Street commissioner Norton reported having expended 569.20 improving streets during month
of February 1886 Warrants ordered drawn to pay the same and report filed
Auditor Rielly reported 930.25 due city officers and 903.30 due members of the fire department

Marshall Moore reported 1076.65 due the police for salaries for the month of February 1886 and
that the same had made 66 arrests and that he paid to the city treasurer the sum of 1.50 fees

25.00 per year 325 Those lamps were paid for and your committee find they were not in
existence
Ald Crawford moved the report be referred to a committee consisting of the mayor city engineer
city attorney and the chairman of the police and gas committee to notify mr Burden to appear
before them and show cause if any why report should not be adopted carried

for macadam purchased during the month of February 1886 and that this amount was purchased
at the rate of 75 cents per cubic yard
Ald Thomas Byrne offered as an amendment to Ald Deckert's report that all parties quarrying
and breaking stone be allowed 1.00 per yard and all parties breaking rock quarried by the city
be allowed 75 cents per yard lost

Ald Craword of the Ordinance Committee presented an ordinance to amend an ordinance

the revised ordinances and read the same for the first time

Ald Crawford presented an ordinance to amend Chapter XXIII of the Revised ordinances being
an ordinance in relation to license and read the same for the first time
The same moved the blanks specifying the rates to be charged for such license shall read not less
than twenty five cents nor more than ten dollars per day carried
The same moved the rules be suspended and the ordinance read for teh second time and put upon
its final passage

Ald Crawford of the ordinance committe reported on the petition of Magt Carr as follows
To the city council of the city of Dubuque your committee on ordinance to which with the
city attorney was referred the petition of Magt Carr asking the city council to cancel the special
tax of 128.94 levied by the council on the 1st day of October 1883 on lot number two 2 in
Marsh's Dubuque Addition to pay for paving curbing and macadamizing Brad Street in front of
said lot respectfully report that since th elevying of said special tax the supreme court of the state
has decided in the case of Gatsch against the City of Des Moines and other cases that before
the levyingg of any special tax on abutting real estate to pay for improving the street in front
of such real estate the owner is entitled to be notified

of the intention of the council to levy such tax in order that he may have an opportunity of appearing
and being heard in relation to the same As no such notice was served on Mrs Carr the owner of
the lot above described the levy of the special tax on the lot is invalid and cannot be legally
collected
We therefore recommend that the resolution levyin said special tax on said lot two 2 in Marsh's
Dubuque adopted October 1st 1883 be rescinded
We further recommend that the city recorder be instructed to cause to be served on Mrs Magt
Carr the notice required by ordinance tht at the session of the council to be held on the second
Thursday of april 1886 the question of levying a special tax of 128.94 on lot 2 in Marsh's Dubuque
will be considered and that she appear at said session and show cause why said tax should
not be levied

The city ttorney reported as follows on the petitions for the establishment of a superior court
Whereas a petition sighed by more than one hundred citizens of the city of Dubuque has been this
day presented to the city council of the city of Dubuque asking tht the question of the establishment
of a superior court in the city of Dubuque in accordance with the provisions of Chapter 143 of
the acts of the 16th general assembly laws of Iowa and
Whereas the provisions of said Chapter regulating proceedings for the submission of said question
have been compiled with it is therefore
Resolved by the city council of the city of Dubuque
That the mayor be and is hereby authorized and empowered to issue his proclamation in the
manner and at the time required by law submitting to the qualified voters of the city of Dubuque
at the annual election for city officers in the year 1886 the question of establishing a superior
court in the city of Dubuque and that said question be voted upon by the qualified electors at
said election

Be it resolve by the city council of the city of Dubuque that the chief engineer of the fire departent
be instructed to receive bids from first class veterinary surgeons for their services for one year
adopted
Ald Hollnagel offered the following resolution
Be it resolved by this council that the alley between Couler Ave and Jackson St and 22nd and
23rd streets be opened
also that the city engineer be and is hereby instructed to give the abutters the line whereby to
set their fences
The ayes and nayes being called on the adoption of the preceeding resolution to open alley it passed
by the following vote

Be it resolved by the city council of the city of Dubuque that the city recorder be instructed to
advertise for bids for the iron superstructure of 7th street bridge
The same also offered the following resolution
Resolved by the city council of the city of Dubuque that 15th street between white and alley
between Elm and Pine Streets be graded guttered curbed and macadamized in conformity
with the ordinance upon that subject that the city engineer be and he is hereby instructed to make
the necessary plans and specifications for said improvement and the city recorder directed to
give the proper notice for bids and proposals for the performance of the work the guttering
curbing and maadamizing to be done at the expense of teh owners of the abutting property
the ayes and nayes being called on the adoption of the preceeding resolution it passed by the

Elm Streets be graded guttered curbed and macadamized in conformity with the ordinance upn
that subject That the city Engineer be and he is hereby directed to make the necessary plans
and specifications for said improvement and the city recorder directed to give the proper notice
for bids and proposals for the performance of the work the guttering curbing and macadamizing
to be done at the expense of the owners of the abutting property

Waverly Avenue to city limits and present the same to the council with the written consent of
abutters to giving right of way adopted
The city engineer presented an estimate of amount of work done by Wm H Rebman contractor
improving Cornell St also a bill for the same amounting to 713.87 On motion bill was ordered

Be it resolved by the city council of Dubuque that a warrant of 15.00 be drawn in favor of Mrs
Gottlieb Schwagler being amount paid by her as a boarding house license adoptedd
The same also moved that the street commissioner be instructed to stop breaking and blasting
of rock by the city and to bargain for no movre macadam carried
the city attorney reported on the petition of Mst Moore that the petition be not granted adopted
The same reported on the petition of James McGrath that the petition be received and filed and
that he notified mr Howie of this claim and he agreed to settle the claim report adopted

the chair stated the object of the meeting was to hear the anual reports of city officers to select
polling places and appoint judges and clerks of election and for the transaction of any other business
the council might think proper
Ald Kane of the committee on claims reported on the petition of G F Rath in favor of referring the
petition to the committee of the whole report adopted
The same reported on the petition of E L Curtis recommending it be referred to the committee
of the whole report adopted
The same reported on the petition of Dr Asa Horr recommended it be referred to the committee

The same reported on the communication of the city engineer in regard to the claim against Mr

Ald Olinger moved that part of the petition remonstrating against th eimprovement of 15th street
from White to Washington Sts be granted carried
Ald Deckert moved that part of the resolution providing for the improvement of 15th street from
white to washington streets be reconsidered and stricken out carried
Ald Olinger moved the bids for the improvement of 15th street be opened carried
Ald Deckert moved the bids for the improvement of 18th street be opened also carried
The recorder opened and read the bids for the improvement of 15th and 18th streets and on
motion the same were referred to the city engineer

Resolved that the Julien Ave sewer be arched with stone masonry from the present termination
of the arching of said sewer at the Lorimier House westerly to the intersection of Julien Ave with
Hill St that the city engineer be instructed to prepare the necessary plans and specifications and
the city recorder to advertise for proposals for diong the work
The same moved the adoption of the resolution

to the common counci of the city of Dubuque
Pursuant to the terms of section twelve 12 of an ordinance adopted by your honorable body
adopted February 10th 1886 entitled An ordinance granting to the Chicago Burlington and
Northern Railroad Company its successors and assigns th eright of way across and along
certain streets and alleys and to use and occupy for railroad purposese certain public ground in
the city of Dubuque
I Albert E Touzalin president of the said chicago Burlington and Northern Railroad Company and
fully authorized and empowered by said company to accept the terms and conditions of the
said ordinance and do hereby notify your honorable body of such acceptance thereof

Ald kane presented a bill from D Gillan 5.00 paid to Morrison Bro for a pump to pump water from
his cellar on West 8th St claimed to be caused by the improper grading of said street and moved
the bill be paid
Ald Crawford amended by moving the bill be referred to the committee on claims carried
Ald Crawford offered the following resolution
Resolved that the resolution of the city coumcil adopted october 1st 1883 levying a special tax
upon lot sixteen 16 in Marsh's Dubuque owned by jacob Auer for the purpose of defraying the
expense of paving curbing and maadamizing brad street from Julien Ave to a point one hundred feet
north of Julien Ave be and the same is hereby rescinded and repealed resolution on motion
adopted

That to pay for curbing guttering and macadamizing Brad Street from Julien Ave to 100 ft
north by J A spear contractor in front of and adjoining the same a special tax be and is hereby

Ald Crawford moved that the resolution presented this date providing for the levy of a special
tax upon lots two 2 and sixteen 16 in marsh's Dubuque to pay for curbing guttering and macadamizing
the portion of Brad Street in front of said lots be postponed until the session of the council to be
held on the second Thursday in April 1886 and that the city recorder be instructed to cause to
e ser ved upon each of the owners of said lots the notice required by ordinance notifying them
to appear on said datae before the city council and show cause if any they have why the special
taxes provided in said resolution should not be levied adopted
Ald Deckert offered the following resolution
Resolved by the city council of the city of Dubuque that the south side of 14th street between
Jackson St and Pine Streets be graded guttered curbed and maadamized in conformity with the
ordinance upon that subject That the city Engineer be and he is herereby directed to make the
necessary plans and specifications for said improvement and the city recorder directed to give the
proper notice for bids and proposals for the performance of the work the guttering curbing and
macadamizing to be done at the expense of the abutting property owners

into two election precincts and the holding of city elections therein be read for the second time

annual reports of city officers and heads of departments on motion of Ald Kane was referred to
a committee consisting of the mayor and the chairmen of the printing and finance committees
to have printed in pamplet orm and that they award contract to the lowest bidder
Ald Crawford moved the ordinance eproviding for a diviion of the 5th ward into two polling
precincts be published in both german papers carried
The matter of submitting the question of forming a superior court being brought before the council
ald page moved the resolution adopted at a previous session ordering the question of establishing
a superior court be submitted to the people at the next annual city election be reconsidered

The chair stated the object of the meeting was to award the contract for the construction of the
iron superstructure of 7th st bridge to appoint clerks and judges of election and locate polling
places and for the transaction of any other business the council might think proper
Ald Crawford moved the bids for constructing 7th st Bridge be considered carried
Ald Deckert of the street committee made the following report and the same was on motion
accepted
To the honorable mayor and city council of Dubuque
Your committee on streets would respectfully report that the bids for the iron superstructure of
7th st bridge have been opened and that the city engineer has eamined and calculated the
strains and finds the bids all in conformity with the specifications The bid of the shiffler bridge co
of Pittsburgh penn E A Spaulding Agt being the lowest eve would report in favor of awarding
the said company the contract according to specification marked D for the sum of 1346.00
Ald Hollnagel offered the following resolution
Be it resolved by this council that a warrant be drawn on the city treasurer amounting to two hundred
dollars 200.00 in favor of J J Pfiffner on account for services as city assessor Adopted by the
following unanimous vote

Ald Deckert moved the rules be suspended and permission granted to the owners of property
abutting on Kniest St to address the council in regard to the opening or vaation of a part of

E Mayor O'donnell addressed the council in behalf of the property owners favoring a vaction
of a portion of the street he was followed by Messrs Rhomberg and Wood who spoke briefly
in regard to the proposed vacaction

part of Kniest street as returned by the city engineer and commanding the marshall to summon
a jury of twelve free holders citizens of the city and not directly interested to to appear at a time
and place therein stated and not less than five days from the date thereof to assess the damages
if any caused by the reaction or alteration of a portion of Kniest street a provided by the ordinances
provided the parties petitioning for the vacation of Kniest street first pay into the city treasury the
cost and additionally execute a bond that they will hold the city harmless from any and all damages
assessed or sustained by the empaneling of said jury to assess such damages
Ald Kane moved the adoption of the resolution carried by the following unanimous vote

the chair stated the object of the meeting was for the transaction of unfinished business and any
new business the council might think proper
Ald Hollnagel called the attention of the council to the necessity of the improvement of Broadway
extension and moved the rules be suspended and permission granted to parties present owning
property abutting on said street to address the council on the matter of proposed repairs or
improvement motion carried
Several owners of the property abutting on Broadway extension spoke of the necessity of the
immediate repair or improvement of said street on motion the matter was finally postponed
awaiting the action of the street committee
ald Crawford offered the following resolution
Resolved that his honor the mayor be authorized and requested in behalf of the city council and
citizens of Dubuque to extend to the grand army of the republic of the state of Iowa a cordial
invitation to hold its next grand encampment in 1887 in the city of Dubuque adopted
Ald Hollnagel moved mr Peter Sahm be appointed clerk of election for the western precinct of
the 5th ward to fill the vacancy caused by the removal of Alex Young carried
