INTRODUCTION
The purpose of this memo is to provide information to the City Council regarding a
request submitted by DuTrac Community Credit Union ("DuTrac") to alter the
boundaries of the Washington Street Neighborhood Conservation District. Specifically,
DuTrac is requesting the removal of the block bounded by Washington Street, East 14th
Street, Elm Street, and East 13th Street (hereafter referred to as the "Subject Block")
from the conservation district.
BACKGROUND
On behalf of DuTrac, President and CEO Andrew Hawksinson submitted a formal
request to the City Clerk seeking the removal of the Subject Block from the Washington
Street Neighborhood Conservation District. The stated purpose of this request is to
facilitate redevelopment plans that DuTrac is pursuing for the area.
What is a Conservation District?
The Unified Development Code defines a conservation district as:
CONSERVATION DISTRICT: An area designated by ordinances of the city
council which:
A. Has defined geographic boundaries;
B. Contains contiguous pieces of property under diverse ownership;
C. Encompasses areas of historically and architecturally significant buildings,
sites, structures, objects, or districts, including potential national or local
historic districts; and
D. Is important to maintain and preserve for its economic and social value and
as a neighborhood or area of affordable housing.
Note: A separate exhibit provides a map illustrating the four areas referenced in this
memo: the original Washington Street Neighborhood Conservation District established
in 1975, the 2011 expansion area, the Washington Residential National Register
Historic District and the Subject Block proposed for removal.

Establishment of the Washington Street Neighborhood Conservation District
On February 10, 1975, the City Council adopted Ordinance No. 7-75, designating seven
neighborhoods —including the Washington Street Neighborhood, comprising ten
blocks —as areas containing notable concentrations of historically and architecturally
significant buildings. The ordinance recognized that preserving and maintaining these
structures serves the public interest, while unchecked demolition could undermine
future City efforts to protect these valuable cultural and architectural assets. Therefore,
the ordinance established a temporary delay on the demolition of such significant
buildings, allowing the City Council sufficient time to explore viable alternatives to
demolition.
Expansion of Washington Street Neighborhood Conservation District
On February 22, 2011, the City Council approved the expansion of the Washington
Street Neighborhood Conservation District. The reason for expansion of the
conservation district was a recommendation of the "Washington Neighborhood:
Revitalize" Initiative Strategic Plan.
The Safe Community Task Force's recommendations for Management of Physical
Environment include improving Dubuque neighborhoods by
(a) encouraging home ownership;
(b) encouraging a mixed income approach to neighborhood development; and
(c) creating (or re- creating) a sense of place through good design.
Expansion of the Washington Neighborhood Conservation District addressed the Task
Force recommendations by encouraging homeownership and mixed -use opportunities,
while preserving the character and sense of place of the neighborhood. The
Washington Neighborhood is a mixed -use neighborhood with many single-family and
duplex units, scattered multi -family units, and major commercial zones in the
Central/White corridor and the Five Points area.
Note: This 2011 expansion brought the Subject Block into the conservation district.
Washington Street Neighborhood Conservation District Boundaries
The boundaries of the Washington Street Neighborhood Conservation District were
based on the boundaries of the 2011 Washington Neighborhood Association excluding
the following properties:
Heartland Financial/Dubuque Bank & Trust - 1300 Block of White Street
As part of the proposed expansion of the Washington Street Neighborhood
Conservation District, the City Council received a request from Heartland
Financial/Dubuque Bank & Trust to exclude the block bounded by 13th,
White, 14th and Jackson Streets from any extension of the Washington Street
Conservation District. They indicated they owned several buildings on the block
and had future development plans. They noted if the block is included in the
district, it may deter further economic development by their companies in
downtown Dubuque. The City Council approved the request to exclude these

properties.
Blum Elm Scrap Yard - 15th & Elm
As part of the proposed expansion of the Washington Street Neighborhood
Conservation District, it was discussed that the Blum Scrap Yard area would be
appropriate for exclusion. It was noted that if the property were ever considered
for a change of use, the City would prefer to minimize any obstacles to achieving
that goal. Based on this consideration, the City Council approved the request to
exclude these properties.
Dream Center — 1620 & 1628 Washington Street
On April 19, 2021, the City Council approved removal of 1620 & 1628 White
Street from the Washington Street Neighborhood Conservation District to allow
the Dream Center to create an outdoor program area as part of its efforts to
become a licensed childcare center and to help establish a sustainable source of
income and funding for the organization.
Demolition Permit in Conservation Districts
Demolition permits in conservation districts are reviewed by the Historic Preservation
Commission (HPC). Property owner(s) or applicants with property owner's permission
submit an application to the HPC. The HPC then reviews the application and
documentation and makes a determination as to the following:
1) Whether the building proposed for demolition has historic or architectural
significance to the community.
2) Whether denial of the proposed demolition permit would prevent the property
owner from earning a reasonable economic return on the property.
If the HPC finds that denial of the application would prevent the property owner from
earning a reasonable economic return on the property, or that the building does not
have any historical or architectural significance to the community, the HPC will approve
the application.
If the commission finds that denial of the application would not prevent the property
owner from earning a reasonable economic return on the property, and that the building
has historical or architectural significance to the community, the HPC will deny the
permit application.
Historic Preservation Commission Demolition Permit Review of 1305 Elm Street
On September 18, 2025, the HPC reviewed a demolition permit for the brick multi -family
building at 1305 Elm Street. Staff noted the property lies within the Washington Street
Neighborhood Conservation District but is not within the Washington Residential
National Register Historic District. Staff noted that the neighborhood has lost much of
its historical integrity and context, and the property itself is not considered individually
significant. While it is the last historic structure on the block, it was acknowledged that

surrounding properties have already been lost, making it difficult to justify its inclusion in
a historic district.
The applicant explained that the property is needed for future access from Elm Street
due to a planned overpass on 14th Street, which will block current access to the parking
lot. Some members of the commission agreed that the building lacks neighborhood
context and supported the demolition. Others expressed concern about losing the last
remaining historic structure on the block, suggesting that more research and a structural
analysis should be conducted before making a final decision. There was also discussion
about whether other properties on the block had undergone historic review.
Staff clarified that the commission's role is to determine whether the building at 1305
Elm Street holds historic or architectural significance. If it does, the demolition should be
denied; if not, it should be approved. A motion was made to approve the demolition due
to the property not having architectural or historical significance. By a vote of two ayes
to six nays, the HPC denied approval of the demolition permit.
Historic Review of Other Properties on the Subject Block
During the 2011 expansion of the Washington Street Neighborhood Conservation
District, the Subject Block was incorporated into the district. At the time of the
expansion, there were three buildings located on the Subject Block:
1376-1390 Washington Street, constructed prior to 1884.
DuTrac Credit Union, built in 1999.
1305 Elm Street, built in 1874, with concrete block additions between 1950 and
1964.
On July 27, 2011, DuTrac received approval from the Historic Preservation Commission
to deconstruct the residential dwelling(s) at 1376-1390 Washington Street based on the
building not having architectural or historical significance. (Enclosed Exhibit A)
REQUESTED ACTION
In accordance with the Unified Development Code, DuTrac has submitted a written
request to the City Council to alter the boundaries of the Washington Street
Neighborhood Conservation District to exclude the Subject Block.
Under the Unified Development Code's Chapter 10 Historic Preservation Commission
Applications and Procedures is the process for requesting an alteration of a
conservation district.
Process for Establishment, Expansion or Alteration of Conservation
District: Any person may request that the city council establish, expand or alter a
conservation district. The process for establishment, expansion or alteration of a
conservation district is as follows:
1. A written request for the establishment, expansion or alteration of a
conservation district must be submitted to the city clerk. At its next regular
meeting following receipt of the request by the city clerk, the city council may-

a. Approve or deny the request;
b. Set the request for consideration at a subsequent meeting;
c. Set the request for a public hearing; or
d. Refer the request to the Historic Preservation Commission for a
recommendation.
2. At its next regular meeting, if a referral is made to it by the city council, the
Historic Preservation Commission will review the request, and make a
recommendation to the city council to:
a. approve or deny the request, or
b. to table the request for additional information for a specified period not to
exceed sixty (60) days.
Failure of the commission to act on the request within the sixty (60) day period, unless
the applicant requests and the commission grants an extension of such time, constitutes
commission approval thereof. The recommendation of the commission will be
transmitted to the city clerk. The city clerk will promptly transmit the recommendation
and the application to the city council for its consideration. In determining whether to
recommend approval or denial of the request, the commission will consider whether the
proposed conservation district, or the expansion or alteration of the district, has historic
or architectural significance to the community.
3. At its next regular meeting following receipt of the recommendation of the
commission by the city clerk, the city council will approve or deny the request or
refer the nomination back to the commission for modification.
DISCUSSION
As you will notice, there are no set criteria for the City Council to follow when making a
determination on alteration of a conservation district. This allows the City Council to
weigh multiple factors when determining whether to approve the alteration to the district
boundaries. The following are some criteria the City Council may use to make a
determination:
Conservation District
The Unified Development Code defines a conservation district as one that:
A. Has defined geographic boundaries;
B. Contains contiguous pieces of property under diverse ownership;
C. Encompasses areas of historically and architecturally significant buildings,
sites, structures, objects, or districts, including potential national or local
historic districts; and
D. Is important to maintain and preserve for its economic and social value and
as a neighborhood or area of affordable housing.
Criteria B notes that the district should have contiguous pieces of property under
diverse ownership. The majority of the Subject Block was acquired by DuTrac prior to
the Washington Neighborhood Expansion.

The Kriviskey Survey identified 1305 Elm Street as having neighborhood level of
significance. Kriviskey defines Neighborhood Architectural Significance as:
"Structures that are of significance when found in groups or a contributing to the
significance of districts felt to meet one or more of the criteria for listing on the

As part of the Kriviskey Survey, this area was not identified as a district and the building
does not rise to be individually eligible for listing on the National Register of Historic
Places.
Jacobsen Survey
In 2003, James Jacobsen of History Pays conducted an in-depth architectural/historic
survey evaluation of Downtown Dubuque. The general boundaries of this area included
the following the Bluff to the west (excluding Jackson Park and Cathedral Historic
Districts, Dodge Street to the south, Hwy 151 to the west and 18th Street/20th Street to
the North. (See Map Below).

Washington Residential National Register Historic District
The Washington Residential Historic District was added to the National Register of
Historic Places on October 13, 2015. During the evaluation process, it was determined
that the Subject Block did not meet the criteria for inclusion within the district and was
therefore excluded from the designation.
Building Bridges to Elevate Employment (B2E2) Project
The Building Bridges to Elevate Employment (B2E2) Project is a multimodal
transportation project focused on connectivity and safety for all users. Improving these
transportation corridors will better connect neighborhoods and residents with economic
opportunities, recreational amenities, and community resources in the Kerper Boulevard
Industrial Park, on Chaplain Schmitt Island, Downtown Dubuque, the Historic Millwork
District, and on the west side of the city via the downtown Intermodal Transportation
Center.
In addition, due to the merger of the Canadian Pacific and Kansas City Southern
railroads, train traffic in Dubuque is expected to increase from approximately 9 trains
per day to 18 trains per day by 2027. This surge in train activity will lead to significant
delays and hinder the efficient movement of people and goods and significantly impact
emergency response and key employment centers. The proposed 14th St. overpass will
help avoid train crossing delays and potential negative impacts to safety and mobility in
Dubuque's downtown urban core.

The City of Dubuque has obtained a $25 million RAISE Implementation Grant to go
toward construction of the initial phases of the B2E2 project. This will include
• A vehicular/pedestrian overpass at the 14th St. railroad at -grade crossing
• Roundabout at the 16th St. and Sycamore St. intersection
• Roundabout at the 16th St. / Greyhound Park Rd. / Admiral Sheehy Dr.
intersection
• Elm St. corridor complete streets improvements
• 16th St. complete streets improvements, including installing sidewalks along
segments without existing sidewalks and enhanced crosswalks at the 16th St.
and Kerper Blvd. intersection
• Bridge sidewalk modifications to the Peosta Channel Bridge, including a
pedestrian and bike shared -use path
At their September 18, 2025 meeting, the Historic Preservation Commission asked the
applicant (DuTrac) what is the intent of the property after demolition? The applicant
noted that DuTrac intended to utilize the area for access from Elm Street. The applicant
said there are plans for an overpass on 14th Street which will block access drives to
their parking lot, and they are trying to get ahead of those changes.
Below is a preliminary conceptual rendering of the 14th Street overpass of Elm Street
and the at -grade railroad crossing. It should be noted that this is very preliminary and
subject to change as the project is designed.

Planning Services Staff recommend that the City Council uses the information in this
memo, enclosures, applications, maps and minutes to:
a. Approve or deny the request;
b. Set the request for consideration at a subsequent meeting;

Commission approved the request noting the building is not historically or architecturally
significant, and recommended that the building be deconstructed and materials be

THEREFORE: Pursuant to Article 10 of the Unified Development Code of the City of
Dubuque, Iowa, the Commission hereby grants permission to the City of Dubuque and

contained in the application, the Commission finds the proposal is in accordance with the

DECISION: By a vote 7 to 0, as indicated in the minutes, the Historic Preservation
Commission approved the request noting the building is not historically or architecturally
significant and recommends that the building be deconstructed and materials be diverted
from the landfill to the greatest extent possible.
Expiration date is one year from the date of issuance.
THEREFORE: Pursuant to Article 10 of the Unified Development Code of the City of
Dubuque, Iowa, the Commission hereby grants permission to the City of Dubuque and its
designated representative(s) to issue the regulated permit(s) required to complete the
approved project.

DuTrac Credit Union has been in discussion with Ms. McCarty for the past several years
concerning the purchase of her property. Ms. McCarty has decided to sell her property
pending her acceptance at a retirement community. Pending approval for the
demolition of this property, it is DuTrac's intention to complete the purchase of the
property from Ms. McCarty, demolish the current building within one year of approval,
and then expand our parking area. An expanded hard surface parking area would allow

Physical Characteristics: The duplex has a two-story side gable plan with a recessed
south end entry. There is a two-story rear wing with a gable roof. It appears on the
1884 Sanborn map, an L-plan that wrapped around two rear additions on the northeast
corner, and a single -story south end extension. By 1891 the southern units were in use
as a boarding house. By 1909/36 a number of rear extensions were added on the
southernmost unit. Long sheds always infilled the alley end of the lot, but all were gone
by 1962. Joseph Kessler owned this parcel when it was sewered along the alley to the
east in 1910.
Staff Analysis: The applicant is requesting a Certificate of Appropriateness to demolish
the duplex. The application explains DuTrac is interested in purchasing the building to
demolish it and expand their parking.
The building has been surveyed and evaluated under the Phase Ill Architectural and
Historical Survey Report -Downtown Dubuque. The building has been identified as non-
contributing to the potential Old Town Residential National Register of Historic Places
District.
The property is located in a conservation district. For demolition requests in
conservation districts, the role of the Commission is to review the application and make
a determination as to the following:
1. Whether the building proposed for demolition has historic or architectural
significance, and
2. Whether denial of the proposed demolition permit would prevent the property
owner from earning a reasonable economic return on the property.

Staff Member Wernimont presented the staff report noting the property was included in
the Washington Street Neighborhood Conservation District, but left out of the
Washington Residential National Register Historic District. He described the
neighborhood and the history of the block noting that the integrity of the neighborhood
was lost and there is little context left. He noted the property is not individually
significant and not part of a district.
Commissioner Doyle agreed with staff stating that he writes site inventories and said
that it would be difficult to create a district around this site and said the property would
not rise to be individually significant. He noted that while this is the only historic
structure remaining on the block, there were properties across the street and near to the
Washington Street Historic District.
Commissioner Stuter asked what the intent was after demolition.
The applicant, Kim Adams, 380 E. 14t" Street, representing the applicant, noted that
they intended to utilize the area for access from Elm Street. She said there are plans for
an overpass on 14t" Street which that will block access drives to their parking lot. She
said the bank is trying to get ahead of those changes.
Commissioner Monk noted that there appears to the building does not have
neighborhood context due to loss of several structures on the block and Commissioner
Gau agreed.
Commissioner Schwendinger noted that he would like the property to stay. He stated
that more research is needed on the property and later added that historic reports are
not as detailed as one might expect. He used his own property historic report as an
example. He said the subject property was in pretty good condition and that just
because it is the last property on the block, it is not justified to be demolished. He noted
that he would prefer it to stay residential. He asked if the other properties on the block
went through historic review. Wernimont stated that he was unsure, since the
conservation district may or may not have been present when some of the buildings
were demolished.
Commissioner Esser stated that she would hate to see it go but understand why it might
need to go. She said we have to use the information at hand to make a decision.

Commissioner Witthoeft noted that the city needs housing, and that just because it is
the last structure on the property that it is not justified to demo. He said he would prefer
re -use of the property and that he would like to see a structural analysis. He said the
demo is being requested in anticipation of a potential overpass. He concluded that it is
significant because it is the last building standing.
Staff member Wernimont clarified that the Commission is tasked with using the
information at hand and that they are to review the application and determine whether
the residential structure at 1305 Elm Street has historic or architectural significance to
the community. He noted that if the Commission finds the building proposed for
demolition does not have historic or architectural significance, the Commission should
approve the application. If the Commission finds the building proposed for demolition
has historic or architectural significance, the Commission should deny the application.
He concluded that if denied, meaning the Commission found the property has historic or
architectural significance to the community, the applicant is afforded the opportunity to
file a subsequent application to determine whether a reasonable economic return can
be earned on the property.
Motion by Monk, seconded by Pettitt, to approve the demolition due to the property not
having architectural or historical significance. Motion denied by the following vote: Aye —
Christina Monk and Tim Gau; Nay — Janice Esser, Bill Doyle, Heidi Pettitt, Rick Stuter,
Chad Witthoeft, Adam Schwendinger.
Commissioner Doyle returned to the Chambers.
DESIGN REVIEW
Applicant: Zephyr Aluminum Products

Project: Replace one wood window with one fiber window
District: West 11t" Street Historic District
Staff Member Schrobilgen presented the staff report noting that the structure is a
contributing building within the West 11t" Historic District. He stated that the applicant is
requesting a Certificate of Appropriateness (COA) for alterations to a single window and
that they would replace the window with the same style, type, and size but with wood -
fiber composite instead of wood.
Bruce Timmerman, 555 Huff Street, spoke in favor of the request. He noted that the
existing window is deteriorating and that the window is located in a bathroom. He said
the property owner was hoping to make the switch to wood -fiber composite so that it
won't deteriorate going forward. He said the edge of the rail is beveled to replicate a
wood window and that the window would be in the entire opening and not a pocket
window, in order to maintain the size.

Commissioners discussed the proposal. Monk asked if the sash was repairable and the
applicant noted that too much of it was missing. Schwendinger noted that no
alternatives were proposed and asked if the owners had considered just replacing the
sash and said it would likely be cheaper. The applicant said he was unsure. Doyle
asked if there were dimensions and noted that the bottom rail is typically larger than the
others. The applicant replied that the bottom rail was the same thickness as the sides,
so there would be a minor change there. Stuter asked what all the other windows are
made of. The applicant noted he changed a couple wood windows a few years ago.
Staff noted that the remaining windows appeared to be wood. They noted the alteration
of one window can become a slippery slope and noted that it was on a primary fagade.
Motion by Gau, seconded by Witthoeft, to approve the application as submitted. Motion
carried by the following vote: Aye — Janice Esser, Tim Gau, Christina Monk, Rick Stuter,
Chad Witthoeft; Nay — Heidi Pettitt, Bill Doyle, and Adam Schwendinger.
Note: Commissioner Doyle recused himself from the 1248 Iowa Street citing a conflict of
interest and left the Chambers.

Staff Member Schrobilgen presented the staff report noting that the structures are
eligible for the National Register of Historic Places, and contain some non -original
elements, like the rear 211 and 3rd story sections proposed for demolition. He said it is
unclear how old the shed structure is atop the one-story section, but it is proposed to be
removed. He noted that the elements to be demoed are not a part of the original
structure but the commission may consider if those sections have historic or
architectural significance. He also noted that the Commission does not have design
review over this project but the project is receiving city funding and therefore, Historic
Preservation staff will have design review of the project.
Andrew McCready, 563 Design and Josh Jansen, RRS described the project noting that
it will be a rehabilitation of the original building and that the deteriorating additions are to
be demolished.
Commissioners asked for clarification on which sections were to be demolished. They
agreed with the applicants that the portions to be demolished were not original and
should enhance the historic portions.
Motion by Gau, seconded by Schwendinger, to approve the application as submitted
due to those portions being demolished lack of significance. Motion carried by the

Staff Member Wernimont stated that the request was to see whether demolition would
be allowed. He said the owner stated that they purchased the building with the intention
of rehabilitating it, but the condition and structure of the building has proved difficult to
do that financially.
Staff Member Schrobilgen presented the staff report noting the two-story side gabled
house retains its basic form but has had material changes over the years. He said the
structure is not individually eligible for the National Register but is contributing to both
the West 11th Street historic and conservation districts in which it resides and as a result
is listed in those National Register and local historic districts.
Commissioners noted that the structure is one of few examples throughout the city and
that it is contributing to the national register and historic districts. Commissioners noted
that the property has architectural significance to the community.
Motion by Monk, seconded by Gau, to approve the application as submitted. Motion
denied by the following vote: Aye — none; Nay — Janice Esser, Bill Doyle, Tim Gau,

Physical Characteristics: The multi -unit residence is a symmetrical three bay 1874 red
brick structure on a limestone block foundation, with a moderately shallow side -gabled
roof. The windows are one -over -one double hung sash. There are two side chimneys on
this former tenement building. Additions to the structure include one-story concrete
block structures at the north side along Elm and west of the building, created for the use
of the business which was a restaurant and bar. Today there are eight mailboxes on the
structure.

Telegraph Herald and City Directory files:
City Directories show occupancy of a carpenter for the Illinois Central Rail Road, Nick
Koffman, at 1305 Elm Street as early as 1874-75. He was living on the southwest
corner of the same location in 1870-71 and moved to 13t" & Washington in-between. It
is likely he was the first owner, as we see Kaufmann ownership of the site through the
1920s. Newspaper articles show Kaufmann (spelled many ways in the newspaper and
directories) throughout the late 19t" and early 20t" centuries.
Statement of Significance: The primary structure was identified in the 1978 Kriviskey
survey as neighborhood supportive. The 2003 Jacobson Phase III survey finds it
contributing. The structure is largely intact with major changes including roofing type,
additions and modification of the entrance. The structure is in a largely industrial area,
and was excluded from the Washington Residential National Register Historic District
boundary in 2015, due to the fact that so much context around the structure is lost.
Staff Analysis- The structure has lost most of its context within the formerly residential
neighborhood that supported the industrial areas around it. It retains a good degree of
integrity on its own, but its status as a historic property is marginal as its context is lost.
Standards for Demolition Review: The city of Dubuque's historic property inventory
and any subsequent official architectural/historical surveys/evaluations and nominations
to the National Register of Historic Places serves as the standard for review.
Requested Action- Please review the application noting the standards for review and
determine whether the residential structure at 1305 Elm Street has historic or
architectural significance to the community.

piece of Dubuque history to be demolished. We cannot continue to eat away at the fabric of our
community just because other historic structures were demolished in the block. There are many
access points to Du Trac's property and no need to tear down this structure. With the demand for
affordable housing, why take more housing away from our city center? This is a viable property and
should remain.

Dear Mayor Cavanagh, Members of the Dubuque City Council, and City Manager Van
Milligen,
DuTrac Community Credit Union submits this letter in continued support of our prior request to
modify the boundary of the Washington Street Neighborhood Conservation District.
As a member -owned credit union founded in Dubuque on July 25, 1946, DuTrac takes great
pride in preserving community heritage while supporting progress that benefits residents and
businesses across our city. Our current request stems from one such community improvement —
the planned 14th Street overpass project.
During meetings with City Planning and Zoning representatives, DuTrac was informed of the
anticipated overpass and received a rendering of the proposed 14th Street and Elm Street layout
(attached). This project will significantly enhance mobility across the north end and downtown
by eliminating delays at the railroad tracks, and it will also improve emergency response times
by allowing first responders to reach both sides of the tracks more quickly.
However, one unavoidable result of this project is the direct impact on access to DuTrac's St.
Mary's Branch property at 380 E. 14th Street. While final designs remain in development,
DuTrac has been advised that access from 14th Street to Washington Street will be removed,
along with alleyway access to 14th Street. Additionally, portions of DuTrac's parking lot along
14th Street and possibly its Elm Street entrance may be affected. These changes will have an
immediate and significant impact on member and community access once construction begins.
Since opening the St. Mary's Branch in the late 1990s, DuTrac has proudly served the downtown
and north -end neighborhoods that helped build our institution. To continue doing so, DuTrac
must proactively plan for alternative access, parking, and traffic flow before the overpass
construction begins. This is why we respectfully request removal of the block bounded by 13th
Street, 14th Street, Elm Street, and Washington Street from the Washington Street
Neighborhood Conservation District.

continued accessand functionality once. the loth Street: overpass is complete. Preliminary plans
include.the potential for an additional entrance 6rimproved . raffc: pattern to maintain safe,

DuTrac fully. respects the Historic .Preservation Commissi ii and appreciates its service.
However, the Commission's.:scope is necessarily limited to the preservation criteria within the
district. The City Council, on -the other hand, hasjhli broader ability to consider fhe overall
public good, including -the unavoidable impact.the City's infrastructure project will have on
DuTrac'.s property and -operations.
It is interesting, to note that the Conservation District was expanded in 2011 and then the entire
district was also added to -the National. Historical District.exceptthis block in question today,
signifying this block did not significantly contribute to the Conservation district.
For this reason; we respectfidly ask* the Council to take -a forward -thinking approach---one.that
acknowledges: both ther community --wide benefit of the overpass and the need for DuTrac to
remain accessible. and viable. Reinovin�g this single block from the Conservation District will.
allow DuTrac to respond promptly and responsibly once the project design is finalized, without
negatively affecting the surrouodifig neighborhood.

I am a property owner and Landlord who owns multiple properties in the Washington Street
Neighborhood Conservation District, including 1305 Elm, which is in the proposed alteration block.
I understand and accept the general idea and goal of conservation of certain neighborhoods, including
the Washington St Neighborhood, which as mentioned I own other property in. That said I do not agree
that the "subject block" which DuTrac and I own property on should be part of that as it is and our
neighbors are more of a commercial area and not part of the actual "Washington St Neighborhood".

establishment, expansion, or alteration of a conservation district, and outlines the procedure
for City Council consideration of such a request; and
Whereas, the Washington Residential National Register Historic District, listed on
October 13, 2015, did not include the block due to its lack of qualifying historic or
architectural integrity; and
Whereas, the City's ongoing Building Bridges to Elevate Employment (B2E2) project
includes major transportation improvements, such as the construction of the 14th Street
vehicular and pedestrian overpass, which may alter access patterns for the DuTrac
property; and
Whereas, the City Council finds that removal of the block from the Washington
Street Neighborhood Conservation District will not adversely affect the historical or
architectural character of the remaining district.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:

Process for Establishment, Expansion or
Alteration of Conservation District
Any person may request that the city council establish, expand or alter a
conservation district. A written request for the establishment, expansion or
alteration of a conservation district must be submitted to the city clerk.
■ On October 24, 2025, DuTrac submitted a letter to the City Clerk requesting
alteration of the Washington Street Neighborhood Conservation District to
remove the property bounded by Washington Street, East 14t" Street, Elm
Street and East 13t" Street as known as the "Subject Block".
At its next regular meeting following receipt of the request by the city clerk, the
city council may:
a. Approve or deny the request;
b. Set the request for consideration at a subsequent meeting;
c. Set the request for a public hearing; or
d. Refer the request to the Historic Preservation Commission for a
recommendation.
If a referral is made to it by the city council, at its next regular meeting, the Historic
Preservation Commission will review the request, and make a recommendation to the
city council to:
a. approve or deny the request, or
b. to table the request for additional information for a specified period not to
exceed sixty (60) days.
■ Failure of the commission to act on the request within the sixty (60) day period,
unless the applicant requests and the commission grants an extension of such
time, constitutes commission approval thereof.
■ The recommendation of the commission will be transmitted to the city clerk.
■ The city clerk will promptly transmit the recommendation and the application to
the city council for its consideration.
■ In determining whether to recommend approval or denial of the request, the
commission will consider whether the proposed conservation district, or the
expansion or alteration of the district, has historic or architectural significance to
the community.
At its next regular meeting following receipt of the recommendation of the
commission by the city clerk, the city council will approve or deny the request or refer
the nomination back to the commission for modification.
What is a Conservation Districte
The Unified Development Code defines a conservation district as:
CONSERVATION DISTRICT: An area designated by ordinances of the city
council which:
A. Has defined geographic boundaries;
B. Contains contiguous pieces of property under diverse ownership;
C. Encompasses areas of historically and architecturally significant buildings,
sites, structures, objects, or districts, including potential national or local
historic districts; and
D. Is important to maintain and preserve for its economic and social value and
as a neighborhood or area of affordable housing.
Establishment of the Washington Street
Neighborhood Conservation District
■ February 10, 1975, the City Council adopted Ordinance No.
7-75, designating seven neighborhoods —including the
Washington Street Neighborhood, comprising ten blocks —as
areas containing notable concentrations of historically and
architecturally significant buildings.
■ Recognized that preserving and maintaining these structures
serves the public interest, while unchecked demolition could
undermine future City efforts to protect these valuable
cultural and architectural assets.
■ Established a temporary delay on the demolition of such
significant buildings, allowing the City Council sufficient time
to explore viable alternatives to demolition.

Expansion of the Washington Street
Neighborhood Conservation District
On February 22, 2011, the City Council approved the expansion of the Washington Street
Neighborhood Conservation District. The reason for expansion of the conservation district
was a recommendation of the "Washington Neighborhood: Revitalize" Initiative Strategic
Plan.
The Safe Community Task Force's recommendations for Management of Physical
Environment include improving Dubuque neighborhoods by
(a) encouraging home ownership;
(b) encouraging a mixed income approach to neighborhood development; and
(c) creating (or re- creating) a sense of place through good design.
Expansion of the Washington Neighborhood Conservation District addressed the Task
Force recommendations by encouraging homeownership and mixed -use opportunities,
while preserving the character and sense of place of the neighborhood.
The Washington Neighborhood is a mixed -use neighborhood with many single-family and
duplex units, scattered multi -family units, and major commercial zones in the
Central/White corridor and the Five Points area.

Demolition Permit in Conservation Districts
Demolition permits in conservation districts are reviewed by the Historic Preservation
Commission (HPC). Property owner(s) or applicants with property owner's permission
submit an application to the HPC. The HPC then reviews the application and documentation
and makes a determination as to the following:
1) Whether the building proposed for demolition has historic or architectural
significance to the community.
2) Whether denial of the proposed demolition permit would prevent the property
owner from earning a reasonable economic return on the property.
If the HPC finds that denial of the application would prevent the property owner from
earning a reasonable economic return on the property, or that the building does not have
any historical or architectural significance to the community, the HPC will approve the
application.
If the commission finds that denial of the application would not prevent the property owner
from earning a reasonable economic return on the property, and that the building has
historical or architectural significance to the community, the HPC will deny the permit
application.
Historic Preservation Commission
Demolition Permit Review of 1305 Elm Street
■ On September 18, 2025, the HPC reviewed a demolition permit
for the brick multi -family building at 1305 Elm Street.
■ A motion was made to approve the demolition due to the
property not having architectural or historical significance.
■ By a vote of two ayes to six nays, the HPC denied approval of
the demolition permit.

Historic Review of Other Properties on the
Subject Block
2011 Expansion incorporated the "Subject Block" into the Washington
Street Neighborhood Conservation District. The following properties
were existing at the time of expansion:
■ 1376-1390 Washington Street, constructed prior to 1884.
■ DuTrac Credit Union, built in 1999.
■ 1305 Elm Street, built in 1874, with concrete block additions
between 1950 and 1964.
July 27, 2011, DuTrac received approval from the Historic Preservation
Commission to deconstruct the residential dwelling(s) at 1376-1390
Washington Street based on the building not having architectural or
historical significance.

Process for Establishment, Expansion or
Alteration of Conservation District
When considering an alteration to the conservation district, the
City Council may evaluate not only the information submitted
but also any additional information related to the architectural
and historical significance of the property. There are no set
criteria the City Council must follow when making a
determination on an alteration, allowing the Council to weigh
multiple factors in deciding whether to approve changes to the
district boundaries.
