The application, staff report and related materials are attached for your review. nicri iccinn Hilary Dalton, Habitat for Humanity Executive Director, spoke on behalf of Habitat for Humanity. She noted the goal is to create individual properties along the private drive. She said they are requesting that the private drive be named Rosalynn Carter Place in honor of the Carters' dedication to Habitat for Humanity. Staff detailed the staff report, noting that a rezoning of the property had previously been reviewed/approved by the Commission. Staff explained that the proposed plat of survey would allow lots/homes to be sold to individual property owners and that the private drive, stormwater detention, and other common areas on the site would be managed by a homeowner's association. Staff stated that Lots 1 through 10 require a waiver of street frontage requirements since they will have frontage on a private drive but not a private or public street as is required by code. Staff noted that the conceptual plan in the previously approved PUD ordinance will be updated at a future meeting to incorporate bulk regulations, such as lot coverage and setbacks, resulting from the proposed subdivision plat. The Commission discussed the request and sought clarification as to how Lots 11 through 14 would be accessed. Staff stated that lots 11 through 14 are steeply sloping along Wood Street and so vehicular access for those lots would be from the private drive. Staff noted those lots have frontage along Wood Street and therefore do not require a waiver of street frontage. The Commission questioned whether the subdivision plat has been reviewed by the Development Review Team (DRT). Staff stated that it had been reviewed by the DRT as Service People Integrity Responsibility Innovation Teamwork Page 134 of 817 The Honorable Mayor and City Council Members Page 2 a conceptual plan prior to the rezoning and that the proposed subdivision plat has also been reviewed by the team. The Commission questioned whether the adjacent property owner of "Lot 12" (1840 Wood Street) has been a participant during the property review/development. Staff explained that the property owner was notified, as is required by code, when the rezoning was requested; however, the subdivision plat does not require public notification. There were no public comments. The Zoning Advisory Commission discussed the request and found it appropriate. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the Final Plat of Rosalynn Carter Place subject to waiving the lot frontage requirement for Lot 1, Lot 2, Lot 3, Lot 4, Lot 5, Lot 6, Lot 7, Lot 8, Lot 9, and Lot 10. A simple majority vote is needed for the City Council to approve the request. The property is being subdivided to create individual lots for single-family residential development and to create a private drive. Pursuant to the Unified Development Code (UDC), the proposed subdivision is classified as a Minor Subdivision' and requires a waiver of bulk regulations. All Minor Subdivisions require review by the Zoning Advisory Commission. DISCUSSION The Final Plat of Rosalynn Carter Place proposed to subdivide two (2) existing lots into a total of fifteen (15) lots. The following is a description of the proposed lots: ■ Lots 1 through 14 would contain fourteen (14) single-family residential homes. These lots are shown in green on the image below. ■ Lot A would contain the remainder of the common area that will be managed by a homeowner's association. This lot includes open space, stormwater detention, garage structures, and a private drive named Rosalynn Carter Place. This lot is shown in blue on the image below. Lots 1 through 10 would not have frontage on a public or private street but would be accessible from Wood Street via a private drive titled Rosalynn Carter Place. UDC Chapter 16-11-6 defines a Minor Subdivision as "Any subdivision or consolidation of property in which no new streets, public or private, are proposed and which does not require the construction of any public improvements, and which creates three (3) or more lots." Lots 1 through 10 will not have frontage on a public or private street but rather have frontage on a private drive. Therefore, the applicant is requesting a waiver of the requirement for frontage on a public or private street for Lots 1 through 10. Pursuant to UDC Chapter 11-14, the Zoning Advisory Commission and City Council are the reviewing authorities for Minor Subdivisions and for subdivisions which require a waiver of bulk regulations. The Zoning Advisory Commission shall review the plat to determine whether it is in substantial conformance with the Unified Development Code. RECOMMENDATION Planning staff requests that the Zoning Advisory Commission review the Final Plat of Rosalynn Carter Place and recommends approval of the subdivision plat subject to waiving the requirement for frontage on a public or private street for Lot 1, Lot 2, Lot 3, Lot 4, Lot 5, Lot 6, Lot 7, Lot 8, Lot 9 and Lot 10. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, is waived regarding required lot frontage on a private or public street for Lot 1, Lot 2, Lot 3, Lot 4, Lot 5, Lot 6, Lot 7, Lot 8, Lot 9 and Lot 10 of the Final Plat of Rosalynn Carter Place. Section 2. That the Final Plat of Rosalynn Carter Place, in the City of Dubuque, Iowa is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat.
