City Engineer Gus Psihoyos is recommending City Council adopt a resolution setting a
public hearing for the disposal of City Owned Property lying north of Cedar Crest Court
in Dubuque Iowa be held on January 5, 2026.
The City of Dubuque is the current owner of the real property described as Lots 1, 2, 3
and 4 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa. This property
was deeded to the City along with the stormwater detention basin lot by the developer
of Cedar Ridge Farm Place No. 15.
Recently, the City was contacted by the adjacent property owners on Cedar Crest Court
with inquiries about acquiring portions of the subject property for a proposed residence
and possible expansions of commercial businesses in the future.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memorandum requests City Council approval of a resolution setting a public
hearing for the disposal of City Owned Property lying north of Cedar Crest Court in
Dubuque Iowa.
BACKGROUND
The City of Dubuque is the current owner of the real property described as Lots 1, 2, 3
and 4 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa. This property
was deeded to the City along with the stormwater detention basin lot by the developer
of Cedar Ridge Farm Place No. 15.
Recently, the City was contacted by the adjacent property owners on Cedar Crest Court
with inquiries about acquiring portions of the subject property for a proposed residence
and possible expansions of commercial businesses in the future.
DISCUSSION
The City has drafted and executed agreements with three adjacent property owners
which are JJR Investments LLC, BNZ Properties, LLC, and Jeremy and Andrea
Biedermann. Red Squirrell Development, LLC and BM Properties LLC were contacted
by the City and they have waived their right to purchase their respective portions. BNZ
Properties, LLC and Jeremy and Andrea Biedermann have agreed to split the Red
Squirrell Development, LLC and BM Properties LLC portion equally.
The agreements include the following provisions:
Purchase price of $1 for each of the properties
Each of the three property owners are responsible for one-third of the total
surveying, public notice, and recordation costs
Subject properties from City cannot be developed in the future unless combined
with the current private properties

- The City has reserved a 100' sanitary sewer and recreational trail easement near
the railroad and Catfish Creek over the properties to be sold to the private
property owners for possible future improvements
Per Resolution No. 159-25 the City Council approved the Final Plat of Cedar Ridge
Farm Place No. 21 dividing the subject City property to facilitate the sale of the
lots/areas per the agreements with the three private property owners.
The currently proposed dispositions are described below and as shown in the attached
property owner agreements-
- Lot 1 of Cedar Ridge Farm Place No. 21 to JJR Investments, LLC
- Lots 2 and 3 of Cedar Ridge Farm Place No. 21 to BNZ Properties, LLC
The conveyance of the portion to Biedermann is being delayed several months due to
an ongoing floodplain permitting issue between the property owner, the City, and the
Iowa DNR.
BUDGETIMPACT
None
RECOMMENDATION
I respectfully request that the properties be conveyed to JJR Investments, LLC and BNZ
Properties, LLC, as indicated above, and that a public hearing be set for the disposition
of the City's interest in the subject areas on January 5, 2026, through adoption of the
enclosed resolution.

RESOLUTION OF INTENT TO DISPOSE OF AN INTEREST IN CITY OF DUBUQUE REAL
ESTATE LOCATED NORTH OF CEDAR CREST COURT PURSUANT TO AGREEMENTS
BETWEEN THE CITY OF DUBUQUE AND JJR INVESTMENTS, LLC AND BETWEEN THE

Whereas, the City of Dubuque, Iowa (City) is the owner of the real property described as
Lots 1, 2, and 3 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa; and
Whereas, City and JJR Investments, LLC have entered into an Agreement for the sale of
City property described as Lot 1 of Cedar Ridge Farm Place No. 21 lying north of and adjacent
to the JJR Investments, LLC property on Cedar Crest Court to JJR Investments, LLC; and
Whereas, City and BNZ Properties, LLC have entered into an Agreement for the sale of City
property described as Lots 2 and 3 of Cedar Ridge Farm Place No. 21 lying north of and
adjacent to the BNZ Properties, LLC property on Cedar Crest Court to BNZ Properties, LLC;
and
Whereas, per Resolution No. 159-25 the City Council approved the Final Plat of Cedar Ridge
Farm Place No. 21 dividing City land to facilitate the sale of the properties per the JJR
Investments, LLC and BNZ Properties, LLC agreements; and
Whereas, the Code of Iowa requires that the City Clerk publish notice of the proposal and of
the time and place of the meeting at which the City Council proposes to take action thereon
and at which meeting the City Council shall receive oral and/or written objections from any
resident or property owner of said City to such proposed action.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 1 of Cedar
Ridge Farm Place No. 21, in the City of Dubuque, Iowa by quit claim deed to JJR Investments,
LLC pursuant to the executed Agreement attached hereto.
Section 1. That the City of Dubuque intends to dispose of its interest in Lots 2 and 3 of
Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa by quit claim deed to BNZ
Properties, LLC pursuant to the executed Agreement attached hereto.
Section 2. The City Clerk is hereby authorized and directed to cause a notice to be
published as prescribed by Iowa Code Section 364.7 of a public hearing on the City's intent to
dispose of the foregoing -described Property, to be held on the 5th day of January, 2026, at 6:30
p.m. in the City Council Chambers at the Historic Federal Building, 350 W. 6th Street, Dubuque,
Iowa.
Section 3. That a public hearing, and/or by virtual means, on the intent to dispose of Lots 1,
2, and 3 of Cedar Ridge Farm Place No. 21, in the City of Dubuque, Iowa, per Sections 1 and
2 above is hereby set for the 51h day of January, 2026, at the Historic Federal Building, 350 W.
6th Street, Dubuque, Iowa, beginning at 6:30 p.m., and the City Clerk be and is hereby
authorized and directed to cause a notice of public hearing on the intent to vacate said real
estate to be published in the manner as prescribed by law.

AND BETWEEN
JJR INVESTMENTS LLC
AND
THE CITY OF DUBUQUE, IOWA
This Agreement, dated for reference purposes the 21 st day of
January, 2025 ,21 is made and executed by and between the City of Dubuque,
Iowa, (City), a municipal corporation, and JJR INVESTMENTS LLC (JJRI).
WHEREAS, JJRI is the owner of property located on Cedar Crest Court and legally
described as LOT 2 CEDAR RIDGE INDUSTRIAL PLACE NO.6 (the JJRI Property); and
WHEREAS, City is the owner of the property legally described as LOT L CEDAR
RIDGE FARM PLACE NO. 15 lying adjacent to the JJR Property on Cedar Crest Court (the
City Property); and
WHEREAS, JJRI is requesting the sale of a portion of the City Property being
approximately 1.5 acres in size and as generally shown on the attached Exhibit A; and
WHEREAS, the sale will require the subdivision of the City Property; and
WHEREAS, JJRI and City desire to enter into an agreement with respect to the
proposed sale of the portion of City Property as set forth herein.
NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES HERETO AS
FOLLOWS:
SECTION 1. CITY RESPONSIBILITIES.
1.1 Subj ect to all of the conditions set forth herein, City will sell approximately 1.5 acres of the
City Property, as generally shown on Exhibit A, to JJRI for $1.00.
1.2 City will reserve a public sanitary sewer utility and recreational trail easement over the
northerly 1 00'ofthe City Property (the Easement Area) shown on Exhibit A. The easement
will preclude the placement of buildings and other structures in the Easement Area in order
to allow for maintenance or replacement existing and future trails and utilities in the area.
1.3 City will procure three quotes from local land surveying firms and will select the lowest
responsible quote for the surveying services ("Selected Surveyor") required to subdivide
the City Property into the four lots as generally shown on Exhibit A.
1.4 The City will instruct the Selected Surveyor to ensure that the extension of the lot line
running from the southwest to the northeast, between the property to be titled in JJRI and
the property to be titled in BNZ Properties, LLC, is straight and true with no angular
deviation

1.5 The initial four-way lot split as shown on Exhibit A is considered a Minor Subdivision
and each lot will be labeled as non -buildable due to the fact that the lots do not have
street frontage. Because the new lots will not have street frontage, a waiver from the
Planning Services department will be required. The Minor Subdivision Plat/waiver
request will require review and approval by the Zoning Advisory Commission and City
Council (one meeting each).
1.6 The other private property owners shown on Exhibit A have asked to purchase the other
lots shown on Exhibit A. After the Minor Subdivision surveying is complete and the
plat is recorded, City staff will work with the other private property owners and/or their
representatives to prepare quit claim deeds for the other lots. A public hearing to dispose
of the City's interest in the lot is required.
1.7 Upon receipt of the Minor Subdivision plat for the lots proposed to be sold, the requests
for sale to the JJRI and the other private property owners will be taken to the City
Council to be set for a public hearing and formal approval of the sale of the City lots.
1.8 After the public hearing and approval of the sale of the lots by the City Council and
receipt of the publication and filing fees, the City will execute quit claims deeds to JJRI
and the other private property owners and will record the deeds.
SECTION 2. JJRI RESPONSIBILITIES.
2.1 JJRI will be responsible for one-third (33%) of the total cost of the surveying services
required to subdivide the City lot into the four lots shown on Exhibit A. City will procure
three quotes from local land surveying firms and will select the lowest responsible quote.
Each of the three private property owners shown on Exhibit A must sign a contract with
the selected surveying firm and paytheir portion ofthe surveying costs directly to the firm.
The Minor Subdivision plat will include the easement reservations referred to in Section
1.2.
2.2 JJRI will purchase approximately 1.5 acres of the City Property, as shown on Exhibit A,
from the City for One Dollar ($1.00).
2.3 JJRI will also be responsible for one-third (33%)) of the total cost for City staff to process
this Agreement and all filing, publication, and recording fees associated with the request.
2.4 JJRI will also be responsible for the costs of surveying to consolidate its existing lot with
the purchased lot if and when fature development or redevelopment activities on the
purchased lot is planned. The lot consolidation surveying is required to remove the non -
buildable status put in place by the Minor Subdivision described above.

written approval will not be unreasonably withheld.
5.2 This Agreement represents the entire Agreement between the parties. There are no verbal
additions to this Agreement, and all amendments, additions or changes to this Agreement
must be in writing and agreed to by both parties.
5.3 All covenants, conditions, and provisions of this Agreement will inure to the benefit of
and be binding upon the parties hereto and their respective successors, heirs and assigns.
5.4 This Agreement is governed by the laws of the state of Iowa and venue for any action
arising from or related to this Agreement will be in the Iowa District Court for Dubuque
County, Iowa.
5.5 If any term of this Agreement is found to be void or invalid, such invalidity will not affect
the remaining terms of this Agreement, which will continue in full force and effect.

Thhhs Agreement, dated for reference purposes the day of

Iowa; (City), a municipal corporation, and BNZ PROPERTIES, LLC (BNZP).
WHEREAS, BNZP is the owner of property located on Cedar Crest Court and
legally described as LOT 1 CEDAR RIDGE FARM PLACE NO. 8 (the BNZP Property);
and
WHEREAS, City is the owner of the property legally described as LOT L CEDAR
RIDGE FARM PLACE NO. 15 lying adjacent to the BNZP Property on Cedar Crest Court
(the City Property); and
WHEREAS, BNZP is requesting the sale of a portion of the City Property being
approximately 2.73 acres in size (1.07 acres area and 1.66 acres area) and as generally
shown on the attached Exhibit A; and
WHEREAS, the sale will require the subdivision of the City Property; and
WHEREAS, BNZP and City desire to enter into an agreement with respect to the
proposed sale of the portion of City Property as set forth herein.
NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES HERETO AS
FOLLOWS:

subdivide the City Property into the four lots as generally shown on Exhibit A.

1.4 The City will instruct the Selected Surveyor to ensure that the extension of the lot line
running from the southwest to the northeast, between the property to be titled in JJRI and

the selected surveying firm and pay their portion of the surveying costs directly to the firm.

A RESOLUTION APPROVING THE FINAL PLAT CEDAR RIDGE FARM
NO. 21, IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat Cedar Ridge Farm
No. 21 in the City of Dubuque, Iowa; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14(B) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived regarding required lot frontage for Lot
1, Lot 2, Lot 3, and Lot 4 of Cedar Ridge Farm No. 21.
