1886 June Council ProceedingsRegular Session June 7th 1886 Mayor Glab in the Chair Present Ald Thos Byrne Jms M Byrne Doerfler Downer Hayden Hollnagel Parker and Trexler the minutes of th esession of April 29 1886 and of the May sessions were read and upon motion approv ed The matter of publishing the official proceedings of the council in the offiicial paper being brought before the council Ald downer moved the council continue its business the same as heretofore adopted Ald Doerfler moved the resolution of ald Hollnagel offered at a previous session in regard to a German official paper to be reconsidered carried Ald Hollnagel moved the recorder be instructed to strike out the words additional official paper carried The following bills were allowed Chas Steuck G Kirmse & Co Jos Ogle Jms the following bills were on motion referred Jms Daniels and L Piel to street commissioner Central Union Telephone Co to committee on claims Larry Daley to committee on markets Jms H Herancourt to committee on public grounds and buildings the following bills were referred to the fire committee Dubuque Brass and metal co Dubuque Rubber and Belting Co M V Fry and A Y Mcdonald and Dubuque Rubber and Belting Co A communication from city engineer Tschirgi asking that the city pay him for damages to a level broken by a teamster of Mr Tim Byron said amount being paid by him for repair of level was on motion of ald Crawford referred to the city attorney Ald Crawford moved the chairman of the fire and delinquent tax committees be furnished with a telephone each and that the city pay for the rent of same carried the matter of publishing the official proceedings of the council being agin brought up for discussion it was finally disposed of by ald Crawford moving the recorder to be instructed to hire a man for three months the city to pay him 30.00 per month and if found to be expedient to be continued which motion was carried the petition of the Dubuque Butchers Assn asking that the order of the city council causing the rendering of lard to be discontinued at their rendering establishment be reconsidered Ald Ryder moved the rules be suspended and mr Ruegamer president of the butchers assn be permitted to address the council carried Mr Ruegamer addressed the council stating the cause of the complaint and condition of cleanliness existing at the slaughter house and rendering establishment Ald Crawford moved the petition be referred to the city attorney board of health and health physician to investigate the condition of said slaughter house and interview the neighbors and men working in the C M and St P shops as to its condition and that in the meantime the order of the council be suspended until the commmittee reports carried On motion council adjourned to meet at 2 oclock pm Regular Session June 7th 1886 Mayor Glab in the chair Present Ald Jms M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler Council met at 2 oclock pm the bill of the sisters of Mercy Hospital for board of man named Regan who was shot be a polliceman in May 1885 was presented for payment Ald Jms M Byrne moved the bill be paid passed by the following vote Ayes Ald JM Byrne Downer Hollnagel Hayden and Trexler 5 Nays Ald Crawford Doerfler and parker 3 ald Trexler of th epolice committee reported in favor of paying the bill of Henry Schueler manager of the telephone station at West Dubuque 2.00 for telephone service for policemen carried Petitions Communication of D J Linehan asking to be released from his contract with the city to prosecute certain cases pending in the courts on motion of ald Crawford the petition was granted R cox asking to be exempt from laying sidewalk on the n orth side of Ninth Street between Main street and the alley between Main and Locust Streets until he builds his new building on the corner On motion of Ald Jms M Byrne referred to street committee Jms Pickley et al asking that obstructins placed on Mineral Lots 347 and 348 by Jms Meukels be ordered removed as said lots have been donated to the city and are now used as a public thoroughfare Ald Parker moved the petition be referred to Aldermen from the fifth ward city attorney and city engineer with power carried Guitli Verein asking permission to use the court room in the city hall in which to hold their semi weekly meeting on motion of ald doerfler the prayer of the petitioners was granted N H Schilling asking to have gutter on couler Avenue abutting lot no 1 in L H Langworthy's add improved referred to street committee H F Frenk praying to havef sidewalk and roadway on Hill St extension improved referred to street committee Regular Session June 7th 1886 Mayor Glab in the chair Present Ald Jms M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler Deidrich Lilly asking compensation for damages sustained by him by falling into 14th street sewerr on motion referred to committee on claims B Lagen asking compensation for damages of broken buggy sustained by horse backing said vehicle into southern Avenue sewer which is unprotected by a railing referred to the committee on claims Mary Ellen Conlan asking that her property be exempt from tax sale for special assessment levied against said property for improvement of west Eighth St and that said tax be cancelled as her property was damaged by said improvement referred to the finance committee and the mayor ald Crawford moved Dennis Gillians claim be also referred to the same committee carried The same moved the treasurer be instructed not to sell the property of mrs Conlan and Dennis Gillian until the committee submit their report carried Mrs andrew Murphy asking that she be compensated for land taken from lot 8 in Summer Hill add caused by the widening of grand view ave said lot being her property Ald ryder moved the petition be referred to the aldermen of the first ward and city engineer carried Wm Corcoran et al praying for the improvement of Emmet and St Marys Streets and that the expense be charged to the owners of abutting property except the cost of grading referred to the street committee E W Albbee et al owners of property abutting on main st asking that the city treasurer be instructed to accept the original amount of their special assessment with interest at the rate of 8% since the same became delinquent Ald ryder moved the petition be referred to the committee of the whole Ald Hollnagel offered as an amendment that the petition be received and filed The ayes and nayes being called on the adoption of the remain as constructed on motion prayer of petitioners was granted Phil Jungk et al praying that Division Street be opened from its present terminus to Couler Ave Referred to street committee and fifth ward aldermen J K Farley et al asking that J K Farley be permitted to erect a frame building on lot no 3 of out lot 674 Referred to committee on fire with power G Baumgartner et al remonstrating that he be granted a permit to act as auctioneer without license referred to the mayor and committee on finance Invitation from committee on arrangements of firemens tournament to the council to participate in parade on wednesday June 10th 1886 on motion accepted Ald ryder moved a committee on arrangements be appointed carried The chair appointed Alds Ryder Hayden and Trexler Philip Sand asking that lot 209 be filled above high water mark to prevent water from entering his cellar referred to street committee S Harrughty et al asking that nuisance on sidewalk in front of lot on wilson or to exchange said lots for piece of ground owned by city between Queen and Prince streets being lot 2 of subdivision of Min lot 313 referred to committee on public grounds and buildings Geo Crane asking that the assessment of 1885 on the law library of allison and crane be reduced to 1000.00 and that the council order a warrant to be drawn in his favor for 12.36 the amount of taxes overpaid referred to delinquent tax committee Ernest Wiedner et al asking that a policeman be placed on High Street above the beat of policeman Elmer referred to city marshal Jms Souther well et al asking that the alley between Alpine and nevada streets be improved on motion of Ald Crawford the petition was granted C B Dorr asking that his stock in the building and loan association be cancelled claiming his debts are more than 240.00 the value of said stock referred to delinquent tax committee J K Graves et al asking that the water mains be extended from the present terminus on Julien Ave up hill street to Third Street thence along Fenelon Street to its terminus to afford protec tion to property owners from fire along said streets referred to fire committee aldermen of second ward and city attorney R Fengler et al asking that a bridge be built across north 6th street in Hams addition at intersection with High Street referred to street committee Petitions of the following named parties praying for the cancellation of their respective taxes for the year 1885 were on motion referred to the delinquent tax committee Margt Dunn Mrs Ann McLaughlin Rose Cadman Mary Staner reports of officers The street commissioner reported having expended 2567.00 in street improvements during May ordered received and filed and warrants ordered drawn to pay same the city marshal reported the salaries of the police amounted to 1100.60 for the month of May that 85 arrests had been made and that he paid into the treasurer the sum of 1.00 fees collected ordered received and filed and orders drawn to pay salaries J P Quigley justice of the peac e reported having paid to treasurer the sum of 25.00 fines collected during May ordered received and filed Regular Session June 7th 1886 Mayor Glab in the department 1070.00 ordered paid and filed Market master Rice reported having weighed on central market scales 191 draughts paying to the treasurer 28.65 the amount received for weighing also that he paid to the same officer 114.30 received for rent of huckster stands That he furnished board for prisoners amounting to 15.60 ordered received and file and warrant drawn for board of prisoners Owen Reynolds wood measurer reported having measured during the past month 1183 cords of wood ordered received and filed Frank Fosselman weigher at fifth ward scales reported having weighed on said scales during the past month 109 draughts and that he paid to the treasurer the sum of 2.45 which is 15 percent of the amount received by him for weighing ordered recieved and filed Recorder agnew reported having issued licenses amounting to 4227.00 during the months of April and May ordered received and filed Chas Pitschner city weigher reported having weighed on the west dubuque scales during the past' month 100 draughts and that he paid to the treasurer 2.35 which is 15 percent of the amount received by him ordered received and filed Henry C Deckert city weigher reported having weighed on the eagle point scales during the past month 53 draughts and that he paid to the treasurer 1.20 15 percent of the amount received by him ordered received and filed reports of committees Ald Ryder of the Finance committee reported on the petition of Jms Gutenkauf in favor of cancelling the tax of 1858 on city lot 339 adopted Ald J M Byrne of the committee on claims reported in favor of paying the bills of Jas Agnew 60.00 and telephone company 63.50 adopted Ald J M Byrne of the special committee to furnish a veterinary surgeon for fire department reported in favor of accepting the bill of doctor whitwall 60.00 a year for furnishing medical services for horses adopted Ald Crawford of the ordinance committee presented and read for the first time an ordinance to amend an ordinance entitled an ordinance to provide for improving the streets alleys and public landings and for the construction and repair of sidewalks The same moved the rules be suspended and the ordinance read for the following unanimous vote ayes Ald Thos Byrne J M Byrne Crawford Doerfler downer Hayden Hollnagel Parker Ryder and Trexler The recorder read the ordinance for the second time The ayes and nays being called for its adoption it passed by the following unanimous vote Ayes Ald Thos Byrne J M Byrne Crawford Doerfler Downer Hayden Hollnagel parker Ryder and Trexler Ald Crawford presented an ordinance to restrain cows horses and other animals from running at large in the city of Dubuque and read the following amendment to section 1 of the same Provided that the provisions of this section so far as they relate to milch cows and geese shall not apply to the following portions of the city to wit all of the first ward situated south of Dodge Street and west of Brad Street All of third Ward and Fifth Ward situated East of the tracks of the Chicago Milwaukee and St Paul Railway all that portion of the fourth ward south of Julien avfenue which is situated west of Brad Street all that portion of Fourth ward north of Julien Avenue which is situated west of Vista street all that portion of Fifth Ward east of Couler Avenue which is situated north of Eagle point Avenue and Kniest Street and all of the Fifth Ward west of Couler Avenue and Clay Street which is situated north of seminary street The ayes and nayes being called on the adoption of the amendment it passed by the following vote Ayes Ald Thos Byrne J M Byrne Crawford Doerfler downer Hayden Hollnagel and parker 8 Nayes Ald ryder and Trexler 2 The recorder read the ordinance as amended for the second time The Ryder and Trexler Ald Crawford of the street committee reported on the petition of Jms Kelly adverse to constructing a retaining wall in front of his lot no 14 Southern Avenue addition they recommended that his request for the establishment of a grade on Sullivan street abutting said lot be referred to the city engineer adopted The same committee reported on the resolution of Ald Ryder for improvement of Dodge Street that it be adopted providing not more than 50.00 be expended Regular Session June 7th 1886 Mayor Glab in the chair Present Ald Jms M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler on the work without further authority from the council adopted The same committee reported on the petition of patrick McPoland in favor of having the street commissioner instructed to place a crossing on Pearl St west Dubuque of broken stone or quarry material at the point described adopted the same committee recommended the granting of the prayer of C Langworthy Jms Pregler and the Dubuque furniture and burial case company asking the council to rescind so much of the resolution providing for the improvement of 18th street as directs to the curbing guttering and macadamizing of the block between Elm and Washington Streets be granted providing the contractor for the work will consent adopted The same committee reported in favor of paying the bill of Duggan Sullivan and Kinsella 16.40 adopted the same committee reported on the petition of C MBuettel et al recommending the prayer of the petitioner asking for the repair and reconstruction of the sidewalk on the north side of West Locust Street from 16th street to the top of the hill near the intersection of Seminary Street be granted and the street commissioner ordered to give the matter his prompt attention adopted The same committee recommended the petition of Jms D Bush asking the council to approve accompanying plat of his subdivision of Mineral lot 172 be granted and plat approved adopted The same committee reported on the petition of G H Fry et al for the laying of a sidewalk on the west side fo Grove Street that it be granted carried the same committee reported on the petition of Robt W Lange et al asking for the grading of Lake street from Johnson Ave to Humboldt street that it be not granted at prsent The street if graded would be impassable unless macadamized and most of the abutters are opposed to that improvement adopted The same committee recommended the granting of the petition of Henry Pfiffer et al asking for a two foot sidewalk on the east side of the north extension of Iowa Street on Seminary Hill north of Geo Raths place adopted The same committee reported the improvement askef for by Mrs Braan in reference to the water pipes on Jones street has been carried out report adopted The same committee offered the following resolution be it resolved by the city council that the street commissioner be and is hereby instructed to do the necessary committee offered the following resolution Resolved by the city council of the city of Dubuque that a sidewalk three feet wide laid crosswise of good two inch plank be within fifteen days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks on the north side of Bennett Street between Grand View Avenue and East Street where not already laid Adopted by the city council of the city of Dubuque that the sewer on Fourteenth Street between White and Clay Streets be arched that the city engineer be and is hereby directed to make the necesary plans and specifications for said improvement and the city rec order directed to give the proper notice for bids and proposals for the performance of the work carried The same committee offered the following resolution Regular Session June 7th 1886 Mayor Glab in the chair Present Ald Jms M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler Resolved by the city council of the city of Dubuque that the north side of Julien Avenue between Bluff Street and West line of Lorimier subdivision be fraded guttered and curbed in conformity with the ordinance upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder be directed to give the proper notice for bids and proposals for the performance of the work the guttering curbing and macadamizing to be done at the expense of the abutting property adopted by the following vote Ayes ald Thos Byrne J M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler 9 Nayes ald Ryder 1 the same commmittee offered the following resolution resolved by the city council of the city of Dubuque that a sidewalk two feet side of good two inch plank be within 15 days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks on the east side of Iowa Street between Seminary Street north to old corporation line adopted by the following vote Ayes Ald thos Byrne J M Byrne Crawford Doerfler Downer Hayden Hollnagel parker Ryder and Trexler 10 The same committee offered the following resolution Resolved by the city council of the city of Dubuque that a sidewalk six feet wide of good two inch plank be within fifteen days of this notice constructed and laid in conformity with the ordinance in relation to sidewalks on the west side of Grove Street abutting the south 50 ft of lot 2 of lot 775 of McDaniels subd adopted by the following unanimous vote Ayes ald Thomas Byrne J M Byrne Crawford Doerfler Downer Hayden Hollnagel Parker and Trexler The same committee reported on the petition of F W Kringle et al for improvement of west seventeenth street that in order to carry out the improvement asked for a large amount of expensive grading would have to be done also that many of the abutting property owners are opposed to the improvement of teh street as asked for at the present time We therefore recommend that the improvement be postponed for the present adopted The same also offered the following resolution which upon his motion was laid over until the regular meeting in July and the recorder instructed to notify the owners of abutting property to appear and show cause if any they have why said assessment should not be levied Resolved by the city council of the city adopted ald Hollnagel of the committee on printing reported in fvor of paying the bills of Hough and Hardie 7.00 and Ham and Carver 13.90 adopted Ald Hollnagel of the fire committee reported on the bill of Jms Newman recommending 15.00 be paid on the bill of 20.00 said 15.00 being payment in full adopted the same staed that several of the firem en were unable to pay the full amount of the cost of their new uniforms at present and moved the treasurer be instructed to retain one half the cost of the uniforms this month and the remainder next month from all who are unable to pay in full Resolved by the city council of the city of Dubuque that the alley between Seventeenth and Eighteenth streets between White and Jackson Streets be graded and macadamized in conformity with the ordinance upon that subject that the city engineer be and he is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the grading and macadamizing to be done at the expense of the owners abutting property adopted by the following vote ayes Alds Thos Byrne between clay and White Streets be graded guttered curbed and macadamized in conformity with the ordinance upon that subject that the city engineer be and he is hereby directed to make the necessary not to blockade the sidewalk on south Fourteenth Street adopted ald Crawford reporte dthe following bids for the improvement of Fourteenth Street sewer james Lee 382.80 Jms Schroman 440.80 Mr Lee being the lowest bidder was on motion awarded the contract Ald hayden moved the recorder be instructed to read the petition of J V Struber et al carried The petition of J V Struber et al asking that J V Struber be Adjourned Regular Session June 14th 1886 Mayor Glab in the chair Present Ald Thos Byrn Jms M Burne Crawford Doerfler Downer Hayden Hollngel Parker and Trexler permitted to complete a frame addition to his redsidence in the block bounded by eleventh and twelfth streets and jackson and washington streets Ald Hayden moved the prayer of the petitioners be granted carried The mayor stated he had expelled a policeman from the force for disorderly conduct and asked the council to sustain his action on motion his request was granted The chair appointed the following commitee on equalization for the ensuing year Alds Thos Byrne Hayden Trexler Parker and Doerfler Ald Crawford of the street committee reported that Jms Schromen contractor had completed the extension of the Eight Street Sewer from the C M and St P Railway tracks east and that the street committee had examined and accepted the work he therefore moved the bill of mr Schromen for doing said work 1199.05 be paid motion carried On motion of Ald Doerfler the bills for the payment of special police during tournament week 208.00 were ordered paid Ald Trexler moved the bids for improving the alley from Fifteenth to Sixteenth streets between Jackson and Washington streets be opened The bid of Wm Rebman 20 cents per cubic yard for grading and 70 cents per lineal foot for macadamizing being the lowest and only
