WHEREAS, pursuant to Council Res-
olution 228-79, dated September 4, 1979
the City of Dubuque has purchased and
now owns fee simple interest in the pro-
perty at 599 West 8th Street, legally
described as: Lot 2 of Lot 3 of Lot 14 of
Out Lot 703, and Sub. 15, Out Lot 703,
Lot 1
WHEREAS, the identified real pro-
perty is located in the Hill Neighborhood
Improvement Area, which is qualified,
by Council Resolution 13.77 and Chapter
403 of the Iowa Code for public activities
to alleviate blight and deterioration of
private property; and
WHEREAS, the identified real pro-
perty has been publicly offered for sale
to the highest bidder, and that a quail:
fled high bid has been received; and
WHEREAS, the qualified high bidder
has presented to the City Manager a fi
nancially and technically feasible pro-
posal for the rehabilitation of the identi-
fied real property according to the stan-
dards of the Hill Neighborhood Improve-
ment Plan; and
WHEREAS, the qualified high bidder
has agreed to receive a Quit Claim Deed
and execute a Homestead Agreement as

March 11, 1980, adopted the Fiscal Year
1981 budget which appropriated the
$66,000 for the construction of this new
well; and
WHEREAS, the City of Dubuque now
operates five shallow wells, four of these
wells constructed in 1956 and one con-
structed in 1969, in addition to four deep
wells used for standby purposes; and
WHEREAS, there has been some evi-
dence of degradation of the existing
shallow wells; and
WHEREAS, good management prac-
tices would dictate the advisability of
having well capacity equal to or greater
than the treatment capacity of the water
plant;

WHEREAS, the Constitutional Spemb
lng Limit Proposal is directly opposed
and contrary to the spirit of the constitu-
tional amendments that granted cities
local home rule; and
WHEREAS, the Constitutional Spend-
ing Limit Proposal precludes local deter-
mination in addressing and responding
to particular economic and capital im-
provement programs; and
WHEREAS, local governments are
capable of providing prudent fiscal
management in controlling taxes; and
WHEREAS, the Constitutional Spend-
ing Limit Proposal preempts local offi-
cials from exercising judgment in repre-
sentative government; and
WHEREAS, the Constitutional Spend-
ing Limit Proposal does not assist local
governments to meet inflation and
creasing costs in maintaining needed
services; and
WHEREAS, the Constitutional Spend-
ing IAmlt Proposal may jeopardize fed-
eral financial assistance in the areas of
maintenance of efforts and meeting fed-
eral mandates; and
WHEREAS, the local Constitutional
Spending Limit Proposal is deemed not
to be in the best interest of the City of
Dubuque;
