The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request.
The application, staff report, and related materials are attached for your review.
Discussion
James Steiner, University of Dubuque (UD) Vice President of Finance & Auxiliary
Services, spoke on behalf of the application. He stated that they are seeking to construct
a campus innovation center and add the property at 2104 Bennett Street to their district.
He noted the new building would be constructed where Smith Hall is now, and it would
have 75,000 square feet of interior area. He said the construction would start in 2026 and
finish in 2027. He stated the center will provide interdisciplinary, collaborative, hands-on
and team -oriented learning opportunities. He stated UD will work to comply with all
required regulations.
Catherine Behnke, 1380 O'Hagen Street, stated that she has experienced increased
water runoff at her property and in the surrounding area particularly since Hardees and
McGovern Hardware were demolished and turned into gravel lots. She expressed
concern for this flooding but did not know who to direct her inquiry to.
Mr. Steiner stated the new building will comply with stormwater management
requirements. He noted that the gravel lots along University have not been developed
because they are waiting on the City's roundabout study.
Staff detailed the staff report explaining that new building is to be built at the corner of
McCormick and Grace Streets where Smith Hall sits currently. Staff noted that the
Security Department is relocating from Smith Hall to 2104 Bennett Street, so UD is
seeking to incorporate that property into their Institutional District. Staff stated that the
Bennett Street property will return to a residential use once the new building is completed.
Staff stated that there are two reasons to amend an Institutional District, which include
when there is a substantial construction project or when the borders of the district are

being modified, and this request includes both. Staff explained stated that staff will look
into the runoff issue that Ms. Behnke brought up and put her in touch with the Engineering
Department. Staff noted that this project will be required to go through site plan review
with the Development Review Team.
The Commissioners had no questions or concerns.
Recommendation
By a vote of 6-0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Amendment to the University of Dubuque Institutional District to allow the
construction of a new academic and administrative building.
INTRODUCTION
The University of Dubuque (UD) is requesting to amend their Institutional District to allow
for the demolition of Smith Hall located at 1010 McCormick Street (northeast corner of
McCormick and formerly Grace Streets) and in its place construct of a new four-story
academic and administrative building. They are also requesting to expand the UD PUD
boundary to include the property at 2104 Bennett Street which they intend to utilize as a
temporary security office.
DISCUSSION
The Institutional District within the City of Dubuque is primarily applied to colleges,
seminaries, and hospitals uses. The Institutional District is a type of Planned Unit
Development that, because of the unique nature of these campuses, establishes specific
regulations guiding the continued growth and development of the institutions. The Unified
Development Code (UDC) establishes two reasons to amend an Institutional District
which includes the geographical expansion of the district and a significant on -campus
project is proposed. The proposed multi -story building to replace Smith Hall is a significant
on -campus project and expansion of the district is also proposed.
The proposed building will replace the existing Smith Hall and will include administrative
offices and academic rooms, including new lab space which will help meet the needs of
university programming. The current security offices within Smith Hall will temporarily be
located at 2104 Bennett Street and UD plans to extend the boundaries of the district to
permit its use.
Planning staff has reviewed the proposed projects with other City departments and have
received no concerns with serving the proposed buildings with water, sanitary sewer, or
fire protection. The new building along McCormick would require site plan review prior to
the issuance of building permits. Any alterations to 2104 Bennett would require a building
permit.

Planning staff recommends the Zoning Advisory Commission review the information
provided and make a recommendation to the City Council on the requested Institutional
District amendment.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY PROVIDING FOR THE APPROVAL OF
AN AMENDED CAMPUS DEVELOPMENT PLAN FOR THE UNIVERSITY OF DUBUQUE ID
INSTITUTIONAL DISTRICT TO ALLOW CONSTRUCTION OF AN ACADEMIC AND
ADMINISTRATIVE BUILDING.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development
Code, be amended by providing for the approval of an amended campus development plan for
the University of Dubuque ID Institutional District to allow construction of an academic and
administrative building, a copy of which is on file with the City of Dubuque Planning Services
Department.
Section 2. Institutional District Regulations.
A. Use Regulations.
The following regulations shall apply to all uses made of land in the above -described
ID Institutional District:
1 . Principal permitted uses shall be limited to:
a. Offices for administrative personnel or other institutional employees and
affiliates.
b. Churches, libraries, and museums.
c. Classrooms, laboratories, lecture halls, and similar places of institutional
assembly.

d. Off-street parking and loading.
e. Recreational or athletic facilities for the primary use and benefit of
institutional residents or affiliates.
f. Single-family, two-family, or multi -family dwellings for the housing of
institutional residents or affiliates.
2. Accessory Uses. The following uses shall be permitted as accessory uses in the
above -described ID Institutional District.
a. Located entirely within a principal building, bookstores, or bars seating no
more than seventy-five (75) persons at one time and located not closer than
two hundred feet (200') from the nearest Residential or Office Residential
District.
b. All uses customarily incidental to the principal permitted uses in conjunction
with which such accessory uses operated or maintained, but not to include
commercial use outside the principal building.
B. Lot and Bulk Regulations.
Development of land in the ID Institutional District shall be regulated as follows:
1. The proposed administrative and academic building shall be constructed in
substantial conformance with the attached amended campus development plan, a
copy of which is on file with the City of Dubuque.
C. Performance Standards.
The development and maintenance of uses in this ID Institutional District shall be
established in conformance with Section 5-22 of the Unified Development Code and
the following standards:
1. The stormwater control shall be designed and built in accordance with City
Regulations subject to review and approval by the City of Dubuque Engineering
Department.
2. That appropriate erosion and sediment control will be installed prior to
commencement of any land disturbing activity related to the subject project,
including all required state and city permits related to erosion control.
3. New outdoor lighting shall utilize 72-degree cut-off luminaries.
4. Landscaping shall be provided in compliance with Article 13 of the Unified
Development Code.
5. All utilities, including telephone and cable television, shall be installed underground.
6. Final site plans shall be submitted in accordance with Articles 12 and 13 of the
Unified Development Code.
D. Parking Requirements
The off-street parking requirements for the principal permitted uses for the herein
described ID Institutional District shall be regulated as follows.

Any significant expansion or reduction in the number of off-street parking spaces
must be reviewed by Planning Services staff for compliance with the adopted
Institutional District regulations.
E. Sign Regulations.
The sign regulations shall be the same as that which are allowed in Institutional
District as established in Article 15 of the Unified Development Code.
F. Additional Standards.
That all previously approved campus develiopment plans are hereby amended to
allow for the attached campus development plan.
G. Transfer of Ownership
Transfer of ownership or lease of property in this PR Planned Residential District shall
include the transfer or lease agreement a provision that the purchaser or lessee
acknowledges awareness of the conditions authorizing the establishment of the
district.
H. Modifications
Any modifications of this Ordinance must be approved by the City Council in
accordance with zoning reclassification proceedings of Section 16-9-5 of the Unified
Development Code.
Section 3. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 4. The foregoing amendment shall take effect upon publication, as provided by
law.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE
OF ORDINANCES, UNIFIED DEVELOPMENT CODE, BY PROVIDING FOR THE
APPROVAL OF AN AMENDED CAMPUS DEVELOPMENT PLAN FOR THE
UNIVERSITY OF DUBUQUE ID INSTITUTIONAL DISTRICT TO ALLOW
CONSTRUCTION OF AN ACADEMIC AND ADMINISTRATIVE BUILDING
The ordinance amends Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, by providing for the
approval of an amended campus development plan for the
University of Dubuque ID Institutional District to allow
construction of an academic and administrative building, a
copy of which is on file with the City of Dubuque Planning
Services Department.
The foregoing amendment shall take effect upon publication,
as provided by law.
