The Dubuque City Council met in regular session at 6:30 p.m. on September 2, 2025, in the second -
floor Council Chambers of the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank, Wethal;
City Manager Van Milligen, City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a regular session of the City Council called for the
purpose of conducting such business that may properly come before the City Council.
PLEDGE OF ALLEGIANCE
Breitfelder announced that Barry Lindahl’s Savvy Over 60 Award Recognition was removed from the
meeting and will be rescheduled for the next regular city council meeting.
PROCLAMATIONS
1. Nathaniel and Charlotte Morgan Peace Week (September 1 - 6, 2025) was accepted by Ernestine
Moss on behalf of the Nathaniel Morgan Memorial Committee.
2. Days of Peace and Nonviolence (September 6 - 28, 2025) was accepted by R.R.S. Stewart on
behalf of the Dubuque International Day of Peace Coordinating Committee.
3. Crop Hunger Walk Day in Dubuque (September 27, 2025) was accepted by Sara McCaw on
behalf of Dubuque Area Congregations United.
CONSENT ITEMS
Cavanagh requested Item No. 13 be held for separate discussion. Motion by Resnick to receive and
file the documents, adopt the resolutions, and dispose of as indicated , except No. 13. Seconded by
Farber. Motion carried 7-0.
1. Minutes and Reports Submitted: City Council Proceedings for August 18, 2025; Historic Preser-
vation Commission of July 17, 2025; Human Rights Commission of July 8, 2025; Library Board of Trus-
tees Minutes of June 23, 2025; Library Board of Trustees Update of July 24, 2025; Long Range Plan-
ning Advisory Commission of May 21, 2025; Park and Recreation Advisory Commission of July 8, 2025.
Upon motion the documents were received and filed.
2. Notice of Claims and Suits: Lubenow Express, LLC for vehicle damage. Upon motion the docu-
ments were received, filed, and referred to the City Attorney.
3. Disposition of Claims: City Attorney advised that the following claims have been referred to Public
Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool: Lubenow Express,
LLC for vehicle damage; Major Joseph Jenkins for property damage. Upon motion the documents were
received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and Resolu-
tion No. 279-25 Authorizing the Chief Financial Officer/City Treasurer to make certain payments of bills
that must be paid and approved for payment in accordance with City procedures was adopted.
RESOLUTION NO. 279-25
AUTHORIZING THE CHIEF FINANCIAL OFFICER / CITY TREASURER TO MAKE CERTAIN PAY-
MENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT IN ACCORDANCE
WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the Finance
Director-City Treasurer shall keep an accurate account of all disbursements, money, or property, spec-
ifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods and services
have been pre-audited by Finance Department personnel in accordance with generally accepted inter-
nal control procedures and have been determined to have been requ isitioned for a lawful municipal
purpose; and
Whereas, the Chief Financial Officer-City Treasurer has provided a list of Expenditures attached
hereto, and by this reference made a part hereof, to be drawn to pay for goods and services provided
for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -18 adopted
May 7, 2018, authorized the Chief Financial Officer-City Treasurer to issue checks in payment of certain
expenditures known as Exception Expenditures prior to City Council approval and such list is attached
hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA THAT:
Section 1. The Chief Financial Officer-City Treasurer is hereby authorized to issue payment for
goods and services provided for City purposes in response to the purchase orders and contracts issued
in compliance with state and municipal code requirements a s requested by designated requisitioning
authorities in accordance with approved budget appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Chief Financial Of-
ficer are hereby authorized and directed to provide the statement of receipts and disbursements to the
City Council, and to publish a summary thereof.

5. Intent to Apply for Local Housing Trust Funds through Iowa Finance Authority for 2026 : Upon
motion the documents were received and filed, and Resolution No. 280 -25 Authorizing Submittal of the
Application for Local Housing Trust Funds to the Iowa Finance Authority was adopted.
RESOLUTION NO. 280-25
AUTHORIZING SUBMITTAL OF THE APPLICATION FOR LOCAL HOUSING TRUST FUNDS TO
THE IOWA FINANCE AUTHORITY
Whereas, the City of Dubuque administers a Local Housing Trust Fund; and
Whereas, the City of Dubuque proposes to continue administering the Local Housing Trust Fund, to
apply for funds from the Iowa Finance Authority for Local Housing Trust Fund for their Fiscal Year 2026;
and
Whereas, the Local Housing Trust Fund Advisory Committee will hold a public hearing for the appli-
cation on September 10, 2025, and such application is pending approval by the Committee for submit-
tal.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA, THAT:
Section 1. That the Local Housing Trust Fund Advisory Committee Chair and the City Attorney are
hereby authorized to submit the application for Local Housing Trust Funds to the Iowa Finance Author-
ity.

6. Grand River Center Floor Slab Lifting & Leveling Project - Acceptance of Public Improvement
Construction Contract: Upon motion the documents were received and filed, and Resolution No. 281 -
25 Accepting the Grand River Center Floor Slab Lifting & Leveling Project was adopted.
RESOLUTION NO. 281-25
ACCEPTING THE GRAND RIVER CENTER FLOOR SLAB LIFTING & LEVELING PROJECT
Whereas, the public improvement contract for the Grand River Center Floor Slab Lifting & Leveling
Project (the Project) has been completed by the Contractor, Keller North America, Inc. of Commerce
City, CO, (Contractor), and the City Engineer has examined the wor k and recommends that the Project
be accepted; and
Whereas, the final contract amount for the Project is $73,286.20; and
Whereas, the Contractor has previously been paid $69,621.89, leaving a balance of $3,664.31; and
Whereas, the City Council finds that the recommendation of the City Engineer should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is hereby ac-
cepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the re-
tainage of $1,496.26 as provided in Iowa Code chapter 573, and to pay such retainage in accordance
with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13 .

7. September/October 2025 City News Newsletter: City Manager provided a copy of the Septem-
ber/October 2025 issue of the City News newsletter, which will be mailed with City utility bills from
August 13 through September 10. This issue and archived issues are available at www.cityofdubu-
que.org/citynews. Upon motion the documents were received and filed.
8. Contract amendment for home advocacy and nursing services for HUD Lead and Healthy Homes
grant: City Manager recommended approval of the amendment and extension of the subcontract with
Dubuque Visiting Nurses Association for services related to the HUD Lead and Healthy Homes grant
for the period of performance now extended through November 30, 2025 . Upon motion the documents
were received, filed, and approved.
9. Problem Property Assessment: Upon motion the documents were received and filed, and Reso-
lution No. 282-25 Authorizing the City to Collect Delinquent Problem Property Charges in Accordance
With 14-1J1 International Property Maintenance Code Section 109.5 and/or Section 112.5 Code of
Ordinances of the City of Dubuque, Iowa was adopted.

AUTHORIZING THE CITY TO COLLECT DELINQUENT PROBLEM PROPERTY CHARGES IN AC-
CORDANCE WITH 14-1J1 INTERNATIONAL PROPERTY MAINTENANCE CODE SECTION 109.5
AND/OR SECTION 112.5 CODE OF ORDINANCES OF THE CITY OF DUBUQUE, IOWA
Whereas, residential properties in the City of Dubuque are considered hazardous or unsanitary
premises if problem properties are allowed to deteriorate according to 14 -1J1; and
Whereas, whenever in the judgment of the Code Official, a nuisance that is “palpably and indisput-
ably such” exists which requires immediate action to protect the public health, safety or welfare of the
public, the Code Official may order the emergency abatement of such; and
Whereas, delinquent problem property charges shall be certified by the City Clerk to the Dubuque
County Treasurer for collection with, and in the same manner as general property taxes.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That the persons listed on the attached Problem Property Assessment Schedule are de-
linquent in the payment of problem property charges.
Section 2. That the City Clerk be and is hereby ordered and directed to certify to the County Treas-
urer of Dubuque County, Iowa, that the persons named on the attached Problem Property Assessment
Schedule are delinquent in the payment of problem property c harges in the amount set aside of the
respective names, and that said amounts shall be collected in the same manner as general property
taxes against the respective parcels of property set opposite the names of the owners.

Whereas, residential properties in the City of Dubuque are considered substandard if any conditions
exist to an extent that endanger life, limb, health, property, safety or welfare of the public or the occu-
pants thereof; and
Whereas, whenever in the judgment of the Housing Officer, a nuisance that is “palpably and indis-
putably such” exists which requires immediate action to protect the public health, safety or welfare of
the public, the Housing Officer may order the emergency abatement of such; and
Whereas, delinquent grass and weed cutting and garbage collection charges shall be certified by
the City Clerk to the Dubuque County Treasurer for collection with, and in the same manner as general
property taxes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:

12. Water System Improvements 2024 North English Road Water Main Extension Project – Receipt
and Consideration of Bids: City Manager shared information on the bids for the Water System Improve-
ments – 2024 North English Road Water Main Extension project. Upon motion the documents were
received and file and adjourned further action to October 6, 2025.
13. Workforce Housing Brochure: Motion by Jones to receive and file the documents. Seconded by
Sprank. City Council Members thanked city staff for demonstrating the meaning of workforce housing,
highlighting housing’s focus for the City Council and other community organizations, and th anked com-
munity partners for their efforts in expanding housing. Motion carried 7-0.
ITEMS SET FOR PUBLIC HEARING
Motion by Roussell to receive and file the documents, adopt the resolutions, and set the public hear-
ings as indicated. Seconded by Wethal. Motion carried 7-0.
1. Resolution Setting Public Hearing on a Proposed Development Agreement with ASJS Properties,
LLC for Redevelopment of 1913 Jackson Street: Upon motion the documents were received and filed
and Resolution No. 284-25 Fixing the date for a Public Hearing of the City Council of the City of Dubu-
que, Iowa on a Development Agreement by and between the City of Dubuque, Iowa and ASJS Prop-
erties, LLC, including the proposed issuance of Urban Renewal Tax Increment Revenue Obligations
relating thereto, and providing for the Publication of Notice thereof was adopted setting a public hearing
for a meeting to commence at 6:30 p.m. on September 15, 2025 in the Historic Federal Building.
RESOLUTION NO. 284-25
FIXING THE DATE FOR A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA ON A DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF DUBUQUE, IOWA
AND ASJS Properties, LLC, INCLUDING THE PROPOSED ISSUANCE OF URBAN RENEWAL TAX
INCREMENT REVENUE OBLIGATIONS RELATING THERETO, AND PROVIDING FOR THE PUB-
LICATION OF NOTICE THEREOF
Whereas, the City of Dubuque and ASJS Properties, LLC have tentatively entered into a Develop-
ment Agreement, subject to the approval of the City Council, INCLUDING THE PROPOSED
ISSUANCE OF URBAN RENEWAL TAX INCREMENT REVENUE OBLIGATIONS RELATING
THERETO, a copy of which is now on file at the Office of the City clerk, City Hall, 50 W 13 th Street,
Dubuque, Iowa for the development of property located at 1913 Jackson Street; and
Whereas, the City Council has tentatively determined that it would be in the best interests of the City
to approve the Development Agreement with ASJS Properties, LLC; and
Whereas, it is deemed necessary and advisable that City should authorize Urban Renewal Tax In-
crement Revenue Obligations, as provided by Iowa Code Chapter 403, pursuant to the Development
Agreement; and
Whereas, before said Obligations may be approved, Iowa Code Chapter 403 requires that the City
Clerk publish a notice of the proposal and of the time and place of the meeting at which the City Council
proposes to take action thereon and at which meeting the City Council shall receive oral and/or written
objections from any resident or property owner of said City to such proposed action.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA THAT:
Section 1. The City Clerk is hereby authorized and directed to cause a notice to be published as
prescribed by Iowa Code Section 403.9 of a public hearing on the City's intent to approve the Develop-
ment Agreement and authorize Urban Renewal Tax Increment Revenue Obligations, to be held on the
15th day of September 2025 at 6:30 p.m. The official agenda will be posted the Friday prior to the
meeting and will contain listening, viewing, and public input options. The City Council agenda may be
accessed at https://dubuqueia.portal.civicclerk.com/ or by contacting the City Clerk’s Office at 563-589-
4100, ctyclerk@cityofdubuque.org.
Section 2. The City Council will meet at said time and place for the purpose of taking action on the
matter of authorizing Urban Renewal Tax Increment Revenue Obligations and the execution of the
Development Agreement relating thereto with ASJS Properties, LLC, the proceeds of which obligations
will be used to carry out certain of the special financing activities described in the Urban Renewal Plan
for the Greater Downtown Urban Renewal District, consisting of the funding of economic developments
grants to ASJS Properties, LLC pursuant to the Development Agreement. It is expected that the aggre-
gate amount of the Tax Increment Revenue obligations to be issued will be approximately $15,000.
Section 3. The Clerk is hereby directed to cause at least one publication to be made of a notice of
said meeting, in a newspaper, printed wholly in the English language, published at least once weekly,
and having general circulation in said City, said publication to be not less than four days nor more than
twenty days before the date of said meeting on the issuance of said obligations.
Section 4. That the notice of the proposed action to issue said obligations shall be in substantially
the form attached hereto.

ment of 1701 Central Avenue: Upon motion the documents were received and filed and Resolution No.
285-25 Fixing the date for a Public Hearing of the City Council of the City Of Dubuque, Iowa on a

Whereas, Adam Vogel Building, LLC, is the owner of the property legally described as follows:
“Kennedy Central Avenue Place” in City Lot 675; and Lot “A” of “Kennedy Central Avenue Place”
in City of Lot 675; in the City of Dubuque, Iowa, according to the recorded plats thereof locally
known as 1701 Central Avenue (the Property); and
Whereas, the City of Dubuque and Adam Vogel Building, LLC have tentatively entered into a Devel-
opment Agreement, subject to the approval of the City Council, including the issuance of authorize
Urban Renewal Tax Increment Revenue Obligations, a copy of which is now on file at the Office of the
City clerk, City Hall, 50 W 13th Street, Dubuque, Iowa for the development of the Property; and
Whereas, the City Council has tentatively determined that it would be in the best interests of the City
to approve the Development Agreement with Adam Vogel Building, LLC; and
Whereas, it is deemed necessary and advisable that City should authorize Urban Renewal Tax In-
crement Revenue Obligations, as provided by Iowa Code Chapter 403, pursuant to the Development
Agreement; and
Whereas, before said Obligations may be approved, Iowa Code Chapter 403 requires that the City
Clerk publish a notice of the proposal and of the time and place of the meeting at which the City Council
proposes to take action thereon and at which meeting the City Council shall receive oral and/or written
objections from any resident or property owner of said City to such proposed action.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA THAT:
Section 1. The City Clerk is hereby authorized and directed to cause a notice to be published as
prescribed by Iowa Code Section 403.9 of a public hearing on the City's intent to approve the Develop-
ment Agreement and authorize Urban Renewal Tax Increment Revenue Obligations, to be held on the
15th day of September 2025 at 6:30 p.m. The official agenda will be posted on Friday, September 12,
2025, and will contain listening, viewing, and public input options. The City Council agenda may be

Section 2. The City Council will meet at said time and place for the purpose of taking action on the

gations will be used to carry out certain of the special financing activities described in the Urban Re-
newal Plan for the Greater Downtown Urban Renewal District, consisting of the funding of economic
developments grants to Adam Vogel Building, LLC pursuant to the Development Agreement. It is ex-
pected that the aggregate amount of the Tax Increment Revenue Obligations to be issued will be ap-
proximately $65,000.
Section 3. The Clerk is hereby directed to cause at least one publication to be made of a notice of
said meeting, in a newspaper, printed wholly in the English language, published at least once weekly,
and having general circulation in said City, said publication to be not less than four days nor more than
twenty days before the date of said meeting on the issuance of said obligations.
Section 4. That the notice of the proposed action to issue said obligations shall be in substantially
the form attached hereto.

Whereas, the City of Dubuque is pursuing an engineered solution to bring water service to a portion
of the SW Arterial, starting at Edval Lane and N. Cascade Road, west along the SW Arterial to North
English Road through an Iowa, State Revolving Fund assis ted pilot program; and
Whereas, as part of the SRF loan process, the City is required to complete an environmental review
through the public hearing process; and
Whereas, a discussion is to be held on the environmental impacts of the project; and
Whereas, a transcript of the public hearing and a summary of public comments will be available for
public review; and
Whereas, before said obligations may be approved, Chapter 403 of the Code of Iowa requires that
the City Clerk publish a notice of the proposal and of the time and place of the meeting at which the
City Council proposes to take action thereon and at which meeting the City Council shall receive oral
and/or written objections from any resident or property owner of said City to such proposed action.

PUBLIC HEARINGS
1. Approving a Development Agreement by and between the City of Dubuque, Iowa and Greater
Dubuque Impact Investment Fund for Redevelopment of 1550 Elm Street : Motion by Roussell to receive
and file the documents and adopt Resolution No. 288-25 Approving disposal of an interest in real prop-
erty owned by the City of Dubuque by sale through a Development Agreement with Greater Dubuque
Impact Investment Fund. Seconded by Wethal. Dubuque Initiatives Committee Member Rick Dickinson
spoke in support of the agreement, noting the organization’s 501(c)(3) nonprofit status and its use of
funds from the Dubuque Racing Association (DRA) for capital projects. In response to a question,
Brumwell stated that there may be periods when county taxes are levied and when they are not, as the
county has a process for determining property tax exemption. In response to a question, Dickinson
stated that the nonprofit is pursuing federal funds to address environmental issues on the former Blum
property. Motion carried 7-0.
RESOLUTION NO. 288-25
APPROVING DISPOSAL OF AN INTEREST IN REAL PROPERTY OWNED BY THE CITY OF DUBU-
QUE BY SALE THROUGH A DEVELOPMENT AGREEMENT WITH GREATER DUBUQUE IMPACT
INVESTMENT FUND
Whereas, the City Council of Dubuque, Iowa, did on April 21, 2025, adopt an Amended and Restated
Urban Renewal Plan for the Greater Downtown Urban Renewal District (“the Plan”) for the Urban Re-
newal Area described therein; and
Whereas, the City of Dubuque, Iowa, is interested in stimulating reinvestment in the Greater Down-
town Urban Renewal District; and
Whereas, the Plan provides, among other things, for the disposition of properties for private devel-
opment purposes; and
Whereas, Greater Dubuque Impact Investment Fund has submitted to the City a proposal in the form
of an offer to purchase (the “Development Agreement”) for the purchase of certain City -owned real
property hereinafter described, to wit LOTS 182, 183,184,185 & 186 E AST DUBUQUE ADD, locally
known as 1550 Elm Street (“the Property”), which Development Agreement proposes Greater Dubuque
Impact Investment Fund will undertake the redevelopment of a building and surrounding land on the
Property as described therein, which Property is the real estate consisting of 0.59 acres shown on
Exhibit A, and which Development Agreement requests that this Property be made available for sale
as rapidly as possible; and
Whereas, Iowa Code Chapter 403 authorizes cities to dispose of property in furtherance of an urban
renewal project and to take other actions as may be necessary to carry out the purposes of said Chap-
ter, and the Plan similarly authorizes the City to dispose of property; and
Whereas, in compliance with Iowa Code Section 403.8, and to the extent required by law, Iowa Code
Section 364.7, the City Council has set forth its proposal to dispose of its interest in the Property and
the City Clerk published notice on July 23, 2025, as required by law soliciting competitive proposals for
the Property; and
Whereas, as of 10:00 a.m. on September 2, 2025, the City Clerk received no competitive proposals
for the Property; and
Whereas, the City Council believes it is in the best interest of the City of Dubuque to approve the
Development Agreement proposed by Greater Dubuque Impact Investment Fund and the sale of the
Property as provided in the Development Agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. The Council finds that the transfer of the Property will promote the purposes of the urban
renewal law, Iowa Code Ch. 403 in the City and, together with the other consideration provided for in
the Agreement, that these benefits constitute fair value for the City’s disposal of interests in the Property
under Iowa Code Section 403.8.
Section 2. The Development Agreement between the City and Greater Dubuque Impact Investment
Fund including the sale of the Property as provided therein, is hereby approved.
Section 3. The Mayor is authorized and directed to execute said Development Agreement on behalf
of the City of Dubuque.

Whereas, by Resolution 262-25 adopted on August 4, 2025, the City Council of the City of Dubuque,
Iowa authorized the preparation of an Amended and Restated Urban Renewal Plan (the “Amended and
Restated Urban Renewal Plan” or “Plan”) for the Dubuque Industrial Center Economic Development
District (the "District"); and
Whereas, the Amended and Restated Urban Renewal Plan for the District, Version 2025.3, is on file
in the City Clerk's Office; and
Whereas, the City Council’s primary objective for the Amended and Restated Urban Renewal Plan
for the District is to remove certain property from Subarea B of the District as shown in the Amended
and Restated Urban Renewal Plan, Version 2025.3, to provide opportunities which will further economic
development purposes and objectives as described in the Plan; and
Whereas, a consultation process has been undertaken with affected taxing entities in accordance
with Chapter 403 of the Code of Iowa and no written objections or recommended changes to the Plan
have been received; and
Whereas, the City Council, in accordance with Chapter 403 of the Code of Iowa, has held a public
hearing on the Amended and Restated Urban Renewal Plan after public notice thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That the Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center
Economic Development District, Version 2025.3, is hereby approved.
Section 2. That a feasible method exists for the location of any families who will be displaced from
the District, as amended, into decent, safe and sanitary dwelling accommodations within their means
and without undue hardship to such families; and that the Amended and Restated Plan conforms to the
general plan of the City as a whole. With respect to any real property in the District acquired by the City
in connection with the land and projects included in the Plan, non -residential use is expected and with
reference to those portions thereof which are to be developed for non -residential uses, such non-resi-
dential uses are necessary and appropriate to facilitate the proper growth and development of the City
in accordance with sound planning standards and local community objectives.
Section 3. That the District, as amended, continues to be an area for economic development (com-
mercial and industrial) within the meaning of Iowa Code Chapter 403; that such area is eligible for
designation as an urban renewal area and otherwise meets all requisites under the provisions of Iowa
Code Chapter 403; and that the rehabilitation, conservation, redevelopment, development, or a combi-
nation thereof, of such area is necessary in the interest of the public health, safety or welfare of the
residents of this City.
Section 4. That, notwithstanding any resolution, ordinance, plan, amendment or any other document,
the Amended and Restated Plan shall be in full force and effect from the date of this Resolution until
the Council amends or repeals the Plan.

4. Public Hearing Vacating a portion of a Utility Easement over part of Lot 2, Block 4, of Indian Hills,
in the City of Dubuque, Iowa - Emily and Scott McGuire Property at 1195 Arrowhead Drive: Motion by
Roussell to receive and file the documents and adopt Resolution No. 291 -25 Disposing of property by
vacating city interest in a portion of a Public Utility Easement over and across Part of Lot 2, Block 4, of
Indian Hills, in the City of Dubuque, Iowa. Seconded by Wethal. In response to a question, Assistant
City Engineer Bob Schiesl explained that the property owners’ proposal to vacate the easement af-
fected an existing permanent easement. To address this, the owners established a new utility easement
in a different area of the property, which required approval from all private utilit y providers. Motion
carried 7-0.

DISPOSING OF PROPERTY BY VACATING CITY INTEREST IN A PORTION OF A PUBLIC UTILITY
EASEMENT OVER AND ACROSS PART OF LOT 2, BLOCK 4 OF INDIAN HILLS, IN THE CITY OF
DUBUQUE, IOWA
Whereas, the City Council, by Resolution No. 271 -25, dated the 18th day of August 2025, declared
its intent to dispose of City interest in a public utility easement on real property, legally described as:
Lot 2, Block 4, of Indian Hills, in the City of Dubuque, Iowa, according to the recorded plat thereof
(the Property); and
Whereas, in 1956 a public utility easement was platted over a portion of Lot 2, Block 4, of Indian
Hills, in the City of Dubuque, Iowa according to the Plat of Block 1, Block 2, Block 3, and Block 4 in
Indian Hills in the City of Dubuque, Iowa recorded in Plat Book 23, Page 310, in the office of the Dubu-
que County Recorder; and
Whereas, pursuant to published notice, a public hearing was held on the proposed disposition on
the 2nd day of September 2025 at 6:00 p.m. in the Historic Federal Building, 350 W. 6th Street, Dubu-
que, Iowa; and
Whereas, it is the determination of the City Council that City interest in the public utility easement on
the Property as shown on the attached Exhibit A should be vacated and doing so is in the public interest
of the City of Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,

Section 1. The City hereby vacates all interest in the public utility easement located at the Property

5. Rustic Point Park Development Project Public Hearing : Motion by Sprank to receive and file the
documents and adopt Resolution No. 292 -25 Rustic Point Park Development Project: Approval of
Plans, Specifications, Form of Contract, and Estimated Cost. Seconded by Wethal. In response to a
question, Van Milligen explained that the funding is sourced from Tax Increment Financing (TIF) asso-
ciated with the development. The state mandates that expenditures be made from the general fund,
with reimbursement coming from the TIF source, which is certified as debt. He also noted that the City
Council approved this arrangement during the budget process. While unsure of the exact repayment
timeline, he believed the turnaround would be relatively quick. Motion carried 7-0.

RUSTIC POINT PARK DEVELOPMENT PROJECT, APPROVAL OF PLANS, SPECIFICATIONS,
FORM OF CONTRACT, AND ESTIMATED COST
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
That the attached plans, specifications, form of contract and estimate of total cost for the Rustic Point
Park Development Project, in the estimated construction amount of $258,278.50, are hereby approved.

ACTION ITEMS
1. Smart Parking & Mobility Management Plan Update: Motion by Roussell to receive and file the
documents and hear the presentation. Seconded by Wethal. Director of Transportation Services Ryan
Knuckey made a presentation on the progress of the Smart Parking & Mobility Management Plan. In
response to questions, Knuckey stated that the On-Street Parking Request for Proposals (RFP) must
be completed before options for integrating the City’s parking technology can be discussed. He noted
that the parking ramps are equipped with call buttons that connect directly to parking staff, who can
provide assistance similar to a help desk. He further stated that parking ramps allow a 15 -minute grace
period, enabling users to test the system without incurring a fee. He reported that the new parking
technology will reduce the amount of staff time currently spent repairing outdated systems, allowing
more time to be dedicated to maintenance and upkeep of the ramps. He clarified that the Transit Advi-
sory Board (TAB) is required by the Federal Transit Administration (FTA) to provide input on transit
operations and noted that parking updates are shared with the TAB because of their impact on transit.
Van Milligen emphasized that the TAB has no role in parking operations and noted that Knuckey main-
tains strong communication with major parking ramp users, including the business community. City
Council Members acknowledged residents’ concerns regarding potential issues in the parking ramps
and their hesitancy toward changes. Council Members also commended the universal color-coding
system in the ramps and expressed appreciation for the real-time updates. Motion carried 7-0.
2. Dubuque County Historical Society Letter of Authorization to Iowa Economic Development and
Finance Authority’s Historic Preservation Tax Credit Program: Motion by Sprank to receive and file the
documents and approve the letter of authorization in support of the Dubuque County Historical Society’s
application to the Iowa Economic Development and Finance Authority’s State Historic Preservation Tax
Credit program. Seconded by Resnick. In response to a request for an update on the Mathias Ham
House, Interim Parks and Recreation Director Steve Fehsal reported that both interior and exterior
improvements are underway, including painting, window repairs, and ceiling molding. He noted that the
work is being funded through existing grant agreements and Capital Improvement Plan (CIP) funds. He
stated that the reopening date has not yet been determined but will be confirmed . Motion carried 7-0.
3. Letters of Support for an Iowa Redevelopment Tax Credit Application for Downtown Redevelop-
ment Projects on a Grayfield Site: Motion by Roussell to receive and file the documents and approve
the submission of the letters of support to accompany an Iowa Redevelopment Tax Credit Application
to the Iowa Economic Development Authority being submitted for redevelopment of three downto wn
properties in Dubuque. Seconded by Jones. City Council Members highlighted the significant invest-
ment and housing units created through the developments and thanked all parties involved. Motion
carried 7-0.
4. Fly DBQ Rewards and Incentives: Motion by Farber to receive and file the documents. Seconded
by Jones. City Council Members reaffirmed air service as a priority for the past few years, acknowl-
edged the challenges of attracting and retaining providers, and thanked Dubuque Initiatives and Denver
Air Connection for offering incentives. Motion carried 7-0.
5. Greater Dubuque Development Corporation (GDDC) Wins International Economic Development
Council Gold Award: Motion by Roussell to receive and file the documents. Seconded by Resnick.
GDDC President and CEO Rick Dickinson acknowledged GDDC’s Strategic Initiatives Consultant Dave
Lyons for leading the Dubuque Broadband Acceleration Initiative. Motion carried 7-0.
6. Welcome College Students Video: Motion by Jones to receive and file the documents and view
the video. Seconded by Wethal. Multimedia Specialist Felicia Carner introduced a video produced by
the City’s Media Services division, which featured a welcome message from Mayor Cavanagh and
highlights of life in Dubuque, that was played as part of the Welcome Students campaign organized by
GDDC and the local Community of Colleges. Rick Dickinson discussed GDDC’s collaborations with
local colleges. Motion carried 7-0.
COUNCIL MEMBER REPORTS
Sprank reported on attending a DRA board meeting, the DRA grant reception, and a Point Neigh-
borhood Association event. Sprank also reported on the upcoming Dubuque Dragon Boat Races event
and the upcoming Nathaniel Morgan memorial event.
Farber reported on the Tim McGraw concert at the Field of Dreams.
Roussell reported on attending Dubuque Main Street committee meetings, a HACAP board meeting,
and the Labor Day Parade. Roussell also reported on volunteering with Dubuque Trees Forever at the
community orchard and the Dubuque Farmer’s Market.
Jones reported on attending a Travel Dubuque Board meeting, a DRA board meeting, the DRA grant
reception, a Bluff St. Neighborhood Association meeting, ribbon cuttings for McDonald’s Supply and
GoodLife Integrative Veterinary Care, Elevated Images’ open house, the book signing event for former
Iowa State Trooper Bob Hurley’s memoir, a Dubuque Metropolitan Area Solid Waste Agency
(DMASWA) board meeting, and the Labor Day Parade. Jones also reported on meeting with Chrissy
Hogue Bartels of Torfoot Entertainment Group, who is exploring film opportunities and partnerships in
Dubuque.
Resnick reported speaking with a visitor who praised Dubuque, specifically Hotel Julien and St.
Raphael’s Cathedral.
Wethal reported on attending the Tim McGraw concert, the DRA grant reception, the Labor Day
Parade, and a Dubuque County Early Childhood board meeting.
CLOSED SESSION
Motion by Jones to convene in closed session at 8:43 p.m. to discuss Pending Litigation and Pur-
chase or Sale of Real Estate – Chapter 21.5(1)(c),(j) Code of Iowa. Seconded by Resnick. Mayor
Cavanagh stated for the record that the attorney who will consult with City Council on the issues to be
discussed in the closed session is City Attorney Brumwell. Motion carried 7-0.
The City Council reconvened in open session at 9:23 p.m. stating that staff had been given proper
direction.
