of the abutters for the improvement of west Eighth street to the same committee and engineer The remonstrance of Peter Fay objecting to special assessment for the improvement of an alley to the same committee The petition of Joseph Simons for privelege to set curb and pave gutters in front of his property to the same committee The petition in relation to the width of Kniest Street was referred to the same committee The petition for impovement of the sidewalks on Main and Madison Street to the same committee The petition of Ed Muntz asking the refunding of two dollars on license cancelled granted the petition of R L Polk asking subscription for new city directorys on motion of ald Crawford five copies were subscribed for The petition for the vacation of an alley in Collins sub was referred to the committee on streets the remonstrance against teh improvement of the alley between Washington and Elm and 11th and 12th street was referred to the committee on streets The petition of Chas Schaffert et al against the improvement of Washington Street was on motion received and filed The petition of Anton Trieb et al for gas lamp on Ellis Street was referred to the committee on Police and Gas The petition in relation to the width of Kniest Street was referred to the committee of the whole the petition of A McArthur et al in relation to the improvement of the alley between West 3rd and Fenlon St to the com on streets The petition of Carl Spiegelhalter for free saloon license was referred to the com on police and gas Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page the petition of Chris Jansen to have part of saloon license refunded was referred to the committee on Finance the petition of Joseph Miller for license to sell vegetables about the city was referred to the committee on markets the petition of M Morgan to be employed to put in stone crossings on Main Street at 5 cents per lineal foot was referred to the com on streets with power the following petitions in relation to taxes and assessments was referred to the committee on delinquent tax of Cath Dolter Johanna Broderick Cath Farrell Rachel Davis mary J Luke Bridget Gregory Iowa Coffin Co and James Rowan Administrator The improvement of Main Street having been suspended the city engineer was called and made a statement in relation to the affiar as did also Mr Linehan the contractor after which the council adjourned until 2 oclock pm in the meantime to visit and examine the stone crusher of the contractor the council met at 2:30 pm Mayor ODonnell in the chair and all the aldermen present Report of Officers The lamplighter reported having lighted 202 lamps during the month including 4 park lamps the report was received and filed the wood measurer reported having measured 844 cords of wood which had arrived by river and rail received and filed the marshal reported that eighty one arrests were made during the month and that thirty two dogs had been killed by the police force the sum of 1148.65 was necessary to pay the force for the month the report was received and filed and the men ordered paid The deputy marshal reported that he had served the proper notices of special assessment for improvements completed received and filed The treasurer reported having paid out 711.00 as interest and part pay on work done warrants were ordered drawn for the amount Auctioneer Hedley reported sales of real estate the amount of 4649.00 the report was received and filed Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page The auditor reported the payroll of the city officers and employees and the members of the fire department amounting to 1849.70 which was ordered paid The recorder reported having issued license to the amount of 997.40 during the month of July received and filed The street commissioner reported having expended 1773.20 on the streets during the month of July for men and teams warrants were drawn for the amounts Police Justice T T Duffy reported having tried eight cases for violation of the city ordinances the fines amounting to seven dollars being paid into the city treasury the report was received and filed The market master reported having collected rent of Huskcster stnds 27.00 and from the sacales 15.90 which he paid into the treasury Also that he had furnished 110 meals to prisoners and lodgers amounting to 22.00 which was ordered paid The city weighers reported as follows West Dubuque Scales fifth Ward Scales First Ward Scales Reports of Committees Ald Crawford chairman of the committee on ordinance reported in favor of the adoption of teh ordinance of the overland telephone co the ordinance was read for the second time and then adopted by the following vote Ayes Ald Byrne Crawford Hollnagel Deckert Kane and Martin Nays Clancy McCarthy Olinger and Page The same presented an ordinance to amend section 13 of an ordinance entitled an ordinance in relation to license which was read On motion the ordinance was read for the second time after the suspension of the rules and was adopted by the unaminous vote of the council Ald Kane Chairman on Finance reported that it was necessary to borrow five thousand dollars to meet the current expense of the month of July Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Deckert chairman of the committee on streets reported on the petition of A W Lynch for privelege to build a retaining wall on weigle Alley that the petition be received and filed adopted the same reported in favor of paying the bill of Duggan S & K Amounting to 43.60 which was adopted the same reported on the petition of J B Needham in favor of doing the necessary work according to the engineers estimate and plan not to exceed 75.00 cost the petitioners to pay 25.00 adopted The same reported on the petition of J Zangmeister et al that the work petitioned for had been completed by the street commissioner adopted The same reported on the petition for the improvement of exchange street that the petition be received and filed adopted The same reported on the petition for change of grade on Francis Street that the city engineer report a change of grade adopted The same reported on the petition for culvert across centre street Simpsons add that the street commissioner put in the culvert adopted The same reported on the petition of Chas Saunders that the petition be granted and engineer set the grade stakes adopted Ald Page reported adversely to the claim of Thos Cunningham and that the same be received and filed adopted The same after the sworn statement of Dr Lesser and the mayor being heard reported in favor of receiving and filing the claim of Dr Lesser Adopted Ald Hollnagel Chairman of the committee on Delinquent Tax reported in favor of cancelling the ta of 1882 of Bridget Roach and Bridget Burke Adopted the same reported on the petiton of Wm K deLorimer that his assessment of Moneys and credits be cancelled adopted The same reported on the petition of Chad B Dorr that his assessment on personal property be reduced to 700.00 adopted The same reported on the petition of Roberts and Langworthy Iron Works that the petition be received and filed adopted Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Deckert offered the following resolution Resolved by the city council of the city of Dubuque that the alley between 13th and 14th between Jackson and Washington streets be graded and macadamized in conformity with the ordinance upon that subject That the city engineer be and is hereby directed to makle the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the grading and macadamizing to be done at the expense of the owners of the abutting property the resolution was adopted by the unanimous vote of the council Ald McCarthy offered the following Whereas it is costing the city a large sum of money each month for assistants to the city engineer and that the cost for the month ending to the city was 113.50 therefore be it resolved by the city council of the city of Dubuque that we proceed to elect a deputy city engineer at a salary not to exceed 70.00 per month until January 1st 1885 and that no bills be allowed for assistants to help the city engineer other than provided in the foregoing The ayes and nays wer called on the resolution Ayes Ald Byrne Clancy Deckert Kane Martin McCarthy Olinger an dPage Nays Ald Crawford and Hollnagel Ald Crawford moved as an amendment that the engineer be authorized to nominate an assistant Ayes Ald Crawford Deckert Hollnagel and martin Nays Byrne Clancy Kane McCarthy Olinger and Page The council then proceeded to elect an assistant engineer Ald Page and Byrne were appointed tellers and the vote resulted on the first ballot in the election of Wm Evans Ald Hollnagle called the attention of the council to a nuisance on Francis St Livola add Mr Brown was heard in relation to the abatement of a nuisance on his property the subject matter was referred to the ex com of the board of health Ald Crawford offered the following resolution Whereas upon an examination of the plat and report of the engineer on Russell and Rowan streets and of the assessment and estimate of the jury summoned to appraise the damages resulting to the owners of the property on the line of said streets caused by the laying out and offering the same it is decided by the city council that it is expedient and necessary to lay out and open Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page said streets in the manner shown on the plats of same on file in the office of the city engineer Therefore Resolved that the assessment of the jury summoned to assess the damages caused by the opening of Russell and Rowan sreet this day returned to teh council be and the same is hereby accepted and approved and the several amounts awarded as damages be set apart in teh city treasury and paid to the several persons entitled to the same on their executing in the proper legal manner a relinquishment to the city of the right of way for said streets over the property taken. That Russell Street and Rowan Street be each and severally declared public highways and the marshal be instructed to proceed to open the same as soon as practicable adopted the jury summoned to assess the damages caused by the opening of Russell and Rowan Streets made the following report to the city council of the city of Dubuque We the undersigned having been duly appointed jury men to assess the damages if any by recision of the opening and establishment of streets known as Russell and Rowan streets in the city of Dubuque and having been duly sworn on oath respectfully report that we have this day viewed the premises through which said streets are proposed to be laid out or opened according to plats thereof returned here with and made part of this report and have made the following assessment of said damages to witt Rowan Street to Bridget McMahon or owner thereof lot 5 of minl lot 21 to Ann Russell pt minl lot 20 Russell Street To Ann Russell or owner thereof pt minl lot 20 Timothy Dillon 12 John Hickey 14 and we further say that the above is just and fair award as we verily believe Dubuque July 22nd 1884 Geo Salot John Ruegamer Thos S Nairn Theo Altman Conrad Schmied Chas H Gregorie M Morgan J V Rider A McCann Frank Brede P H Halpin Jury Regular Session August 4th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page Ald Kane offered the following REsolved that the recorder instruct the treasurer to cancel the city taxes of James Linehan est for 1882 and 1883 on lot 17 corriells sub adopted Ald Crawford offered the following Resolved that the committee on ordinances in connection with the committee on harbors be instructed to report an ordinance defining the ice harbor and regulating the same adopted Ald Hollnagel offered the following Be it resolved by the city council of the city of Dubuque that the taxes of Mr Mary Schwind on lot 107 in east Dubuque be cancelled adopted Ald Crawford offered the following Resolved that the city marshal be instructed not to make any arrests or institute any prosecutions to compel the payment of license for the keeping of private boarding houses until he shall consult the city attorney on the subject and obtain his approval of such proceedings adopted Ald McCarthy offered the following resolved that the city of Dubuque pay to the city marshal of the city of Dubuque 20% of all license collected this year in excess of the amount collected last year adopted Ald Kane offered the following Resolved that the city recorder be instructed to draw a warrant on the city treasurer for two thousand 2000 dollars in favor of D W Linehan as part payment for the improvement of Main Street adopted Ald Kane offered the following Resolved that the finance committee be instructed to borrow five thousand dollars to defray the expenses for the month of July adopted ald Kane moved that the vote by which Mr Evans was elected assistant engineer be reconsidered Ald mcCarthy moved to amend that the matter be postponed until the next meeting of the council in one week The amendment was lost by a vote of 4 to 6 ald Kanes motion was put and carried by the casting vote of the mayor Ald Crawford moved that the election of an assistant engineer be indefinitely postponed which was lost 3 to 7 Ald Crawford then moved that the question of creating the office of assistant engineer be referred to the city attorney to report at the next session of the city council The matter of the improvement of Main Street was then referred to the city engineer and the contractor to work in harmony the city attorney reported that he had made a lease for two years for right to mine under Weigel Alley with condition with condition that surface shall not be broken and in case of damage to surface leasee to pay all expense of repairing resulting from damage leasee to pay of all mineral discovered Ald Clancy moved that the contract for the improvement of Bluff Street extension be let to Spear and Lee the motion was lost On motion the bids for the improvement of Washington street between ninteenth and lake Street were opened and the contract awarded to Geo Martin for 624.85 he being the lowest bidder adjourned attest J W Halpin City Recorder Special Session August 15th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Hollnagel Kane McCarthy and Page Absent Ald Deckert Martin and Olinger the mayor stated the object of the meeting to be to take some action in relation to the erection of a frame building in the fire limits the petition of John McCoy was read and attached thereto was the building permit of the city engineer the marshal was called on and explained his action in relation to the matter the city engineer was also called and stated that he had issued the permit with the understsanding that the building was to be covered with sheet iron On motion the rules were suspended and Mr McCoy was allowed to explain the matter and stated that he had stopped work when notified Ald McCarthy moved that the action of the city engineer in granting the permit be approved The mayor suggested that the building be allowed to proceed under the supervision of the city engineer Ald McCarthy said he would change his motion in accordance with the mayors suggestion ald Byrne moved to amend that the work be allowed to proceed under the fire building ordinance and that the building be covered with iron themotion as amended was carried by a full vote of the members present the petition of thos Hackney for employment on streets was read and on motion of Ald Kane the petition was granted and teh street commissioner instructed to employ Mr Hackney Special Session August 15th 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Hollnagel Kane McCarthy and Page Absent Ald Deckert Martin and Olinger On motion the rules were suspended and J Drehouse was allowed to address the council in relation to the erection of large frame sheds within the fire limits On motion of ald Kane the fire building ordinance was referred to the committee on ordinance and city attorney for revision the city attorney was called on and stated his opinion in relation to the collection of license from private boarding houses that under the existing ordinance the city could not collect said but the ordinance could be so amended that the city could collect a license Ald McCarthy asked the street committee about the improvement of West street ordered at the last session On motion the street commissioner was instructed to proceed with the work at once Ald Kane moved that the marshal proceed to collect all saloon licenses by the 20th of this month and to close all those who have not paid at that date the motion was carried Adjourned Attet J W Halpin City Recorder
