Herald. a newspaper of general circula-
tion published on the 251h day of Janu-
ary, 1980, in the City of Dubuque, Iowa,
the City Council of the City of Dubuque,
Iowa met on the 4th day of February,
1980 at 7:30 o'clock P.M. ICST) in the
City Council Chambers of the City Hall,
Dubuque. Iowa to consider the proposal
to dispose of interest of ~he City of Du~
buque, Iowa in real estate being the va-
cation of a portion of a twenty foot 120')
wide alley running between King Street

A Resolution Designating as Histori-
cally and Architecturally Significant
the Properly Hereinafter Described,
Pursuant to the Requirements of Ordi-
nance No. 32.75.
WHEREAS, the City Council has
heretofore passed, approved and adopt-
ed an Ordinance permitting structures
with historical or architectural signifi-
cance to be used for certain low-intensity
commercial uses; and
WttEREAS, the City Council has re-
ceived a request to designate the struc-
ture situated on the real estate herein-
after described as being architecturally
or historically significant for the pur~
poses of Ordinance No. 32~7,5~ and
WHEREAS, the City Council has held
a public hearing and has received and re~
viewed the comments of the City Histor-
ic Preservation Commission, the County
Historical Society and the State Historic
Preservation Officer regarding the his-
torical and architectural significance of
said structure:

Section d. That the Mayor of the City

for Release of Funds for the following
Project:
Cooper Street Steps Lighting
The City of Dubuque has made an En-
vironmental Review Record for the pro-
ject, and has placed this record on fileia
the Office of the City Clerk in City Hall,
13th and Central Streets, Dubuque,
Iowa, where said records may be exam-
ined and copied between the hours of
8:00 AM and 5:00 PM, Monday through
Friday until 5:00 PM on the 29th day of
February, 1980~
The name of the applicant is the City
of Dubuque~ Iowa, and the Chief Execu~
tire Officer of the applicant is Carolyn
Farrell. The mailing address for both the
applicant and the Chief Executive Offi-
cer is City Hall, 13th and Central Ave-
nue, Dubuque, Iowa.
The City of Dubuque will undertake
the project described above with Block
Grant Funds from the U.S~ Department
of Housing and Urban Development
(HUD), under Title I of the Housing and
Community Development Act of 1974.
The City of Dubuque is certifying to
HUD that the City of Dubuque and Caro-
lyn Forte]l, in her official capacity as'
Mayor, consent to accept the jurisdic-
tion of Federal Courts if any action is
brought to enforce responsibilities in re-
lation to environmental reviewS, deci-
sion-making, and action; and that these
responsibilities have been satisfied. The
legal effect of the certification is that
upon its approval, the City of Dubuque
may use the Block Grant Funds and
HUD will have satisfied its responsibili-
ties under the National Environmental
Policy Act of 1969. HUD will accept an
objection to its approval of the release of
funds and acceptance of the certification
only if it is on one of the following bases:
(a) That the certification was not in fact
executed by the Chief Executive Officer
or other officer of applicant approved by
HUD; or (b) That applicant's environ-
mental review record for the project in-
dicates omission of a required decision,
finding, or step applicable to the project
in the environmental review process.
Objections must be prepared and sub-
mitted in accordance with the required
procedure (24 cfr Part 58), and may be
addressed to HUD at the Omaha Area
Office, 7100 West Center Road, Omaha,
Nebraska 68106. Objections to the re-
lease of funds on bases other than those
stated above will not be considered by
HUD. No objection received after the
29th day of February, 1980 will be con-
sidered by HUD.

Urban Renewal Pro|ect, iowa R-15
WHEREAS. under the date of July
26, 1967, the ,C, ity of Dubuque, pursuan[
to Chapter 403 of the Iowa Code. and the
Special Session, February 18, 1980
United States o£ America entered into a
Loan and Capital Grant Contract for th,
undertaking of the Downtown Urban
Renewal Project, Iowa R-15; and
WHEREAS, under date 0I May i8,
1967, the Council of the City of Dubuque,
after Public Hearing, adopted an Urban
Renewal Plan for the said Project and
which Urban Renewal Plan is on file in
the Office of the City Clerk and is record-
ed in the Office of the Recorder of Dubu-
que County,Iowa, in Book 295 of Mort-
gages, Pages 235 to 259; and
WHEREAS, pursuant [o such Urban
Renewal Plan and Loan and Capital
Grant Contract, the City of Dubuque has
acquired land, relocated site occupants,
removed structures and other improve-
ments, constructed site improvements
and public facilities, and marketed land
and improved property for private and
public redevelopment purposes; and
WHEREAS, the City of Dubuque and
the United States of America have ef-
fected a financial settlement of the
Downtown Urban Renewal Project,
Iowa R-15; subject, however, to certain
conditions agreed to in Resolution No.
167 77 adopted June 1, 1977, and which
conditions required:
Deposit of the proceeds ~rom the
sale or lease of property ~o the
credit of the Cumin unity Devel
ment Block Grant Program (re-
fers to that land which was unsold
as of June 2, 1977);
2. Improvement of land must con-
form to the Urban Renewal,Plan;
3. Proposed conveyances ar(~ sub-
ject to public disclosure require~
meats of Section 105 (e) of Title
of the Housing Act of 1949, as
amended; and
4. Prohibition of discrimination in
the sale, lease, rental, occupancy
or other use of said properties or
in any improvements erected or
to be erected thereon; and
WHEREAS, the City recognizes that
the redevelopment of the Project in a
manner which meets the objehtives of
the Urban Renewal Plan will be a com-
plex undertaking requiring a joint parti-
cipation agreement between the City
and the prospective developer; and
WHEREAS, the City of Dubuque
deems it to be desirable and in the best
interest of the City and the Project to
publicly invite proposals from prospec-
tive redevelopers for participation in the
pJanning and implementation of the re-
d6velopment of the remaining cleared
land in the Project Area; and
WHEREAS, the Fixed.Price Compe-
tition me~hod permits the selection of a
prospbctive redew~[oper upon criteria
and factors other than price but upon the

qualifications and experience of the re:
developer or redevelopment team, the
magnitude and importance of the pro-
posed redevelopment to the achieve-
meat of the objectives of the Urban
Renewal Plan, accessibility to major ten-
ants acceptable to the City and the abil-
ity of the redeveloper to implement the
proposed redevelopment.

RESOLVED BY THE CITY' COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That a public invitation for
formal proposals for participation in the
planning and implementation of the re~
development of the cleared land in the
Downtown Urban Renewal Project,
Iowa R-15, identified as Blocks 12, 13, 14
and 17 in Dubuque Downtown Plaza be
approved.
Section 2, That documents pertain-
ing to the selection of a tentative rede-
veloper and to the disposition of the land
are hereby approved and filed of record
with the City Clerk.
Section 3. That the Fixed:Price
Method of offering the land for sale to a
redeveloper is the appropriate method
of making the land available for redevel-
opment.
Section 4. That the price for the dis-
posal of each parcel included in the land
to be conveyed shall be" i,~n0t less than the
fair value for the land for uses in accor~
dance with the Urban Renewal Plan and
reflective of the agreement to be reach-
ed between the city and developer on
their respective contributions to the
project.

System Improvement Act of 1979 to

WHEREAS, the City of Dubuque;
Iowa is desirous of becoming a part of a
combination of units of generallocal gov-
ernment which is known as the North-
east Iowa Area Crime Commission;
NOW THEREFORE~ be it resolved
by the City Council of the City of Dubu-
que, Iowa, that the City of Dubuque,
Iowa authorizes the Northeast Iowa
Area Crime Commission to act in its be-
half in criminal justice planning, submit-
ting applications for federal and state
funds, administering training programs
and administering grant funded pro-
grams for the years 1980, 1981, ~982 and
any future years.
The City of Dubuque, Iowa, will be
represented on the Northeast Iowa
Area crime Commission by a duly ap-
pointed Commissioner as provided in

the amount of the cost of the improve-
ment, they shall be deemed to have
waived all objections thereto.
Said improvement shall be construct~
