1884 July Council ProceedingsSpecial Session July 1st, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin Olinger and Page Absent Ald McCarthy the mayor stated the object of the meeting to be to take final action on the gauge of the proposed double track for the street railway and called on the citizens present for their views on the matter after hearing remarks on the subject from several citizens the matter was allowed to remain as it was a broad gauge The mayor aslo stated that a notice had been served on the city by the property owners on Main Street giving notice that suit would be commenced for an injunction to restrain the city from collecting a special assessment for the improvement of Main street Ald Crawford moved that the matter be referred to the city attorney to examine and report to the council at its regular session next Monday the petition of James H Shields in relation to filling lot 2 of block 9 was referred to the committee on harbors The resignation of Policeman A Pfeffer was read and on motion accepted Health Officer Waples made a report in relation to some nuisances and asked the council to order the same abated the officer was instructed to report at the next regular session when action would be taken the marshal was instructed to notify Mr H H Clark to put his building in proper shape to comply with the ordinance the bid for the improvement of Weigel Alley was opened and read and on motion the contract was awarded to Spear and Lee The proposals for the improvement of bluff Street extension was Fourth and Locust st be set back ten feet from the sidewalk was on motion granted the communication of D G Scott in relation to an appropriation for the improvement of third street on motion the street commissioner was instructed to expend not to exceed seventy five on third street between St mary's and Summit Street the petition of A Kammann in relation to warrants past due was referred to the committee on Finance the petition of F Weigle asking for mining right under the Weigel alley was referred to the mayor and city attorney with power A communication from the Health Officer in relation to the abatement of nuisances was referred to the board of Health and city Attorney with power the petitions of Bridget Burke and Bridget Roach asking for remittance of taxes was referred to the committee on delinquent tax the petitions of W K deLorimer an dChas B Dorr in relation to assessment was referred to the same committee The petition of J Zangmeister in relation to sidewalk on Forrest Lane was referred to city engineer Tschergi to have the sidewalk laid as ordered the petition of Chas J W Saunders askinf for grade to curb and gutter on the north side of Eagle Point Avenue and Page The petition of J Zangmeister et al asking for street crossings was referred to the committee on streets the petition of A W Lynch asking prielege tobuild a wall on Weigel Alley was referred to the committee on streets with power The petition of Ptk Moran asking compensation for filling sidewalk on Rush Street referred to teh same committee The petition of Francis P Wood and others asking for a change of grade on Francis Street Tivola add referred to the same committee The petition of Ross McMahon in relation to eighth street sewer was referred to the same committee Reports of Officers Marshal Zugenbuehler reported that 85 arrests had been made during the month that he had paid into the city treasury 2.25 for impounding 1.00 fines and 4.25 for broken lamp post that the sum of 1191.10 was necessary to pay the police force for the month of June the report was received and filed and the amounts ordered paid Auditor Reilly reported that the amounts due the city officers and employees for June was 944.90 and the fire department 903.30 ordered paid Treasurer Traut reported having paid out during the month as interest etc 1576.80 ordered paid Street commissioner Norton reported that 1291.65 had been expended on streets during the month of June ordered paid Police Justice Hoffmann reported that he had tried eight cases for violation of city ordinances and had paid into the city treasury 12.00 as fines in said cases that there was due him 7.75 as fees in said cases which was ordered paid Lamplighter Hackney reported having lighted 200 gas lamps during the month received and filed Auctioneer Hedley reported auction sales amounting to 13,430.05 during the month received and filed Regular Session July 7th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Woodmeasurer Warring reported having measured 842 cords of wood during the month received and filed The city weighers reported as follows Fifth Ward Scales West Dubuque Scales First Ward Scales Market House Scales Market master price reported that he had collected from the Huckster Stands 27.75 and that there was due him 17.60 for board of prisoners and lodgers received and filed City Engineer Tschirgi reported that he had served the proper notices on Russell and Rowan Streets for the right of way of streets which was received and filed He also reported the estimate cost of grading division Street from Middle Street to Johnson Ave also the estimated cost of extending Division St from Johnson Ave to Kniest St Amount of Grading 4450 cu yds at 20 cents 890.00 Extending Division St N 25 ft lot 4 Kniest Add 200.00 20 ft owned by School District and used as an alley 5 ft school district 50.00 250.00 He also reported he had made a careful measurement of the filling done by contractor Frank Randall on lots ordered filled and find the same to be as follows on lot 2 of w 1/2 block 10 Dubuque Harbor Co's add lot 3 lot 4 lot 5 On E side Main St along side lots Total amount of filling All of which was adopted The recorder reported the total amount of license issued during the past month to be 129 for which he holds treasurers receipts to the amount of 1086.50 All of which was respectfully submitted received and filed Regular Session July 7th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Reports of committees ald Kane Chairman on Finance reported as follows in the relation of water tax of the railroads We hereby recommend that the water tax of the CM & St P Railroad be place at 19.00 and the IC Railroad at 22.66 adopted Ald Chas Hollnagel chairman on delinquent tax reported as follows on the petition of William Teide you committee recommends that an order be drawn on the city treasurer for the amount of 44.00 as refunded tax The same committee reported on teh petition of Jms Conlan that an order be drawn on the city treasurer for 1.10 the same to be refunded to petitioner The same committee reported on the petition of M M Walker in relation to the Oriental Powder Works that an order be drawn on the city treasurer for 43.10 as refunded tax on the petition The same committee reported on the petition of M M Candy that the personal taxes of M M Candy is not a license on the property of his wife The same committee reported on the petition of Mrs James Linehan that the tax be cancelled the same committee reported on the petition of Mrs mary Winterer that the tax be cancelled The same committee reported on the Sal Burns that the assessment be reduced on lot No 2 in Oak Grove Add to 70.00 Ald H C Deckert chairman of committee on streets reported on the petition of Margaret Leary to pave gutter and set curb Olinger and Page the same committee also reported on the petition of the motor railway co that they be allowed 75.00 for planking on Hill St sewer The same committee reported that a plank sidewalk four feet wide be laid on the south side of Seventh St between White and Jackson Sts within fifteen days of this notice The same committee reported in favor of petition of John Wolfe to curb and gutter abutting lot 31 on 18th st The same committee also reported on the petition of Jos Vogel et al in favor of ordering City Engineer in making plat and survey of said roadway adopted The same committee reported on the petition of James Harrigan et al in favor of ordering street commissioner to grade sidewalk adopted the same committee reported in relation to petition of the Dubuque Street Railway Co for exact grade on Couler ave that the city engineer obtain owners consent to proposed grade engineer to give grade in 30 days granted The same committee reported on the petition of Nick Kaufmann that he be granted permission to set curb and guttering The same committee reported in favor of granting the petition of J Ganahl that he be allowed to set curb and guttering abutting his property cor 19th and white st Ald thomas Burns chairman Harbor Committee reported on the communication of J H Shields that the same be received and filed Ald Clancy from the committee on Police and Gas reported on the petition of Geo Zumhof Jr that the same be received and filed the same committee reported on the petition of E W tyler et al in favor of placing a lamp post corner of 5th and nevada streets Ald Olinger Chairman of Committee on Fire reported on the petition of A A Cooper that the same be granted Ald Page from the committee on claims reported on the petition of Dr Sigismund Lesser that the sworn statement of petitioner and mayor be given before the whole council Ald McCarthy from the committee on public grounds and buildings reported in favor of paying several bils referred to his committee in the previous session Regular Session July 7th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page the same recommended that the city buy fifty new iron seats for use in the parks at an expense of 350.00 the recommendation was received and filed Ald McCarthy reported on the petition of John Pier in relation to old bond that the same be received and filed On motion the sidewalk on the east side of Jackson Park was ordered to be gravelled by the street commissioner A recommendation to paint the town clock was on motion received and filed ald Kane moved that the street commissioner employ Thos Hackney as foreman on the streets if he has work for him which was adopted City Attorney reported on the petition of B J Duffy that he had made application for a rehearing of the case and that the petition be received and filed adopted On the petition of John Cooney that the same be received and filed he also returned the contract with B W Jones for building the 4th street engine house to the recorder He also presented an ordinance entitled an ordinance to prevent hogs and other animals from running at large which was read and on motion the rules were suspended and the ordinance read for the second time and adopted by a unanimous vote of the council Ald McCarthy offered the following resolution Whereas the steps leading from fifth street to the alley leading from the eastern terminus of Fenlon Place are in a bad condition and dangerous to travel over the same and as it is the only outlet that those residing on Fenlon St have therefore resolved by the city council of the city of Dubuque that the street commissioner be and is hereby instructed to have the same repaired the ayes and nays were called on teh adoption of the resolution and it was adopted by a unanimous vote of the council Ald McCarthy offered the following which was adopted Resolved hat the com on Police and Gas have power to order the gas company to lay gas pipe to the center of Washington park as the citizens have a lamp post in the park that they ask gas for Regular Session July 7th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Crawford offered the following resolution which was adopted Resolved that a special committee be appointed to confer with the proprietors of the lorimer House artesian well with a view to obtaining the free use of water from said well for a drinking fountain to be placed on the outer edge of the sidewalk at the point for the use of passers by including animals also with the proprietors of the steam heating works relative to water for a similar fountain on 6th street between Iowa and Clay Streets The mayor appointed Ald Crawford McCarthy and Deckert as such committee Ald Crawford offered the following Resolved that a street lamp post and gas lamp be put in on the north side of Julien Avenue at a point opposite the vacant lot immediately west of the store of Joseph Traut the resolution was referred to the committee on Police and Gas with power Ald Crawford offered the following resolution which was adopted Whereas it is deemed advisable by the city council to lay out and open Russell Street in the manner shown on the plat now on file in the office of the city engineer and the owners of the property proposed to be taken have been duly notified as required by law Therefore resolved that the city recorder be instructed to issue a venire to the city marshal commanding him to summon a jury for the purpose of appraising the damages caused by laying out of said street all of the proceedings to be had in conformity with the provisions of chapter 25 of the revised ordinances Ald Crawford offered the following which was adopted Whereas it is deemed advisable by the city council to extend Rowan St southerly to Grand View Ave and the persons whose property is proposed to be taken as shown by the plat in the office of the city eng have beenduly notified as required by ordinance therefore resolved that the city recorder be instructed to issue a venire to the city marshal commanding him to summon a jury for the purpose of appraising the damages caused by laying out and extending said street all of the proceedings to be had in conformity with the provisions of chapter 25 of the revised ordinances Regular Session July 7th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page the city attorney gave his opinion on the petition of Wm G Watters and stated that a public water way could not be used by private parties Ald Crawford moved that the street commissioner be instructed to turn the water into the gutters out of the sewer and the matter of pumping out the cellar be referred to the mayor with power carried Ald Crawford moved that the committee on fire be instructed to place a fire plug at the corner of ninth and pine street which was adopted Ald McCarthy moved to reconsider the vote by which Mrs Sophia Stange was allowed 100.00 Ald Crawford moved to lay the motion on the table which was carried The bill of Wm Rebman for the improvement of Park Street was referred back until the work was accepted by the street committee and city engineer Ald Byrne stated that some disatisfaction was expressed at the manner that main street was being improved the matter was referred to the special committee on Main St Adjourned Attest J W Halpin Recorder Adjourned Regular Session July 15th 1884 The council met at 7:30 pm Ald Crawford in the Chair The roll was called and a quorum not being present the council adjourned to meet July 16th at 7:30 pm Attest J W Halpin City Recorder Regular Session July 17th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page The council met at 7:45 pm The petition and claim of Ross McMahon was on motion referred to the committee on streets with Ald Kane and McCarthy Ald Crawford chairman on ordinance reported on the ordinance of the Dubuque Overland Telephone Company with two sections added as amendments Ald McCarthy moved to amend by inserting another section fixing the amount to be charged for telephones on which the ayes and nays were called Ayes Ald Clancy Deckert McCarthy Olinger and Page Nays Ald Byrne Crawford Hollnagel Kane and Martin The mayor voted nay and the amendment was lost The report of the committee as amended was then adopted On motion of Ald Olinger the ordinance was then referred back to the committee to agree on a report A petition from the residents on white street between 12th and 13th street in relation to the children of the Lutheran School was referrd to the marshal with power to abate the nuisance complained of Ald McCarthy reported in favor of paying the bill of the Dubuque Times fo 22.70 adopted Ald Hollnagel offered the following resolution which was adopted Be it resolved by the city council of Dubuque that the gutter on the east side of Couler Avenue from the residence of Mrs P Ellwanger to Eagle Point Avenue be repaired so that the stagnant water will flow into the Eagle Point Avenue sewer and the street commissioner be instructed to commence the work immediately Ald Crawford moved that the street commissioner be instructed to put a gang of men to work repairing Couler Avenue as soon as the street railway company have laid their track onsaid street the matter of grade to be left with the city engineer carried. Regular Session July 16th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Martin moved that a cooper be allowed to store barrels in the basement of the city hall the matter was referred to the committee on public grounds and buildings City engineer Tschergi stated that he had asked the mayor pro-tem not to sign the warrant ordered at the last session as he had been ery careful in his measurement of the macadam and that Mr Lavan had received all that was due him On motion the action of the council in the matter and the petition was referred to the committee on streets Ald Clancy stated that the charge preferred against a policeman referred to his committee at the last session had been throroughly investigated and proved to be groundless the mayor also stated that from what he could learn there was no foundation to the charges Ald Deckert offered the following resoluton which was adopted Be it resolved by the city council of the city of Dubuque that four hundred dollas be paid Ross McMahon as part payment on 8th street sewer contract the warrant to be drawn in favor of the city treasurer who holds a receipt for the amount Ald Deckert offered the following Resolved by the city council of the city of Dubuque that Washington Street between 19th and Lake Streets be graded guttered curbed and macadamized in conformity with the ordinance upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the guttering curbing and macadamizing to be done at the expense of the abutting propety the resolution was adopted by a unaminous vote of the council The special committee on Main Street was called on to report and ald Crawford asked the attorney to report on the matter referred to him in relation to the subject The city attorney reported that he had examined the records as instructed and found all the proceedings in the matter correct and regular and that the city had the right and can collect the special assessment for the improvement Regular Session July 16th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Deckert moved that the work be stopped at third street until such time as the injunction suit threatened wsa settled or withdrawn The ayes and nays were called on the motion Ayes Ald Byrne Deckert Hollnagel Kane and Olinger Nays Ald Clancy Crawford Martin McCarthy and page The mayor voted nay and the motion was lost Ald Crawford moved that it be declared the sense of the council that the work be prosecuted as speedily as possible Ald McCarthy moved to amend that a committee of three be appointed to ascertain what the property owners were willing to do the ayes and nays were called on the amendment Ayes Ald Byrne McCarthy and page Nays Clancy Crawford Deckert Hollnagel Kane Martin and Olinger Ald Crawford motion was then put and carried The bill of F Heer architect for plans for engine house c c amounting to 110.00 was ordered paid Ald McCarthy reported that the bill of N H Faust of 32.50 for lightning rods for engine house was correct ordered paid On motion W H Rebman was allowed $400.00 as part payment on his contract for the improvement of Park St Adjourned Attest J W Halpin City Recorder
