SUBJECT: Acceptance of Public Improvements in South Pointe #2 Subdivision

City Engineer Gus Psihoyos is recommending City Council adopt the attached
resolution accepting the public improvements completed by the owners, Dubuque South
Pointe, LLC, in South Pointe #2 Subdivision.
On October 20, 2025, the owners, requested City's acceptance of the public
improvements in South Pointe Subdivision. Upon inspection by the City, it has been
determined that the public improvements required by Resolution 163-24 have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.
A maintenance guarantee covering said public improvements shall be provided by the
owners, Dubuque South Pointe, LLC, for a period of two (2) years from the date of
acceptance by City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in South Pointe #2 Subdivision
INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
that the developers, Dubuque South Pointe, LLC, have recently completed in South
Pointe #2 Subdivision.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 163-24, the
developer of South Pointe #2 Subdivision was required to install certain public
improvements including street paving with curb, curb underdrain, storm sewer and catch
basins, sanitary sewer main, water main, fiber optic conduit, accessible sidewalk ramps,
and street lighting and to dedicate these improvements to the City upon completion.
The Farm Subdivision Phase 1 public improvements are as shown on the attached
exhibit.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On October 20, 2025 the owners requested City's acceptance of the public
improvements in South Pointe Subdivision. Upon inspection by the City, it has been
determined that the public improvements required by Resolution 163-24 have been
completed in accordance with plans approved by the City Council and in conformance
with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public improvements in
the subdivision. A maintenance guarantee covering said public improvements shall be

provided by the owners, Dubuque South Pointe, LLC, for a period of two (2) years from
the date of acceptance by City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements in South Pointe #2 Subdivision.

RESOLUTION NO. 351-25
ACCEPTING PUBLIC IMPROVEMENTS IN SOUTH POINTE #2 IN THE CITY OF
DUBUQUE, IOWA
Whereas, pursuant to Resolution 163-24, certain public improvements including
street paving with curb, curb underdrain, storm sewer and catch basins, sanitary sewer
main, water main, fiber optic conduit, accessible sidewalk ramps, and street lighting were
installed by the developer of South Pointe #2 Subdivision in the City of Dubuque, Iowa;
and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public improvements in South Pointe #2 Subdivision be and the same is hereby
accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, Dubuque South Pointe, LLC, for a period of two (2) years
from the date of this resolution.
