Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that he is resubdividing the subject lots to allow
construction of a new duplex on Lot 1. Staff reviewed the request, noting that the submitted plat will
allow construction of a new duplex, creating two off-street parking spaces for the existing residence
on Lot 2, and allow the existing garage on Lot 3 to be combined with the adjacent property to the
north. Staff noted that Lot 1 does not meet lot area requirements and Lot 2 does not meet lot area
and lot frontage requirements.
The Zoning Advisory Commission reviewed the request and found that waiving the lot area
requirement for Lot 1 and Lot 2, and the lot frontage for Lot 2, will not adversely impact adjacent
property and will still provide adequate space to construct a duplex.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the
request, waiving the lot area for Lot I and lot area and frontage for Lot 2.
simple majority vote is needed for the City Council to approve the request.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS '1 THRU 3 OF
GLENDALE ADDITION NO. 3
Whereas, there has been filed with the City Clerk a plat of survey of Lots1 thru 3 of
Glendale Addition No. 3; and
Whereas, said plat provides Lot 1 with 5,139 square foot of lot area, where 6,000
square feet is required and provides Lot 2 with 41.82 feet of lot frontage and 3,086 square feet
of lot area, where 50 feet and 5,000 square feet are required, respectively, by Section 42-
19(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot
1 to have 5,139 square feet of lot area, where 6,000 square feet is required, and to allow Lot 2
to have 41.82 feet of lot frontage and 3,086 square feet of lot area, where 50 feet and 5,000
square feet are required, respectively.
Section 2. That the plat of survey of Lots 1 thru 3 of Glendale Addition No. 3 is hereby
approved, and the Mayor and City Cterk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said final plat.

INTRODUCTION
The submitted plat of survey resubdivides throe existing parcels of land into throe new
lots to facilitate the construction of a duplex on Lot 1, provision of space for off-stroet
parking on Lot 2, and the sale of Lot 3 to the adjacent property owners with an existing
two-car garage. The Zoning Advisory Commission is being asked to roview the
submitted plat of survey because of insufficient lot aroa for Lot I and Lot 2 and
insufficient lot frontage for Lot 2.
DISCUSSION
The applicant, Randall J. Klauer, previously reviewed the proposed subdivision with the
Zoning Advisory Commission at their Apdl meeting. The applicant has rovised his
proposal to provide sufficient space for off-stroet parking on Lot 2, and providing
sufficient area between the existing house at 2845 Pinard and the proposed two-story
duplex to meet setback requiroments. Lot I is roquirod to have 6,000 squaro feet of lot
aroa for a duplex, but has only 5,139 squaro feet, a deficiency of 861 square feet. Lot
2 has 41.82 feet of frontage, whero 50 feet is roquired, and 3,086 squaro feet of lot
aroa, whero 5,000 squaro feet is requirod. The submitted plat in all other aspects is in
compliance with City of Dubuque Subdivision Regulations.
RECOMMENDATION
Planning staff rocommends that the submitted plat of survey be approved, as it does
not adversely impact the futuro development and improvement of adjacent property,
subject to the waiving of lot area for Lot 1 and Lot 2 and lot frontage for Lot 2.
