This Second Amendment:
1. Amends Section 6.1 to revise the FLSA hours worked from 212 to 204 before
FLSA overtime kicks in. This is merely an oversight in the CBA language, and the
204 number of hours worked has been the standard pay practice for the duration
of the contract. This cleans up that section to ensure language is consistent with
practice and the parties' intent.
2. Revises Agreement Cover Page, Article 12 Duration and Negotiations, and
the Appendices in A to reflect the parties' intent for a five (5) year contract (July
1, 2024 through June 30, 2029) with re -openers in years four and five of the CBA
only as to the Wages/OT Article 5 and Supplemental Pay Article 6. This
language is consistent with the parties' intent when the contract was negotiated.
The Union ratified this Second Amendment on January 9, 2025.
I respectfully request your support for the recommendation that the Dubuque City
Council votes to ratify, and therefore fully execute, this Second Amendment to the July
1, 2024 DPFA (Fire) CBA.

TO
AGREEMENT
BETWEEN
THE CITY OF DUBUQUE, IOWA
AND
DUBUQUE PROFESSIONAL FIREFIGHTERS' ASSOCIATION, LOCAL 25
July 1, 2024 — June 30, 2027
This Second Amendment to Agreement, dated for reference purposes the 10th day of
December, 2025, is made and entered into between the Dubuque Professional
Firefighters' Association ("Union" or "DPFA") and the City of Dubuque, a municipal
corporation ("City").
The parties agree as follows:
Section 1. Effective upon ratification, at Article 6 SUPPLEMENTAL PAY, the first
paragraph of Section 6.1 of the Agreement is amended to reflect the correct hours for a
27-day "work period" to comply with the Fair Labor Standards Act "fire protection
employees" "work period" basis as it pertains to overtime pay requirements.
Section 6.1 — Fair Labor Standards Act (FLSA) Overtime and Compensatory Time
The definition of compensable hours of work shall be the definition contained in the Fair
Labor Standards Act. Effective December 1, 2024, an employee shall have the option of
receiving compensatory time in lieu of overtime pay for all hours worked in excess of 204
hours in a 27-day work period. Employees shall declare their intention to receive
compensatory time in lieu of pay by December 1 st each year for the following calendar
year. Employees shall not be allowed to change their decision to receive either pay or
compensatory time until December 1st of the following year for compensation in the
following year. Employees who select compensatory time will be credited with
compensatory time up to the maximum accrual amount allowed by law; all time over such
maximum accrual amount will be paid as overtime. (Bold emphasis added to reflect the
section 6.1 change from 212 hours to 204 hours)
Section 2. Both the Union and the City have identified the need to update the dates on
the Agreement cover page, Article 12- Duration and Negotiations, and the Appendices
in A to reflect the intent of the parties' negotiations to have a five-year contract for the
period from July 1, 2024 through June 30, 2029 and with a re -opener for years four and
five regarding Article 5-Wages/Overtime and Article 6-Supplemental Pay of the
Agreement and for such other items upon which the parties may mutually agree.

Effective upon ratification, Article 17- Duration and Negotiations:

The Agreement shall be effective as of the first (1s') day of July 2024 and shall remain in
full force and effect through the thirtieth (30'h) day of June 2029. Negotiations regarding
Article 5 and 6 to become effective the first date of the first full pay period after July
1, 2027, and for such other items upon which the parties may mutually agree, shall
begin after August 15, 2026, but no later than December 15, 2026. Negotiations
regarding Article 5 and 6 to become effective the first date of the first full pay period
after July 1, 2028, and for such other items upon which the parties may mutually
agree, shall begin after August 15, 2027, but no later than December 15, 2027.
Negotiations for a succeeding agreement to become effective July 1, 2029, shall
begin after August 15, 2028, but no later than December 15, 2028. (Bold emphasis
added to reflect the change in duration and wage re -opener years).
Section 3. Added Appendix A.4:

Section 4. Each person signing this Second Amendment on behalf of a party represents
and warrants that the party has the requisite power and authority to enter into, execute,
and deliver this Second Amendment on behalf of such party and that this Second
Amendment is a valid and legally binding obligation of such party enforceable against it.
Section 5. This Second Amendment represents the entire agreement between the parties
with respect to its subject matter and supersedes all prior discussions or understanding
that the parties may have with respect to same.
