The bill of the sister superior of Mercy Hospital for the board of Mr Regan the man wounded by a policeman
10.30 was on motion of Ald Ryder referred to the mayor and ald Crawford to wait upon the board of supervisors
and have the bill paid by the county
Ald page moved that the committee on public grounds and buildings wait upon Mr. Scott who occupies and
claims a small piece of ground belonging to the city situated on second st abutting the C M and St P Railway
track and have him relinquish his claim to the same without further legal proceedings adopted
Petitions
Petition of Ed Goldthorpe asking that he be allowed to pay the taxes of 1884 on aand 1/2 city lot 71a and that he
be allowed the discount of 3% also on the N 6 ft 9 in city lot 72 at the same proposal
Ald J M Byrne moved that the rules be suspended and Mr R W Stewart permitted to address the council in
behalf of Mr Golathorpe carried
Mr Stewart stated he called to pay the tax on the propoerty set forth in the petition of Mr Goldthorpe and the
treasurer being busy placed the description of the lots on a spindle and stated he would make out the receipts
when time permitted He stated further that he again called and was told the tax was paid
The treasurer being called stated that Mr Goldthorpe called and paid the taxes on all property owned by
him and did not claim to own the property described in petition
ald hollnagel moved that the petition be referred to the Delinquent Tax Committee and the property held
from sale until the petition is reported on carried

M Tschirgi Jr presented a communication verifying the affidavit of Mr Stevenson presented by James H
Shields it was placed with the affidavit
Petition of P McCullough et al for the abatement of a nuisance caused by a catch basin crner of 14th and Bluff
Sts referred to the committee on streets
The city engineer presented a plat of the proposed waterway from th eeast end of Division St to Couler Creek
and estimated the cost of the construction of the same to be 125.00 referred to the committee of the whole
The same to whom was referred the petition of Wilhelm Kulow et al presented a plat and estimated cost of the
opening of a proposed alley east of Elm St and between sanford and 23rd sts the same being 630.00
Ald Hollnagel moved that the report be referred to the committee of the whole and action deferred on the same
until next spring carried
the city engineer also presented the estimate cost of the construction of 4th st sewer on a cheaper basis than
the one first proposed by him to be 256.00
Ald Downer moved that the city engineer prepare the necessary plans and specifications and the city recorder
advertise for bids for the construction of said 4th street sewer carried
Reports of officers
The street commissioner reported having expended 1737.95 for the repair of streets during September.
Ordered paid and filed.
the city marshal reported the salaries of the police for September amounted to 1102.30 that he has paid into
the treasurer 4.50 fees and 6.50 for impounding collected by him during the past month Ordered paid and
filed
The city auditor reported the salaries of City Officers amounted to 923.25 and of Fire Department to
903.30 for September ordered paid
The treasurer reported having paid during September for interest refunded tax and supplies for the fire
department 536.56 Warrnats were ordered drawn to refund the same

for confiscated butter He also reported having furnished meals to prisoners amounting to 17.00 ordered
filed and paid
The recorder pro tem reported having issued licenses amounting to 423.00 during September Ordered
filed
Police Justice Hoffman reported having paid to the treasurer 13.25 fines collected during September Ordered
filed
Wood measurer Reynolds reported having measured 632 cords of wood during September ordered filed
Wm Caughlin lamplighter reported having lighted 219 gas lamps during September ordered filed
the weighmasters made the following reports for September First Ward 219 draughts Fifth Ward 98 draughts

Reports of committees
Ald Ryder of the Finance Committee read a communication from the city treasurer asking that the finance
committee be instructed to borrow 4000.00 to defray the expenses of the past month and offered the following
resolution
Be it resolved that the city council of the city of Dubuque instruct the Finance Committee to borrow the sum
of four thousand dollars4000.00 to defray the expenses for the month of September 1885 adopted
The same also offered the following resolution
Resolved that the city council of the city of Dubuque instruct the city recorder to draw loan warrants in
favor of the following parties three 3 warrants one thousand 1000.00 dollars each favor of L Reinecke
dated Sept 7th 1885 payable Feby 1st 1886 with interest at rate of 7% per annum
One 1 warrant favor of D J Crotty for five hundred 500.00 dollars dated Sept 10th 1885 payable Feby 1st
1886 with interest at the rate of 8% per annum
One 1 warrant in favor of Ed Redden for five hundred 500.00 dollars dated Sept 10th 1885 and payable

Ald Hollnagel of the printing committee reported in favor of receiving and filing the bill of Dubuque Printing Co
Ald Kane amended the report of Ald Hollnagel by moving that action on the bill be postponed and that the
printing committee investigate and see if bills of similar character have not been allowed other papers
carried
Ald Page of the police committee reported in favor of granting the petition of Ferdinand Kuhn et al for
a street lamp corner of Schiller and division Streets also in favor of receiving and filing the petition of
J Dillon adopted
Ald T Byrne of the delinquent tax committee reported in favor of granting the petitions of the following persons
for the cancellation of the tax of 1884 August Prange Est Mary Stanger Mary Canovan Jane Young Sophia
Robison and Mrs smith Adopted

1885 for the improvement of Cornell St also to reduce the width of the sidewalk on part of high street to eight ft

The health offices called the attention of the council to a nuisance existing on the premises of the Union
Slaughter House and asked that the same be abated

to be a nuisance to have it abated immediately carried
The city attorney reported havign examned the bond of James Agnew city recorder pro tem and found the
same to be secure and reported in favor of approving said bond adopted
The same reported having examined the resolution levying a special assessment for the laying of a sidewalk
in front the property described in the same recorded on page 414 of this book and found the resolution to
be regular and legally made

street improvemens
Ald Deckert of the street committee offered the following
Resolved by the city council of the city of Dubuque that a sidewalk four 4 feet wide of good two inch plank be
within 15 days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks
on the west side of high street between Kniest Street and lake Street
The ayes and nays being called on the adoption of this resolution it passed by the following vote

imrovement and the city recorder directed to give the proper notice for bids and proposals for the performance
of the work the grading and macadamizing to be done at the expense of the owners of the abutting property

from day until day until the final decision of the case now pending before the supreme court is rendered

Petition of the Linwood Cemetary Association for the grading of Windsor Ave abutting their property

The city engineer presented a profile of the change of grade on cornell st as agreed upon by the abutting
property owners which on motion of Ald Thos Byrne was adopted
Ald Hollnagel presented the following resolution and move its adoption
Be it resolved by the city council of the city of Dubuque that the marshal be and is hereby instructed to notify
the Dubuque and Northwestern Railroad Company to remove all obstruction from the Couler Creek
Or in other words to pull out or cut off all piles already driven into said creek

The bids were opened and referred to the city engineer
the bill of Geo W burden for lighting and care of gasoline street lamps for month of September amounting
to 415.92 was ordered paid
Ald Crawford presented the following reolution
Resolved that the city attorney be instructed to draft and report to the council an amendment to SEc 14 of Chaper
26 of the revised Ordinances which shall provide for the sale of real estate for the nonpayment of special
taxes within sixty days after they shall become delinquent adopted
Ald Crawford moved that the city attorney draft an amendment to the same ordinance providing that the
notice by the holder of a tax sale certificate for a tax deed shall be served by the ciy marshal or some other
officer empowered to serve legal processes carried
Ald ryder offered the following resolution
Be it resolved by the city council of the city of Dubuque that on and after the 1st day of October 1885 the
salary of the captain of night police be fixed at 75 per month

The City Attorney made the following report in regard to the defects of the ordinance in relation to the
measurement of wood
At the last session of the council I was instructed to examine and report the defects in the ordinance in
relation to the

measurement of wood On the face of the ordinance there appear to be no defects which can prevent the
enforcement of any of its provisions
this ordinance was enacted for the protection of purchasers of wood within the city and applies only to wood
bought within the city limits and there offered for sale If purchased outside of the city limits an delivered within
the city after sale there is nothing in the ordinance requiring the purchaser to have the wood inspected as
otherwise provided by the ordinance th eordinance also exempts all wood sold or offered for slae outside of
certain limits prescrived by Section 8 of the ordinance if offered for sale while loaded on any vehicle The woodmeasurer
suggests the repeal of seciton 8 and the amendment of the ordinance so as to authorize the measurement
by him of all wood brought within the city wherever purchased or offered for sale Whether these changes are
desireable the council must first determine When an ordinance embracing these amendments will be necessary

The city attorney presented the following report in regard to the petition of Magt Rawlins
We respectfully report that mrs Rawlins has been assessed for 1.61 acres of minl lot 170 which includes the
part covered by Delhi Road as shown the street has been traveled as shown for more than ten years There
appears to be no legal claim by reason of the part of her land taken by the street it is a matter in the discretion
of the council as to whether any reduction in her assessment should be made

Ald Crawford moved that the report be received and the question of her tax claim of this and preceeding
years be referred to the delinquent tax committee carried
the city attorney presented an ordinance granting to A A Cooper and Bart E Linehan their successors
associates and assigns the right to construct and operate a line of sewers in the alleys between Main and Locust
Streets from First to Eight Street in teh city of Dubuque and regulating the same

The city attorney called the attention of the council to the petition of the heirs of Joseph Koetzel and asked
to have their action reconsidered
ald Crawford moved that the councils action on the petition be reconsidered and the petition recommitted
to the delinquent tax committee carried
the city engineer reported the bids for the improvement of Cornell St as follows J A Spear 1273.10 Chas
Steuck 1153.60 James Lee 1024.06 Wm Rebman 1009.98 For the construction of 4th St Sewer etc Chas
Steuck 270.00 J A Speaer 250.00
On motion Wm Rebman was awarded the contract for the improvement of Cornell St and J A Spear the contract
for the construction of 4th St Sewer etc

Council met at 4:15 pm
The chairman stated the meeting was called to take action in regard to the resolution ordering the D & N W
Railway to remove all piling driven into Couler Creek said resolutio being adopted Oct 12 1885
Ald Deckert moved that the city marshal be notified to take no further action to remove the piling driven
by the D&NW Ry Co into couler creek until ordered to do so by this council
On motion the rules were suspended and Mr Fouke allowed to address the council in behalf of the D&NW Ry
ald Deckert moved the adoption of his motion carried
Ald Hollnagel moved to adjourn carried
