INTRODUCTION
The enclosed resolution authorizes the City Manager to execute a Supplemental
Agreement No. 2 with AECOM Technical Services, Inc. (AECOM) which approves
revisions to the original scope of services to the Consultant Professional Services
Contract to complete land survey and replating of property along the Southwest Arterial
/ US52 corridor from US Highway 20 to US Highway 61 / 151.
BACKGROUND
Now that the Southwest Arterial / US52 project is completed and per the terms of the
Memorandum of Understanding (MOU) and the Transfer of Roadway Jurisdiction (TOJ)
Agreements between the City and the Iowa Department of Transportation, the City is
responsible for the survey and replating of the highway corridor to allow for the roadway
and interchange property to be conveyed from the City to the State of Iowa.
AECOM was the design consultant and the Licensed Professional Land Surveyor of
record for the Southwest Arterial / US52 project. AECOM prepared and signed all the
plats for right-of-way property acquisition along the entire corridor.
Per the MOU, the City was the lead agency and responsible for the right-of-way
property acquisition along the Southwest Arterial corridor. When the properties were
purchased, said title ownership was acquired in the name of the City of Dubuque.
Per the TOJ, now that the project is completed, the City is responsible for the survey
and plating the highway access control right-of-way, plating the interchange locations,
plating right-of-way for the frontage roads, and identifying any potential excess remnant
parcels. Once the replating of the highway access control right-of-way is completed
from US 20 to US 61 / 151, the highway corridor property will be conveyed from the City
to the State of Iowa.
RECOMMENDATION
I recommend that the City Council authorize the City Manager to execute the Consultant
Professional Services - Supplemental Agreement with AECOM Technical Services, Inc.
to complete land survey and replating of property along the Southwest Arterial / US52
Corridor from US Highway 20 to US Highway 61 / 151.

SOUTHWEST ARTERIAL RIGHT-OF-WAY SERVICES
SUPPLEMENTAL AGREEMENT NO. 2
WHEREAS, a Professional Services Agreement was entered into between the City of Dubuque (Client), 50
W. 13t" Street, Dubuque, Iowa, and AECOM Technical Services, Inc. (ATS), 501 Sycamore Street, Suite
222, Waterloo, Iowa, dated March 22, 2022, for right-of-way services for the Southwest Arterial; and
WHEREAS, the Client and ATS entered into Supplemental Agreement No. 1 for additional right-of-way
services and platting for the Southwest Arterial, dated May 8, 2024; and
WHEREAS, the Client and ATS now desire to enter into Supplemental Agreement No. 2 for additional right-
of-way services and platting for the Southwest Arterial.
NOW THEREFORE, it is mutually agreed to amend the original Professional Service Agreement as follows:
PROJECT DESCRIPTION
The City of Dubuque obtained property for the construction of the Southwest Arterial, which
included an approximate 6-mile long, 4-lane freeway on new alignment with three new
interchanges. The property acquired included 56 different properties and 93 partial/total
acquisitions along US 20, across the rural southwest side of Dubuque, along US 61/151 and along
Olde Davenport Road. During project development, the Iowa DOT and the City of Dubuque agreed
to a Memorandum of Understanding (MOU). The MOU described how the Southwest Arterial
became US 52, allowing for the Transfer of Jurisdiction of existing US 52 through Dubuque from
the Iowa DOT to the City of Dubuque and designating Southwest Arterial as the new US 52. In the
future, the right-of-way that is currently owned by the City of Dubuque within the new US 52 right-
of-way will need to be partitioned and transferred to the Iowa DOT.
To determine the method the Iowa DOT wanted to follow for the right-of-way transfer, monthly
meetings were held to develop the process for creating excess right-of-way / disposal documents
and plats for the right-of-way transfer. Over 20 meetings were held with the Iowa DOT since
March of 2023. During the meetings, much discussion focused on the location of the right-of-
way, identification of excess right-of-way, and the proper form of platting.
The original scope anticipated using the existing acquisition plats and modifying them
accordingly. The agreed upon approach is to develop 11 Minor Subdivision Plats along US 20
and the Southwest Arterial that can document and record the proposed Iowa DOT road right-of-
way. Excess right-of-way will be described with separate plats that can be used in legal
documents pertaining to Iowa DOT's right-of-way disposal process.
Supplemental Agreement No. 2 is for the additional efforts needed to finish the platting and
meetings needed with the Iowa DOT.
II. SCOPE OF SERVICES
The Scope of Services for this supplemental agreement will encompass and include work, services,
materials, equipment, personnel and supplies necessary to provide the plats, staking, and meetings
needed to document and define the Iowa DOT right-of-way on US 20, Southwest Arterial, and US
151/61. Included in Supplemental Agreement No. 2 are the plats, staking and meetings to
document and define the right-of-way for the remaining plats on Southwest Arterial.

The Scope of Services is further defined by the following tasks:
Preparation of Plats (Tasks 1 - 6): These tasks are for the preparation of the minor subdivision
plats agreed to by the Southwest Arterial Right -of -Way committee which meets monthly. The
minor subdivision plats will meet the requirements of the City of Dubuque and Dubuque County
for subdivision platting. The remaining descriptions are Southwest Arterial Minor Plats 5 - 8. It is
assumed that one round of minor revisions for each of the remaining plats 5 - 8 will be required.
Additional revisions and/or a change in platting process required by the County and/or City will be
additional work. Each plat will identify the existing plat and lot information in the surrounding area
which will involve research and data gathering. This will include document number identification
on the plat and within the description. A graphical representation of the overall plat will include
the section lines, purchased right-of-way line, existing utility easements, proposed utility
easement and the agreed to limits of Iowa DOT right-of-way. A metes and bounds description
will be developed for each minor subdivision plat. Bearing and distance tables with closure
checks will be developed for each lot identified in the minor subdivision plats. It is estimated that
5 tables per plat would be needed. Metes and bounds descriptions and bearing and distance
tables with be checked and reviewed. The following tasks are anticipated:
Task 1 — Existing Plat / Document Research
Task 2 — Graphical Layout of Minor Subdivision Plat
Task 3 — Metes and Bounds Descriptions
Task 4 — Bearing and Distance Tables
Task 5 — Closure Checks
Task 6 — Check and Review of Minor Subdivision Plats
Field Work (Task 7): This tasks include the staking of the right-of-way through the US 20
Interchange, along Southwest Arterial, and the US 151/61 Interchange. This task also includes
miscellaneous field surveys to identify existing features such as fence, utilities, or guardrails that
are pertinent to the location of the proposed right-of-way. The remaining plats that need to be
staked include Southwest Arterial Minor Plats 3 — 8. It is assumed that field work can be
consolidated and available for work in three mobilizations included in this Agreement.
Task 7 — Staking of the Proposed Right -of -Way
Meetings and Administration (Tasks 8 — 11): These tasks are for the remaining meetings and
project administration. Tasks include preparation / displays for virtual meetings, meetings and
minutes with Iowa DOT, meetings and minutes with Dubuque County, and project administration
tasks.

III. COMPENSATION
Compensation for the above services will be on a cost-plus fixed fee bases (fixed overhead rate)
in accordance with Part VI of the original agreement and shall be integrated with the fees in the
original agreement and Supplemental Agreement No. 1. The total compensation for these services
is a not -to -exceed fee of Seventy -Seven Thousand Dollars ($77,000.00), as shown below.

OF DUBUQUE, IOWA:
SECTION 1. That said Consultant Professional Services - Supplemental
Agreement No. 2 between AECOM Technical Services, Inc. and the City of Dubuque for
to complete land survey and replating of property along the Southwest Arterial / US52
corridor from US Highway 20 to US Highway 61 / 151 is hereby approved.
SECTION 2. That the City Manager be authorized and directed to execute said
Consultant Professional Services - Supplemental Agreement No. 2 with AECOM
Technical Services, Inc.
