who constructed the 8th street sewer in 1884 was presented

Ald Crawford moved that the prayer of the petitioner be granted and that the city attorney be instructed to
draw up an ordinance similar to the one governing the telephone company granting them the permit and that
Mr Dickey be allowed to commence the construction of the line immediately carried
The bill of the key city gas co claiming 75.00 for the erection on three new lamp posts was read and an
objection was raised on account of the lamp not being removed from in front of omnibus barn
Ald Crawford moved the bill be paid and the lamp in front of bus barn allowed to remain providing the omnibus
company pay for the gas
ald Page amended Ald Crawfords motion by moving that they be allowed 50 for the erection of two lamps
and the cost of erecting the third lamp be referred to the police committee and mayor caried

J W Norton Street Commissioner reported having expended 1884.40 in repairing streets during August Also that
he collected 50.00 for filling the Crotty Lot and 2.75 for the sale of gravel and returned the amounts to city
treasurer Ordered paid and filed
Andrew Reilly auditor report the salaries of city Officers amounted to 954.75 and of members of the Fire
Department to 903.30 for the month of August ordered paid and filed
Edward Moore city marshal reported the salaries of members of the police force amounted to 1085.10 for
August and so that they made fifty four arrests and that he paid into the city treasury 1.50 fees collected and
4.90 received for impounding Ordered paid and filed
Saml B Rice market master repoted having weighed 155 draughts on the market house scales during August
receiving therefore 23.45 and received 28.50 rent of huckster stands and 3.00 for confiscated butter and that
he returned the amount 55.35 into the city treasurer also that he furnished meals to prisoners amounting to
19.40 ordered filed and warrant drawn for board of prisoners
Paul Traut treasurer reported having paid for interest etc 238.70 during August Warrants ordered drawn
to refund the same
J W Halpin Recorder reported having issued licenses amounting to 473.50 during August ordered filed
Lamplighter laughlin reported having lighted 218 gas lamps during August ordered filed

J P Quigley Police Justice for August reported having collected 3.00 for fines and paid the same to the
city treasurer filed
Owen Reynolds woodmeasurer reported having measured 687 cords of wood during August Ordered filed
ald Kane called the attention of the council to the inability of the wood imspector to collect fees for wood
measured for private parties on account of a defect in the ordinance governing the same and moved that the
ordinance be referred to the ordinance committee for revision
Ald Crawford amended Ald Kane's motion by moving it be referred to the city attorney to report its defects
carried
The several city weighers reported the following number of draughts weighed by them during August 1st
ward scales 271 West Dubuque Scales 72 5th Ward Scales 100 ordered filed
reports of committee
Ald Ryder of the special committee to whom was referred the mater of purchasing a patrol wagon reported
in favor of laying it over until May 1886 adopted
Ald Ryder Chairman of the Finance Committee read a communication from the city treasurer asking that the
finance committee be authorized to borrow 4000.00 to defray expenses for the month of August and offered
the following resolution
Resolved that the city council of the city of Dubuque instruct the finance committee to borrow the sum of four
thousand 4,000 dollars to defray expenses for the month of August 1885 at the lowest rate of interest
that the money can be had adopted
Ald Crawford from the committee on ordinances presented the following report on teh petition of A L Pizer
et al
To the city council of the city of Dubuque
At the last regular session of the council a petition signed by et L Pizer and several hundred other citizens
asking the city council to compel the enforcement of the state and municipal sabbath laws was referred to
your committee on ordinances As instructions accompanied the reference your committee is not clear as
to the object in referring the matter to the ordinance committee the city council has already several years ago
adopted a very stringent ordinance providing for the observance of the sabbath It not only enacted the state
law on the subject but added several additional provisions making it more comprehensive Nothing could possibly
be added to it which would make it

stronger We also find the ordinances of the city providing for the enforcement of all municipal laws and for
punishing city officers who may neglect or refuse to perform their duties are sufficiently full and ample
Under the ordinance relative to the refusal or neglect of any city officer to perform him duty any resident of
Dubuque may prefer charges against such city officer in which case it is made the duty of the council to try
the officer charged Section 3 provides that the complaint shall be in writing signed and sworn to by some
resident of the city of Dubuque and directed to the city council that such complaint shall briefly set forth the name
of the person charged the title of the office byhim held and the facts which constitute the grounds of the
charge
The ordinance further provides for the removal expulsion or other punishment on connection of the officer
charged In the opinion of your committee no addition or amendment could be made to the ordinance on the
subject which would give it greater force or effect
Unless then some resident of the city of Dubuque shall present written charges under oath against the Mayor
Marshal or other city officer of neglect or refusal to perform his duty the city council has done everything in
its power under the city charter to secure the object of the petitioners viz the observance of the sabbath. It has
passed a stringent ordinance providing for such observance and also provided for the punishment on conviction
of any officer who may be guilty of neglect or refusal to do his duty under th eordinance whenever any citizen
under oath shall prefer the charges
It is the opinion of your committee that while the petition referred to us is signed by many intelligent and
worthy citizens they greatly mistake the powers and duties of the city council. The council is purely a
legislative body It may pass ordinances but has nothing to do with the enforcement of them except to
try and punish officers neglecting or refusing to do their duty and then only when charges are properly
presented Congress and the legislature may pass laws but no one not an idiot would think of densuring
the members of those bodies because some of the laws they enacted were not enforced
It is further the opinion of your committee that the signers of the petition may also be mistaken as to their
own powers and duties as citizens if they or any considerable number of them really desire the enforcement
of the laws and ordinances for the observance of the sabbath and know of any violations of them the
mater is in their own hands

All they have to do is to go before a justice of the peace and file their complaint The justice will cheerfully issue
the warrants and the officers will be greatly pleased to serve the papers.
the only way to enforce any law or ordinance is to punish those offending against it. The constitution of Iowa
provides that no man shall be punished for crime except by due process of law Somebody who knows the law
has been violated must first make a complaint under oath against the violation It is not the duty of an officer
to do this more than any other citizen It is equally the duty of any citizen who has personal knowledge of the
violation of the ordinance to make teh complaint If he fails to do so any charge against others of neglect
of duty comes with a poor grace from him
After a careful consideration of teh subject your committee respectfully reports that no new ordinance or
amendments to existing ordinances are necessary or would tend to promote the object of the petitioners.
As all the various city officers are required by the present ordinances to perform their duties faithfully and are
likewise sworn to do so it would seem that any additional special instructions to that effect are uncalled
and superfluous As no present actions of the council relative to the matter referred to in the petition is required
we recommend that it be received and filed

The same presented and read an ordinance repealing Section 13 of Chapter XXIII of the revised ordinances
and enacting a substitute therefore And moved that the rules be suspended and the ordinance read for the
second time and placed upon its passage

Ald Crawford moved the ordinance preventing cattle from running at large be acted upon Carried
The same presented the following amendment thereto
Provided that the provisions of this ordinance shall not apply to the fifth Ward nor to the following described
portions of the first third and fourth wards to wit all of the first ward situated south of Dodge Street and West
of Brad Street all of the third ward situated East of the track of the Chicago Milwaukee and St Paul Railway
and all of that portion of the Fourth South of Julien Avenue with is situation west of Brad Street and all of
the portion of said Fourth Ward north of Julien Avenue which is situated West of Alta Vista Street
amendment was lost
Ald Crawford moved the ordinance be read for 2nd time carried
The recorder read the ordinance for the 2nd time
Ald Downer moved the ordinance be adopted

The ordinance granting to the city recorder privileges to appoint a deputy which was laid over at a former
meeting was read by the recorder
Ald Ryder asked the opinion of the city attorney in relation to the filling of the duties of the recorders office
by a deputy
The city attorney asked for time to examine the matter as to contracts made and business transacted by
the deputy recorder during the absence of the recorder granted
Ald Page moved the matter be referred to the city attorney to report on Monday Sept 7th at 2:30 p.m.
ald Crawford amended Ald Page's motion by moving that the city attorney draft an ordinance empowering
the city council to appoint a recorder pro tem who shall discharge the duties of the office of recorder and
receive the full salary fixed for doing the same carried

the same reported on having granted the petitions Frank Beyer and the German Catholic Building Association

The same also reported in favor of paying the bills of Isaac Bunn 30.98 Henry Reed 2.32 and in favor of
allowing Chas Steuck 200.00 on account of work done on Windsor Ave adopted
ald Hollnagel of the committee on public grounds and buildings to whom was referred the petition of the
Dubuque Lawn Tennis Club read the following report on the same
Your committee to whom was referred the petition of the Lawn Tennis Club has found several reasons why
it could not report favorably on said petition
1st by allowing the Tennis Club the use of parks be allowing all other clubs such as baseball and etc the same
privilege
2nd it will attract a large crown of people which will be an annoyance to the neighborhood
3rd our parks are small and not prepared for playing as parks in Chicago New York and other large cities
Therefore your committee respectfully recommend that the prayer of the petitioners be not granted

The same called the attention of the city council to complaints made by James hayes and Chas Leute against
the levying of the special assessment for the improvement of the alley abutting their property

City attorney linehan reported in favor of receiving and filing the petition of J S Garrigan et al and on the
bill of Chesley Taylor that the claim was fully satisfied adopted

City attorney linehan reporrted the paying of the bill of Dr Waples was wholly in the discretion of the council
adopted
Ald Crawford moved the bill be received and filed carried
Ald Thos Byrne offered the following resolution
Resolved that the ten thousand dollars personalty taxed against city lot 175 and assessed to Junkerman
and Haas be canceled for the year 1884 as the above named firm was dissolved and not possessor of the
same during any part of the past fiscal year
ald Crawford moved that the resolution be laid on the table carried
Ald Crawford offered the following resolution and moved it be referred to the committee on streets
Whereas It has been decided by the circuit court of Dubuque County that the special tax levied by the city
council upon the abutting property to defray the expense of the curbing guttering and macadamizing of
Main Street between 1st and 8th streets cannot be collected which decision has been appealed from to the
Supreme Court
Therefore resolved that the city council will undertake no new or furthe rwork of curbing guttering or macadamizing
in front of any private property until the final decision of said suit and that all such improvements be postponed
until the question as to the power of the city of Dubuque to make the same at the expense of the abutting
property shall be fully settled
The resolution and motion was lost
Ald thos Byrne moved that two more blocks on Locust St be repaired
Ald Olinger amended Ald Byrnes' motion by moving that Clay Street be improved from 4th to 7th streets
ald Deckert offered as a substitute that the matter of street improvement be referred to street committee
to report at next meeting carried
Ald Hollnagel offered the following resolution
Resolved by this council that Millville Street be improved from Vanderscheiders house westward to the city
limits and that 50.00 be appropriated for that purpose and the street commissioner be instructed to do the
work at once

ald Hollnagel offered the following resolution
Reolved by the city council of the city of Dubuque that a sidewalk four feet wide of good two inch plank be
within fifteen days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks
on the north side of Sanford St between Couler and Windsor Ave where it is not already laid adopted
Ald Ryder offered the following resolution
Be it resolved that the city council of the city of Dubuque instructe the city recorder to draw loan warrants in
favor of Dubuque Building and Loan Association for 3000 three thousand dollars dated Aug 4th 1885 payable
feby 1st 1886 with interest at rate of 7% per annum
also one in favor of Julia C Clark for two thousand 2000.00 dollars dated Aug 6th 1885 payable Feby 1st
1886 with interest at the rate of 8% per annum adopted
Ald Hollnagel offered the following resolution
Whereas a large proportion of our citizens and tax payers of German descent necessarily derive their information
regarding municipal and other public matters from and look for it in their local newspapers printed in the
German language
and whereas ever since the city of Dubuqeu has had a corporate existence the publication of notices and
advertisements of the city in some local paper printed in German has in the public interest and as a matter
of justice and fairness towards a large proportion of our population been considered a necessity which
necessity instead of decreasing increases with the growth of the city
Therefore be it resolved that the publishers of newspapers in this city printed in German be requested to
hand in propositions for doing the city printing during the ensuing year to the committee on printing on or
before Sept 15th 1885 at 4 oclock said propositions to be accompanied by sworn statements regarding
the bona fida suscribers of such papers residing within the limits of the city of Dubuque
Resolved further that such of said papers which considering its city circulation makes the lowest bid shall
be and is hereby declared the official paper of the city provided however that no bid in excess of former
compensation for similar work shall be considered

Resolved by the city council of the city of Dubuque that White Street between 19th Street and North line
of N M 1/5 of City Lot 488 be graded guttered and macadamized in conformit with the ordinance upon that
subject that the city engineer be and he is hereby directed to make the necessary plans and specifications
for said improvement and the city recorder directed to make the necessary plans and specifications for said
improvement and the city recorder directed to give the proper notice for bids and proposals for the performance
of the work the guttering curbing and macadamizing to be done at the expense of the owners of the abutting
property
The ayes and nays being called on the adoption of the proceeding resolution it carried unanimously
The report on the petition of James H Shields was laid over until the next meeting

Resolved that the city Marshal be instructed to have the sidewalk on the east side of Iowa Street between
12th and 13th streets put to a uniform grade

the city engineer stated the curbstone had fallen away from the proper grade

Be it resolved by the city council of Dubuque that 14th street sewer from the east side of jackson Street
753 feet east to the railroad right of way be arched and that the city engineer is hereby instructed to prepare
plans and specifications for said work and the city recorder to advertise for teh construction of said sewer

the mayor read the following report of the committee of the whole in relation to awarding contract for the
lighting of the gasoline street lamps
Resolved that the bid of Jms Pickley for furnishing all necessary material and lighting clenaing and keeping
in repair the gasoline street lamps of the city be accepted and the contract awarded to him provided that it
be understood and made a part of the contract that said contractor is to replace without cost to the city all lamp
posts which may rot down or fail from natural causes and shall also furnish at his own expense the necessary
burners and that the city council shall reserve the right to terminate the contract at any time
Ald Olinger moved that before the contract be awarded the rules be suspended and Mr Burden permitted
to address the council

City Attorney Linehan reported in favor of paying the bills of J P Quigley et al for fees in the cases of the
city of Dubuque vs Wm Hardy and the same vs Jms Evans adopted
The same also reported in favor of referring the bill of Jms Thurnher back to the city council

bid was found to be the lowest and best bid and he was awarded the contract
Health officer Waples called the attention of the council to a nuisance on the premises occupied by the Union
Slaughter house

The mayor stated the ofject of the meeting was to transact unfinished business of last meeting and to hear
the report of the city attorney on some tax petitions
D L Linehan city attorney reported having examined the notices of Wm Hintrager to the city of Dubuque to
redeem from ta sale lot 12 in Milligans Subd and Lot 68 in Union Add and that he found both lots were now
parts of streets said streets having been laid out since the lots were sold at tax sale
ald Kane moved the matter referred to the mayor and city auditor with power to redeem carried
the city attorney reported on the petition of J N Hill that the property be redeemed if the city find the sale was
irregular and to cancel the sale if found to be illegal
ald Crawford moved that the mayor be authorized to have the property redeemed by the auditor providing
the city attorney find the sale was legal if illegal that the sale be canceled carried
Petition of the Knapp Stout and Co company for the improvement of 3rd st by the city from the C M and St P
Railway track easterly to the river wsa refered to the street committee to report next meeting
The mayor called the attention of council to the worn out condition of 7th st bridge and stated a new bridge
was needed also that he thought it would be advisable to have a commtitee appointed to consult with the
board of supervisors and try and secure the aid of the county in constructing the proposed bridge
Ald Page called for the city engineers opinion regarding teh conditin of the 7th st bridge
the city engineer stated he had examined said bridge and found it in need of repairs which if it received
would probably do until spring he also stated that the bridge was not

Ald Downer moved that the ordinance committee present an ordinance providing for the laying of brick or stone
sidewalks exclusively on certain streets in the city carried
Ald Page called the attention of the council to the proposed plans of driving clusters of piling in the Ice Harbor
by the Government Engineers and moved that a committee of five be appointed to wait on Eng Bueck and
protest against the proposed plan carried
The mayor appointed Ald Crawford Downer Page Tom Byrne and Hollnagel as such committee
Ald tom Byrne offered the following resolution
Be it resolved by the city council of the city of Dubuque that the street commissioner be instructed to repair
the part of the wall on St mary's street that is falling or about to fall as soon as practicable

ald Crawford offered the following resolution
Whereas in the judgment of the city council the driving of clusters of piles in the Ice Harbor of this city is
inexpedient and would be injurious to the convenient use of the harbor for general purposes in the season
of navigation and incosistent with the plans of the city government for the construction of levees on the north
south and west sides of the same Therefore resolved that the city council respectfully but earnestly protests
against the proposed driving of piling in said ice harbor and requests major McKenzie the US Government
Engineer officer having supervision of the work to change his designs in that respect so as to conform to
the plan of the city government for the construction of levees
That a committee of five be appointed from this council to conver with Major McKenzie on the subject and
to present him with a copy of this resolution adopted
