from the suburban gas light company of kansas city mo was referred to the police and gas committee
A communication from W W Wormood proposing to take care of the city clock was referred to the committee
on public grounds and buildings
The petition of the key city gas company asking that the time of their contract be extended from five yeras
to ten years The rules were suspended and Mssrs J H Lull and J B Howard addressed the council on
the subject
On motion the vote by which the ordinance was adopted was reconsidered
Ald Crawford then moved that the proposition of the gas company be substituted for the ordinance
Ald Deckert moved to amend by providing that the rates as fixed by the ordinance adopted be the rates
for the first five years and that the council then in existance fix the rates for the last five years
The ayes and nays were called on the amendment which was lost

Crawford the proposition of the gas company was adopted and the city attorney instructed to prepare an
ordinance
present the same at the next session of the council
following recommendation regarding
when the contract for the fourth street engine house was
requested delay upon the matter until after
opportunity to bring the matter before you gentlemen
to it my reason for so doing was that it has become perfectly apparent that an engine house according to teh
plans proposed a
finished much more
contracts were first let
expend any more money on the improvement
an engine house than is absolutely necessary the
contracting for these houses last fall were
2000 to 3000 for the upper and not to exceed 4000 for the lower
did not include the expense necessary to
for occupation and yet probably none of us thought of this
we thought of building at the above figures now the upper house is finished and instead of expending 3000
upon it expended the sum of 5233.94 as the lowest bid was 3955 and the balance was for extra and
necessary work and it will take about 100 more to finish the lower window casing and other small matters
making the total cost 5333 The amount is nearly if not quite double what we first thought sufficient to secure
the upper engine house if we build the lower house as at present contemplated the contract being for 5595
will it not when properly finished and furnished come very near costing us 8000 making a total of 13,333
approximating a sum far in excess of what the people would desire to have us expend for new engine houses
at a time hwen we cannot afford the money and really must borrow in order to make payment How can we
cut down the cost it seems to me we can change the proposed plan by reducing the properties of
the building and still have sufficient rroom for working of the department as I understand it is proposed to
have the house large enough to accommodate the engine hose cart and hook and ladder truck to do this
would necessitate a wide double doored building now can not we have the hook and ladder truck just where it
is at the ninth street house where it is more centrally located than at either of the new houses and save the
expense of the increased building to accomodate it at fourth street the room at ninth street is sufficnet to
house the LInehan when kept as reserve and the hook and ladder truck also by reducing the proportion of
the new building we can save to the city and it seems to me it is our duty to do so There is not in the state
as large and fine an engine house as the one we have already finishe and there is no need of building a
larger or more expensive one I propose we do not exceed the amount expended for the upper house but
try and contract below those figures

On motion of Ald Crawford the subject was referred to the committee on fire and the mayor to so modify
and change the plans and arrange with the contractor to build a suitable structure
the following ordinance was read for the first time and second time and adopted by a full vote of the council
An ordinance granting to the Dubuque and Northwest Railway Company the right of way on and along a
certain street in the city of Dubuque
Be it ordained by the city council of the city of Dubuque
Secion 1 that permission be and the same is hereby granted to the Dubuque and Northwestern Railway
company to successors and assigns to lay down and operate such railroad track or tracks as may be necessary
in the prosecution of its business upon along and though Pine Street in said city of Dubuque provided such
track or tracks do not interfere with the rail road tracks now laid in actual use of any other railroad company
Section 2 That whenever required by the city council of this city said Dubuque and Northwestern Railway
Company shall at its own expense grade such part of said Pine Street as shall be used for said track or tracks
and that portion of any street crossed by its tracks along said pine street shall keep the space between the
rails and to the end of the ties so graded that carriags and other vehicles may easily pass over the same and
on each side of every street crossed by its said track along said pine street shall construct and maintain suitable
culverts and drains so that the free passage of water shall not be impeded by the track or tracks hereby permitted
shall at street crossings along siad Pine Street plank between the rails and make suitable approaches to
enable vehicles to cross its track and shall fully comply with all reasonable police regulations which the
authorities of this city may establish in relation to the running of trains on said track or tracks within the
limits of this city
Section 3 that the track or tracks herein authorized shall be liad to the grade established by the city and
should the grade be changed at any time the said track or tracks shall be changed to conform to said
change of grade such change of the track or tracks to be made at the expense of the company and the
company to have no claim for damages against the city because of such change
Section 4 all ordinances of this city heretofore passed in conflict with this ordinance or inconsistent with
this ordinance are hereby repealed
Section 5 That of said company or its successors does not construct a rail road and operate the same
upon said right of way within five years from the date hereof all rights here in under shall be forefeited

The petition of the Key City Gas Company
to the mayor and city council of the city of Dubuque
Whereas the key city gas company intends to make and valuable improvements in connection with its gas
works and proposes to renew and extend its gas mains in order to accommodate consumers not now on its
lines and in view of the further fact that at the reduced prices for gas hereinafter proposed said key city gas
company will be unable to realize fair and just dividends upon the capital actually invested in its works until t
the amount of consumption of gas is largely increased That to obtain such increase or consumption said
company will require much time and also be compelled to put forth great efforts in order to make good
the losses necessarily incident to said reduction of prices and the fact that a period of five years will be
too short a time within which to accomplish the purose aforesaid And in view of the fact that the city of
Dubuque has already determined to change or lower the surface of Main Street between first and eighty
in said city a change that will compel said gas company to relay or renew its mains on that portion of
Main Street and also to put in or replace new service pipes to every building necessary to make proper connections
within said mains altogether making an outlay of expenditure of many thousand dollars the said key city
gas company makes to the city of Dubuque the following proposition which is in accordance with the recent
report made by your committee on the subject and ask its immediate consideration
to the Mayor and council of the city of Dubuque
The key city gas company hreby proposes to furnish to the city of Dubuque for a period of ten years from
the first day of July 1884 all the gas which said city shall have occasion to use for heating or illuminating
purposes good to the inhabitants of said city all the gas they may desire to use for illuminating heating or
other purposes where the buildings to be supplied are situated on or contiguous to the line of streets or
alleys in which the gas pipes of said company are now laid or may hereafter be laid at prices not exceeding
the following rates
First for all gas used by the city in the city hall Fire Engine Houses and other buildings and offices for the five
years commencing July 1st 1884 per thousand cubic feet $2.00

needed until the number in use shall reach 250 25.00

Over 300 for the remainder of the ten years from July 1st 1884 21.00
Third for Gas for private consumers for the five yeras commencing on July 1st 1884 per thousand cubic

For gas for the five years commencing July 1st 1889 per thousand cubic feet 2.25
Said city of Dubuque to reserve to itself all the right power and authority it now has to grant to other persons
or corporations the right or franchise to lay mains through the streets and alleys of the city for the purpose
of distributing gas the intention being to leave the rights of respective parties in the respect exactly as they
now are under the existing ordinance and amendments thereto
said city not to be liable for any damage to the pipes or other property of said company caused by any change
of grade in the cutting down of the surface of any street nor for the expense of lowering or relaying of said
pipes necessary in conequence of teh change in the surface of any street in the city
In consideration whereof the said city shall extend or continue in force all the rights privileges and franchise
now held or enjoyed by said key city gas company for a period of ten years from and after the first day of
July 1884

On motion of Ald Crawford the proposition was accepted by the council and on motion the city attorney
instructed to draft an ordinance to comply with its provisions

On motion the annual reports of city officers were deferred until the adjourned session to be held March
10th 1884 at 7:30 p.m.
A contract with the Babcock Fire extinguishing company for a new four wheeled hose carriage which was
on motion approved by this council

Reports of officers
Street commissioner foster reported that the sum of 677.45 had been expended on the streets during the
month of February
Marshal Zugenbuhler reported that the sum of 960.00 was necessary to pay the police force for February
also that 55 arrests had been made during the month
Treasurer traut reported having paid interest on warrants 831.32 for refunded tax 128.80 postage 8.00 and asks
that warrants be drawn in his favor for the amounts
Auditor Brayton reported the amount due as salaries to city officers and employees as 895.20 due the members
of the fire department 919.15 warrants were ordered drawn for the amounts
The recorder reported having issued licenses to the amount of 237.55 during the month
received and filed
Justice Quigley reported having tried three cases for violation of the city ordinances and asks that an order
be drawn in his favor for 11.25 as costs in the cases
Woodmeasurer Warring reported having measured 1117 1/2 cords of wood which arived by team and rail
during the month
Auctioneer Hedley reported sals of Real Estate to the amount of $1300 during the month
City Engineer Tschergi reported the dangerous condition of the walls on Seminary Street West Eleventh
Street and on Grov Street which should have immediate attention also the dangerous condition of an old
mineral shaft on Bluff Street extension
Market Master Rice reported having furnished 274 meals to prisoners and lodgers at 25 cents per meal
54.80 ordered paid

and an estimate of cost of extending West Third Street as petitioned for

Ald Crawford chairman on ordinance stated that he had several important matters to report on but asked for

To the honorable mayor and council of Dubuque
Gentlemen the under signed were appointed as a committee to investigate the building situated on lot
13 Cummins subdivision commonly known as the Barracks and herewith present the following report
Your committee found the building to be a frame structure three stories high containing 16 rooms in each
story yon 48 in all the foundation walls are of stone and as much of them as could be seen were in very
bad condition portions of the walls had fallen in requiring props to be placed under the timbers supporting
the joists of the first floor and the sills of the framework these supports had evidently been placed there
recently the upper part of the building though not in a dangerous

condition is very much out of repair theThird story is unoccupied onr or two families on the first floor constitute
the numer in the building Your committee found that underneath the ground or first floor which was unused an
accumulation of water and drainage from rear of building which in warm weather must become the source
of sickness and offensive odors the combined sewerage from the entire building is allowed to accumulate
in one place and flow in quite a stream toward Walnut Street becoming quite offensive to passers by in
warm weather. We think that section 3 page 144 of our ordinances clearly applies to this case and should
be enforced for not only is the health of the inmates of this unwholesom and unfit for habitation building
endangered but the entire community may suffer if it is allowed to remain. We would therefore recommend
that the proper steps be taken to have the above building condemned as being unfir for habitation the
foundation walls being insecure and the sanitary condition of the building poor

On motion the appointment of judges and clerks for the coming election was postponed until the adourned

Ald Crawford offered the following resolution which was adopted
Resolved that the city engineer be and is hereby instructed to make a careful examination and survey of
Main Street from first to eighth streets prepatitory to the proposed cutting down of said street showing cross
sections of the surface of the street at the end and center of each block exhibiting the exact amount of
cutting at each point and a complete plan of the proposed improvment
also
Resolved tht the subject of the reduction of the surface of main street from First to Eighth Streets be
referred to a special committee of one from each ward with instructions to report at the next regular meeting
of the council and that said committee examine into the feasibility and expedience of acopting some
method of paving said portion of Main Street other than macadamizing

On motion of Ald McCarthy the report of the special committee on the barracks was referred to the city

Ald Deckert offered the following resolution which was adopted
Whereas the expenses of repairing our macadamized streets are becoming greater each year and the
principal cost being the narrow tires on the wheels of our heavy loaded wagons which drush and rut the macadam
Therefore be it resolved by the city council of the city of Dubuque that an ordinance be drawn up and enforced
requiring certain width of tires on wheels of wagons hauling certain loads and that the committee on
ordinance be instructed to prepare such an ordinance which will fully cover this resolution and that they
report at the next session of the council
On motion of Ald Olinger the petition of Howard Linehan was referred to the committee of the whole
On motion of Ald Kavanaugh the recorder was instructed to advertise for bids for the filling of certain lots
ordered filled at the December session

The mayor stated the object of the meeting
Ald Crawford offered the following resolution
Whereas the ownesr of lots two 2 three3 four4 five 5 six 6 seven 7 eight 8 nine 9 ten 10 and eleven 11 in the
west half of block ten 10 in the subdivision of the Dubuque Harbor company's addition situated on the east
side of Main Street between Jones and Dodge Streets in the city of Dubuque have wholly neglected and refused
to comply with the resolution of the city council adopted on the 6th day of December AD 1883 requiring said
lots to be filled and raised to a height even with the present surface of Main Street in front of said lots
although duly nnotified of the adoption of said resolution in the manner required by law and ordinance
therefore resolved that the city recorder be and is hereby instructed to advertise for proposals for the filling and raising
of said lots in the manner and to the height designated in said resolution the advertisement to require the
proposals to state the price per cubic yard for earth filling and to reserve the right to the council to reject
all bids if deemed excessive also to require a good and sufficient bond to accompany such proposal
the resolution was amended so as to include lot 2 two of block 9 nine owned by J H shields
On motion the rules were suspended and mr Shields addressed the council in relation to the matter after
which the resolution as ammended was adopted by a full vote of those present
On motion the recorder was instructed not to advertise for the filling of the shields lot for three months
Ald Hollnagel offered the following resolution which was adopted
Be it resolved by the city council of the city of Dubuque that teh taxes of Mrs John OHern on Lot 9 of S M
Langworthy's addition be cancelled
Ald Altman chairman of the committee to whom was referred the matter of license of street cars reported
as follows
Your committee recommend that Sec 1 of the ordinance regulating the Dubuque Street Railway be amended
by striking out the words "and freight" and said company upon consenting to such changes in writing
be not required to take out a license for carrying passengers

The same reported on the petition of John Cooney adversely to the claim for compensation as it appears
that the city is not liable in damages for the same but recommend that the council assist him in paying his
physicians bill as he is very poor and deserving the report was adopted
The ordinance of the key city gas company was read for the first time
Ald Carwford moved that the rules be suspended and the ordinance put upon its passage the motion
was lost
Ald Crawford moved that when the council now adjourn it be until Tuesday March 18th at 7:30
adopted
On motion the adoption of the gas ordinance was postponed for one week until the next meeting
Ald Crawford read an ordinance regulating the qualifications of certain city officers and fixing the time of
their entering on the discharge of their duties which was laid over until the next session
Ald Carwford read an ordinance to protect the macadamized streets of the city referred to the committee
on ordinance

On motion of Ald Altman the compensation of Judges and Clerks and for rent of room for election purposes
fixed at five dollars each
the city attorney reported that the stocking claim had been settled and that he had placed the old bonds
in the hands of the treasurer the fees in the case were still due To J J Dunn in the district court 418.75 and
costs in the united states court 171.36 on motion the bills were ordered paid
He also returned the bond of B W Jones for the erection of the fourth street engine ordered place on file
On motion the rules were suspended and Mr Beach allowed to address the council in relation to the simplot
matter after an explanation of the matter
Ald McCarthy moved that Mr Beach reduce the proposition to writing and then referred to a special committee
to consist of the mayor city attorney and Ald Crawford
On motion Ald McCarthy was substituted for Ald Crawford

On motion of Ald Carwford the recorder was instructed to issue a venire to the marshal to summon a jury
to assess the damages by the extension of West Eighth Street
Ald Deckert offered the following
Be it resolved by the city council of Dubuque that Eighth Street sewer be arched from Iowa Street to the east
side of White Street and that the city engineer be and is hereby insructed to prepare plans and specifications
for the above work and the city recorder be instructed to advertise for bids
Ald Clancy moved to amend by including the dodge street sewer
Ald kavanaugh moved to lay on the table on which the ayes and nays were called

Be it resolved by the city council of Dubuque that Weigle alley be graded and the contract awarded to

Ald Kavanaugh offered the following
Be it resolved by the city council of the city of Dubuque that from this day forth no boss or street commissioner
be allowed to employ any team belonging to an alderman while he can get other teams that pay license to the
city the ayes and nayes were called on the adoption of the resolution
Ayes Ald Crawford Glab Hollnagel and Kavanaugh 4
Nays Clancy Deckert Martin and Olinger 4
The vote being a tie the mayor voted aye and the resolution was adopted
Ald Deckert chairman of the committee on streets reported that the petitions of the DNW Railroad co Henry
Schuler et al and city engineer be received filed also the petition of Mary Murphy and that the petition of
H Riker be referred to the committee of the whole
Ald Glab reported on the petition of Edward Bowen that he be allowed $40.00 which was amended by Ald
Hollnagel that the amount be $20.00 The matter was finally referred to the city attorney
On motion of ald Crawford the bids for the filling of Lots 2 to 11 in Block 10 of the Dubuque Harbor Company's
addition were opened and read as follows
James n Foye per cubic yard for filling 48 cents
Wm H Rebman 46 1/2 cents
F L Randall 39 cents
Ald Crawford moved that the contrac be let to Mr F L Randall him being the lowest bidder and that he will
agree to fill within four feet of the present surface of main street and to be paid for roadways necessary to
do said filling

Ald Olinger presented the new plans for the fourth street engine house the plans and specifications were
referred to the committee on Fire and Mayor
The matter of the sale of the life saving apperatus was referred to the committee on fire to report before taking
any action
The ordinance fixing the time when officers elect shall tkae charge of their officers and their compensation
for the same begin was read for the second time the rules were suspended and the ordinance adopted
Mayor O'Donnell called the attention of the council to the fact of submitting a proposition to the voters at
the coming election looking toward the funding of the floating indebtedness and suggested the following
which was adopted

Shall the city issue $75,000 or so much thereof as is necessary of 5 percent semiannual coupon bonds the
one eighth part thereof to be due each year after the first two and all payable within ten years for the purpose
of paying off the floating debt of the city

On motion of Ald Kavanaugh the marshal was instructed to bring in the absent aldermen and the council
took a recess until he returned
During the recess Ald martin arrived
The marshal returned and reported as follows
Ald Altman sick Clancy not found Deckert sick Glab out of town McCarthy out of town Olinger not found
Ald Kavanaugh moved that the council adjourn to meet March 27th 1884 at 7:30 p.m. and that the city physician
visit the aldermen and report to teh council if they were able to attend the meeting.

A quorum not being present Ald Olinger moved to adjourn until the regular session in April
amended by Ald Kavanaugh that the adjournment be until April 2nd at 7:30 p.m. which was carried
