The purpose of this memorandum is to recommend that the City Council accept the
Eagle Valley, Westbrook, and English Ridge Subdivision Parks Development Project
and approve the attached resolution.
BACKGROUND
The project involved the furnishing of labor and new materials for the construction of
Eagle Valley, Westbrook, & English Ridge Parks and includes approximately; 949 CY of
excavation; 366 Tons of granular subbase; 46 LF of curb and gutter; 11 SY of 4" HMA
pavement; 662 SY of 4" PCC Sidewalk, 0.53 AC of conventional seeding, type 4; trees
and plants; landscaping; 1,385 LF of filter socks; 680 CY of topsoil; three (3) park signs;
394 LF of split rail fence; 4,105 SF of pour -in -place safety surfacing; new park
equipment; and 0.53 AC of hydraulic seeding.
DISCUSSION
The Eagle Valley, Westbrook, and English Ridge Subdivision Parks Development
Project was completed by McDermott Excavating, of Dubuque, Iowa in the final contract
amount of $735,897. The original contract amount was $719,550. The increase in cost
of $16,347 was due to change orders related to nuclear density testing, rodent guards
and concrete aprons on outlets of drain tiles, thickened edge sidewalk, additional
sidewalk installation, additional embankment material, and additional drainage swale
construction.

RECOMMENDATION
I recommend that the City Council accept the Eagle Valley, Westbrook, and English
Ridge Subdivision Parks Development Project and authorize the payment of the
contract amount of $735,897 to McDermott Excavating based on the facts above.

RESOLUTION NO. 362-25
ACCEPTING THE EAGLE VALLEY, WESTBROOK, AND ENGLISH RIDGE
SUBDIVISION PARKS DEVELOPMENT PROJECT AND AUTHORIZING THE
PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR
WHEREAS, the Public Improvement Contract for the Eagle Valley, Westbrook, and
English Ridge Subdivision Parks Development Project (the Project) has been completed
by the contractor, McDermott Excavating. (Contractor) and WHKS has examined the work
and filed a certificate stating that the Project has been completed according to the terms
of the Public Improvement Contract and that WHKS recommends that the Project be
accepted; and
WHEREAS, the final contract amount for the Project is $735,897.00; and
WHEREAS, the contractor has previously been paid $699,102.15, leaving a
balance of $36,794.85; and
WHEREAS, the City Council finds that the recommendation of WHKS should be
accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The recommendation of WHKS is approved, and the Project is hereby
accepted.
Section 2. The Chief Financial Officer is hereby directed to pay the balance of the
retainage of $36,794.85 as provided in Iowa Code chapter 573, and to pay such retainage
in accordance with the provisions of Iowa Code chapter 573 or Iowa chapter 26.13.
Passed, approved, and adopted this 3rd day of November 2025.

Letter Recommending Project Acceptance
Dear Mr. Fehsal:

McDermott Excavating has completed construction of the Eagle Valley, Westbrook, and English
Ridge Parks project at a total cost of $735,897.00. The project included eight (8) change orders
that added an additional $16,347.00 to the original bid amount of $719,550.00. The improvements
were constructed in substantial compliance with the contract documents and authorized extra
work.
WHKS recommends that the City of Dubuque accept the construction project as complete. Once
the City accepts the project as complete, final payment can be made to McDermott Excavating,
after waiting a minimum of thirty days. The two-year maintenance bond and equipment warranties
on this project will start with the City's acceptance of the project.
