committee on fire reported on the petition of Henry L Stout asking for permission to erect a frame building recommending that petition be granted report adopted The special committee to whom was referred the claim of John Coogan for work on Jefferson Street wall reported as follows your committee report in favor of requesting the petitioner to select same competent engineer at his own expense and have him examine and estimate the amount of work done in connection with the city engineer and that whatever they agree upon be accepted by the city council report adopted Ald Olinger offered the following resolved by the city council of the city of Dubuque that a sidewalk six feet wide of good two inch plank be within 30 days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks on the south side of ninth street between white and jackson streets ald Olinger submitted the following Whereas our fire department are in need of new hose therefore be it resolved by the city council of the city of Dubuque Regular Session November 5, 1883 Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Clancy and Kavanaugh the the committee on fire be instructed to purchase said hose not exceeding 1000 feet also to receive bids from the different rubber companie for the same and to purchase from or contract with the lowest responsible bidder on motion the resolution was adopted The city marshal submitted a bill for repairing a sidewalk in front of lot 76 in Union addition amounting to $16.10 als one for repairing sidewalks in front of lots 12 and 13 in Newbury and Hales addition amounting to $5.45 whereupon the following resolution was adopted Resolved by the city council of the city of Dubuque that to pay for repairing sidewalk abutting lots 12 and 13 in Newbury and Hales subdivision and lot 76 in Union addition by F J Zugenbuhler City Marshal in front of and adjoining the same a special tax be and is hereby levied on the several lots and parts of lots and parcels of real estate hereinafer named situate and owned and for the several amounts set opposite each lot or parcel of real estate as follows F M Robinson owner lots 12 13 newbury and hales subd John Fitzpatrick owner lot 76 Union add ald Deckert offered the following which was adopted Be it resolved by the city council of the city of Dubuque that the expenses for street work for the present month be limited to one thousand dollars and that no matierial be purchased without an order from the street committee Ald Deckert offered the following resolution which was adopted Resolved by the city council of the city of Dubuque that a four foot plank sidewalk be laid on the east side of High Street from Ann Street to Reed Street at the expense of the abutting property owners the walk to be laid within 15 days from date of notice Ald Crawford from the committee on ordinances and harbors offered the following resolution which was adopted Resolved that all lumber and lumber rafts be excluded from the ice harbor and that the harbor master be instructed to notify all persons owning or having in charge of any such lumber or lumber rafts now in said harbor to remove the same within five days from this date and that the harbor master is further instructed to proceed at once to remove therefrom all lumber or lumber rafts remaining in said ice harbor on or after November 10 1883 at the expense of the owners and to arrest and prosecute the owner or agent of said lumber or rafts in the manner offered the following resolution which was adopted Resolved that the city engineer be instructed to make a survey and report a suitable grade for west 14th street from Alta Vista Street to the Delhi Road and to present a profile of the same at the next meeting of the council Ald Crawford offered the following resolution which was adopted resolved that the city recorder be instructed to issue a venire to the city marshal commanding him to summon a jury of twelve free holders having the qualifications prescribed by ordinance for the purpose of assessing the damages which will be caused to the owners of the property to be taken for the extension of west 8th street to Wilson Avenue according to the plat of said proposed extension on file in the office of the city engineer that the recorder assessment of damages be conducted in the manner prescribed by ordinance Ald Crawford offered the following resolution which was adopted whereas the owners of lots one two three four five six seven eight nine ten and eleven in the west half of Block ten 10 in the subdivision of the Dubuque Harbor Company's addition have wholly failed to comply with the order of the council adopted February 5 1883 requiring said lots to be raised and filled on or before July 1 1883 be it resolved that the city engineer be instructed to prepare and report an estimate of the expense of filling said lots in the manner required by said order and that the recorder be instructed to advetise for proposals for the doing of the work Ald Crawford offered the following resolution which was adopted whereas the owners of lot number two 2 of block number nine 9 in the Dubuque Harbor Company's addition have failed to comply with the order of the council adopted July 13 1883 requiring said lot to be filled up and raised on or before the first day of October 1883 Be it resolved that the city engineer be instructed to prepare and report an estimate of the expense of filling said lot in the manner required by said order and that the recorder be instructed to advertise for proposals for the doing of the work Chief Engineer Drehouse recommended that 1500 feet of hose for the use of the fire department the continued on the force until furthe rnotice was carried Ald McCarthy stated that the committee on equalization would meet Thursday night at 7:30 pm after which the council adjourned attest J W Halpin of Chief Eng Drehouse asking that the fifth ward Engine House be equipped was referred to the committee on fire with power The petition of John Kuntz asking permission to erect a frame warehouse inside fire limits was granted On motion of Ald McCarthy the mercy hospital was granted the use of the first floor of city hall for the purpose of holding a fair Ald Olinger from the special committee to whom was referred the resolution for the improvement of Weigle Alley recommended that action be postponed until the next regular meeting of the council which was adopted Mr Howard appeared in behalf of the gas company and made charges against the lamplighter on motion of Ald Altman the matter was referred to the committee on Police and Gas to report at the next meeting of the council adopted A motion by Ald McCarthy that a committee of three be appointed to consider the advisability of adopting the new standard time and report at next meeting of the council The mayor appointed Ald McCarthy Crawford and Hollnagle as such commttee Report of equalization com On motion of Ald Crawford all appeals from assessments of Money and Credits and all verbal statements in relation to the same be required to be made under oath was adopted The petition of Wm Coates asking for reduction of assessment on real and personal property Motion by Ald Crawford that moneys and credits be reduced to $9000 the petitioner refusing to make affidavit a motion of Ald Hollnagel that the report of the committee be adopted was carried the committee reported that the petition be not granted Regular Session November 15, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Glab Hollnagel Martin McCarthy and Olinger Absent Ald Deckert and Kavanaugh The petition of A Cragin asking for cancelation of assessment of $10,000 moneys and credits to the statement being sworn to the com report in favor of granting the petition adopted The petition of Hansen and Linehan asking that the sed on water street ordered removed be allowed to remain on motion of Ald Glab the prayer of petitioner was granted At the request of the city attorney the mayor appointed Ald Crawford Glab and Clancy a committee to confer with the attorney in relation to the stocking case Messrs Cady Rhomberg and others were heard in relation to the change of grade of alley on motion of Ald McCarthy the matter was postponed until the regular session in May 1884 The city attorney submitted his opinion in regard to the manner of the collection by the city of the cost of filling lots on Main st he suggested that the ordinance governing the case should be ammended before taking further action because it now reads it is not comprehensive enough Ald McCarthy moved that the matter be referred to the committee on ordinances carried On motion the council then adjourned to meet Nov 19th 1883 at 7:30 pm J W Halpin city recorder Adjourned Session November 19, 1883 Mayor O'Donnell in the chair Present Ald Altman Crawford Deckert Glab Hollnagel Martin McCarthy and Olinger Absent Clancy and Kavanaugh The mayor stated the object of the meeting to be to take action on the report of the equalization committee A communication was read from the marshal asking that officer Hall be dismissed from the police force also bringing sworn charges against said officer On motion the matter was postponed for one week to allow the officer to appear to answer the charges Ald McCarthy from the committee appointed to investigate the advisability of adopting the standard time reported as follos Your committee to whom was referred the advisability of adopting the standard time do recognize the revolutin that has taken place in the adoption of the new standard time of great importance to the travelling public as it gives a universal time to all railroads now running within a certain district and thus avoid collissions which so often cause the loss of many lives Also that the does not interfere in any material manner with the commercial or business interests of the city It is only a qusetion of short time when all cities and railroads of importance will adopt the new standard Therefore your committee do recommend that the city of Dubuque to adopt the standard time to take effect on Sunday Nov 25th at noon and that Asa Horr MD the superintendent of our city clock be instructed to adjust our city clock to convorm with the new standard based on the 90th meridian which is the central time adopted The petition of D E Lyon asking for reduction of assessment Mr Lyon being present stated his cae on motion his assessment on moneys and credits was placed at $1000 for 1883 Ald McCarthy offered the following resolution Whereas it has been rumored that the Bridge Co has made a part proposition to plank the railroad bridge and give the people a wagon bridge to the east side of the river and whereas there is a long felt want for such a bridge and a general desire on the part of our merchants and citizens to secure the same therefore be it resolved that a committee of three be appointed to investigate the desirability Adjourned Session November 19, 1883 Mayor O'Donnell in the chair Present Ald Altman
